Insurance Fraud Bay City, Mich. Foot Dr. Sentenced

BAY CITY, Mich. (AP) — Federal prosecutors say a judge has sentenced a Flint-area podiatrist to four years, seven months in prison for his role in a $1.6 million fraudulent medical billing scheme.

U.S. Attorney Barbara McQuade says Richard A. Behnan of Fenton was sentenced Monday after pleading guilty in November 2011 to conspiracy to commit health care fraud.

McQuade says U.S. District Judge Thomas Ludington also ordered the 56-year-old foot doctor to pay $1.43 million in restitution to Medicare and $197,000 in restitution to Blue Cross Blue Shield of Michigan.

The government says Behnan provided services at senior centers and assisted living facilities in Bay City, Flint, Detroit, and Lansing. It says he billed for covered procedures while actually trimming and polishing nails — services insurance doesn’t cover.

Arson Investigation Brentwood, TN Landlord Hires Tenant to Burn Houses for Insurance Fraud

A Brentwood man who owns half a dozen inexpensive homes in North Nashville colluded with one of his tenants to burn down two homes in an effort to collect insurance money, prosecutors have charged.

In early May, according to police records, landlord Scott Williams gave tenant Corey Gaines five months of free rent and $1,000 to burn down two homes on 14th Avenue North.

Shortly after the houses burned, Williams, 54, who owns Kairos Investment Properties, filed fraudulent insurance claims asking for tens of thousands of dollars as compensation for the damage, according to the indictment.

Both Williams and Gaines last week pleaded not guilty in state court, three months after a grand jury in Davidson County indicted the two on arson and insurance fraud, among other counts. Tomeka Gaines also was indicted on charges of theft and not reporting crimes to authorities.

Fire investigators discovered gasoline around the burned homes, which led them to suspect arson. Williams later gave investigators a written statement implicating himself in the arson, although he now maintains his innocence.

Gaines, 32, whose criminal history includes convictions for assault, burglary, harassment and about a dozen other charges and has served at least nine prison sentences, allegedly stole from one of the homes before setting it ablaze.

Authorities say Gaines took air conditioners, clothes, furniture and other personal property from the home of Mary Butler, who was one of Williams’ tenants, before setting fire to the residence.

The grand jury’s indictment noted that one firefighter sustained serious injuries after combating the fire at 1807 14th Avenue North. But no injuries were reported in the May fires.

A recent visit to the residential corridor on which the arsons occurred revealed that there was no trace of the home at 1807 14th Avenue North. The other appeared intact and lived-in.

Neighbor Carolyn Haddox, 54, who has lived on 14th Avenue for several years, said fires had broken out at the 1807 property a handful of times while she has lived across the street.

The fire that ultimately destroyed the home, though, seemed different.

“It happened way too quick,” Haddox recalled, noting that despite how close the community is, she did not know Gaines. “Something about it didn’t seem right.”

In addition to the six North Nashville properties he owns under the Kairos Investment name, records show that Williams is the listed owner on two homes in Brentwood and two in Davidson County.

Attorney Jon Perry, who represents Williams, said his client is a “victim,” adding that “the court process will demonstrate the actual guilty party.”

Williams was released on a $15,000 bond.

Corey Gaines is currently in a Metro prison on a $50,000 bond.

Accident Reconstruction 4 Yr Old Killed in Christian County Accident

A four-year-old girl was killed in a single-vehicle accident in Christian County Tuesday night.

The accident happened at about 6 p.m. on Dr Martin Luther King Jr Way in Hopkinsville. Brooklyn Coleman, of Hopkinsville, was killed when the SUV she was a back seat passenger in lost control when crossing a bridge which was covered with ice. The SUV then left the roadway and struck a guardrail before coming to rest.

Brooklyn was pronounced dead at the scene of the collision by Christian County Coroner Dorris Lamb. The 1998 Ford Explorer was being driven by 29-year-old Amber K. Coleman of Hopkinsville and another passenger in the vehicle was 29-year-old Brian F. Baker, also Hopkinsville. Amber Coleman was treated for non-life threatening injuries at Jennie Stuart Medical Center while Baker sustained no serious injuries.

Police say it appears Brooklyn Coleman was not wearing a seatbelt at the time of the collision. Both Amber Coleman and Baker were wearing seatbelts.

Insurance Fraud Louisville Broker Charged

A Louisville insurance broker has been charged with insurance fraud after a state investigator said he submitted fraudulent life insurance applications to increase his commission payments.

Justin Andrew Bauer, 30, of Coleman-Bauer Insurance Group in Louisville, was arrested at his office at 806 Stonecreek Parkway about 1 p.m. Friday, an arrest citation said.

The insurance fraud charge stems from 2009, when Bauer was an insurance broker with Bankers Life and Casualty Insurance Agency, a Jefferson County court summons said.

Justin A. Bauer is listed as one of the initial organizers and a principle member of Coleman-Bauer Insurance Group LLC, which was established in February 2009, Kentucky Secretary of State incorporation filings show.

A man who identified himself as Justin Bauer answered the phone at Coleman-Bauer and confirmed the address of the business listed on court records was correct, but said he was not the person who had been charged. He said the date of birth, home address and home telephone number listed on the records were not his.

The man also said he was not a broker for Bankers Life and Casualty in 2009.

Court records list two home addresses for Bauer, one in the 100 block of Fairlawn Drive and the other in the 3100 block of Randolph Avenue.

The Justin Bauer listed in court records is accused of filing 25 to 30 fraudulent life insurance applications using the names of actual clients while a broker for Bankers Life and Casualty “with the intent of increasing the amount of his commission.”

Special Investigator Melvin Nicholson of the state Insurance Fraud Investigation Division said that when Bauer was interviewed, he said he had been submitting the fraudulent applications for more than a year, a criminal complaint said.

Bauer “stated that he needed the money,” it said.

The total amount Bauer received in the insurance scam was $6,780.38, the complaint said. He was charged with one count of fraudulent insurance acts of more than $500.

Identity Theft Suspects Wanted in Colorado Springs

Colorado Springs police are investigating a case of identity theft.

Police say it happened December 23. The victim noticed his car window had been broken into after service at the Beth El Mennonite Church on Ranch Drive.

When he looked inside, he noticed his garage door opener and vehicle registration had been stolen. Police say when they arrived at the victim’s home, his 2004 blue Honda Element with Colorado license plate 430RXE was gone. Several items of value including a handmade violin were also stolen from the home.

Several credit cards belonging to the victim were stolen and immediately used at Home Depot, Best Buy and DSW Shoe stores by the suspects.

Insurance Fraud York, NE Woman Pleads Not Guilty

YORK – Susan Schulz, 51, of rural York has pleaded not guilty to felony insurance fraud and misdemeanor false reporting.

The York resident appeared in York County District Court this past week for arraignment, along with her attorney, York County Public Defender Nancy Waldron.

York County Sheriff Dale Radcliff says the cases stem from two separate incidents.

“The first – the insurance fraud case – stems from the defendant calling our office saying her house had been burglarized,” the sheriff explained. “She said she left to take her son to school and when she returned home, she found that someone had broken into her house. She said she was missing a computer, medications, jewelry, cash and other items.”

He said Schulz attempted to file a claim with an insurance company to recoup the value of the stolen property.

“The problem was that there was never a crime,” the sheriff said.

He didn’t provide the details that led to the discovery it was an alleged false claim. Radcliff only stated that the investigative process revealed she allegedly made up the story.

“She even gave us a license plate number of a male driver who had been seen in the area,” the sheriff said, “but there was no crime. It was all a lie in an attempt to get money from the insurance company.”

In a separate situation, Sheriff Radcliff said his department received a call from York General Hospital.

“Hospital personnel reported that Schulz was there, saying she’d been in a car accident – an accident that hadn’t been reported to us. She said she had back pain and needed medication,” Sheriff Radcliff said. “But it was discovered that she wasn’t hurt, she just needed drugs. She said the accident happened while she was delivering newspapers for the Omaha World Herald – but we confirmed that she was not a carrier for the World Herald and there was no indication of an accident with the vehicle or signs of such at the place where she said it had allegedly occurred. We also have evidence that she’s been to a number of other hospitals with the same false reporting of accidents that never happened, just to get medications.”

A trial has been set for May 14.

If convicted, Schulz could be facing a possible maximum sentence of 21 years in prison and/or $26,000 in fines.

Pedophile Tracking Ayden, NC Man Arrested

Police say an Ayden man is accused of sex crimes involving two young sisters.

Mark Lampson, 55, was arrested around 9:45 p.m. Monday by Ayden police, according to officials at the Pitt County Detention Center.

Lampson faces two counts of taking indecent liberties with a child. Police say their investigation began back in October, with one of the offenses happening at the man’s house and the other in his vehicle.

Police say the victims were six and eight years old at the time and Lampson reportedly was a friend of the family.

Lampson’s bond was set at $200,000.

Pedophile Tracking Claims of KY Based Church Cover Up

LOUISVILLE, Ky. (AP) — Five people have joined a lawsuit in Maryland that claims a Kentucky-based evangelical church covered up allegations of sexual abuse against children and failed to alert police.

The new anonymous plaintiffs join three women who filed a civil lawsuit against Sovereign Grace Ministries in October. The church moved its headquarters last year from Maryland to Louisville.

One of the new plaintiffs accuses a co-founder of the church of sexual abuse and assaulting her with “plastic and wooden sticks.”

The church said in a statement about the suit last year that it contains “a number of misleading allegations, as well as considerable mischaracterizations of intent.” The church said its lawyers were crafting a response to the complaint.

Wrongful Death Shooting at Community College in KY

LEX 18 is following breaking news out of Perry County tonight where there has been a shooting on the campus of Hazard Community and Technical College.

Sources tell LEX 18 that three people have been shot and that two of those people are dead. We’re told this happened in the First Federal Center parking lot at HCTC just before 6:30 p.m.

Hazard Police are on the scene along with Kentucky State Police.

Kentucky State Police say two people who identified themselves as having some sort of involvement with the shooting came forward to the KSP post in Hazard and are being questioned.

Private Detective Police Investigate Violent Laurel County Home Invasion

Police in Laurel County are investigating a home invasion robbery that happened early Tuesday morning.

The incident happened at about 12:30 a.m. at a home on Dogwood Lane in Lily, located about six miles south of London. Police say two male suspects armed with clubs and pistols robbed a Lily couple, taking medication and cell phones.

The female victim was outside her residence when the two suspects jumped her, chasing her into her residence, and then beating her and her husband with clubs, and threatening them with guns. The suspects are identified as white males – one wearing a ski mask, and one had face paint on. They fled the scene on foot.

The victims are identified as Claude David Jones, 52, and Caroline Jones, 53. Both received serious cuts and scratches and were treated at the scene by Ambulance Inc. of Laurel County
