Arson Investigation Waco Blaze that Killed 2 Children was Arson

Waco deputy fire marshals say a fast-moving mobile home blaze that killed a mother and two small children in February was arson.

Waco Fire Marshal Kevin Vranich said authorities came to the conclusion that the Feb. 16 fire that swept through the home was intentionally set, in part, by ruling out all accidental causes of the blaze.

But police officials announced Tuesday they have closed their portion of the six-month investigation.

Ashley Dawn Rogers, 27, and two of her children, 8-month-old Gage Megginson and 3-year-old Madisyn Marie Megginson, perished in the Bosqueville-area mobile home at 6312 N. 19th St., despite efforts by neighbors and firefighters to save the family.

The only survivor was then-2-year-old Kaiden Megginson, who was pulled to safety by a neighbor.

Pathologists at the Southwestern Institute of Forensic Sciences who performed autopsies on the victims determined they died of thermal burns and smoke inhalation, according to the reports. Their deaths were ruled by medical examiners as accidental, the documents state.

From the outset, the Waco police and fire departments ran a joint investigation, with police detectives focusing on the deaths of Rogers and the children, and deputy fire marshals studying the cause of the blaze.

But on Tuesday, Waco police Sgt. W. Patrick Swanton said detectives recently closed their investigation after exhausting all leads in the case and finding no criminal wrongdoing. In previous interviews, he said a trained canine had not found evidence of accelerants.

There were no smoke detectors found in the home, officials said.

“At this point, there’s nowhere else that we can go with it, pending additional information coming forth,” Swanton said. “We can always open it back up.”

Deputy fire marshals, who are licensed peace officers, will continue their investigation into the cause of the fire independently.

“We do have reason to believe it is an arson fire, and we are investigating it as an arson fire,” Vranich said.

He said he could not discuss additional details about the ongoing investigation.

Reached by phone late Tuesday afternoon, Tommy Megginson, the father of the children, said he remains focused on caring for his son, who was released to his custody several days after the fire.

The boy, who authorities said was treated in February for smoke inhalation and minor burns, cuts and bruises, is doing well, he said.

“They are loved and missed and still cherished,” Megginson said about Rogers and the children. “I still love them, even though they’re not here.”

Pedophile Tracking 4 Arrested after Beating Pedophiile to Death

Four people have been arrested and police are seeking a fifth after a suspected pedophile was found brutally beaten, strangled and robbed outside a home.

The body of Dean Barker, 51, was found outside a brand new Washington home that was for sale on September 8. His hands had been tied behind his back, his mouth had been taped shut and a red bandanna was tied around his neck.

According to local news reports, a red bandanna is the sign of a local blood gang.

Angela King, 24, William Barry, 33, Justin Mahaffey, 23, and Aileenah Horton, 17, have been arrested, but have yet to be charged in the murder.

Police are still looking for Jeffrey W. Powell, II, 30. He was been charged with first-degree murder, robbery and kidnapping.

According to court documents, two of those arrested have accused Barker of sexually assaulted them in the weeks before his death. One of the men arrested told authorities Barker had molested a three-year-old girl.’

County Prosecutor Mark Lindquist says it’s not clear ‘if this is a case of vigilante revenge or if the allegation of sexual assault is just a cover story’.

Missing Person in Johnson City, TN Maybe Dead

Johnson City police investigators are hesitant to say a missing woman is the victim of a homicide, but a report in the case indicates her boyfriend told a family member he had killed her.

Vonda Berry Marshall Donaldson, 28, was reported missing by her family on Sunday after she couldn’t be found, didn’t answer her cell phone and didn’t show up to pick up her children from their father.

Steven Odell Bennett, 31, is the sole suspect in Donaldson’s disappearance.

According to a police report, Bennett called a family member Sunday night and said he had killed Donaldson and was going to dispose of her body. Apparently Bennett and Donaldson got into an argument and he strangled her after she called him names.

He was arrested Monday on a parole violation but has not been charged with Donaldson’s death, according to JCPD Capt. Mike Street.

“We have conferred with the Attorney General’s Office and charges are forthcoming but after conferring with them, we have decided not to place any charges at this point in time,” Street said. “I think after talking with the District Attorney’s Office we would very much like to locate the body before we actually place any formal charges.”

That search has centered on the area of Butler Bridge in Carter County. Investigators spent part of the day there with officials from the Carter County Sheriff’s Office and Carter County Rescue Squad.

Squad members launched a rescue boat equipped with sonar and began making broad sweeps of the section of the lake downstream from the bridge.

Carter County Sheriff Chris Mathes said the search would continue until dark on Tuesday, then resume this morning.

Investigators think Donaldson’s body was dropped off the bridge into Watauga Lake.

Chief Deputy Ron Street was aboard the boat during the early part of the search. Although it was a windy day, the boat appeared to be having no problems in searching the mountain rimmed lake.

After conducting the broad sweep, Street left the boat and the rescue squad continued making more localized searches of the lake. Street said the sonar is a more effective and less labor intensive method of searching for a body than the old dragging operations.

The squad continued to search throughout the afternoon under favorable weather conditions, but did not locate Donaldson’s body.

A family member last heard from Donaldson at 11:20 p.m. Saturday. By 7:30 a.m. Sunday, Donaldson was nowhere to be found.

Her mother, Rosie Jenkins, went to Donaldson’s apartment after her daughter’s dog showed up at her house. She said Donaldson’s apartment door was unlocked and slightly open, but she thought her daughter was out looking for the dog.

When she couldn’t reach her through the day and when Donaldson didn’t show up to pick up her two daughters from their father by 7:30 p.m., Jenkins knew something was wrong.

After getting information about Donaldson’s disappearance, police officers located her car at Leeland Trailer Park. Bennett was inside the car, according to Street.

This isn’t Bennett’s first encounter with Johnson City police. He has a string of convictions in Washington County, including evading arrest, multiple auto thefts, assault on a police officer and aggravated kidnapping.

That incident happened in November 2002 when Bennett — then 21 years old — forced a woman into a vehicle in the parking lot of The Planet, which was located at 820 W. Walnut St.

The 18-year-old victim told police she and friends were leaving the nightclub around 3 a.m. when Bennett approached them to ask for directions.

The teenager said she asked Bennett if he had a cell phone she could borrow and was standing only inches from his vehicle when he grabbed her, pulled her across his lap in the driver’s seat and began driving, attempting several times to slam the door shut and threatening to cut her throat if she continued to resist.

The teen said she hit and kicked Bennett several times as he held her in the car and kept fighting until she broke free, fell out of the car, then got up and ran back into the nightclub.

The vehicle Bennett was driving was stolen and an officer spotted it driving more than 100 mph on University Parkway. He tried to pull the driver over, but Bennett wouldn’t stop. Unicoi County officers later stopped Bennett and arrested him after he ran into some woods on the south side of Erwin, according to reports of the incident.

Bennett apparently gave a videotaped statement the following morning in which he first confessed to stealing his mother’s 1994 Ford Taurus in Nashville several days earlier, driving it to Johnson City and wrecking the car at West Market Street and Perma R Road.

According to reports on the 2002 incident, Bennett said he stole a second car from a West Market Street convenience market but later abandoned that car at a North Johnson City package store where he took a 2001 Mitsubishi Eclipse that had been left running in the store’s parking lot.

Finally, Bennett admitted to driving the Mitsubishi to King George County, Va., where he stole the Grand Am he was driving on the night of the alleged abduction.

Bennett has been in and out of the Washington County Detention Center more than half a dozen times since 2001. He was most recently sentenced to 12 years in 2004 on the kidnapping and various theft convictions.

He also had an existing 10-year sentence from previous convictions tacked onto the 12 years, for a total 22-year prison sentence.

The violation of his parole — which only started when he was released from prison June 27 — is unrelated to Donaldson’s disappearance, but Street did not know what Bennett had done to be violated.

Missing Person Surveillance Photo Released of Twitter Hoax Girl

Police have released a surveillance photo of a young woman they believe to be the runaway 16-year-old New Jersey girl who set off a Twitter firestorm after she apparently falsely indicated an intruder was in her home and disappeared.

Kara Alongi, 16, was seen on a security camera at the NJ Transit Rahway train station in Union County, holding a backpack and a large purse. Police say she purchased a train ticket to New York Penn Station Sunday evening and authorities are working with NJ Transit to review available station video.

Alongi gained thousands of followers after asking people on Twitter to call 911 Sunday because an intruder was in her home and then vanishing. People re-tweeted her message and #helpfindkara trended on the social network.

Investigators later said it appeared Alongi, of Clark, had voluntarily called a taxi company and gotten a ride to the Rahway train station, which police say is confirmed by the surveillance photo. Police do not believe any foul play was involved, but stress Alongi remains missing and her family wants her home.

“Kara might feel that she will be in trouble if she comes home after this scare and causing a panic,” Clark Police Chief Alan Scherb said Monday as the extensive search got underway. “At this point, all everyone cares about is seeing her safe and at her house where she belongs.”

Twitter users worldwide tweeted messages of good will @KaraAlongi Sunday night as her initial post asking for help circulated. Many said they were frightened to think about what could have happened to her.

Others were skeptical about her pleas for help, pointing out a Tweet that allegedly popped up on Alongi’s account that said: “Why is everyone saying I’m missing? I was jkin haha” and was deleted a short time later.

For Carly Martin, a Rutgers sophomore who followed the tweets Sunday night, it was more than disappointing to find out someone just a few years younger would take advantage of a social media site in that way.

“That’s just ridiculous,” Martin said. “You shouldn’t be making a joke out of that when people are actually missing.”

Accident Reconstruction Georgetown, KY Crash

A crash reconstruction team is on the scene after an accident in Georgetown Wednesday morning.

The accident happened at the intersection of Hemingway Place and the bypass around 7:45 a.m. A minivan sustained side-door damage, and there was front-end damage on a car. Police say the van was turning left onto the bypass when the car T-boned it.

EMS took both drivers to UK Hospital.

Identity Theft Pennsylvania Man Set to be Arraigned

PITTSBURGH—A southwestern Pennsylvania man used the identity of a baby who died in 1953 to get a second state identification card from the Department of Transportation, state police said.

Raymond Davis Buck, 59, of Grindstone, was scheduled to be arraigned Wednesday before a district judge in Fayette County on identity theft, records tampering and making false unsworn statements on government documents.

The Herald-Standard of Uniontown first reported the charges Tuesday, filed by Trooper William Coddington, who is assigned to investigate driver’s license fraud cases at the barracks in Belle Vernon.

Coddington told The Associated Press the case was referred to him by PennDOT officials who use facial recognition technology to spot duplicate identification cards and driver’s licenses. Although both cards list Buck’s name, they list different birth dates and were issued based on two sets of identity documents—one set belonging to Buck and the other set issued in the dead baby’s name.

According to a criminal complaint, Buck was born on Jan. 9, 1953, and got his legal Social Security card in 1967. But, somehow—the complaint doesn’t specify and Coddington told The Associated Press he couldn’t say—Buck also came to possess various documents belonging to the baby, Wesley Thomas Glagola.

The baby was born in September 1952 and died 11 months later.

certificate in the baby’s name in 1994, and the state of California—where Buck used to live—issued a certificate in 1995 indicating that Wesley Thomas Glagola changed his name to Raymond Buck. A second Social Security card was then issued to Buck in 2002 using the baby’s birth date and other identity information, the trooper found.

After returning to Pennsylvania, Buck got a Pennsylvania driver’s license using his true birth date and Social Security number at the Uniontown driver’s license center in April 2007. That license has since been renewed and is valid through 2015 and lists Buck’s address in Grindstone, Fayette County.

But the trooper said that in May 2007, Buck used the Social Security number and birth date of the baby to apply for a state ID card at a driver’s license center in Belle Vernon. That card has also been renewed and lists Buck’s name and his correct address.

Buck didn’t immediately return a message left on his home phone Tuesday, and his public defender declined to comment.

Pedophile Tracking Man Claimed to be Investigating Child Porn

DuPage County prosecutors on Tuesday accused a private detective of using “the Pete Townsend defense” to explain how more than 160 images of child pornography ended up on two of his computers and his cellphone.

Luigi Castillo, 34, of Glendale Heights, pleaded guilty in July to possessing one of the images but maintained he mistakenly downloaded child pornography and was investigating it to help victims.

At sentencing Tuesday, Prosecutor Romas Mockaitis sought 3½ years in prison for Castillo, comparing his story to that of the popular British guitarist Pete Townsend of The Who, who claimed he was researching child abuse when he was caught up in an child pornography investigation in 2003.

Mockaitis said that if Castillo really wanted to help victims, he would have contacted police or the National Center for Missing and Exploited Children during several years of downloading child pornography.

“It’s sort of like the Pete Townsend defense,” Mockaitis said. “What steps did he take (to report the crimes) in three or four years?”

Judge Kathryn Creswell sentenced Castillo to three years of probation and four months in jail. She said his explanation was “certainly unusual,” but she found his decision to plead guilty mitigating.

Defense attorney David Camic said Castillo was a private investigator when he came across the images that led to his arrest. Castillo told police he went as far as contacting an out-of-state high school to “put an end to the abuse” of two victims he identified in pornography through a piece of clothing that identified the school.

“My actions have never been with evil or malice,” Castillo told the judge in court Tuesday, apologizing to his family and the victims depicted in the images.

Castillo starts serving his jail sentence next week. In addition, he has been ordered to register as a sex offender, get a full-time job and stay away from minors other than his own two children.

Wrongful Death Man Killed at Lexington Nursing Home

A 31 year-old man is dead after being shot behind a Lexington nursing home, and police are still looking for the shooter.

It happened around two at Northpoint Healthcare Center off Trent Boulevard.

Police say three shots were fired after three people met up in the parking lot.

“They were meeting to have a discussion. The discussion didn’t go so well,” says Lieutenant Scott Blakely.

Officers say the people knew each other and one of them worked at the nursing home, but authorities aren’t sure which one. They also don’t know why the discussion escalated.

“It absolutely had nothing to do with the nursing home, other than the fact it occurred here,” Blakely says.

Officers say the man responsible for the shooting took off, and 911 was flooded with calls from people who saw what happened.

“We had multiple people calling in and we’re working through that information as people provided it. I feel certain we’ll be able to identify the party that’s no longer here,” Blakely says.

Many of those witnesses work in the nursing home. No one would talk about what they saw on camera. The nursing home administrator couldn’t tell LEX 18 anything about the worker who police say was involved in the shooting.

“I want to ensure anyone that has residents or relatives at this nursing home, that they are perfectly safe,” says Blakely.

Police don’t have a description of the shooter. They also haven’t found the murder weapon.

Accident Reconstruction Mother and Daughter in a Car Accident in Madison County, Ky

State Police say a woman and her daughter were hurt in a single-vehicle accident in Madison County early Tuesday morning.

The incident happened just before 7 a.m. on Red House Road, which is east of Richmond. Police say a 2006 Toyota Corolla driven by Devon Proctor, 22, was traveling west on Red House Road. Police say Proctor lost control, went off the right side of the road and struck a tree.

Officials say Draya Grissom, her six-year-old daughter, crawled out of a sunroof to flag down motorists to help her mother.

Proctor, of Richmond, was transported to University of Kentucky Hospital, where she was admitted for her injuries and is listed in critical condition. Grissom was also taken to UK Hospital for treatment of minor injuries.

Pedophile Tracking Man Caught Looking at Porn in Library

A registered sex offender is facing charges after Louisville Police say he was caught looking at child porn on a computer at a public library.

Mark Brown already served time for sex abuse charges when he was an aide in a special education classroom in 2004.

Over the weekend, police say staffers at the Bon Air Library called police when they noticed Brown looking at child porn on the computer.

Brown is now facing new charges of possession of matter portraying a sexual performance by a minor.
