Fraud Investigation Richard Plato of Baytown, TX

HOUSTON—A repeat fraud offender who owed nearly $30 million in restitution at the time of a Texas securities scam faces up to 120 years in prison.
A federal jury in Houston convicted 64-year-old Richard Plato of Baytown on five counts of mail fraud and one count of conspiracy to commit mail fraud.
Prosecutors on Monday said no sentencing date has been set for Plato, who owned Momentum Production Corp. in Baytown. Investigators say Plato diverted about $2 million in company funds.

State regulators began investigating Plato in 2008 following complaints from oil and gas investors.
Records show Plato earlier was convicted of fraud in Texas, Florida and Louisiana. He was on supervised release and owed almost $30 million in restitution when the Momentum securities were sold.
Plato remains in custody.

Wrongful Death Body Found in Trunk by Would be Thief

A would-be thief stopped in his tracks on Monday when he found a human body inside the trunk of the car he was about to rob.

Houston police say the body of Donald Michael Lapointe, 28, had been shot in the chest, Click 2 Houston reports. Lapointe’s face had been severely beaten, and a bag of pills was hidden in his underwear.

The car containing Lapointe’s body was spotted around 4 a.m. by a passing motorist, whose name has not been released, according to KTRK. The motorist told officials he was driving down the freeway with his wife and baby when he saw the car in a ditch, and he decided to take a look to see if there was anything worth stealing inside.

The aspiring robber says he called police when he opened the car’s trunk and, instead of valuables, found a dead body.

Investigators believe Lapointe’s death was a murder, and may have been drug-related.

The Houston Chronicle reports that the man and woman who discovered the body are not suspects.

Missing Person Johnny Brown of Columbus, OH

COLUMBUS, Ohio — Columbus police will be conducting a search for a Columbus man who has been missing since Jul. 6.

Johnny Brown, 60, was last seen at his home in the 2400 block of Joyce Avenue on the city’s northeast side. Police say he left his home to purchase an item from a local carryout and did not return home.

Officers will be conducting a search in the area of East Hudson Street and Joyce Avenue.

Brown is described as a black male who is 6 feet 1 inch tall and weighs 186 pounds. He is bald with brown eyes and was last seen wearing a white T-shirt, blue jeans, and black tennis shoes.

Police say Brown does have some medical issues, but he is very mobile and high-functioning.

All leads in this case have been exhausted, according to police.

Insurance Fraud Richmond Virginia Woman Sentenced

A Richmond woman last week received a prison sentence for false insurance bills made through her Virginia business.

Veronica Sharon Cunningham, 49, received a sentence of 135 months on 26 counts of health counts, along with eight counts of falsifying health care records and one count of filing a false tax return.

Cunningham owned Community Neurological Services in Richmond, from which she billed insurance companies along with Medicare and Medicaid.

Overall, officials said she bilked those companies out of more than $6 million and failed to pay more than $470,000 in taxes.

The judge ordered her to pay more than $6.6 million in restitution to Medicare, Medicaid and the private insurers.

Private Detective Couple Arrested After Kids Found in Trunk

A Woodinville woman and her boyfriend are facing a host of felony charges after troopers found the duo speeding through Bothell with three young children and a dog in the trunk of their car.

A trooper first noticed the car Sunday just before 11 a.m. in the area of Canyon park. The car, a 2007 Nissan Sentra, was going 77 mph in a 60 mph zone, according to trooper Keith Leary. The trooper hit his lights, but he said it took roughly a half mile for the car to pull over.

Once stopped, the trooper said he immediately smelled marijuana in the car. The driver, 28-year-old Anna Boyle, allegedly said she “just took a few hits earlier.” The trooper said both Boyle and her passenger, 27-year-old Aaron Johnston, appeared very nervous.

Boyle gave the trooper permission to search the car, and he soon found evidence of methamphetamine and heroin, as well as drug paraphernalia and prescription drugs.

While he was searching the car, the trooper said he heard a “thumping sound” coming from the trunk. A second trooper saw the top of the trunk move, and when he opened the hatch he was shocked to see three young children and a dog. The kids — an 8-year-old girl, a 7-year-old boy and a 5-year-old boy — allegedly told the troopers they hadn’t eaten since the previous night.

After helping the kids out of the trunk, the troopers began questioning Boyle. She said the kids, who are hers, “crawled back there” from the back seat, according to Leary.

Trooper say the car was packed with various items, including a snowboard, a guitar and various bags of miscellaneous items. There were no child seats in the car.

Troopers arrested Boyle and Johnston and booked them into Snohomish County Jail on drug charges. The prosecutor will decide if they’re charged for keeping the kids in the trunk.

Missing Person Stephen Bowman of San Miguel, CA

On 9-24-12, the San Luis Obispo County Sheriff’s Office took a report of a missing person from San Miguel. 52-year-old Stephen Edward Bowman was last seen leaving his house to go on a walk at 9:30 AM.

Bowman is described as a white male adult, 5-9, 195 pounds, blond hair, and blue eyes. He was last seen wearing blue denim shorts, white t-shirt with an unknown logo, possibly a Miami Dolphins ball cap, flip-flops, and possibly a black backpack. The Sheriff’s Office Search and Rescue Team, Sheriff’s deputies and a Sheriff’s K9 unit are currently involved in the search. Bowman had moved to San Miguel from Hawaii in February and has been living with his sister in San Miguel. The Sheriff’s Office asks that anyone locating Bowman contact Sheriff’s Dispatch at (805) 781-4550 immediately so he can be contacted by law enforcement.

Missing Person Dearborn Man Missing, Clothes Found Near Detroit River

WYANDOTTE — A 40-year-old Dearborn man has been reported missing and is believed to have drowned Saturday afternoon in the Detroit River.

Police Chief Daniel Grant said an anonymous person called police at about 12:30 p.m. Saturday concerning men’s clothing, including a pair of boots and sunglasses, that were found at the north end of Bishop Park.

An officer found the clothing as reported by the caller, with prescription sunglasses, on a park bench near the water. A pair of work boots was found on a ledge on the water side of the railing in the part of the park close to the Wyandotte power plant.

Grant said the park was heavily occupied, with at least two birthday parties going on during the time, but no one reported seeing anyone jump into the river.

One of the Police Department’s night shift patrol units noticed a pickup truck parked in the area throughout the night and after investigating discovered that the license plate was registered to a Dearborn resident.

“One of our detectives was able to make contact with the vehicle owner’s girlfriend, who identified the found clothing and boots as belonging to her boyfriend, who had not returned to their home and was missing,” Grant said Monday morning. “The U.S. Coast Guard along with other law enforcement agencies have searched the area near the park and downstream with watercraft and helicopters with no result at this time.”

Grant said the name and photograph of the missing man will be released as soon as his immediate family is notified of his missing status.

Missing Person 4 Yr Old Warren Co., Ohio Boy’s Body Found

WARREN COUNTY —

A 4-year-old boy found dead in a body of water near his Franklin Twp. home Monday was identified as Jonah Smith, of the 8800 block of Cam Drive.

Smith, who was reportedly autistic, was reported missing by his father at about 12:58 p.m., said Maj. Brian Tinch of the Warren County Sheriff’s Office.

Authorities found the body at 2:25 p.m. in a large pond at Waterscape Aquafarm, a sport fishing club, adjacent to the boy’s home. Neighbors said the pond was a former “gravel pit” and is surrounded by a fence. The boy’s father and grandmother were home at the time the boy was reported missing.

“As you can imagine, they’re pretty upset,” Tinch said.

The sheriff’s office and Joint Emergency Medical Services were at the scene. The body was taken to the Montgomery County Coroner’s Office for autopsy.

Neighbors gathered as news of the boy’s death spread through the neighborhood.

Christina Thacker came to the area to see if she could help when her mother sent her a text about what was happening.

“It’s awful, it’s devastating,” she said.

Bill Cencebaugh, who has lived in the neighborhood for 38 years, said, “Like everybody else, you’ve got to feel sorry for them. He described the neighborhood as “tight knit,” but not to the point where everyone knew each other. He noted that it was rare for police or other authorities to appear on their street.

Tinch said the sheriff’s office “sympathizes greatly with the family at this very troublesome time.”

The investigation is ongoing and it is not yet known if any charges are pending.

Fraud Investigation Phone Scam in Adair County, KY

Police in Adair County are warning of a phone scam that has been reported in the county.

Cell phone users in the Adair County area are receiving phone calls from an unidentified source claiming to be Publisher’s Clearing House. The caller is advising people that they are to receive a prize of $1.1 million if they go to the local Walmart and purchase two Green Dot cards. They are then advised to meet with someone in the parking lot to be escorted to a local bank by the Kentucky State Police to cash their winning check.

The call is a hoax and should be disregarded.

Identity Theft Hastings, NY Man Charged

Central Square, NY – A Hastings man who allegedly used another person’s credit card information and a false name to buy cell phones and other goods faces felony forgery and other charges, the Oswego County Sheriff’s Office said.

Bill H. Willis, 20, of 996 U.S. Route 11, Roxbury Estates, Lot 21, was charged Friday following an investigation into credit card fraud, officials said. They said Willis used the credit card information and fictitious name to buy goods including cell phones and accessories in July from JGS Wireless on South Main Street, Central Square.

Willis was charged with second-degree forgery, second-degree identity theft and unlawful possession of a personal identification, all felonies, and second-degree criminal impersonation and petit larceny, both misdemeanors, officials said.

He was arraigned in Central Square village court and ordered held at the Oswego County Correctional Facility on $2,500 bail or $5,000 bond. He is to return to court on Wednesday.
