Drug Dog Sweep Caroline County Student Arrested

A Caroline County student is in trouble with the law after drug dogs were used to search the school Wednesday.

According to Sheriff Tony Lippa, a drug dog was brought in to sweep the Caroline Diversified Learning Center, something they randomly do for training or re-certification purposes.

The dogs alerted deputies about 9 a.m. to drugs on school property, Lippa said.

An investigation led to charges against a 17-year-old male student.

He is charged with one count of possession of marijuana with the intent to distribute and one count of possession of marijuana with the intent to distribute on school property, which carries a stricter penalty.

Pedophile Tracking Jennifer Mahoney

TRENTON, N.J. — A New Jersey woman admitted Wednesday to sexually assaulting a 5-year-old girl she was allegedly babysitting and putting a video of the assault on the Internet.

Jennifer Mahoney, 33, of Manalapan pleaded guilty in U.S. District Court to sexual exploitation of a child.

She faces between 15 and 30 years in prison when she is sentenced Aug. 22, and will have to pay restitution to the victim. She had been charged with two counts of sexual exploitation of a child.

As part of the plea, Mahoney agreed 30 years is the appropriate sentence, although the judge will have the final say. She would be under supervised release for anywhere between five years and life after her sentence is completed. She also agreed not to appeal.

Mahoney has been in custody since December after prosecutors said three pornographic videos showing assaults on the child were found on the computer of Robert Ramos Jr. of Austin, Texas.

Ramos was charged with possession of child pornography and sexual exploitation of minors. Prosecutors in Texas say he set up seven fake Facebook accounts to solicit teenage girls to send him nude photos and videos of themselves engaged in sex acts.

Mahoney admitted to sexually assaulting the girl and streaming the assault live over a video chat service on the Internet. She also admitted to abusing the girl on another occasion, recording the abuse on a camera phone and emailing the video to at least one other person. Finally, Mahoney admitted to viewing other videos of child sexual abuse streamed to her using a video chat service.

“This horrible crime is a stark example of how harmful child pornography is, and how its young victims bear not just the physical and emotional scars of violent sexual assault, but lifelong trauma as others repeatedly watch,” U.S. Attorney Paul Fishman said in a statement. “Those like Mahoney, who create and feed the market, perpetuate unimaginable suffering for the children they abuse.”

Private Detective 6 Burglaries in 4 Kentucky Counties

Authorities say they are confident surveillance video will help them catch the people who burglarized six convenience stores throughout four Kentucky counties.

In each hit, their MO is the same – throw a rock through a store window and steal as many tobacco products as possible. Their get-away vehicle hasn’t changed much either.

Detectives say they’re driving either a green or tan SUV that they can see that in the video from the stores targeted in this crime spree that began April 28th in Montgomery County.

“They’re probably very smart or very experienced, one or the other,” said Montgomery County Sheriff’s Detective Mark Collier who figured that because the burglars, who first hit the area’s Stop-N-Shop, wore hoodies, a mask and gloves.

They also used a rock to break inside and steal dozens of tobacco products.

“We’ve been told they’re selling them or possibly they’re taking them to some kind of store, liquor store, tobacco store,” said Collier.

“It’s crazy, they did a lot to us and we’re still trying to catch up from what they had done,” said Amber Stapleton.

Three days later, a similar smash and grab scene was caught on a cell phone camera by Powell County’s Gasoline Alley assistant manager who said the crooks took mostly cigarettes.

“It was about 197 cartons,” said Amber.

Eight-thousand dollars worth is gone. Stapleton did save the rock detectives said is the weapon of choice in each crime.

“Hopefully, fingers crossed, that they’ll catch who this is because this is just crazy,” said Amber.

From there, surveillance cameras caught the green SUV take off to Clark County where detectives said they stole from a general store. Then on Tuesday night, a week later, they showed up at a food mart in Estill County. Video shows the thieves detectives said went on to burglarize two other nearby in less than an hour.

Detectives are looking for at least three people. Their descriptions are vague. The green SUV, though, is what’s most recognizable because it has severe, front-end damage. If you know anything, call your local sheriff’s office.

Once they’re caught, the people will face burglary and criminal mischief charges, which are both felonies.

Electronic Surveillnace Shows Man Videoing Children

Hialeah Police say videos captured from the cell phone of a retired chiropractor show Jonathan Davis seeking out young girls under the age of 12 to videotape.

Likewise, police say the cell phone audio recordings show a man desperate for the attention of the children, using catcalls and laughter to entice them and win their trust.

All the while, police say Davis touched himself inappropriately, using a ruse that he was “itchy” to elicit help from the youths.

Hialeah Police provided edited surveillance video and cell phone audio to CBS4 News of Davis in a Burlington Coat Factory in Hialeah.

Detective Felix Mendigutia said the cell phone videos show Davis in numerous South Florida stores approaching and videotaping children.

“This is a guy who’s brazen,” said Det. Mendigutia. “He’s fearless. He’s not afraid to get caught.”

Hialeah Police said the case began because an alert security guard at the Burlington Coat Factory noticed Davis recording children in the store at the end of March. The surveillance video shows store cameras zooming in and out on Davis as he roamed the store.

Mendigutia says Davis got just inches away from some children who were with their parents.

“In some cases I could actually see that a parent was holding a child by the hand,” Mendigutia said. “In some cases the parent was 5 feet from their child.”

Police say Davis appeared to be on the prowl, crouching down in store aisles and hiding behind merchandise — all in an effort to surreptitiously take video of girls as young 5 years old, while touching himself.

“You can see in the children’s eyes when they would first look up at him and then they would look down in the area in the lower part of his body,” Mendigutia said.

And the audio recordings add another creepy element to this case. Police say Davis used a series of catcalls to get the kids’ attention — making a “psst” noise and saying “Ouch!”

Investigators say most kids turned around to see Davis scratching his private parts. Police say some children who were away from their parents spoke to him at length.

Police say the cell phone audio shows Davis telling one child, “You can’t see what I’m hiding.” And telling another one, “You can’t have a butt that nice when you’re 8.”

Police say Davis even tried to get the girls to go with him to a different part of the store.

“He’s saying things like ‘Where’s the toy section? I have a little niece. Can you help find this? What size shoe are you?’,” Mendigutia said.

Investigators do not believe any children went with Davis but they continue to investigate the case.

Police do believe Davis did this at numerous stores. Davis is charged with lewd and lascivious exhibition at a Kmart in Hollywood.

Davis is free on bond, and Detective Mendigutia is not happy about it.

“I don’t feel comfortable with the fact that he’s out on bond, and I’m very concerned for the children in our society,” Mendigutia said.

After the security guard noticed Davis in Hialeah, a police officer confiscated his phone. Police say Davis contacted the officer through email to apologize.

“He acknowledges that he has an issue and that he’s gonna do something about it,” Mendigutia said. “He’s gonna get help for it.”

Days later, after obtaining a search warrant, polices say they found 80 videos on Davis’ phone.

Police say this case again proves that parents must supervise their children at all times. Mendigutia told CBS 4 News that the children who were with their parents were only recorded and did not interact with Davis.

“The parents that were close to their kids, he couldn’t go that next step,” Mendigutia said. “The parent was too close by. So staying close to your children is always going to be the safest thing to do.”

Insurance Fraud Danny Patel

According to federal authorities, Danny A. Patel, 45 years of age, has been indicted by a federal grand jury on charges of mail fraud, witness tampering, and false statements to the government.

According to the indictment, Patel, while managing a BP gas station, submitted false insurance claims to Harleysville Insurance Company arising from a Dec. 25, 2011 accident at the BP. The indictment also alleges that Patel lied to federal agents and obstructed justice by asking witnesses to lie to authorities.

The law provides for a maximum total sentence of 85 years in prison, a fine of $1,250,000.00, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed would be based upon the seriousness of the offenses and the prior criminal history, if any, of the defendant.

An indictment is an accusation. A defendant is presumed innocent unless and until proven guilty.

Identity Theft Ex-Sailor Sentenced to 3 years

A former Navy petty officer from Atlanta was sentenced Tuesday to three years in prison for stealing the identities of recruits to file fraudulent tax returns.

Kevon Kerr, 36, will also serve 3 years of supervised release and pay $9,857 in restitution, federal authorities said.

“Kerr exploited his position in the Navy for his own selfish ends,” U.S. Attorney Sally Quillian Yates said. “In stealing the identities of fellow sailors from their personnel files, he damaged the mutual trust and peace of mind of service members deployed around the world in defense of their country. …”

Kerr was in charge of personnel files at a processing center for new and prospective recruits at Fort Gillem in Forest Park, Yates said.

Kerr photocopied recruits’ drivers licenses and Social Security cards and forwarded them to an accomplice, Tyrone Boyd, 33, of Decatur, who served with Kerr in the Navy, Yates said. Boyd and Lawanda Mitchell, 31, of Atlanta then provided the stolen identities to Ashuana Turner, 33, of Riverdale, who filed fraudulent state and federal tax returns, she said.

A search of Turner’s house turned up the stolen Navy identities and other stolen identities that were used to file hundreds of fraudulent tax returns, Yates said.

Kerr, Boyd, Mitchell and Turner were indicted in June 2010 on 42 counts of identity theft.

Kerr and Boyd pleaded guilty to one count of theft of public money and one count of aggravated identity theft. Boyd was sentenced in February 2011 to 2 years, 9 months in prison and 3 years of supervised released and ordered to pay $9,857 in restitution.

Turner pleaded guilty to conspiracy to steal identification documents of U.S. military service members. She was sentenced to 3 years, 6 months in custody and 3 years of supervised custody and was ordered to pay $121,905 in restitution to the IRS and $73,935.38 to the Georgia Department of Revenue.

Mitchell pleaded guilty to one count of wire fraud and one count of aggravated identity theft. She was sentenced to 3 years, 3 months in prison and 5 years of supervised release and ordered to pay $9,857 in restitution.

Private Investigator Andrew Weber Indicted for Drug Trafficking

An Indian Hill man is now charged with drug trafficking, accused of selling hallucinogenic mushrooms to a Terrace Park teen, who was then hit and killed by a vehicle back in March.

A Grand Jury today indicted 21 year old Andrew Weber on four counts of trafficking in drugs. He accused of selling psyllium, also known as hallucinogenic mushrooms, to 16 year old Collin Barton on March 17th for $80.

Barton, a Mariemont High School student, was walking five miles from a party to his home along Wooster Park in the early morning hours of March 18th when he was struck and killed by a vehicle. His body was not discovered for several days. Toxicology tests indicate he had mushrooms in his system at the time of his death. The prosecutor says that he believes Barton was taking risks he would not normally take because of the drugs.

The Hamilton County prosecutor says the man who hit Barton was the designated driver for his friends that evening. He went to Milford Police after arriving at his home and telling his mother that he thought he’d hit something. Milford Police searched the area where the driver thought the collision had occurred but they could not find anything.

Deters says we never know exactly what happened when Barton was killed. However, Barton was not on the sidewalk and Deters said, there is no provable case that the driver who hit him did anything wrong.

Weber was arrested after he allegedly sold marijuana to another juvenile last weekend-an informant-and police say he had marijuana in his home ready for distribution. Weber faces 7 years in prison if convicted on all the charges.

Identity Theft Connects to Sex Offenders

Each year more than 9 million people become victims of identity theft. But what’s at risk isn’t just money it can be your freedom.

Local 12 News Reporter Rich Jaffe has this ‘all too personal’ experience.

In 2010, a Seattle, Washington man, Dan Wheeler made headlines when a police officer stopped him for making an illegal left turn.

“Next thing I know he’s listening to his radio, puts his hand on his gun and says turn around put your hands on the car. You’re under arrest. I said for what? He says there’s a warrant for your arrest.”

That warrant was really for convicted sex offender Jason Ellis. He’d been using Wheelers name as an alias for years…but Wheeler ended up in jail until the he convinced authorities they’d made a mistake.

It’s something Wheeler may have to fight for the rest of his life.

“If you think Wheeler’s an isolated case, wait until you hear what happened to me.”

While filing some documents at the Clermont County Sheriff’s Office a few years ago, I also discovered a problem. Law enforcement checked my social security number and found that it comes back to an Arizona man named John G. Ponsart.

“Someone enters that wrong social security number when they’re booking someone in or the criminal gives a fake I.D. And it just so happens to be your I.D. Your social security number so it is a huge problem for people.”

John George Ponsart Jr. currently resides behind the walls of the Arizona State Prison in Eyman.

Ponsart’s been arrested on forgery charges, theft, a variety of drug charges, and oh…did I mention, he’s also a registered sex offender. Convicted of having sex with a child under the age of 15.

He’s not the kind of guy you’d want to be connected to…but I am.

Initially I contacted the sheriff’s office in Pinal County, Arizona where Ponsart lives. They investigated but nothing changed.

Last year, Georgetown Police Chief Buddy Coburn ran the license plates on my truck and it happened again.

“When that popped up I got kind of a sick feeling in my stomach, my initial thought was what the heck? I wanted to think this can’t be right.”

It appears that at on March 21st of 2003, when John Ponsart was arrested by police in Casa Grande, Arizona, his social security number was incorrectly entered on the arrest documents and Ponsart became me-by the numbers. A simple mistake with potentially catastrophic results.

Credit checks, security checks, parking tickets; Any place people don’t know Rich Jaffe I could be in big trouble just like Dan Wheeler.

“As a law enforcement officer we rely extremely heavily on the information we get from the computer.”

“That sex offender or that violent offender could end up with an active warrant and you’re gonna be looking at yourself handcuffed in the back of a cruiser trying to explain it.”

Attorney General Mike Dewine says my problem’s not unique.

“The real problem is you don’t know it until something happens.”

In Ohio, the State Bureau of Criminal Investigation gets about a dozen calls every month from people in similar situations.

Earlier this year with Clermont County Sheriff’s Officials I tried again to clear the records in Arizona, and again we failed. So a few weeks ago I contacted Arizona law enforcement one more time, but now I also enlisted the aid of our Attorney General.

“What we’re doing in your case for example is contacting the three agencies in Arizona that put in information about this clown out in Arizona.”

It’s not over yet, but fortunately Ponsart’s in prison until 2022. While he may not even know he’s had my social security number for the last few years, he serves as a serious reminder that we’re all just one digit away from disaster.

The Arizona Department of Public Services told us there’s nothing they can do to fix Rich’s problem. The FBI is looking into it.

Missing Persons Bain Family Update

The man suspected of kidnapping a woman and her three daughters was spotted in surveillance video shot three days after the Tennessee family first disappeared.

In the video from the evening of April 30, the suspect, Adam Mayes, can be seen wearing a white t-shirt in the County Line One Market on Highway 348 in Guntown, Miss. Mayes was last seen a day later, and authorities believe he may have changed his appearance and that of the two missing girls , Alexandra Bain, age 12, and Kyliyah Bain, age 8. The bodies of the two girls’ mother, JoAnn, and sister, 14-year-old Adrienne, were found in the backyard of the Mayes’ family home in Guntown on May 5.

The women were first reported missing on April 27 by Gary Bain, JoAnn’s husband and the stepfather of the children. During the investigation, police interviewed Mayes, who admitted he was the last person to see the four women prior to their disappearance. When police went back to request a second interview later in the investigation, Mayes fled, according to the police warrants obtained by ABC News.

He is considered armed and dangerous, and was added to Tennessee’s Top Ten Most Wanted list Tuesday.

His wife and mother have been arrested in connection with the Bain family’s disappearance, according to a Hardeman County, Miss., court clerk. They are charged with “especially aggravated kidnapping” in connection with the kidnapping.

Details in the arrest warrants show that on April 27, Adam Mayes and his wife, Teresa Mayes, worked together to take Bain and her daughters from their home in Tennessee to Mississippi, where Adam and Teresa share a home with his parents.

Teresa and Adam’s mother, Mary Mayes, both confessed to police during interviews that on April 27, they witnessed Mayes digging holes in his mother’s backyard, where the two bodies were later found.

Police said they believe that Bain and her daughters were confined on the Mayes property. At some point in their confinement JoAnn and Adrienne died and were buried on the property.

“It is believed that Adam Mayes removed or confined Jo Ann Bain and her 3 daughters…in a manner that substantially interfered with their liberty,” the warrant states. “Concerning Jo Ann Bain and Adrienne Bain, both victims suffered serious bodily injury as a result of their removal or confinement.”

Police were digging in the Mayes’ yard on Monday, but have not said what they were looking for or whether they found anything.

Teresa Mayes’ sister, Bobbi Booth, said her sister knew about the killings, but may have been too scared to call the police, according to the Associated Press.

During the investigation, police also found a trailer that Mayes had rented from Union County, Miss., which contained property of the two girls who are still missing and thought to be in Mayes’ custody.

Mary Mayes is charged with conspiracy to commit especially aggravated kidnapping, while Teresa is charged with committing especially aggravated kidnapping.

The Tennessee Bureau of Investigation is offering a $6,000 reward for information leading to Adam Mayes’ whereabouts and arrest, and the FBI and U.S. Marshals Service are offering a $50,000 reward for information leading to the location of the missing victims and the arrest of Mayes.

Private Detective Women Plotted to Kill Husband

A Laurel County woman has admitted plotting to kill her husband last year.

Amber Hursey, 25, has pleaded guilty to complicity to commit murder and faces a 12-year sentence.

Hursey was indicted in January for allegedly offering to pay a man to kill her husband, a disabled war veteran. The couple was involved in a messy divorce.

Hursey will be sentenced May 29.
