Insurance Fraud William Hlushmanuk of Churchville

A Bucks County man has been indicted in a scheme that bilked Medicare of more than $5.4 million.

William V. Hlushmanuk, 35, of Churchville was charged in a 23-count health care fraud indictment that was unsealed today by the U.S. Attorney General’s office.

Hlushmanuk, also known as “Bill Le,” allegedly started the Starcare Ambulance Company in 2006 to transport kidney dialysis patients.

Because Hlushmanuk had a criminal record that included conviction for burglary, assault and firearms violations, he was ineligible to operate the company under his own name, so he used a straw owner identified in documents only as B.R.

Starcare employees instructed patients who could otherwise walk to climb onto stretchers for their three-times-a-week trips to dialysis clinics. Each round-trip averaged $400 allowing the company to continuously bill Medicare for the unnecessary rides, according to investigators.

During the course of five years, Starcare billed over $5,443,315.72 in rides to the U.S. government.

The indictment, which demands the return of the money, along with a 2006 Hummer, charges 21 counts of health care fraud, one count of conspiring to commit health care fraud and one count of aiding and abetting in a false statement relating to a health care matter.

Insurance Fraud Thomas Wasilko

ELIZABETH, Pa. (AP) — A Pittsburgh-area dentist has been arrested and charged with insurance fraud after he allegedly continued to see patients while his license was suspended.

The Attorney General’s office says in a statement Friday that 55-year-old Thomas Wasilko, of Elizabeth, is charged with two counts of insurance fraud and two counts of theft by deception.

Prosecutors say that Wasilko’s dental license was suspended in Nov. 2010 for at least six months, but he allegedly continued to practice. Wasilko allegedly submitted more than 100 insurance claims during the time his license was suspended and receive nearly $5,000 from an insurance company.

Wasilko was released without bond and a preliminary hearing is scheduled for July 9.

Wrongful Death Carnel Chamberlain Killed by Mom’s Boyfriend

A 20-year-old man has been charged with assaulting his girlfriend’s 4-year-old son whose family says was found dead under a porch at the mid-Michigan Indian reservation where they live.

Anthony Bennett is charged in a federal criminal complaint Friday in Bay City.

Hundreds of people gathered Thursday night at a vigil for Carnel Chamberlain near Mount Pleasant at the Saginaw Chippewa Indian Tribe’s reservation, where he had lived with his mother and Bennett. He was reported missing June 21 while in the care of Bennett, while his mother was at work.

For days, investigators searched woods, ponds and the tribe’s wastewater treatment areas to no avail. Family spokesman Kevin Chamberlain said Carnel’s body was discovered on Thursday.

Bennett is not charged in Carnel’s death.

Federal authorities were silent on the case early Friday, and the tribe was expected to hold a news conference in the afternoon at the Isabella Indian Reservation.

On Friday morning, a tribal police car sat outside the family’s one-story home, less than a mile from tribal police headquarters and the offices of the Saginaw Chippewa tribe. Just beyond the offices is the tribe’s gleaming Soaring Eagle Casino and Resort, which attracts gamblers from around the state.

Kevin Chamberlain, the tribe’s former chief who is a cousin of Carnel’s mother, Jaimee Chamberlain, said he had no details about what led investigators back to the house after many days of searching woods, ponds and the tribe’s wastewater treatment areas.

The body “had to be in a grave. We had looked underneath before and didn’t see anything,” he said.

Carnel disappeared June 21 while in the care of Bennett. The Morning Sun newspaper reported that Bennett was considered a person of interest by police after the boy disappeared.

Tribal police had been leading the investigation. On Thursday, they referred calls to the FBI, which declined to comment Thursday and again on Friday morning. Any charges in the case would be handled by federal authorities, who have jurisdiction over major crimes on Indian reservations.

A message seeking information on the case was sent early Friday to a spokeswoman for a U.S. attorney’s office in Michigan.

The vigil was attended by Jaimee Chamberlain, relatives and others. People sang, played drums and spoke urging love and healing in the face of tragedy.

Arson Investigation Waldo Canyon Fire

The out of control fires that broke out in Waldo Canyon in Colorado Springs, CO have started to fuel speculation that some of it could be due to arson. Numerous confirmations from news outlets getting emails from the FBI say that investigations are underway to decide whether an arsonist was responsible for some or all of the fires.

Fox News had released a statement from Dave Joly, FBI spokesman in an email that said, “The FBI Denver Division is working closely with local, state, and federal law enforcement to determine if any of the wildland fires resulted from criminal activity.” The Denver Post added to the statement from Dave Joly saying, “FBI personnel are supporting command post operations in the fire regions and offering assistance with managing the volumes of information related to these tragic events.”

The fire was recognized and reported around 12:00pm on Saturday June 23rd, 2012 as record heat waves started to hit the Midwest. At this point there is no official statement to the cause of the Waldo Canyon Fire that continued to burn into Colorado Springs taking out historic locations like the Flying W. Ranch. A statement on the Flying W. Ranch’s homepage from Flying W. Ranch Management, Staff & Ownership announced, “With much sadness we have to report that the Flying W Ranch as well as several homes in the Mountain Shadows area has in fact been burned to the ground. We ask that in this sad time that you remember the Flying W and the Wolfe family who has owned and operated the Flying W Ranch since 1953.”

At this point confusion and anger has set in as rumors start to spread among residents in Colorado Springs about potential criminal activity. The Colorado Springs arsonist speculation has been fueled by Teller County fires that have been confirmed as arson fires. So far the Denver Post reports that nearly thirteen of the fires in Teller County were set by a serial arsonist but had all been caught in time. Now it seems it is up to the FBI Denver Division and local police to figure out the question burning in people’s minds: Were the Colorado Springs Fires set by an arsonist?

Wrongful Death Fort Brag Soldier Killed Superior

FAYETTEVILLE, N.C. — A Fort Bragg soldier shot and killed another soldier during a unit safety briefing on post Thursday afternoon, then shot and wounded himself, officials said.

According to an Associated Press report, Fort Bragg officials confirmed that the suspect shot and killed his superior officer.

Both soldiers were assigned to the 525th Battlefield Surveillance Brigade.

A third soldier, Spc. Michael E. Latham, 22, suffered a minor injury and was released from Womack Army Medical Center, according to the AP report.

The identities of the other two soldiers have not been released by Fort Bragg authorities.

The shooting happened around 3:30 p.m. during a briefing ahead of the long weekend for soldiers, officials said. It is unclear how many shots were fired.

Fort Bragg spokesman Col. Kevin Arata said he did not know the specific nature of the injuries of the two surviving soldiers, but said the shooter was alive and in custody.

A senior U.S. defense official told NBC News that the soldier killed was a battalion commander. Arata wouldn’t confirm the report but did say the brigade’s commander was not harmed.

“This is a tragedy for our community. We don’t yet know the reasons for the shooting, but are working with the unit and the affected families to help them through this difficult period,” Arata said. “Our prayers are with those who have been affected by this terrible incident.”

The killing is believed to be the first shooting murder on Fort Bragg in more than 15 years, when Sgt. William J. Kreutzer Jr. opened fire on his brigade at Towle Stadium. But the 525th Battlefield Surveillance Brigade lost another soldier about three months ago when he was shot and killed in Fayetteville.

Thursday’s shooting was in a field next to the Bastogne Gables neighborhood on Fort Bragg. The area is in Fort Bragg’s historic district, several blocks from Macomb Street.

The field, often used for formations by nearby units, is flanked by buildings used by the 525th and the 16th Military Police Brigade.

Hours after the shooting, military police and agents from Army Criminal Investigation Command remained on the scene, which centered on the area around a small wooden stage.

Nearby intersections in the area of Letterman and Armistead streets remained blocked Thursday evening.

The 525th Battlefield Surveillance Brigade has several subordinate battalions, including the 319th Military Intelligence Battalion, the 519th Military Intelligence Battalion, the 1st Squadron of the 38th Cavalry Regiment and the 525 Brigade Support Battalion.

Safety briefings are common on Fort Bragg and typically take place before weekends or holidays to remind soldiers to be safe and use caution.

Fort Bragg soldiers have a training holiday today and do not report back for duty until Tuesday.

It is unclear what, if anything, was the motive for the attack.

The Army has been confronting a surge of suicides within the military, officials have said.

Pentagon statistics obtained by The Associated Press show that suicides have spiked this year to roughly one a day, higher than the rate of combat deaths. About half of those turning weapons on themselves have no history of deployment.

Thursday’s killing came three months after the murder of Sgt. Kevin Moseby in Fayetteville. Moseby, who had been with the Special Troops Battalion, 525th Battlefield Surveillance Brigade since January 2010, was shot at his home in March.

Another soldier, Duane Brown Jr. of Sanford, was charged in that killing.

While several non-shooting murders have occurred on Fort Bragg in recent years, officials said it is very rare to have a soldier shot and killed on the military installation.

In October 1995, Kreutzer shot and killed Maj. Stephen Mark Badger and wounded 18 other soldiers. Kreutzer is serving a life sentence at a military prison in Kansas.

Desrivieres is believed to have fled to New Jersey after the murder. On June 19, 2012, Desrivieres was charged with two counts of first degree murder, among other charges, in Montgomery County, Pennsylvania. A federal arrest warrant was issued for Desrivieres in the Eastern District of Pennsylvania on June 26, 2012, after he was charged with unlawful flight to avoid prosecution.

Pedophile Tracking Winston Louis Hale Charged 31 Counts of Child Porn

A McCracken County man was arrested on charges related to child pornography Monday after Kentucky State Police served a search warrant at his home.

Winston Louis Hale, 31, is charged with 31 counts of distribution of matter portraying a sex performance by a minor and 20 counts of possession of matter portraying a sex performance by a minor. He is being held in the McCracken County Jail.

Hale was arrested as the result of an ongoing undercover Internet Crimes Against Children investigation that began in January 2012. KSP Electronic Crime Branch detectives began investigating after they discovered a suspect sharing images of child sexual exploitation online. The majority of the images depicted the sexual abuse of children who were less than 12 years of age.

The investigation resulted in the execution of a search warrant at Hale’s residence in West Paducah on June 25, 2012 by the KSP Electronic Crime Branch and personnel from KSP Post 1 in Mayfield. Equipment used to distribute and possess child pornography was seized and taken to KSP’s Forensic Laboratory for examination.

Private Detective Teardrop Rapist Strikes Again

A man dubbed the Teardrop Rapist, who is linked to at least 35 attacks on women in the southern Los Angeles area, may have struck again.

Since attacks began in 1996, multiple composite sketches of the suspect show a changing face, but his mode of operation hasn’t changed, authorities said.
“He will approach them. He tries to make conversation with them. He’ll pull out a weapon,” Los Angeles police Detective Jesse Alvarado said.
Investigators say the man strikes in the early morning hours, often before the sun comes up.

The most recent attack happened 5:30 a.m. June 15 in southeast of downtown LA near the intersection of 25th Street and Naomi Avenue (map).
A 29-year-old woman was approached by a man who attempted to converse with her and then produced a handgun and forced her to walk into an alley where he attempted to sexually assault her, police said.
A vehicle came into the alley and the suspect fled on foot.
“He is the type of person that will flee the minute he believes he may be seen by someone,” Alvarado said.
Detectives said the sexual assaults have happened across a broad swath of the city — within six police divisions and in the unincorporated Firestone-Florence area. Many of the incidents have occured in South Los Angeles and Koreatown.

In 33 of the 35 cases, Latina women have been the victims.

In April, the Los Angeles Police Department released nine different sketches of men described by victims in similar attacks. Many of the sketches show one or two teardrop tattoos under one eye.

At that time, police said the most recent assault was in November 2011. Now the new incident has neighbors frightened.

“I feel scared especially since we have a lot of little kids on this block,” says Margarita Martinez, a South Los Angeles resident.

Martinez lives only a block away from where the suspect hit last. Officers say the rapist has assaulted girls and women ranging from 14 to 41 years old.

“Maybe I’ll carry a shank or pepper spray,” Martinez said.

Detectives said the rapist is leaving behind DNA that has already linked him to 10 sexual assaults. They are hopeful word of mouth will lead to a break in the case.

“This individual is known by someone in the community. It’s going to take someone to say this does look like my neighbor,” Alvarado said.

The suspect is a light-complected Hispanic male with a mustache, aged 40 to 55, with brown eyes and brown hair, police said. He is between 5 feet 2 inches and 5 feet 6 inches, weighing 130 to 170 pounds.

The city of Los Angeles is offering a reward for up to $50,000 for information leading to the identity, arrest and prosecution of Teardrop Rapist.

Fraud Investigation James Norman Turek Convicted

LEXINGTON—A federal jury convicted the former president of a Lexington-based company today for defrauding thousands of investors nationwide out of more than $18 million.

The jury convicted 66-year-old James Norman Turek of eight counts of securities fraud and five counts of tax fraud following a two-week trial. After the jury returned the guilty verdict, Chief Judge Jennifer B. Coffman found that Turek was a flight risk, and he was taken into custody by the United States Marshals Service.

The evidence at trial showed that Turek headed Plasticon International Inc., a penny stock company. Plasticon made recycled plastic products but had few sales.

According to the evidence, from 2004 to 2006, Turek lured approximately 8,500 investors to purchase Plasticon stock by falsely claiming that Plasticon was profitable when he knew that the company was losing millions of dollars. In statements to investors and in press releases, Turek also falsely claimed that the company owned valuable patents.

The evidence further showed that Turek told investors that he was working for nothing when he was stealing millions of dollars from Plasticon. Turek stole the money by issuing billions of shares of company stock to himself. He claimed on false and backdated documents that he had previously loaned money to the company. In order to execute his scheme, Turek transferred the stock into the names of friends and family members, including his deceased aunt, before selling the stock to unsuspecting investors.

The evidence also revealed that Turek filed false tax returns for the years 2003 through 2007 by failing to report approximately $12 million that he stole from Plasticon.

Kerry B. Harvey, United States Attorney for the Eastern District of Kentucky; Kathryn M. Keneally, Assistant Attorney General for the Tax Division; Perrye Turner, Special Agent in Charge, Federal Bureau of Investigation; and Christopher A. Henry, Special Agent in Charge, Internal Revenue Service, Criminal Investigation Division, jointly made the announcement today.

The investigation was conducted by the FBI and the IRS Criminal Investigation Division. The United States was represented at trial by Department of Justice Trial Attorney Kenneth C. Vert and Assistant United States Attorney John Patrick Grant.

Turek is scheduled for sentencing on September 27, 2012. He faces a maximum prison sentence of 20 years on each count of securities fraud and three years on each count of tax fraud. However, the court must consider the U.S. Sentencing Guidelines and the applicable federal statutes before imposing the sentence.

Fraud Investigation Tracey Skarhus Embezzled $11k

LOUISVILLE, KY—A Georgia woman who embezzled over $11,000 from the Armed Forces Bank, Fort Knox, Kentucky, pleaded guilty recently in United States District Court before U.S. Magistrate Judge James D. Moyer announced David J. Hale, United States Attorney for the Western District of Kentucky.

On June 18, 2012, Tracey L. Skarhus entered a guilty plea to a one count Information which charged her with embezzlement. According to the Plea Agreement filed in the case, Skarhus, age 45, of Richmond Hill, Georgia, was employed by Armed Forces Bank on Fort Knox, Kentucky, from September 2008 to December 2010. During her employment at the bank, Skarhus embezzled money by removing a total of $11,490 in cash from the bank.

The maximum potential penalties are 30 years’ in prison, a maximum fine of $1,000,000 and a five year term of Supervised Release.

Sentencing is scheduled for September 18, 2012, at 1:00 p.m., in United States District Court, Kentucky, before Judge John G. Heyburn II. Skarhus was released from custody on a $25,000 unsecured bond with no special conditions.

This case is being prosecuted by Special Assistant United States Attorney Andrew J. Browell and was investigated by the U.S. Army Criminal Investigation Command and the Federal Bureau of Investigation.
