Wrongful Death Paducah Man Arrested in Shooting of 3 Yr Old

Police in Paducah say they charged a man with manslaughter after he admitted to police that he accidentally shot and killed a 3-year-old boy at his home.

Police spokeswoman Robin Newberry told NBC affiliate WPSD in Paducah that officers responded to the home on North 12th Street on Saturday afternoon where they found the boy suffering from a single gunshot wound.

Emergency workers tried to resuscitate the boy, who was flown to Vanderbilt University Medical Center in Nashville. The boy, whose name was not released, died at 8:30 p.m.

Twenty-one-year-old Nicholas D. Barbee was charged with second-degree manslaughter. Detective Sgt. Brian Laird said Barbee admitted during questioning to accidentally shooting the child.

Wrongful Death Manhunt for Ex LAPD Officer

BIG BEAR LAKE, Calif. — All that was left were footprints leading away from Christopher Dorner’s burned-out pickup truck, and enormous, snow-covered mountains where he could be hiding among hundreds of cabins, deep canyons and dense woods.

More than 100 officers, including SWAT teams, were driven Friday in glass-enclosed snow machines and armored personnel carriers to hunt for the former Los Angeles police officer suspected of going on a deadly rampage to get back at those he blamed for ending his police career.

With bloodhounds in tow, officers went door to door as snow fell, aware to the reality they could be walking into a trap set by the well-trained former Navy reservist who knows their tactics and strategies as well as they do.

“He can be behind every tree,” said T. Gregory Hall, a retired tactical supervisor for a special emergency response team for the Pennsylvania State Police. “He can try to draw them into an ambush area where he backtracks.”

As authorities weathered heavy snow and freezing temperatures in the mountains, thousands of heavily armed police remained on the lookout throughout California, Nevada, Arizona and northern Mexico for a suspect bent on revenge and willing to die.

Police said officers still were guarding more than 40 people mentioned as targets in a rant they said Dorner posted on Facebook. He vowed to use “every bit of small arms training, demolition, ordnance and survival training I’ve been given” to bring “warfare” to the LAPD and its families.

At noon, police and U.S. marshals accompanied by computer forensics specialists used a search warrant to remove about 10 paper grocery bags of evidence from his mother’s single-story house in the Orange County city of La Palma. Dorner’s mother and sister cooperated with the search, a police spokesman said.

The manhunt had Southern California residents on edge. Unconfirmed sightings were reported near Barstow, about 60 miles north of the mountain search, and in downtown Los Angeles.

Some law enforcement officials said he appeared to be everywhere and nowhere, and speculated that he was trying to spread out their resources.

For the time being, their focus was on the mountains 80 miles east of Los Angeles – a snowy wilderness, filled with thick forests and jagged peaks, that creates peril as much for Dorner as the officers hunting him. Bad weather grounded helicopters with heat-sensing technology.

After the discovery of his truck Thursday afternoon, SWAT teams in camouflage started scouring the mountains.

As officers worked through the night, a storm blew in, possibly covering tracks that had led them away from his truck but offering the possibility of a fresh trail to follow.

“The snow is great for tracking folks as well as looking at each individual cabin to see if there’s any signs of forced entry,” San Bernardino County Sheriff John McMahon said.

The small army hunting him has the advantage of strength in numbers and access to resources, such as special weapons, to bring him in.

In his online rant, Dorner baited authorities.

“Any threat assessments you generate will be useless,” it read. “I have the strength and benefits of being unpredictable, unconventional, and unforgiving.”

Without the numbers that authorities have, Dorner holds one advantage: the element of surprise.

Authorities said they do not know how long Dorner had been planning the rampage or why he drove to the San Bernardino Mountains. Property records show his mother owns undeveloped land nearby, but a search of the area found no sign of him.

It was not clear if he had provisions, clothing or weapons stockpiled in the area. Even with training, days of cold and snow can be punishing.

“Unless he is an expert in living in the California mountains in this time of year, he is going to be hurting,” said former Navy SEAL Clint Sparks, who now works in tactical training and security. “Cold is a huge stress factor. … Not everybody is survivor-man.”

Jamie Usera, an attorney in Salem, Ore., who befriended Dorner when they were students and football teammates at Southern Utah University, said he introduced him to the outdoors. Originally from Alaska, Usera said, he taught Dorner about hunting and other outdoor activities.

“Of all the people I hung out with in college, he is the last guy I would have expected to be in this kind of situation,” Usera, who had lost touch with Dorner is recent years, told the Los Angeles Times.

Others saw Dorner differently. Court documents obtained by The Associated Press on Friday show an ex-girlfriend of Dorner’s called him “severely emotionally and mentally disturbed” after the two split in 2006.

Dorner served in the Navy, earning a rifle marksman ribbon and pistol expert medal. He was assigned to a naval undersea warfare unit and various aviation training units, according to military records. He took leave from the LAPD for a six-month deployment to Bahrain in 2006 and 2007.

Last Friday was his last day with the Navy and also the day CNN’s Anderson Cooper received a package that contained a note on it that read, in part, “I never lied.” A coin riddled with bullet holes that former Chief William Bratton gave out as a souvenir was also in the package.

Police said it was a sign of planning by Dorner before the killing began.

On Sunday, police say Dorner shot and killed a couple in a parking garage at their condominium in Irvine. The woman was the daughter of a retired police captain who had represented Dorner in the disciplinary proceedings that led to his firing.

Dorner wrote in his manifesto that he believed the retired captain had represented the interests of the department over his.

Hours after authorities identified Dorner as a suspect in the double murder, police believe Dorner shot and grazed an LAPD officer in Corona and then used a rifle to ambush two Riverside police officers early Thursday, killing one and seriously wounding the other.

The incident led police to believe he was armed with multiple weapons, including an assault-type rifle. That detail concerned officers whose bullet-proof vests can be penetrated by such high-powered weapons, said LAPD Deputy Chief Kirk Albanese.

As a result, all LAPD officers have been required to work in pairs to ensure “a greater likelihood of coming out on top if there is an ambush,” Albanese said. “We have no officers alone right now.”

In Big Bear Lake on Friday, residents were on edge about the manhunt even as ski slopes remained open.

“A lot of people are frightened by it,” said Dennis Pitner. “A lot of people are at home locked in their houses and probably won’t come out for a couple more days, maybe even longer.”

Missing Person Monument, CO Teen Still Missing

MONUMENT – What was supposed to be a day of celebration was another day of gut-wrenching pain for the family of Dylan Redwine, a Monument boy who vanished in southwest Colorado while visiting his father over Thanksgiving break.

Dylan turned 14 on Wednesday. His family and friends sang happy birthday, ate cake with white and blue frosting, played music and blew up balloons.

But they didn’t celebrate. Without the guest of honor, they couldn’t.

Instead, more than 50 people marked Dylan’s birthday during a somber gathering at Limbach Park, shining lights — or “beams of hope” — into the dark sky as a light snow began to fall. Similar gatherings were held in Farmington, N.M., and Bayfield, the town in southwest Colorado where Dylan once lived.

Dylan disappeared during a visit with his father, Mark Redwine, in the Vallecito area near Bayfield. Authorities have said they don’t believe Dylan ran away, but extensive searches in Vallecito have turned up few clues as to his whereabouts.

Family members believe Mark Redwine isn’t telling investigators everything he knows about Dylan’s whereabouts.

“No child disappears just like poof. It’s impossible,” said Dylan’s 76-year-old grandmother, Maria Goodall.

Goodall, who has terminal cancer, said she had celebrated every birthday with Dylan since he was born.

“I want to see him before I die, and it won’t be long anymore, so I have to see him,” she said.

Wednesday’s gathering started with a prayer by Dylan’s older brother, Cory, who asked the Lord to bring his little brother back home safely.

“We’re all very, very sad he can’t be here to join us. It’s probably the hardest day out of all of them so far in the past 2 ½ months,” Cory told the crowd.

Elaine Redwine, Dylan’s mother, said she wanted to have a birthday gathering for all the people who love and care for Dylan.

“It’s important to keep his face out there and keep his story out there so that anybody who knows anything or sees anything can bring Dylan home, help us bring Dylan home,” she said.

Elaine Redwine said she and her older son have been pleading with Dylan’s father.

“Dr. Phil is offering to put us on this Wednesday,” she said, referring to daytime talk show host Dr. Phil McGraw.

“I would love for (Mark Redwine) to join us,” she said. “It’s very important that we get this information about Dylan out there. As I’ve said all along, this is only about finding Dylan, and we need to work together as a team to do this.”

Private Investigator Murder for Hire UPDATE Woman Found Dead

The woman believed to be behind a murder-for-hire plot is dead, according to the McCreary County Sheriff.

Investigators found Regina Stephens of Pine Knot dead in her home with a self-inflicted gunshot wound when they went to serve an arrest warrant for her on Friday, said Sheriff Gus Skinner.

One of the people involved in the crime, Timothy Prater, 30, was arrested Friday afternoon by Kentucky State Police. Prater told police during his interview that he was paid $1,500 to kill Debbie Taylor of Pine Knot.

According to the citation report, Prater and two other men approached Taylor at her home around 5:30 Thursday morning and identified themselves as FBI agents.

The men handcuffed her, assaulted her and used a stun gun, said Sheriff Skinner, who added that Taylor would have likely been killed had it not been for neighbors who responded to the commotion.

The men left the scene after neighbors refused to leave, investigators said.

Prater was booked into the Laurel County Detention Center and charged with impersonating a law enforcement officer, robbery 1st, unlawful imprisonment and criminal conspiracy to commit murder.

The other two men involved in the crime are still at large, Sheriff Skinner said.

Sheriff Skinner told LEX 18 this was not a random crime but a targeted attempt. He said Stephens and Prater knew each other from working at a Pulaski County restaurant.

The sheriff would not comment on a motive but said Stephens knew Taylor’s husband.

Additional arrests are expected in the case, investigators said.

A Louisville woman was shot to death outside her home while her daughter was inside.

Dominque Carter Bryant died from multiple gunshot wounds early Saturday morning.

Missing Person Independence, OH Man

INDEPENDENCE — Mark Smith’s blue Ford Ranger still sits outside his two-story Independence home in the image captured on Google maps, but both Smith and his pickup truck have been missing for a year.

His hazel eyes still sparkle in the photo on his missing person poster, and there, he’s still smiling.

“He was a happy person and he had a good life with nice things. He’s not the kind of person who would disappear,” said Mark’s sister Mechelle Wallace, who acts as a family spokesperson. “We haven’t heard one single thing. They haven’t found him. They haven’t found his truck. They don’t have a clue. It’s been a year, and we’re still just as baffled as we were a year ago.”

Wallace reported her older brother missing on Feb. 27, 11 days after the 50-year-old construction worker was last seen. He is approximately 6 feet tall and weighs 225 pounds. His Kentucky vehicle license plate is 816-AYX.

She said Smith’s adult son, Dustin, has been through the legal process to acquire survivorship benefits, and they are trying to sell Smith’s house.

“We have all been pitching in and making payments, but it’s been a year, so we decided to try and sell it. If he does come back or show up, we would just give him the money and let him start over,” said Wallace. She said the accounts will “pretty much sit there for seven years” unless Smith comes back to claim them.

After seven years, he can be declared legally dead, even if they never find out what happened.

“He vanished without a trace. It’s bizarre,” said Independence Police Chief Shawn Butler.

“There’s really nothing more for us to go on,” said Detective Jim Moore, who has been watching the case. “Right now, we have exhausted all of our leads. We know that nothing violent occurred in the house. We know that he wasn’t checked into rehab somewhere, not in hospitals or jails. His vehicle never turned up anywhere. There’s been no activity on his credit cards. Somebody out there knows what happened to Mark Smith. Somebody knows his story.”

Wallace said she thinks about her brother every day, searches social media and questions friends and acquaintances for any information she can find about what may have happened.

“Not knowing is terrible,” she said. “Not even having a clue is the worst part, because this is something my brother just wouldn’t do. I thought if somebody knew something they would come forward and say something. Nobody has said anything and I don’t understand why.”

Private Detective Man Arrested in Murder for Hire Plot in McCreary County

A man is in jail this weekend after he says he was paid $1,500 to kill someone.

Timothy Prater was arrested in McCreary County Friday afternoon, accused of assaulting a woman.

Police believe there are two other unidentified attackers who were with Prater. Police say during his interview, Prater told them that he was an FBI agent and was paid to kill the woman he’s accused of attacking.

Identity Theft Austin, TX Man Charged

A Texas man has been charged with nine counts of identity theft and fraud after trying to use an access card that police say was fraudulent at The Mall of Acadiana, according to Lafayette police.

Yosuel Gomila, 40, of Austin, Texas, was found to have additional cards in his pockets that police said were counterfeit.

Gomila was attempting to use a card at a business when a security officer was alerted to a possible problem. When the officer approached, Gomila fled, according to a news release from the Lafayette Police Department.

The security officer followed him, and Gomila was detained without incident. He was then taken to the Lafayette Police Department for questioning.

Police said the card Gomila tried to use appeared to be associated with a national bank, but instead was associated with a Hong Kong bank.

Gomila told police he had purchased the counterfeit cards from an individual in Austin, along with a fake New Jersey driver’s license.

Gomila also had several gift cards in his possession that appeared to have been purchased with the fraudulent access cards, police said.

Gomila was booked into the Lafayette Parish Correctional Center on nine counts each of identity theft, abuse of a monetary instrument and access device fraud. He remained in custody Friday night under a $1,500 bond on each count.

Drug Dog Sweep Couple Arrested in Clearfield, UT

LAYTON — A newly certified drug-sniffing dog assigned to the Davis County Sheriff’s Office made a bust during his first day on the job.

Hasko, a 4-year-old German shepherd, and his handler, Deputy Mike Benoit, were certified Tuesday, said Sgt. Susan Poulsen.

Benoit and Hasko were on their first shift together when they assisted other deputies with a traffic stop at 10:45 p.m. on 650 North at Interstate 15 in Clearfield.

Hasko searched around the outside of a vehicle and detected the presence of illegal narcotics, Poulsen said. The deputies then searched the car and a husband and wife in the vehicle.

About 10 grams of methamphetamine were found along with drug paraphernalia that indicated the man is a suspected drug dealer, Poulsen said.

The two occupants of the vehicle were arrested.

Keith Mietus, 52, was arrested on suspicion of distribution of methamphetamine, possession of paraphernalia and a traffic violation.

Christina Mietus, 41, was arrested for possession of methamphetamine.

Poulsen praised the work of Hasko on his first day on the job.

“It definitely takes a great deal of training to smell drugs and let his handler know,” she said. “They tell me he has an outstanding nose and will be a very good drug dog for the sheriff’s office. We are excited to see what he can do during his career.”

The sheriff’s office has five drug dogs. The law enforcement careers of the dogs typically span five to seven years.

Poulsen said Hasko replaces K-9 Clyde, a Belgian shepherd malinois who retired prematurely from the sheriff’s office after three years due to health issues.

Benoit, who has been with the sheriff’s office for two years, said he took delivery of Hasko on Dec. 7, with the dog spending about two months in training before being certified.

The pair work the graveyard shift for the sheriff’s office.
