Private Detective Floyd County Man Sentenced for Dispensing Perscriptions

LONDON—A Floyd County man who faced the most serious charges in Kentucky’s historic drug roundup in 2009 was sentenced to 240 months for the illegal distribution of thousands of pills in Eastern Kentucky.

United States District Judge Gregory Van Tatenhove sentenced 55-year-old James Marsillett, II yesterday for the offense of operating a continuing criminal enterprise.

http://liarcatchers.com/index.php

In October 2009, Marsillett was charged in the largest drug sweep in Kentucky’s history, resulting in the arrest of more than 500 people. All of the 36 defendants charged federally in the roundup have been convicted.

Marsillett previously admitted that from 2007 to 2009, he funded monthly trips for numerous co-defendants to see Dr. Michael Shook in Florida. Shook worked at Lauderhill Medical Center in Ft. Lauderdale, Florida, and prescribed large quantities of Methadone and Oxycodone.

“Today’s sentence is a significant victory for our law enforcement partners in the ongoing struggle to combat prescription drug abuse,” said U.S. Attorney Kerry B. Harvey. “Mr. Marsillett’s criminal conduct added to the misery caused by prescription pill abuse in many of our communities. We are pleased that he has received justice for playing a leading role in a large drug trafficking organization and hope this sentence will send a warning to others who may be inclined to engage in similar conduct.”

Shook was sentenced to four years in federal prison last year for unlawfully dispensing Oxycodone. He admitted that he spent little time evaluating patients before writing prescriptions for them. The patients Marsillett sent to Shook paid approximately $2,000 for an MRI, a doctor’s visit, and the prescription.

Marsillett acknowledged that the co-defendants he sent to the Florida pain clinic gave him half of the pills they obtained, which he then sold in Eastern Kentucky. Marsillett used the proceeds from the drug trafficking to fund the trips to Florida.

According to court documents, in 2006 and 2007, Marsillett traveled with others to Urgent Care pain clinics in Cincinnati and Philadelphia to obtain Methadone pills for distribution in Eastern Kentucky.

Marsillett will have to serve 85 percent of his prison sentence.

Kerry B. Harvey, United States Attorney for the Eastern District of Kentucky; Perrye Turner, Special Agent in Charge, Federal Bureau of Investigation; and Rodney Brewer, Kentucky State Police Commissioner jointly made the announcement.

The investigation was conducted by FBI, Kentucky State Police, Operation UNITE, and Appalachia HIDTA. The U.S. Attorney’s Office was represented by Assistant U.S. Attorney Roger West.

Identity Theft Scammers Using Search Engines

Conducting an everyday search using internet search engines poses more threat for web surfers than e-mail accounts, according to an analysis conducted by Blue Coat Security Lab. With e-mail users smartening up to phishing scams, thieves are now searching for new ways to take money, spread viruses and implement online identity theft.
Cyber Criminals Shift Focus to Internet Search Engines

Blue Coat Security Lab revealed in an analysis of Web traffic from more than 75 million users on home and corporate networks that web criminals have shifted their focus from e-mail phishing to scams using internet search engines.

http://liarcatchers.com/identity_theft_investigation.html

Researchers found that criminals are poisoning the search results consumers receive when searching for information on Bing, Yahoo, Google and other search services at a rate four times more frequently than they are sending tainted links through e-mail accounts.

The analysis found that most criminals have given up on the e-mail phishing scam, because account holders have learned to detect fake e-mails and delete them immediately. On the other hand, people assume internet searches are safe and are more likely to click on the links provided by a query without questioning the source.
How to Protect Against Online Identity Theft

The threats associated with internet search scams are similar to those of e-mail phishing. Thieves who get individuals to click on tainted links can infect and take control of computers, convince victims to purchase insignificant software and possibly even commit online identity theft.

How can an internet users avoid this online scam? Blue Coat Security Lab suggests individuals watch out for:

Major news event or celebrity links: Many thieves are targeting individuals searching for major news events, celebrities and other popular topics with the help of bad links. When searching for information, stick with reputable links and sources.
Mundane topics: Victims who search for everyday topics like recipes, sample letters and anything else most individuals would assume is completely safe are also being used for online identity theft purposes.
.ru and .cn links: The firm noted that criminals are creating sites under .ru (Russia) and .cn (China), since this is where many of the scams originate. If you’re searching a topic that requires you to visit sites from those countries, Blue Coat Security Lab recommends avoiding these links.

The firm acknowledged that Google and Microsoft are pouring resources into stopping these kinds of search result threats, but with 26 million new samples of malicious software detected online in 2011 alone, it has been difficult to keep up.

Missing Person Heather Hodges

The search for Heather Hodges, the Rocky Mount mother who has been missing since April 9, has been elevated to a criminal investigation, according to Franklin County Sheriff Bill Overton.

“We have found forensic evidence that Heather Hodges’ disappearance was preceded by a violent event,” said Lt. Todd Maxey at a press conference Monday morning. “We do have a person of interest in the case.”

Maxey declined to identify the person of interest or provide details about the evidence and a search warrant that was executed in connection with the case. The search warrant has been sealed by the court.

http://liarcatchers.com/missing_persons_investigations.html

Overton said the person of interest appeared to be cooperative in the beginning of the investigation but has now given several different accounts of circumstances surrounding Hodges’ disappearance.

“We are concerned that this individual’s stories keep changing,” Overton said.

The sheriff’s office wants to keep the public informed, Overton said, but does not want to jeopardize a possible criminal prosecution.

During the press conference Monday, Overton said he also wanted to dispel rumors that have been circulating on social media websites.

“We do not know whether Heather Hodges is alive or deceased,” he said. “We have not found a body.”

“This has been a frustrating case,” Overton added. “We had hoped to have found Heather Hodges by now.”

Now 66 days into the investigation, Maxey said investigators have been treating the case as a major crime since the beginning, even though it was classified as a missing person.

“We didn’t want to miss anything,” Maxey said.

“We are still hoping to bring Heather home to her family, but after 66 days, the outlook is getting grim,” Maxey added.

No one has been in contact with Heather Hodges since she was last seen by her boyfriend, Paul R. Jordan II, at the house they share on Shady Lane in Rocky Mount about 10:30 p.m. on April 9, according to Overton. Jordan reported Heather Hodges missing.

Jordan, 39, told investigators that he left the house for about 10 minutes and was unable to locate Hodges when he returned.

Heather Hodges did not take any of her personal belongings with her, and her vehicle is not missing, Overton said. Heather Hodges has left home in the past but not for this long and not without contacting family members, he added.

Heather Hodges has blonde hair and blue eyes. She is 5 feet, 1 inch tall and weighs about 100 pounds.

Anyone with information is urged to contact the sheriff’s office at 483-3000 or the anonymous crimeline at 483-6620.
