Justine Lingatong, 24 of Carson, California, was sentenced in United States District Court to 60 months in prison followed by five years of supervised release for bank fraud and aggravated identity theft. He will also have to pay restitution in the amount of $189,960.

Lingatong pled guilty to bank fraud and aggravated identity theft on January 23, 2012. On seven occasions between January 11 and January 13, 2011, Lingatong entered Wells Fargo Bank branches in the Treasure Valley and presented false identification showing his picture and the name of a genuine Wells Fargo account holder. He also presented the Wells Fargo account number of the person he was impersonating. Lingatong admitted that on each occasion he withdrew funds from the victim’s Wells Fargo account.

“Identity theft creates financial havoc and disrupts lives,” said Olson. “It is serious criminal conduct that warrants the serious penalty imposed in this case. Mr. Lingatong will spend the next five years in federal prison and must make restitution to his victims. We will continue to work with our federal and local law enforcement partners to aggressively prosecute identity thieves.”

Missing Persons Bain Children Returned Home

A small blonde child peeking over a ridge and spotted by Mississippi state highway troopers led to the rescue of Alexandria and Kyliyah Bain, ages 12 and 8, from kidnapper Adam Mayes on Thursday night, police said in a news conference today.

Moments later, Mayes — kneeling in the grass next to the children — shot himself in what his mother-in-law called the “coward’s way out.”

“We saw something lying down by the wood line that caught our attention. We took another five steps, and I gazed around and saw one of the children. An officer started hollering, ‘Get your hands up,'” said Master Sgt. Steve Crawford at a news conference today.

The highway patrol and state fish and wildlife officers were searching the wooded area for a cabin that they were told Mayes, 35, may have been hiding in with the two girls he kidnapped two weeks earlier from their home in Tennessee.

Mayes is also suspected of killing the girls’ sister, Adrienne, 14, and mother, JoAnn, 37, in order to kidnap the younger girls, whom he thought were his children, relatives have said. The girls had been living with JoAnn and her husband, Gary Bain, and the family was planning to move to Arizona at the end of the school year.

As police searched for the cabin last night, they caught sight of one girl and then another and, finally Mayes’ head popped up.

“All three were lying face down on the ground trying to take cover,” Crawford said.

Adam Mayes’ Wife Still Faces Murder Charges

Tate said that her daughter had called police multiple times for domestic violence accusations against Adam Mayes, and that he had been a controlling, violent person that threatened Josie throughout their years together.

Teresa Mayes is charged with murder and especially aggravated kidnapping for her role in assisting Mayes. She is being held in a Tennessee jail.

During the investigation, police arrested Mayes’ wife, Teresa, and mother, Mary Mayes, in connection with the murder and kidnapping. According to the warrants, Teresa Mayes told police she witnessed Adam kill JoAnn Bain in the garage of the Bain’s home, and then kill Adrienne Bain in the home itself.

Adam and Teresa Mayes then took the dead bodies and two young girls to the Mayes’ home in Mississippi, where Adam Mayes buried the two bodies, the documents state.

The bodies were found earlier this week in the backyard of the home Mayes shares Teresa and his mother and father.

Wrongful Death 14 yr old kills 9 year old half sister

RAGLAND, Ala. — A 14-year-old boy was charged with murder Friday in the death of his half-sister, who was found hanging from a tree outside their home, authorities said.

The body of Katelynn Arnold, 9, was discovered Thursday night outside her home in Ragland, a rural town about 40 miles northeast of Birmingham, said St. Clair County Sheriff Terry Surles.

The cotton rope from an old tire swing was deliberately tied in a simple knot around the girl’s neck, but was not a hangman’s noose, the sheriff said. St. Clair County Coroner Dennis Russell said an autopsy found the cause of death was homicide due to ligature strangulation.

The boy and girl were living with their aunt and uncle as part of a foster home situation, Surles said. Several relatives who had gathered at the small, white home declined to comment Friday.

The girl was riding her bicycle Thursday evening and her aunt noticed she was missing. She drove around looking for the girl for about 45 minutes and came home to find her hanging from a tree outside the home, the sheriff said.

A call came into the sheriff’s department about 8:10 p.m. and by the time investigators arrived, rescuers had removed the girl from the tree. She was pronounced dead at a hospital.

The boy faces juvenile charges so his name was not released. Authorities could later decide to charge him as an adult.

After the girl was found and taken to the hospital, the boy went to bed, Surles said. He was arrested between 2 and 3 a.m. and admitted to killing the girl, Surles said. He said the boy told investigators a motive but Surles did not release it.

The names of the aunt and uncle were not released and authorities did not have information on where the children’s parents might be. It was not clear whether the state had placed the children in their care or if the parents had sent the pair to live there.

Yellow police tape was strung Friday around a couple trees outside the home along a one-lane road and a small bicycle with pink handle bars was parked out front.

Ragland Elementary School planned to have grief counselors available Friday for classmates of the girl.

Fraud Investigation Arch Turner Resigns

The Breathitt County Schools Superintendent who faces allegations relating to his alleged participation in a vote buying conspiracy and recently had his bond revoked in the case has resigned as superintendent.

According to a superseding indictment returned in April, Arch Turner, 66, of Booneville, conspired with John L. Turner, also of Booneville, to buy votes in the May 2010 primary election. The new indictment also alleges that Arch Turner influenced another individual to commit perjury.

Turner allegedly instructed this individual to falsely testify before a grand jury that he had no knowledge of buying votes.

According to the Lexington Herald-Leader, U.S. Magistrate Judge Robert Wier revoked Turner’s bond after a hearing Tuesday. The terms of Turner’s pretrial release barred him from having contact with prosecution witnesses or with defendants in the case, except through his attorneys. Turner allegedly violated that condition.

Arch Turner was originally indicted on March 1, 2012 for conspiracy to buy votes in the fall 2010 election in Breathitt County. He also was charged with obstructing justice and making false statements to a federal agent. John Turner was not charged in the original indictment.

Officials say the two men are not related.

The investigation preceding the Indictment was conducted by the Kentucky Attorney General’s Office and the FBI. The Indictment was presented to the grand jury by Assistant United States Attorney Kenneth R. Taylor and trial attorney Brian Lichter with the Public Integrity Section of the United States Department of Justice. The defendants’ appearances before the United States District Court have not yet been set.

If convicted, Arch Turner faces a maximum prison sentence of 20 years, and John L. Turner faces a maximum prison sentence of five years. However, any sentence following conviction would be imposed by the court after consideration of the United States Sentencing Guidelines and the federal statute governing the imposition of sentences.

Private Investigator Deputies Charged with Theft

Two Fayette County Sheriff’s deputies pleaded not guilty Friday in a theft case against the pair as well as another deputy.

Deputy Merle McDaniel is charged with two counts of theft by unlawful taking, former deputy Bill Beers is charged with two counts of theft by failure to make required disposition-felony and one count of theft by failure to make required disposition-misdemeanor. Another current deputy, Chris Tudor, has been charged with second-degree official misconduct relating to his duties at the Office of the Sheriff.

McDaniel and Beers made their pleas during a court appearance Friday.

“It is with tremendous disappointment that I must announce to you that our investigators have charged three individuals with violations of state law,” said Sheriff Kathy Witt during a Thursday afternoon news conference.

After reports of missing evidence were investigated, it is alleged that McDaniel and Beers, both of whom had over 15 years experience in the Sheriff’s office, took firearms from evidence and sold them to pawn shops.

Missing Person Daniel Hiser

Police in Rowan County are searching for a missing Morehead State University student they believe may be disoriented and possibly hurt following an accident.

According to Morehead State University Police, the last contact with Daniel Hiser, 20, was Wednesday night. A friend received a text message from him around 9:30 p.m. that evening. His vehicle was involved in an accident on Christy Creek (Rt. 32) going toward Elliotville. The vehicle hit a brick building and left the scene of the accident. The damage was found at 5:30 a.m. Thursday by the owner of the property along with the bumper and license plate registered to Hiser.

Numerous attempts to contact Hiser have been unsuccessful. His cell phone records show no activity since Wednesday at approximately 9:30 p.m. He was last seen on campus Wednesday at approximately 1 p.m.

At the request of MSUPD, the Rowan County Emergency search and rescue team has been activated. Other agencies are cooperating and assembling at the Elliottville Fire Department.

Kentucky State Police contacted MSUPD in attempt to locate Hiser Thursday. MSUPD officers were unable to find him and became concerned about his health.

A “Code Red Alert” for Hiser has been sent out to residents in the Christy Creek/Elliottville area of Rowan County.

Hiser is 6’3″ and 240 lbs. with brown hair and brown eyes. The vehicle has Ohio tags and is described as a gold, 2000 Ford Expedition with a missing bumper and possible damage to the passenger side.

Private Detective Christopher Manley Arrested for Meth

Versailles police say an anonymous tip led officers to a meth bust Thursday afternoon.

Police say officers found a met lab inside a house along Douglas Avenue around 3:30 p.m.

Versailles Police Department Detective Wes Jones says community help is imperative in the battle against drugs.

“No small town is immune from it. We got to band together to try and help each other out,” he said.

Police say they have a suspect in custody, but will not release his name until they file formal charges.

According to the Woodford County Detention Center website, jailers booked Christopher Manley, 37, around 7 p.m. Thursday. Charges filed against Manley include manufacturing meth, cultivating marijuana, possession of drug paraphernalia, and possession of a controlled substance.

It remains unclear if he was the man arrested in the Douglas Avenue meth lab bust.

Fraud Investigation Saratoga Nissan

BALLSTON SPA, N.Y. – Michelle Duffey, a spokeswoman for the Attorney General’s office tells NEWS10 investigators are at Saratoga Nissan in Ballston Spa on Wednesday, along with State Police and DMV Officials, investigating possible consumer fraud.

A search warrant was issued Wednesday afternoon in which officials removed boxes of business documents and records from the dealership in connection with an ongoing consumer fraud investigation.

The AG’s office is not being specific as to the types of complaints received at this time, in order to protect the investigation. Duffey says no charges are filed in the investigation.

NEWS10 spoke with one customer who bought a car from Saratoga Nissan two months ago. The mother of two children from Colonie says under her initial agreement with the car dealership was to pay $475 a month. However she started receiving bills that she owns $555. She says it’s a payment she can’t afford.

According to sources at the Attorney General’s office, more than 60 people have come forward since Wednesday. The Attorney General asks that if any customer feels they may have been a victim to a fraudulent transaction by Saratoga Nissan to contact the AG’s consumer fraud bureau at 1-800-771-7755.

Kentucky State Police arrested a man in Scott County on child pornography charges.

Police say members of the Kentucky State Police electronic crimes branch, FBI agents and Scott County sheriff’s deputies executed a search warrant at a home on Gemini Trail after an eight month investigation.

Police arrested Cory Martin Gaines, 21, of Georgetown, and charged him with five counts of possession of matter portraying sexual performance by a minor and five counts of distribution of matter portraying sexual performance by a minor.

Police say the investigation continues and other charges may be pending.

Wrongful Death Jacinto Zuniga Trujillo Killed Stepdaughter

A Long Beach man is facing capital murder and molestation charges as authorities allege that he stabbed to death his 9-year-old stepdaughter to cover up months of sexual abuse.

Jacinto Zuniga Trujillo, 31, is alleged to have stabbed the girl — identified in court papers as Xiomara J. — because he feared she might reveal that he been sexually abusing her since November, prosecutors alleged.

The District Attorney’s Office filed a special circumstances murder charge, which would allow it to seek the death penalty in the case.

The girl’s lifeless body was found in the parking lot of the Los Altos United Methodist Church on Saturday at about 11 a.m. Trujillo was found a short distance from the girl’s body, suffering from self-inflicted stab wounds. Investigators say he attempted to commit suicide.

He was taken to a Long Beach hospital for treatment and released the next day. Authorities immediately took him into custody on suspicion of murder. Trujillo has yet to enter a plea in the case but made a brief appearance in Long Beach Superior Court earlier this week.

Trujillo is accused of the special circumstance allegation that the victim “was killed because she was a witness to a crime,” specifically child molestation.

He also charged with five counts of oral copulation and sexual penetration with a child under the age of 10 involving the victim.

The District Attorney’s Office will not make a decision on whether to seek the death penalty against Trujillo until the case moves closer to trial.

Authorities found letters written in blood next to the girl’s body in a lot at the corner of Woodruff Avenue and Willow Street. The writing was on the side of what appeared to be a gray container that authorities are considering evidence in the case. No other details about the letters immediately were available.
