The disbursements to buyers were usually in amounts between $85,000 and $130,000.

The president of Golden Design Group Inc. (GDG), which built and sold houses in the Denver metropolitan area, according to the information contained in the Indictment.

Capra was also the registered agent for Distinctive Mortgages LLC, which used GDG office space and provided mortgages for some of the purchasers of GDG houses.

As part of the fraud, Capra caused the creation of Cambridge Real Estate Consulting LLC (Cambridge) and Chateau Real Estate Investments LLC (Chateau). Although publicly filed paperwork suggested that these were independent entities, Capra or his associate, a person with the initials RP ., directed all activities of Cambridge and Chateau and controlled their bank accounts.

Capra executed and attempted to execute a scheme to defraud mortgage lenders through the use of applications for residential mortgage loans and related documents associated with real estate purchases in the Denver Metro area for over 3 years.

As part of the scheme, Capra would structure transactions involving homes built and sold by GDG to allow buyers to receive substantial amounts of the lenders’ money at the time of closing without the lenders’ knowledge.

Capra was able to facilitate his scheme by causing first and second mortgage applications related to the real estate purchases be submitted with false and fraudulent representations about the purchasers income, liabilities, and intent to occupy the properties as their primary residences. Many of the purchasers bought multiple properties at or near the same time in an attempt to prevent lenders from discovering the extent of the buyer’s real estate liabilities.

At the closing or soon thereafter, Capra would cause funds to be distributed to the buyers in ways that prevented the lenders from knowing the funds were actually going to the buyers.

The methods included the disbursement of funds to LLCs, causing buyers to sign false warranty waivers, making payments to the buyers through Cambridge, Chateau, or other sham entities, and having GDG issue checks directly to the buyers, which were not reflected on the HUD-1 closing statements.

“This indictment sends a strong message that the FBI will aggressively pursue those individuals who illegally defraud mortgage lenders for their own personal gain,” said FBI Denver Special Agent in Charge James Yacone. “The FBI will continue to investigate real estate and mortgage industry professionals who have ignored their fiduciary responsibilities and commit fraud.”

Peter Vincent Capra of Colorado, was indicted by a federal grand jury in Denver on May 23, 2012 on additional charges of wire fraud, mail fraud, and money laundering, the United States Attorney’s Office, IRS-Criminal Investigation, the Federal Bureau of Investigation, and United States Postal Inspection Service announced. Capra is scheduled to appear in United States District Court on May 29, 2012 at 10:00 AM to respond to the charges. Capra was charged in a previous indictment with obstruction of justice.

The indictment also includes an asset forfeiture allegation, which states that upon conviction of the offenses mentioned in the indictment, the defendant shall forfeit to the United States all property involved in or traceable to property involved in such offense(s), including but not limited to a money judgment.

“Investigating and prosecuting mortgage fraud is one of the highest priorities of this United States Attorney’s Office as well as the Department of Justice as a whole,” said United States Attorney John Walsh. “We are taking action at all levels of mortgage fraud, from those committing the fraud all the way to those who packaged and profited from the fraud.”

“The charges filed in this case illustrate the commitment of postal inspectors to vigorously pursue individuals who utilize the United States mail as part of these complex fraud schemes,” said Adam Behnen, Inspector in Charge, United States Postal Inspection Service, Denver Division.

“With today’s challenging economy, it is critical we make every effort to protect our financial institutions and consumers by ensuring the integrity of the United States mail. We are very appreciative of the working relationship between our agency, the Federal Bureau of Investigation, and the Internal Revenue Service-Criminal Investigation, as it was instrumental in bringing this case forward.”

“Mortgage fraud, like many financial crimes, adds to the underground economy, erodes the integrity of our tax system, and threatens the financial health of our communities. IRS Criminal Investigation is committed to ‘following the money trail’ to ensure that those who engage in these illegal activities are vigorously investigated and brought to justice”, said Sean P Sowards, Special Agent in Charge, IRS Criminal Investigation, Denver Field Office.

Capra faces one count of obstruction of justice, 14 counts of wire fraud, two counts of mail fraud, and 10 counts of money laundering. If convicted, the defendant faces 10 years’ imprisonment and up to a $250,000 fine for obstruction of justice; not more than 20 years’ imprisonment and up to a $250,000 fine for each count of wire fraud and mail fraud; and not more than 10 years’ imprisonment and up to a $500,000 fine for each count of money laundering.

This case was investigated by the Internal Revenue Service-Criminal Investigation, the Federal Bureau of Investigation, and the United States Postal Inspection Service.

This case is being prosecuted by Assistant United States Attorney Matthew Kirsch.

The charges contained in the indictment are only allegations, and the defendant is presumed innocent unless and until proven guilty.

Please remember fraud is not just a white-collar crime; it’s a people crime. People commit it, people suffer in its wake, people’s lives are ruined, people enforce it, and it’s people like you and I who can prevent it.

Mortgage Fraud is insidious; it creeps up on you. Mortgage Fraud exists because it’s able to exist.

Accident Reconstruction 2 Young Men Killed in Crash Near Oddville

Two young men were killed and another was flown to the hospital following a crash Saturday night on Highway 62E near Oddville in Harrison County.

The Sheriff told LEX 18, the victims were all in one vehicle, traveling down Highway 62E, when the driver lost control, went off the road and down an embankment into several trees. Some of those trees then fell on the vehicle.

The Sheriff said the 24-year-old male driver and his 17-year-old male passenger died, while another juvenile male was flown to UK Hospital. No word on his condition.

Names have not been released, but the Sheriff says both young men who died are from Cynthiana. The juvenile is not from Harrison County.

The cause of the crash remains under investigation.

The road was closed for several hours, but has since reopened.

Wrongful Death Matt Tressler of Wolcott

Police who were searching for a White County man missing since Tuesday discovered his body Friday evening near the Wildcat Creek northeast of Dayton.

Matt Tressler, 38, of Wolcott, was found at approximately 8:25 p.m. He had suffered extensive injuries to the head and a firearm was found nearby, according to White County Sheriff Pat Shafer.

Shafer declined to speculate as to the cause of death. That will depend in part upon an autopsy and further investigation, he said. Next of kin had been notified, he said.

“He had extensive injuries to the head, and the Tippecanoe County Coroner’s Office was notified,” Shafer said.

Tressler’s wife, Jennifer, told police she’d last seen her husband when he left for work around 5 a.m. Tuesday. He works at Wabash National Corp. in Lafayette, she said. He never reported for work that day, and police were notified that same day he was considered missing.

After three days, Jennifer Tressler contacted the Journal & Courier midday Friday to help spread the word about her missing husband. The newspaper contacted the Tippecanoe County Sheriff’s Office, who confirmed the search was ongoing.

At around 4:40 p.m. Friday, police converged on a public access site off Tippecanoe County Road 750 East, just north of Haggerty Lane. That’s where they’d found Tressler’s blue Buick LeSabre parked in a gravel lot near the Wildcat Creek, according to Tippecanoe County Sheriff Tracy Brown.

Jennifer Tressler and a few family friends were at the scene as the search began Friday. She was hopeful.

“Just pray,” she said. “He’s got three kids and a family that loves him.”

Four police agencies — from Tippecanoe and White counties, West Lafayette and the Indiana State Police — and the Indiana Department of Natural Resources took part in the search. A K-9 unit from the West Lafayette Police Department found the body, Shafer said.

The investigation is ongoing.

Missing Person Gary Askew of Sacramento

SACRAMENTO, CA – The Sacramento Police department requested the public’s help in locating a man who went missing around noon on Friday.

The missing person is Gary Askew. He is a 55-year-old man, who is described as black, five foot nine inches tall, with black and gray hair and 130-150 pounds. The police report that Askew is developmentally challenged.

He was last seen at the Convention Center, and he was wearing a maroon and black checkered suit.

Drug Dog Issued a Subpoena

This K9 cop sure does his due doggy diligence.

Azor, a doggy deputy who detects drugs in Florida, was issued a subpoena this week to testify about a February traffic stop. The defendant, Rodney McGee, called the canine on Thursday as part of his attempted defense on a citation for failing to use his turn signal, WINK News reported.

“I was hoping that they would let me plant marijuana in the courthouse to see if he could find drugs,” McGee told the station.

Deputy Azor was subpoenaed because he was used to sniff for drugs in McGee’s car during the traffic stop, but didn’t find any.

The defendant’s motion was dismissed and McGee appeared quite riled up in video from the courthouse.

The doggy deputy’s supervisor told The Huffington Post that the Belgian Tervuren is a dual-certified K9 cop who has been on the force for three years, working on drug detection and trailing alongside his partner, Deputy Franko.

“I’ve been on the K9 force for 13 years now, and I’ve never had a dog called in before,” said Sgt. John Heck of the Charlotte County Sheriff’s Department. “Azor has been in court before when there may be high-risk prisoners or something, so he wasn’t uncomfortable in that setting, but we’ve definitely never had this happen.”

McGee’s theatrical move did not sway Judge Peter Bell and he was still fined $300 for failure to signal.

As one poster in a Massachusetts police forum noted, “Good thing the K-9 didn’t have to take the stand, that would have been a RUFF cross-examination.”

Wrongful Death Jessie Durham

A Taylor County man accused of killing his great-grandmother is facing more charges.

20-year-old Jessie Durham is charged with murdering 77-year-old Elizabeth Arinsmier. The Central Kentucky News Journal reports Durham now faces a charge of third-degree assault of a corrections officer.

The paper reports Durham refused to leave his cell at the Taylor County Detention Center and struck a deputy in the face.

Background Checks Prospective Residents of Personal Care Homes

PITTSBURGH (KDKA) — The alleged rape of a care home resident remains under investigation in Ambridge.

A 71-year-old woman was allegedly sexually assaulted early Wednesday morning on the bathroom floor at the Maplewood Personal Care Home by 51-year-old Marvin Lee Brown, of Beaver Falls.

Brown also lived at the facility.

“It was a spur of the moment thing,” Ambridge Police Chief Jim Mann said. “They were watching TV together. She got up to use the bathroom and Mr. Brown followed her into the bathroom.”

The criminal complaint says Brown covered the victim’s mouth as she tried to yell for help. The woman’s arms were bruised and swollen.

“Both of my parents were in a nursing home and I don’t know what I would do if something like this were to happen to one of my parents,” Mann said.

Brown had a criminal record that included sex charges and assault. Under state law, personal care homes are regulated by the public welfare department.

Background checks are required for anyone wanting a job at a care home, but care homes are only urged to check prospective residents’ backgrounds for problematic behaviors or criminal history. It is not required.

“I sleep with one eye open,” Joyce Golden, a resident, said.

The owners of the personal care home did not have any comment.

Missing Person Stephen Ryan Ivens

Information is being sought regarding Special Agent Stephen Ivens, a resident of Burbank, California. SA Ivens was reported missing on Friday, May 11, 2012. His family had last seen him at his residence the previous evening, and information indicates he left on foot. SA Ivens’ service weapon, a Glock handgun, was missing when police responded to the residence. Comprehensive searches conducted in the nearby Verdugo Mountains have proved unsuccessful. It is believed that SA Ivens may possibly be suicidal, and there is no indication that he intended to harm others.

Ivens has been a Special Agent (SA) with the Federal Bureau of Investigation since September 2008, and is currently assigned to the Los Angeles Field Office. He wears prescription glasses and is an avid runner. He was also a former police officer with the Los Angeles Police Department.

Private Detective Human Remains Found in Barn

Kentucky State Police say human remains were found in a barn Friday, behind the former residence of a Boyle County double murder suspect.

Troopers served a warrant at about 6:00 p.m. Friday at at home at 55 Fairlane Avenue in Hustonville. That’s the former home of Thomas Hager, Jr., who is accused of shooting and killing two men Monday night.

Hager’s former roommate, Clint Disken, has been missing since March, but there is no word about whether officials believe this discovery has any connection to that case.

Private Detective Search for Robbery Suspect in Lexington

Police in Lexington are searching for a man who robbed a bank on the southeast side of city Friday afternoon.

The robbery happened at about 3 p.m. at the PNC Bank on Woodhill Drive. Police say the suspect approached a teller and made a verbal demand for money. The teller complied and the suspect fled with an undisclosed amount of cash.

The suspect is a black male, 6’0:, 160 -180 lbs, late 20’s to early 30’s. He was last seen wearing a white ball cap (unknown logo on front of cap), a light color Polo style shirt, khaki pants and white sneakers. The suspect was last seen walking away from the bank.
