The Chenango County Sheriff’s Office is investigating a missing person complaint. The missing person: Jennifer L. Ramsaran, age 36, Sheff Road in the Town of New Berlin was last seen leaving her residence on the morning of December 11, 2012. Jennifer told her husband she was going to Destiny USA in Syracuse to shop. She left in a 2006 Chrysler Town and Country minivan, color maroon with New York registration EFA1962. Jennifer’s cell phone was located on December 12, 2012 on State Route 23 in the Town of Plymouth.

Jennifer may have changed her hair color and style prior to leaving on Tuesday.

Private Detective Data Stored on Cell Phones Not Protected

Data stored on personal cell phones is not protected by the Stored Communications Act (SCA), the U.S. Court of Appeals for the Fifth Circuit has ruled.

As mobile technology changes rapidly, legal questions remain about the extent of digital privacy protection.

The Fifth Circuit determined that the act does not protect information stored on personal devices such as cell phones, laptops and personal computers. The lawsuit was brought by a former police dispatcher who was dismissed after photos and text messages on her cell phone revealed that she was violating police department rules. The plaintiff’s cell phone was removed from her locker and searched without her permission.

The SCA only protects “facilit[ies] through which an electronic communication service is provided” and not the device that is used to access those communication services, the court explained.

Wrongful Death Reward for Tips Leading to Arrest of Andre Ballard’s Killer

A Louisville family is refusing to give up on finding their father’s killer.

Andre Ballard was catching a bus home from work almost a month ago when he was robbed and shot to death.

Now, his surviving family members are posting reward signs near the area where he was killed.

Louisville Police have yet to make any arrests in the case.

Missing Person Robert Lee Folsom of Manton, CA

Red Bluff Police say 55-year-old Robert Lee Folsom of Manton was reported as a missing person by his son on Sunday afternoon.

Police say Robert’s son Tyjal Folsom found his father’s car and dog in the parking lot of Casa Ramos Restaurant in Red Bluff Saturday at 9 p.m. He was unable to find his father, and tried searching for him again on Sunday. When Tyjal was unable to find his father he contacted the police for assistance.

On Sunday evening, the Red Bluff Police Department and Red Bluff Fire Department searched the nearby area on foot, but were unable to find Robert. Police say Robert suffers from a medical condition and needs medication.

Robert is described as a white man with brown hair and blue eyes, 5’11” tall and weighs about 200 pounds.

Insurance Fraud Bethesda, MD Woman Pleaded Guilty

A Bethesda, Md., woman pleaded guilty to a bankruptcy scam involving insurance fraud and concealing assets.

Diana J. Stout, 56, faces five years in prison when sentenced in February, according to federal prosecutors.

The charges are related to Stout filing for Chapter 7 bankruptcy. In 2010, she forged a contractor’s signature on and cashed insurance claim checks intended for repairs to a Hagerstown, Md., home following water damage.

She also concealed assets, including stocks, cars and an $85,000 Cartier diamond bracelet.

Stout’s former boyfriend accused her of misappropriating $1 million of his money.

Private Detective 2 Brothers Convicted of Supplying Drugs to Louisville Drug RIng

Two brothers have been convicted of conspiring to supply cocaine from a Mexican drug cartel to Louisville’s biggest drug trafficking organization — one that the government said distributed more than a ton of cocaine from 2008 to 2010.

A jury found Abel and Ramon Flores guilty of conspiring to supply the drug to the organization led by Michael A. McCarthy Jr. in a scheme in which 26 people have been convicted.

McCarthy, who pleaded guilty, testified against Abel Flores, 41, and Ramon Flores, 34, who prosecutors showed moved the drug to Louisville from Southern California.

The verdict were returned by the jury after only one hour of deliberations and entered by Judge Charles R. Simpson III on Wednesday.

Sentencing for the Floreses and other defendants is set for March 12. They face from 10 years to life in prison and a fine of up to $10 million .

When the U.S. Drug Enforcement Administration and Bureau of Alcohol, Tobacco, Firearms and Explosives finally broke up the ring through an investigation they dubbed “Operation Across the Pond” (the Ohio River, in this case) authorities seized 37 kilograms of powder cocaine, 1 kilo of crack cocaine, an arsenal of more than 20 assault rifles and $4 million in cash.

“These convictions illustrate the importance of law enforcement collaboration across jurisdictional lines,” U.S. Attorney David Hale said in a statement. “Their combined efforts curtailed a violent interstate drug organization. Our communities are safer as a result.” This case is being prosecuted by Assistant U.S. Attorneys Scott Davis and Robert Bonar.

The Courier-Journal reported in July that McCarthy was only in his 20s and so young that his underlings called him “Youngin.” Described as respectful and soft-spoken — he had no felony convictions, let alone any for drug trafficking — McCarthy lived quietly with his girlfriend and children in a $353,000 home on a one-acre plot in Spencer County.

Court-approved wiretaps show that they called their kilo bags “briskets” and referred to selling the drug as “swerving.” They transported their product in 18-wheelers and race-car haulers and they stored it in three stash houses near the Watterson and Gene Snyder expressways.

Accident Reconstruction Man Killed Walking Down Road Hit in Grant County

State Police say a woman couldn’t avoid hitting a man walking down a Grant County road Saturday night.

KSP says Sheila Ray was driving on Kentucky 36 when she hit and killed William Bowling.

Bowling was walking on the travel portion of the road and because of oncoming traffic, Police say Ray couldn’t swerve to avoid hitting him without putting herself in danger.

Ray was not under the influence at the time of the crash but it remains under investigation.

Pedophile Tracking Conroe Man Gets 4 Life Sentences

Kenneth Shaun Lowe, 33, of Conroe, received four life sentences with no chance of parole Friday on four counts of super-aggravated sexual assault of a child, improper photography and indecency with a child by sexual contact.

A sentencing hearing was held Friday before 221st state District Court Judge Lisa Michalk, following Lowe’s guilty plea. Aggravated sexual assault of a child is considered a “super” aggravated offense when it involves a child under the age of 6, with a minimum of 25 years in prison up to 99 years or life, with no possibility of parole, according to a release from the Montgomery County District Attorney’s Office.

It was discovered that Lowe had sexually abused two children under the age of 10. The investigation was led by Investigator Nikki Neeley, with the District Attorney’s Office, on assignment with the Montgomery County Sheriff’s Office.

“Investigator Neeley obtained an arrest warrant and then tracked down Lowe in Lancaster, Texas, where he was arrested by the Lancaster Police Department,” stated Nancy Hebert, chief prosecutor for the Montgomery County District Attorney Office’s Crimes Against Children Division, in the release.

Hebert and Neeley worked together on this case as part of the specialized Child Abuse team located at Children’s Safe Harbor.

“Investigator Neeley’s quick actions not only secured the evidence necessary to prosecute this case, but also ensured that Lowe was located and immediately arrested,” Hebert stated.

At sentencing, Hebert presented the testimony of Neeley; Clare Lucas, the children’s licensed professional counselor and Clinical Director for Children’s Safe Harbor; and the emotional testimony of the children’s father. In response, Lowe took the stand and asked for leniency from Michalk. But while sentencing Lowe, Michalk said that his horrific actions demanded a life sentence for each of the four counts of super-aggravated sexual assault of a child.

Michalk then granted the state’s motion to stack the four life sentences. Consequently, Lowe will never be eligible for release from prison.

Hebert applauded the combined efforts of the Specialized Child Abuse team, Neeley, Children’s Safe Harbor, the Montgomery County Sheriff’s Office and especially the courage shown by the children’s parents in coming forward.

“Judge Michalk sent a clear message that Montgomery County will not tolerate sexual abuse. As a result, this perpetrator will never have an opportunity to destroy the innocence of another child,” Hebert stated.

Missing Person Jordan Hill Since March 23, 2001

Buffalo, NY (MPN) – On the evening of March 23, 2001, twenty year old Jordan Hall called his mother and told her that he needed her to take him back to the hospital. A paranoid schizophrenic, Jordan had been discharged from the same hospital just four days earlier against the advice of family members and social workers.

After his March 19, 2001 discharge, Jordan spent a few days with his family. He then returned to his Buffalo, NY apartment before making the phone call to his mother. By the time she arrived to bring Jordan back to the hospital, he was gone. Jordan has not been seen since.

At the time of his disappearance on March 23, 2001, Jordan Hall was 20 years old and had a goatee. He is six feet tall and 160 pounds, with brown hair and blue eyes. Jordan is a paranoid schizophrenic and is known to remain silent for periods of time due to his belief that he can communicate telepathically. He may be suicidal.

When he was last seen, Jordan was wearing navy blue nylon track pants and grey running sneakers. He also had on a royal blue Columbia ski jacket with black and grey trim on the shoulders. Jordan has a keloid scar on his right elbow, and a third nipple.

Arson Investigatin Clayton Man Last of Four to be Sentenced

ADRIAN — The last of four men convicted of burning a vacant house in Clayton on a dare was sentenced to probation and a treatment program Friday in Lenawee County Circuit Court.

“I plan on being a whole lot wiser in the decisions I make,” Christopher James Beaubien, 30, told the court when he appeared for sentencing on a reduced charge of aiding and abetting arson. “Whatever you give me I will use it as a tool to better myself.”

Beaubien pleaded guilty in the arson case on Oct. 31. His explanation for burning the house was: “I guess, being stupid.”
The night of July 10, he and the three others began daring and encouraging each other to set fire to the house on West Street. Beaubien said he knew the owner but had no hard feelings toward him.

Judge Margaret M.S. Noe said she hoped Beaubien is sincere about bettering himself. But his record is not encouraging, she said.
“I find you have a tendency to be most untruthful. You lie,” Noe told him.

“I want to believe I will never see you again,” she said. “My hope is that you mean it.”

Beaubien is already serving a one-year jail term he received Aug. 27 in district court for a reduced marijuana possession conviction. He is to be released after six months if his fine and costs are paid.
Noe ordered Beaubien to enter a residential treatment program when he is released from jail. He was also placed on five years’ probation and ordered to pay $1,250 court costs. He was also ordered to participate with the three others in paying $54,800 restitution for the fire damage.

One of the three other Clayton men, Shequille Albert Sheffield, 19, was given a 32-month to 10-year prison term for an arson charge he pleaded guilty to on Sept. 19. He admitted actually setting the fire.

Dylan Matthew Scott, 20, was sentenced to a year in jail and five years’ probation for aiding and abetting arson. And Michael Andrew Luft, 23, was given a nine-month jail term and five years’ probation for attempted aiding and abetting arson. He was also ordered released to a residential treatment program after serving six months.
