Missing Persons 4 Missing After Sailboat Crash

SAN FRANCISCO (AP) – A powerful wave swept four crew members off a sailboat during a race near San Francisco and the craft hit rocks attempting a rescue, leaving one person dead and four others missing, the Coast Guard said early Sunday.

The eight-member crew aboard the 38-foot Low Speed Chase was taking part in a yacht race from San Francisco Bay around the Farallon Islands Saturday afternoon as their craft ran aground.

Seas were running high at 10-12 feet when the Low Speed Chase was hit by a larger wave and the four were washed overboard, Coast Guard Petty Officer Levi Read said.

“They turned the boat around to go rescue those people and they got hit by another wave,” sending the boat onto rocks, he said. A Mayday call reporting the accident went out at about 3 p.m. PDT.

Coast Guard and National Guard helicopters and water craft rescued three crew members who were clinging to rocks, Read said. The body of the other crew member was pulled from the water.

A Coast Guard helicopter, a cutter and a smaller boat were searching the waters around the islands, 27 miles west of San Francisco, as well as shoreline areas early Sunday for the missing crew members.

Dozens of boats were registered for the Full Crew Farallones Race, running from the St. Francis Yacht Club on San Francisco Bay to the islands and back, about 60 miles round trip, Read said.

was breaking up because of the powerful waves, he said.

They were wearing life vests and cold weather gear – equipment that gave rescuers hope in the search for the missing.

“There is the possibility that the other four were also in the same kind of gear,” Read said.

He said he didn’t know if the four missing were the same crew members who were swept from the boat.

The search was expected to continue through the night, as long as there was a chance there were survivors, the Coast Guard said.

The names of the eight crew members were not released and there was no immediate word on the condition of the three survivors.

The San Francisco Chronicle reported that the Low Speed Chase is based out of the San Francisco Yacht Club, located in Marin County’s Belvedere Cove. The manager of the club declined immediate comment.

MIssing Person Sammy Mercado

There is no sign of 16-year old Sammy Mercado of Sanger. Fresno County investigators have been searching for boy since Thursday. The biggest concern is he could be wounded from a gunshot after allegedly trying to rip off marijuana growers near Malaga.

According to investigator, it was on Thursday morning that 16-year old Sammy Mercado and his two friends drove on to private property at Annadale and Willow where a medical marijuana garden is located.

“As Mr. Mercado exits the vehicle and goes into the field two Asian males came out of the hut that was on the property,” said Lt. Robert Salazar of the Fresno Co. Sheriff’s Dept.

Lt. Salazar says one of those Asian men fired shots in Mercado’s direction.

“There was evidence at the scene that Mr. Mercado was shot,” said Lt. Salazar.

His friends, who were still in the car, got scared.

“They took off leaving Mr. Mercado there at the scene,” said Lt. Salazar.

The friends later told police they saw an older Asian man pull up next to Mercado in a 4-door, white Toyota Camry.

“The trunk of car was opened, but they’re not sure if they actually put Sammy in the trunk of the car,” said Lt. Salazar.

All three suspects have not been seen since that time.

Meanwhile, CBS47 spoke with a friend of Mercado’s in Sanger.

“I couldn’t believe this was actually going on. I didn’t want to believe it,” said Janessa Soto, Mercado’s friend.

Janessa Soto says Mercado and his buddies visited the field for one simple reason.

“Just trying to come up on marijuana,” said Soto.

She realizes that what her friend did was wrong. Now she’s praying that this can just serve as a strong learning lesson.

“We’re hoping he’s out there and he’s ok. We just want him to come home safe,” said Soto.

MIssing Person Porshia Atwell Update

West Virginia Police Officers state that missing Porshia Atwell, 8, is safe and her father, Tracy Atwell was arrested without incident.

Police say they found Tracy Atwell driving along WV 5, near the intersection of Nubbins Ridge Road and Egeria Road in Mercer County around 4:45 p.m. Saturday, reports WDTV news. Tracy was driving the white Jeep he was originally reported to be driving. Porshia was in the Jeep with him.

There was an active Amber Alert for Porshia Atwell, 8, of Camp Creek, West Virginia, after her father abducted her from her grandparent’s home, after allegedly killing her mother, reports WVNSTV news.

Willard Atwell, Tracy’s father, sent his son a message through the media on Saturday to ask him to bring Porshia to a safe place and turn himself in.

“Tracy, we want you to bring Porshia home. This has went for long enough. I know you’re scared to death. I know, Porshia, having her there makes you feel a lot better, a lot safer. We worry about her. Is she getting fed? I don’t know where you’ve got her. Is she cold? That’s everybody’s primary concern,” he said.

Willard also said that Tracy told him on Thursday that the death of Christina, Tracy’s wife and Porshia’s mother, was an accident. Tracy said he tried to revive her, but couldn’t.

Willard also said he struck a deal with his son, which involved allowing him to tie his and his wife’s hands and leaving with Porshia for a brief visit and then bringing her back and facing what he had done. He said that Tracy said he would be back to untie them, but after two hours he had not returned. Williard knew at that point, that his son had changed his mind.

On Friday, Williard said that Tracy called and said he’d messed up and he didn’t know what to do. Then he let Porshia talk to her Aunt Jeannette. Jeannette said later that Porshia sounded cheerful. Which gave hope to law enforcement, reports the Princeton Times.

After Tracy’s arrest he was taken to police headquarters. Atwell is charged with murder, armed robbery, kidnapping, concealment of a child and grand larceny.

Cold Case Arrest of Robert Edward Peek

Brevard County Sheriff’s Office agents arrested Robert Edward Peek, 47, today on charges of first-degree premeditated murder in a cold case from 1988.

Ramona Lee Moore, 22, of Melbourne was killed in July, 1988. Construction workers paving a northern extension of Washingtonia Drive, west of Melbourne, discovered the body of a woman later identified as Moore. She was found nude, beaten and left in a retention area that had filled with water during a recent rain. The medical examiner determined the cause of death to be drowning and classified the death as a homicide.

“It is a very good feeling when we can meet with the family and tell them that the individual responsible for their loss is being brought to justice,” Sheriff Jack Parker said.

A DNA profile obtained from evidence from the murder scene matched Peek’s profile through a CODIS hit in 2011, according to a release from the sheriff’s office. Following an interview this year about the murder, agents said Peek denied any involvement and provided a DNA sample. Lab comparisons between this sample and evidence from the murder confirmed the previous results, they said.

Earlier today, homicide agents interviewed Peek again, who has been detained at the Brevard County Jail since his arrest on Jan. 16, in reference to two cases involving the trafficking of stolen property. Agents said that interview and the DNA findings led to them obtaining a warrant for Peek’s arrest.

This investigation is the sixth cold case homicide solved by the Brevard County Sheriff’s Office Homicide Unit during the past three years.

Missing Person Willie Hurse Found in Lake

BEVERLY SHORES — Officials have identified a body that washed up on a Beverly Shores beach Wednesday as that of a Michigan man missing since early February.

Porter County Coroner Chuck Harris said the body was identified Friday as that of 33-year-old Willie Edward Hurse of Benton Harbor. Benton Township Police issued a missing persons bulletin for Hurse on Feb. 4.

Harris said officials were using a two-pronged approach to identify the badly decomposed remains. Indiana State Police attempted to pull fingerprints from the remains while officials also investigated a surgically implanted metal support rod with serial numbers discovered in the man’s leg.

“On Friday the Indiana State Police Crime Lab was able to secure a fingerprint from the body and ran it through IAFIS (the Integrated Automatic Fingerprint Identification System),” Harris said Saturday.

Harris said officials initially were not sure if either method for identification would have been successful. Hurse was identified by his thumbprints, the only digits from which experts were able to pull prints.

“This actually happened a lot sooner than expected,” Harris said. Officials initially estimated the identification process could take a couple weeks.

It still isn’t known how the man ended up in the Lake Michigan and how he died. Harris said police officials were not looking for the missing man in the lake. Due to the condition of the remains officials may not be able to determine the cause of death.

Pedophile Priest Had Been Evaluated

STOCKTON – A Catholic priest recently found liable for sexually assaulting an altar boy by a civil jury had been sent to a behavioral health center to be evaluated on his sexual deposition several years before the alleged rape occurred.

The former priest of St. Joachim Church in Lockeford, Michael Kelly, showed pedophilic traits in a psychological evaluation ordered by the Diocese of Stockton, but the test results were inconclusive, said John Manly, who is representing the former altar boy.

Manly said that should have been a warning sign.

Manly’s client, now 37 years old, said he was molested and raped by Kelly more than 20 years ago while they both served at Cathedral of the Annunciation.

Identified in court papers only as John TZ Doe, the plaintiff filed the civil suit because the statute of limitations has run out and criminal charges cannot be filed, his attorneys said.

The second phase of the trial began Thursday, which will determine whether the Diocese of Stockton is liable for damages based on its handling of Kelly, who was found liable in the trial’s first phase.

While the plaintiff’s attorneys say the church tried covering up a scandal, defense attorneys say the church responded to the claim and investigated before reinstating Kelly into ministry.

Kelly served at various parishes throughout Calaveras, San Joaquin and Stanislaus counties. There were various complaints of his roughhousing with children, perceived by parents as odd behavior.

Several years before the plaintiff brought his claim forward, a family from Presentation Church, where Kelly served in the late 1990s, complained that Kelly put their son’s face on his crotch.

In response, the diocese sent Kelly to St. John Vianney Center in Philadelphia, a faith-based center that specializes in the behavioral health of clergy.

Kelly later was sent to a six-month extended therapy stay at a Canadian facility. Manly said parishioners believed Kelly was ill with ulcers.

“He was leaving because they were concerned he was a pedophile,” Manly said.

That’s something the diocese has never disclosed to parishioners, Manly said.

Manly’s team will try to prove the diocese set up its internal investigation and the defense rigged the polygraph test to show Kelly was innocent and have him reinstated as head of St. Joachim Church.

The diocese’s history of child molestations by other priests, such as Oliver O’Grady, is expected to come into evidence.

Defense attorney Jim Goodman said O’Grady, who was convicted of molesting two brothers in San Joaquin County in 1994, is a terrible person.

“This trial is not about Oliver O’Grady,” he said.

Those cases didn’t happen under current Bishop Stephen Blaire, Goodman said. The church denies that Blaire ratified any sexual abuse.

“He is not in any way saying, ‘I know that he molested’ (the plaintiff) and he’s OK with it,” Goodman said.

According to Goodman, Blaire followed proper protocol based on the information he had at the time, and reinstated Kelly only when internal investigations didn’t show he was a danger to children.

Goodman said there were people who thought Kelly shouldn’t roughhouse with children.

“It wasn’t a very pretty story,” Goodman said. But, he said, the diocese’s investigation indicated there was nothing sexual about Kelly’s interactions with children.

Goodman said church officials believe Kelly had boundary issues.
Goodman said Kelly went on his own to a polygraph examiner. He said the polygraph was accurately conducted, and the examiner is a nationally recognized investigator.

Although California law prohibits the use of polygraph tests in criminal courts, San Joaquin County Superior Court Judge Bob McNatt said it can be used with limitations in civil trials and therefore has allowed it into evidence.

On Thursday, McNatt also addressed issues with trial audience members who have approached jury members to discuss the case.

For the second time since the civil trial began, a supporter of Kelly has attempted to interfere with or influence the people who found Kelly liable of sexually assaulting a child.

“That will not be tolerated,” McNatt warned spectators just before the second phase of the civil trial was to begin Thursday.

No other details about the alleged interference were available.

The audience attendance numbers Thursday – less than a dozen people – paled in comparison to the attendance of the first phase when Kelly’s supporters filled the courtroom.

During the second phase, Manly will try to prove the diocese was negligent in keeping Kelly employed among children, that it failed to properly supervise him, failed to warn or educate the public about his behavior, and that the diocese ratified his actions by keeping him in ministry.

“We will show you that the reason they did that is Father Kelly was a prolific fundraiser,” Manly said, adding that the priest had recently raised $6 million for a church construction project.

“Who is more responsible?” Manly said in the opening statement. “The predator who is going to consume the child, or the predator who opened the cage?”

Electronic Surveillance Bill to Monitor Vehicle Reg. Laws Failed

Hartford — Voicing concerns about “Big Brother” surveillance, members of the legislature’s Appropriations Committee on Friday voted down legislation for a study of radio-frequency identification technology to monitor compliance with vehicle registration laws.

The bill failed on a 18-25 vote. Several legislators, including Sen. Rob Kane, R-Watertown, said they felt uneasy about the Orwellian potential: “This whole Big Brother idea and government intrusion.”

With radio-frequency ID, a small transmitter device is embedded in a person’s vehicle that could alert law enforcement once the vehicle’s registration, insurance or emissions compliance expires. The bill, introduced in the Transportation Committee last month by Sen. Andrew Maynard, D-Stonington, would have required the Department of Motor Vehicles to study the technology. The study was estimated to cost $300,000 to $500,000.

Background Check Should Have Been Performed On Firefighter

HERE WAS NATIONWIDE COVERAGE this week given to the tragic event in New Hampshire where a police chief was killed and four other officers wounded in a botched attempt to serve a search warrant. The raid was aimed at ridding the town of what the police called “a menace,” referring to the culprit Cullen Mutrie.

When the operation was wrapped up, the police found Mutrie and his girlfriend both dead from apparent suicides or murder/suicide. While the news was rightly focused on the tragedy of the police officers, we would learn a few things if we take a look at the drug dealer, Cullen Mutrie.

For the past several years, despite his growing criminal record, Mutrie was serving as a volunteer firefighter and had hopes to become a paid firefighter on a New Hampshire department.

His criminal history begins in 2003 when he had a violent confrontation with a former girlfriend who had get a court protective order against him. WMUR-TV posts:

(She) claimed Mutrie, “forcefully grabbed me, choked me and pulled my hair … as well as pushed me down several times.” The woman also said Mutrie was “threatening,” was “prone to jealous rages” and indicated he had guns and knives in his possession.

On Dec. 12, 2003, she accused Mutrie of calling her, “intoxicated in a rage, asking where I was and verbally abusing me. I then woke up on Dec. 13 to find two of my car tires slashed,” she wrote, “I am very scared of him because of our history and his explosive behavior and past history of violence.”

In 2005 he applied for a gun license and was denied “due to his criminal background” according to court records.

In 2006 he pleaded guilty to aggravated assault following a fight with another man, but the next year he applied to the court to have the conviction dismissed and be permitted to have a trial on the charges. His reasoning was that he had been given poor legal advice from his lawyer to told him that a misdemeanor conviction would not prevent him from getting a job as a firefighter. He since found out that was not the case and wanted to get his record cleared. At the time he told the court he has been working as a volunteer firefighter for seven years and has been going to school nights and weekends “to get certified.”

Hampton Falls Fire Chief Jay Lord said Mutrie was a volunteer firefighter from 2004 to July 2010. He said Mutrie was nice and polite and dreamed of a career in the fire service.

In 2010 he was arrested again for beating up another woman. He was ordered then to surrender any guns that he possessed, but the woman told police later that there were still several in the house. A report by Officer Wayne Young quoted the victim as saying Mutrie had “a few” guns in his bedroom, one in his vehicle, one in his living room and that he usually carried another one on his person. So local police went to Mutrie’s home on July 24, 2010 to collect them. It was then that they found more contraband in his house and arrested him on drug charges again.

In February of this year the state drug lab sent more evidence of drug possesion and it was this week’s raid that was based on this recent report.

On his Facebook page that was recently created (and is no longer posted) he claimed that he was currently working for the Hampton Falls FD and also studying “paramedicine” at a local community college.

There are several lessons in this relating to the necessity of background checks for firefighter and EMT applicants. Mutrie was obviously trying to construct a phony resume here, including a Linked In account. Just “surfing the web” does not equate to a bona fide investigation. And there is no excuse to avoid performing this function. Firegeezer has been preaching this for years, yet there are still hundreds of departments who skip this necessity. It’s not enough that they are “nice and polite.”
