Accident Reconstuction One Dead in Lexington Crash

Lexington Police are investigating a deadly crash that officers say happened late Thursday afternoon at Greendale Road and Buck Lane.

According to police, a pick-up driver rear-ended a car, sending it into a FedEx semi. The driver of the pick-up then tried to flee the scene before causing a second head-on crash about 100-yards away. Police said the driver was pronounced dead at University Of Kentucky Hospital.

Missing Person Body Found of Missing Fort Morgan Man

A body found Monday morning at the Pick of the Litter recycling center in Fort Morgan was identified Tuesday as that of a Fort Morgan man who had been recently reported missing.
Roger Allen Ladd, 54, of Fort Morgan was reported missing by family members who hadn’t heard from him in recent weeks.
Fort Morgan Police arrested a man Tuesday who allegedly tried to conceal the death at 125 Park Street.

On Monday, a caller requested a welfare check of Roger Ladd, who had been staying at the Pick of the Litter location. The caller said she had learned that he may be dead.
Police contacted Darwin Secrist, 55, who had been evasive during several previous police contacts as to the whereabouts of Ladd.
Police investigated further and discovered Ladd, who was deceased inside the structure on the Pick of the Litter property in which Secrist had been living. Further results of the post-mortem examination are pending, but the cause of death appears to be from natural causes.
Secrist was arrested Tuesday on charges of Concealing Death (Misdemeanor) and Attempting to Influence a Public Servant (Felony) and held at the Morgan County Detention Center without bond.

Private Detective 2 Arrested Exposing Children to Illicit Drugs

Two women were arrested in Madison County after they allegedly exposed young children to illicit drug activity and dangerous drug paraphernalia.

Police say they were called to the Knights Inn on Northgate Drive at about 3 p.m. on Tuesday. Upon arrival, officers say they were greeted at the door by a visitor to the room, Kathie L. Browning, 51, of Berea. In speaking with Browning, officers deduced that she was under the influence of an intoxicant and noted that the room was filled with smoke and had an odor that officers associated with possible drug use. Officers further observed two small male children, ages 4 and 9, asleep on a bed in the room.

Upon entering the room, officers observed several items of drug paraphernalia scattered about the room, including spoons, cotton balls, pill bottles, burnt marijuana cigarettes, and numerous syringes and pills that were in close proximity to the sleeping children. Officers subsequently located the renter of the room in the bathroom. She was identified as Sarah L. Ritenour, a.k.a. Sarah Hogue, 24, and she also appeared to be under the influence of an intoxicant.

It was subsequently determined that the sleeping children had been brought to the room by Browning, who was a relative of the children but not their guardian.

Browning and Ritenour were ultimately taken into custody and a search of Ritenour’s person produced a syringe, a cut straw, five oxycodone pills, and a baggie containing an unidentified white powder.

Social services representatives were summoned to the scene and transferred custody of the children to another relative.

Browning and Ritenour were both arrested and charged with first-degree wanton endangerment. In addition, Ritenour was charged with first-degree possession of a controlled substance, possession of marijuana and possession of drug paraphernalia.

Both women were held at the Madison County Detention Center.

Wrongful Death More Info on Man Found in Freezer

Walter Logan knew he would be arrested when police officers knocked on his door.

“I’ve been waiting for you,” Logan told them.

They came to his Kokomo home Sunday, looking for Alex Shipp, who had been missing for nearly a month.

“Is he here?” one of the officers asked Logan, according to a probable cause affidavit filed Monday.

“Yes he is,” Logan said.

“Where?” one of the officers asked.

“In the basement,” Logan said, “I put him in the freezer.”

Detective Michael Banush of the Kokomo Police Department was one of the detectives who came to Logan’s house looking for Shipp. The 51-year-old man directed them to the basement door, which had an ironing board lodged against it, Banush said in his report. They found an unplugged freezer lying on the floor with its door facing up; a large concrete block sat on top.

Inside was the 29-year-old homeless man’s decomposing body. Based on Logan’s account of what happened, Shipp’s body had been in the freezer for nearly a month.

Logan told police he and Shipp had had a sexual relationship for about two years. About four weeks ago, Shipp came to his house, where they drank and did drugs, documents said. Logan told police they had sex that night. Afterward, he said Shipp became belligerent and tried to fight him.

That’s when Logan bound Shipp’s hands and feet with duct tape, he told police, and placed it over his nose and mouth, documents said.

The next morning, after he woke up, Logan thought Shipp was dead, but he wasn’t sure, he told police. He then removed the duct tape, carried Shipp to the bedroom, laid him on a mattress, and went back to sleep.

He later saw blood around Shipp’s head after he woke up, Logan told police. Six or seven hours later, he carried Shipp’s body to the basement.

What prompted the fight between Logan and Shipp is still unclear.

Several days earlier, Logan apparently had told a friend, Dan Wagner, that Shipp was dead and that Logan was going to prison. Wagner said he didn’t believe it until he saw a flier about a missing person that had Shipp’s picture on it, according to court documents.

Around 8:30 p.m. Sunday, Wagner called police and told them to go to Logan’s house.

Shipp’s mother, Rebecca Wolf, told police Saturday that she had not seen her son since Nov. 8, when she dropped him off at a local convenience store. Wolf told police it wasn’t like Shipp to be out of touch for weeks.

Both men have had several encounters with police. According to the Indiana Department of Corrections database, Logan was convicted of dealing in cocaine in 2003 and was released from incarceration in Howard County in 2006.

Logan has been formally charged with murder. He is scheduled for an initial hearing Wednesday in Howard Circuit Court.

Insurance Fraud South Jax Woman Gets Probation

A South Jacksonville woman arrested for insurance fraud after dumping her car in Waverly Lake last spring will avoid prison time.

Twenty-seven-year-old Helyne Wiser of the 200 block of East Greenwood pleaded guilty to the crime in Morgan County Circuit Court yesterday. Judge Richard Mitchell ordered Wiser to serve 2 years probation and pay an $1,100 fine.

Morgan County assistant state’s attorney Robert Bonjean says Wiser reported her 2004 Chevrolet Monte Carlo and about $3,000 worth of stereo equipment supposedly inside the car stolen in April. The Morgan County Search and Rescue Team found the vehicle in Waverly Lake in June. The stereo equipment was found at a Jacksonville residence after an investigation.

Bonjean says it’s Wiser’s first felony offense.

“She had no criminal history to speak of that would warrant a sentence to the department of corrections,” says Bonjean. “So, the state felt the appropriate recommendation was probation. And then restitution we don’t have a firm grasp of. That’s why I asked the court to order the probation department to prepare a restitution report for the parties to review.”

He hopes this outcome will serve a lesson to others.

“Conviction for felony is the most severe punishment as a result of [the crime],” says Bonjean. “Hopefully, we can use that as a deterrent for anyone else trying to do something so foolish.”

Twenty-six-year-old Chance Jackson-Stille of the 200 block of East Greenwood is facing a charge of insurance fraud for his role in the incident. A resolution in his case could happen next month.

Private Detective 2 Convicted Harboring Undocumented Bolivian

LOUISVILLE, KY—An Elizabethtown cardiologist and his ex-wife plead guilty in United States District Court before Judge John G. Heyburn, II late yesterday to charges involving the harboring of an undocumented Bolivian national as their servant, for financial gain, announced David J. Hale, United States Attorney for the Western District of Kentucky.

Dr. Javier Arce, age 59, pled guilty to a federal information charging him with misprision of a felony (failure to report knowledge of a felony to the proper authorities). His former wife, Cristina Mier Arce, age 56, of Hardin County, pled guilty to harboring for financial gain. The indictment to which Cristina Arce pled guilty alleged that the defendants recruited an undocumented Bolivian woman to work as their domestic servant and harbored her unlawfully for a total of nearly 15 years. The federal indictment of June 23, 2011, alleges that beginning in 1994, the defendants recruited the woman to travel to the United States and then harbored her in their home and derived financial benefit from her labor as a full-time domestic servant from 1994 to 2006.

Judge Heyburn sentenced both defendants to a period of two years’ probation, and, as part of their plea agreement, the defendants were required to pay the victim restitution for back wages totaling $100,000.

The case was investigated by the Federal Bureau of Investigation (FBI) and prosecuted jointly by Assistant U.S. Attorney Joshua Judd and Trial Attorney Daniel Weiss of the Civil Rights Division’s Human Trafficking Prosecution Unit.

Pedophile Tracking Barren County Man Sentenced to 34 Years

BOWLING GREEN, KY—A Barren County/Sidney, Ohio man was sentenced to 34 years in prison followed by a lifetime of supervised release this week, in U.S. District Court, by Senior Judge Thomas B. Russell. Senior Judge Russell enhanced the sentence of Tony Glenn Harvey, age 57, for committing perjury during trial testimony announced David J. Hale, United States Attorney for the Western District of Kentucky.

Harvey was convicted by a federal jury on August 10, 2012, following a two-and-a-half-day trial, on both counts of a federal indictment that charged him with transporting a minor across state lines to engage in illegal sexual activity and brandishing a firearm in furtherance of a crime of violence. The jury deliberated just over one hour before finding Harvey guilty.

According to evidence presented at trial, Harvey transported the child from Sidney, Ohio to Smiths Grove, Kentucky, in Barren County. In late July 2011, Harvey took the child to a trailer in Smiths Grove, where he forced the child to engage in sexual intercourse and oral sex with him. He also forced her to engage in sexual intercourse and oral sex with another adult male.

On or about August 22, 2011, Harvey again transported the child from Ohio to Barren County, Kentucky. On August 24, 2011, while in Barren County, Kentucky, Harvey encouraged the child to have sex with him and when the child told him no, he brandished a .22 caliber pistol and told her she deserved to die. Harvey also threatened to hurt himself and other family members.

Harvey will forfeit to the courts, property located in Barren County, Kentucky.

This case was prosecuted by Assistant United States Attorney Jo E. Lawless. The Barren County Sheriff’s Office, in close association with the Federal Bureau of Investigation, conducted the investigation.

Wrongful Death Man Indicted in Death of Marion County Deputy

The man accused of killing a Marion County deputy sheriff last month entered a not guilty plea in the case Thursday.

Dewayne Shipp, 49, is charged with murder in the shooting death of Marion County Deputy Sheriff Anthony Rakes. Police say Shipp shot Rakes on November 14 during a routine traffic stop.

Shipp, who police say shot himself in the leg after the murder, was released from University Hospital in Louisville and taken to the Kentucky State Reformatory at Lagrange due to the medical facilities at the prison.

The Marion County Grand Jury indicted Shipp on one count of murder of a police officer and one count of a convicted felon in possession of a handgun.

Shipp’s trial date has been set to begin on September 23, 2013. Prosecutors will seek the death penalty against Shipp.

Missing Persons Bodies of Missing Iowa Cousins Possibly Found

EVANSDALE, Iowa (AP) — Hunters discovered two bodies Wednesday believed to be the young Iowa cousins who vanished five months ago while riding their bikes, authorities said.

The families of 9-year-old Elizabeth Collins and 11-year-old Lyric Cook were notified of the discovery and are asking for privacy, Black Hawk County sheriff’s Capt. Rick Abben said.

He said the bodies were found in a wooded area, but he wouldn’t say where, and that they’re being sent to the state medical examiner’s office for identification.

Appearing to fight back tears during a news conference in Evansdale not far from where the girls were last seen, Abben said: “It’s definitely not the outcome that we wanted, obviously.”

“This is a difficult thing for us to go through. It’s a difficult thing for the community,” he added.

The cousins disappeared July 13 near a popular recreational lake in Evansdale, a city about 110 miles northeast of Des Moines. Investigators found their bicycles and a pink purse near the lake hours later, but no sign of the girls.

Abben declined to say if there were any suspects in the cousins’ disappearance.

On Wednesday night, about 70 people attended a prayer vigil at the lake, some cradling plastic cups with candles to protect the flames from the cold wind. Some were holding out hope that the bodies weren’t those of the missing cousins, though others seemed resigned to the tragic news.

“These were just innocent children. These girls should have been left alone. They should be home safe in their beds, and it’s only a coward who would have done something like this,” said Barb Collins, a machinist who grew up in Evansdale and helped lead the group in prayer.

Hundreds of volunteers had helped investigators search for girls after they went missing, traipsing through cornfields and wooded areas in and around Evansdale, a city of 8,000 residents. The mayor even flew above in his private plane looking for them.

Days later, an FBI dive team brought in specialized equipment to search the bottom of the lake for the girls but found nothing. Police then classified the case as an abduction.

Investigators had largely been tight-lipped in the months since. An FBI spokeswoman initially said investigators had reason to believe the girls were alive, raising the region’s hopes. But other investigators backtracked, saying only that there was no reason to believe the girls were dead.

Authorities had asked hunters to look for the girls in the region during this fall’s popular deer hunting season.

Abben said the bodies were discovered around 12:45 p.m. Wednesday, but refused to say where. He said the area was still being processed as a crime scene and could not be compromised.

“Preservation of that scene is paramount,” he said.

Abben said he hoped to release additional details Thursday.

Abben said the girls’ families wanted to express gratitude to the community for their support but have asked the media to respect their privacy at this time.

Investigators have poured through thousands of tips and chased many different theories in the case.

They looked into Cook’s parents, who had criminal records for prior involvement in making methamphetamine. Cook’s father, Daniel Morrissey, is being prosecuted for domestic assault and a series of meth and other drug charges, and he backed out of a plea agreement with prosecutors the day before the disappearance. They have denied any involvement.

The region had rallied in support of the girls. Photographs of the cousins seemed to be everywhere in northeastern Iowa: on T-shirts and buttons worn by locals, and on fliers hung on gas station walls and in business windows.

“In the beginning, I helped search, and I’ve been to many other vigils they had. The community is so involved,” said Amanda Mulzac, who lives in nearby Waterloo and attended Wednesday night’s vigil. “My heart breaks. It’s just devastating.”

“At their age I was out by myself, but now it’s different,” she added. “Hold your babies close.”

Local residents had held prayer vigils, even as the months passed and both girls had birthdays. Just last week, an anonymous donor pledged $100,000 for information about the girls’ whereabouts, on top of the $50,000 that police had offered.

After Wednesday night’s vigil, family friend Sarah Curl said she had seen “a lot of heartbreak” after news broke about the bodies being found.

“We’re a tight community that cares about one another, and when something happens to one family it happens to all of our families,” she said. “This could have happened to anyone.”

Insurance Fraud Hillsborough Woman Pleads Guilty

A Hillsborough woman pleaded guilty Friday to insurance fraud after lying on her car insurance applications for 13 years, the Somerset County Prosecutor’s Office said.

Maria Demeter, 42, of East Brookside Lane, agreed in front of Superior Court Judge Julie M. Marino, sitting in Somerville, to make restitution to the New Jersey Manufacturers Insurance, and was ordered to perform 50 hours of community service and be placed on non-custodial probation.

Demeter, also known as Maria Schebece, was charged in August with insurance fraud for lying on her applications with NJM since 1999, claiming to be living alone when she was married and living with her husband, who did not qualify for the company’s insurance, the prosecutor’s office said in a statement released Tuesday.

The court may order restitution at sentencing in an amount of up to $39,019.76, representing the premiums Demeter saved with the false informaiton, plus $4,205.76 paid in March 2010 for a claim she made, the prosecutor’s office said.

Demeter’s case was brought to the attention of the Somerset County Prosecutor’s Office Insurance Fraud Unit in April of 2012, after NJM reported she had disclosed she made material misrepresentation in obtaining her motor vehicle insurance policies since 1999, the prosecutor’s office said.

The prosecutor’s office said Demeter had purchased two auto insurance policies based on rates for a single woman living in a household with no other registered drivers.

Prosecutor Geoffrey Soriano said the investigation found Demeter’s misrepresentations enabled her to puchase the policies, but she would have not been eligible for otherwise because of her spouse’s driving record.

NJM was formed nearly 100 years ago to provide insurance to members of the Manufacturer’s Association of New Jersey, now the New Jersey Business and Industry Association, and is known for its strict requirements for eligibility and its low premium costs.

The prosecutor’s office said Demeter benefited by paying substantially lower insurance rates than she would have if she provided accurate information to NJM.

Demeter was served on Aug. 27, 2012, with a summons complaint charging third-degree insurance fraud by detectives from the Somerset County Prosecutor’s Office Insurance Fraud Unit and released on her own recognizance.

She is scheduled to be sentenced on Feb. 1, 2013, before Judge Marino. She has been released on her own recognizance pending sentencing.
