They wanted a fresh start. Christopher Thongs and his family moved to Kentucky after losing everything in Hurricane Katrina. But last week, he became the city’s fifth homicide victim this year. And, his accused killer is someone who should have been in jail. LEX 18 went On Special Assignment to find out why DeMarcus Williams was on the streets.

Williams is accused of gunning down Thongs, 19, last week in the middle of the afternoon on East Loudon in Lexington. Police have released very little information about what led up to the shooting. But LEX 18 has learned that Williams was paroled back in February and was supposed to be under supervision at a Lexington halfway house. Instead, he was on the run.

Williams had served just over 4 1/2 years of a nine-year sentence for possession of handgun by a convicted felon and fleeing or evading police first degree.

“He asked why God let this happen to Uncle Chris, those questions I can’t answer,” said Thongs’ sister, Akilah Kidd, about her seven-year-old son. “We don’t know Demarcus Lee Williams. Our focus is on our family, getting justice for my 19-year-old brother, just an innocent person.”

Williams was released by the parole board February 17. On April 10, he walked away from a Lexington halfway house, never returning, which was a violation of his parole. Then, on May 3, police say Williams robbed and gunned down Thongs, before running from authorities again. He was caught shortly thereafter and is being held in Thongs’ murder.

Kidd says she and her brothers moved to Kentucky for a fresh start after Katrina. now they’re dealing with Chris’ murder, a murder she believes could’ve been prevented had Williams been locked up.

“They can’t predict what he was going to do,” said Kidd. “But I do wish they got him back in custody so this wouldn’t have happened.”

Missing Person Sierra Lamar UPDATE

SAN FRANCISCO — Investigators have located a vehicle that may be connected to the abduction of a Northern California teenager who’s been missing for nearly two months, authorities said Tuesday.

Santa Clara County sheriff’s Sgt. Jose Cardoza wouldn’t say where or when the red Volkswagen Jetta was recovered. Surveillance cameras and witnesses put the car near the area where authorities believe 15-year-old Sierra LaMar was kidnapped in Suburban San Jose on March 16.

“It’s still an open investigation,” Cardoza told The Associated Press on Tuesday following a briefing in San Jose. “Our investigators do not want to compromise the case. We do not want to jeopardize anything.”

Authorities believe Sierra was kidnapped near her home in Morgan Hill while she was walking to a bus stop on her way to school. The car’s discovery comes a day after the sheriff’s office released a photo of a red Jetta that’s similar to the car linked to the disappearance.

Investigators are now looking for anyone who saw the car – which also has a black hood – in the area and who may have been riding in it at the time of Sierra’s abduction, Cardoza said.

“We really need the public to come forward and help provide us with any information they may have about this vehicle,” Cardoza said. “We want to know if they saw it in Morgan Hill, outside of Morgan Hill during the time she went missing so our investigators can piece everything together.”

Cardoza said investigators asked Sierra’s family asked about the car, but they have no knowledge of it.

Sierra’s mother, Marlene LaMar, told KGO-TV on Monday that the car is just the kind of solid lead her family has been hoping for.

“I know everybody out there is going to do everything possible to report the sighting of this car,” LaMar said.

The mother said she is convinced her daughter is still alive, and she had a direct message for anyone involved with her disappearance.

“I am not looking for trouble or a conviction. I just want – we all want her safe return. We all want this nightmare to end, and that’s my plea out there,” she said.

Despite Sierra being missing for nearly two months, there are no indications that she is dead, Cardoza said.

Dive teams were searching private ponds in rural Morgan Hill on Tuesday and were expected to search in unincorporated reservoirs in south San Jose, Cardoza said.

Cyber Investigations Malware Installed on Travelers’ Laptops

Recent analysis from the FBI and other government agencies demonstrates that malicious actors are targeting travelers abroad through pop-up windows while establishing an Internet connection in their hotel rooms.

Recently, there have been instances of travelers’ laptops being infected with malicious software while using hotel Internet connections. In these instances, the traveler was attempting to setup the hotel room Internet connection and was presented with a pop-up window notifying the user to update a widely-used software product. If the user clicked to accept and install the update, malicious software was installed on the laptop. The pop-up window appeared to be offering a routine update to a legitimate software product for which updates are frequently available.

The FBI recommends that all government, private industry, and academic personnel who travel abroad take extra caution before updating software products on their hotel Internet connection. Checking the author or digital certificate of any prompted update to see if it corresponds to the software vendor may reveal an attempted attack. The FBI also recommends that travelers perform software updates on laptops immediately before traveling, and that they download software updates directly from the software vendor’s Web site if updates are necessary while abroad.

Anyone who believes they have been a target of this type of attack should immediately contact their local FBI office, and promptly report it to the IC3’s website at www.IC3.gov. The IC3’s complaint database links complaints together to refer them to the appropriate law enforcement agency for case consideration. The complaint information is also used to identify emerging trends and patterns.

Wrongful Death Adam and Kristan Shaw

Police have released the names of two people whose bodies were discovered Monday morning inside of a home off of Military Pike in Lexington.

The landlord of the home discovered the bodies and called police. Police have identified the pair as Adam Shaw, 32, and his wife, Kristan Shaw, 30.

Police say there was no evidence of forced entry into the home.

So far, no cause of death has been released for either one pending toxicology reports.

Private Detective 2 Arrest Warrants Issued for Armed Robbery

Lexington Police are working to make contact with multiple suspects they say were involved in at least two thefts during the month of April, and have issued arrest warrants for two of the suspects.

The first incident happened on April 21 at approximately 7:18 p.m. Officers were called to 1414 Versailles Road in reference to an armed robbery. Upon arrival, witness informed officers that two suspects, one armed with a handgun, demanded money from a store customer as they were exiting the business. The victim complied with the suspects’ demands. After taking an undisclosed amount of money the suspects fled the area, on foot.

Investigators have identified, and obtained an arrest warrant for, one of the suspects: Kian Terrell Christopher (DOB 12-08-1991). The second suspect has not been identified. He is described as a black male, about 5’9″, with a thin body build, wearing a light blue hoodie.

The second incident happene at on April 24 at approximately 3:35 a.m. Police were called to 3612 Laredo Drive in reference to a burglary with residents present. The victims told officers that three male black suspects, all armed with guns, made forced entry into the home.

Once inside, the suspects ransacked the residence, and removed electronics, money and valuables, before fleeing with the victim’s vehicle. Several hours later, the stolen vehicle was recovered and subsequently returned to the victim.

Investigators with the Robbery/Homicide Unit have obtained arrest warrants for two of the three suspects. The suspects have been identified as:

• Ryan Christopher Hill (DOB: 7-18-1988)
• Kian Terrell Christopher (DOB: 12-08-1991)

Fraud Investigation Women Fakes Cancer for Breast Implants

PHOENIX – Jamie Lynn Toler, 27, was charged Wednesday, May 2, with fraud and theft after telling friends, family and co-workers that she had breast cancer so she could get money for breast implants, according to an online article from the Arizona Daily Star.

Toler told everyone she was uninsured and that she needed a double mastectomy and reconstructive surgery due to breast cancer. Well-meaning loved ones responded by helping her to organize fundraisers and donate money.

Once Toler had accumulated approximately $8,000, she used the cash to pay a plastic surgeon for breast implants, according to medical records obtained by the Mesa Police Department investigators.

The records also show that Toler never had cancer in the first place.

She was arrested Wednesday and released the following day on bond after a brief court appearance. She has not returned reporters’ phone calls.

Electronic Surveillance Being Viewed in Derby Death

Kentucky investigators are working with Churchill Downs to view surveillance footage that might provide clues about the mysterious death of a Guatemalan groomer hours after the Kentucky Derby.

Louisville homicide detectives identified the man whose injured body was found Sunday morning in one of the barns at Churchill Downs a day after the Kentucky Derby as Adan Fabian Perez. Police said Perez, 48, was licensed to work at Churchill Downs since 2008.

Perez’s body was discovered just before 5 a.m. in Barn No. 8, four barns away from where I’ll Have Another, the horse that won the derby, was kept.

The body was identified by Perez’s 19-year-old son, Wilson Deejesus Fabian Perez.

Authorities are working with Churchill Downs to view footage from surveillance cameras in the area, but would not comment on where the cameras were located.

“At this time, a homicide detective is currently interviewing witnesses and individuals who might be involved or have information regarding the case and the medical examiner is doing the autopsy at this time,” Lt. Barry Wilkerson of the Louisville Metro Police Department, said today at a news conference.

Since many of the track workers are so transient, Wilkerson is hoping to complete all witness interviews by Tuesday. Police are using Spanish-speaking officers and interpreters to interview the many Hispanic workers.

Wilkerson also spoke about numerous reported “altercations” leading up to the body’s discovery, but would not go into detail about them.

“We are hearing that there were some altercations earlier in the day, but we’re not sure if they were related to this,” Wilkerson said. “Was [Perez] involved? We’re not sure.”

On Sunday, police spokeswoman Alicia Smiley told ABCNews.com that authorities had found “evidence of injuries that lead us to believe he was involved in an altercation and that foul play was involved.”

Wilkerson would not comment on the body’s condition when it was found, but said, “There were some wounds that obviously [make us] suspect foul play was involved and there’s some other situation that with the location of the body where it was, it just wasn’t a natural event.”

Perez was found in the back portion of the barn, not in a stall or with a horse, police said.

Perez worked for horse trainer Cecil Borel, the brother of veteran jockey Calvin Borel. Perez started working for Borel in 2008 as a groomer.

The owner of Barn No. 8, Angel Montano, told told ABC News affiliate WHAS-TV in Louisville that one of his employees found the body when he arrived for work and he did not know him. Some workers sleep in the backside of Churchill Downs.

Before the body was identified, police said there was no evidence of a connection to the Kentucky Derby or Churchill Downs, the racetrack where the Kentucky Derby is held annually.

“Mr. Perez was a father, a brother, obviously the son of someone. That’s the purpose of how we investigate this case,” Wilkerson said. “I believe this is an isolated incident of a tragic situation that took place. Another individual has lost their life and it is our duty to find out who did this.”

Wilkerson said police have “no suspects at this time.”

Missing Persons Jo Ann Bain and 1 Daughter’s Bodies Identified

The FBI has positively confirmed the identities of the two bodies found in the backyard of a man they believe may have something to do with their deaths and the disappearance of two children on Monday.

Jo Ann “Jodi” Bain and Kyliyah, 8, Alexandria, 12, and Adrienne, 14, have been missing for over a week and the police are searching for Adam Christopher Mayes, 35, who they are calling an alleged kidnapper. Mayes is now known to have been the handyman and babysitter for the Bain family and also the ex-brother-in-law of Gary Bain, Jodi’s husband.

Police found two bodies buried in the backyard of Mayes’ home in Guntown, Mississippi, after a search warrant was executed last week.

Today, the FBI confirmed that the bodies belong to Jodi and her oldest daughter Adrienne, age 14, reports the NY Daily News.

On Friday, April 27, Jo Ann “Jodi” Bain and her daughters disappeared. They were last seen driving away from their home in Whiteville, Tennessee, reports ABC News. When Jodi did not return by Friday evening, Gary called the police. The following Sunday, Bain’s Dodge Durango was found.

The Hardeman County Sheriff’s Department met with Mayes for questioning regarding Jodi and her daughters disappearance. It wasn’t till Tuesday before the authorities realized that Mayes had given them false information.

The search continued for Mayes and the FBI believes that Kyliyah and Alexandria are with Mayes, and he may have even altered his and the girl’s identity by either cutting and/or coloring his and their hair.

Private Detective Hired to Prove Federal Inmates’s Innocence

A federal inmate who has served 11 years on drug charges he says he didn’t commit has convinced prosecutors to let him out of prison.

Elroy Phillips refused to accept his fate after being sentenced to 30 years on charges of selling drugs to an undercover cop. He conducted records searches, hired a private investigator, and dug up information on the dirty cop who testified against him. Last week, federal prosecutors were finally convinced to dismiss charges against him.

The final step is to get a federal judge to let him go free.

U.S. District Court Judge Joan A. Lenard, who originally sentenced Phillips, must now decide whether to accept an agreement signed by prosecutors that would dismiss most of the charges against Phillips and allow him out of prison.

Phillips’ plight has been documented in a series of articles in New Times, starting with a cover story in 2003. His efforts to prove his innocence were outlined in another cover story last year, and Lenard was convinced to give him a hearing to present his new evidence.

West Palm Beach police arrested Phillips in 2001 on charges that he sold drugs to an undercover cop. They claimed to have found drugs on him when he was arrested and then added gun charges for bullets they found in his West Palm Beach apartment.

At his trial in 2003, a cadre of witnesses who had been paid by the government or given reduced sentences testified that Phillips was the head of a drug ring. The most damning testimony came from then West Palm Beach cop Michael Ghent, who claimed to have bought about an ounce of crack from Phillips.

The jury found Phillips innocent of most of the charges, but Lenard sentenced him to 30 years for convictions that would have earned him months in prison in state court. Phillips immediately began fighting the charges. He won a brief victory when an appeals court found that he had been sentenced wrongfully, but Lenard sentenced him a second time to 24 years.

Convinced he could prove himself innocent, Phillips filed public records requests from prison. He discovered that Ghent wasn’t working the night he supposedly bought drugs from Phillips and was actually in a college class across town. A private investigator Phillips hired, Ralph Marston, tracked down a confidential informant who was supposedly with Ghent the night of the drug sale; she said she had not been there that night.

Phillips also dug up documents on Ghent’s own criminal case. Police charged Ghent with bribery and other crimes in 2007 after he shook down a massage parlor for tens of thousands of dollars. Court documents also accused Ghent of running his own drug ring while working as a cop. He entered a deal with prosecutors that allowed the charges to remain off his record in exchange for Ghent serving community service hours.

What finally convinced prosecutors that Phillips should be released was a new deposition of Ghent taken this year. Michael Zelman, Phillips’ court-appointed attorney, had tracked down Ghent to Phoenix, Arizona, and Ghent was interviewed in the FBI’s office there. Under questioning by Zelman and prosecutors, Ghent admitted that he had no recollection of buying drugs from Phillips. He said he had used articles by New Times to try to rebuild the details of the night. Prosecutors later identified 11 lies that he told during the deposition, including his denial that he had sold drugs while working as a cop.

Ghent would have been the main witness at an upcoming hearing in which Phillip was to present his new evidence to the judge. With Ghent’s multiple lies weighing on them, prosecutors began negotiations last month to get Phillips out of prison. Phillips learned on April 29 that his release was imminent. His family brought street clothes to him at the Federal Detention Center in Miami so he could walk out of a court hearing.

On May 4, prosecutors signed a joint motion that agrees to drop all charges against Phillips except for his conviction on the small amount of cocaine found on him during his arrest. That charge carries a two-year sentence, so with credit for the 11 years he has already served, he could be released from prison immediately. Prosecutors also filed court documents seeking Phillips’ immediate release on his own recognizance in case the judge needed time to consider whether to dismiss the charges.

But Lenard filed an order late on May 4 questioning whether she has the authority to outright dismiss the charges. She asked both sides to file a joint motion by May 11 outlining any law that gives her the authority to make such a rare move.

Until then, Phillips remains in federal prison, knowing that he may be released any day, his street clothes still there with him in his cell. Phillips and his attorney declined to discuss the case until Lenard makes her decision. But during a prison interview last year, Phillips, now 45 years old, said he could be patient until the day he convinces the judge that he’s innocent. “I’m an avid chess player, and in chess, you gotta look at the end game, not what’s in front of you,” he said. “That’s what I did here.”

Fraud Investigation Vincent Lopez

The former manager of Plymouth Hill Condominiums who bilked condo residents out of hundreds of thousands of dollars in a kickback scheme has pleaded guilty.

Vincent Lopez, 67, of Quakertown, pleaded guilty May 2 to using condo complex proceeds for personal gain, including theft by unlawful taking and criminal conspiracy for the fraud scheme, according to court papers.

Lopez’s fraud amounted to $585,000, according to Montgomery County Assistant District Attorney Steven Bunn, and other defendants allegedly stole $153,000 more.

“The defendant conspired with vendors to purposely overcharge the association,” said Bunn. “He opened a fraudulent account.”

Two co-defendants, Irving Betoff and Roosevelt Harris, were expected in court May 2 but did not appear. Bench warrants were issued for their arrests.

Sentencing for Lopez was deferred.

According to the criminal complaint, Lopez used the embezzled money to pay for hotels; purchases at jewelry and tobacco stores, wine and spirits stores and restaurants; and also a stay at Caliente, a nudist resort in Florida, between December 2006 and January 2011.

Lopez was fired in January and turned himself in to police in April.

For three months, detectives reportedly found discrepancies in the financial dealings of Lopez. According to the criminal complaint, a total of 72 checks made payable to Plymouth Hill Condominiums were deposited into a fraudulent Continental Bank account opened by Lopez.

In April of last year, Plymouth police Detective David Phillips, who oversaw part of the investigation, said Lopez was using Plymouth Hill Condominium corporate credit cards for personal use, without authorization or repayment to the condo association. Many credit card statements for these accounts were altered to eliminate account numbers, account balances, transaction locations, dates and amounts.

The condominiums, located at 666 West Germantown Pike, are a gated community with 350 units divided between two high-rise buildings. A six-person elected council oversees the community’s financial operations and condo owners are expected to pay association dues based on the size of their unit.

The previous week, a co-conspirator in the case pleaded guilty in court and has agreed to testify against his accomplices. Keith Brandolph, a salesperson with Siemens Fire Safety, is one of several contractors hired by Lopez to conduct work on the condos, all reportedly at an inflated price.

Brandolph told investigators he would agree to testify against Lopez and a man named John Jurkofsky, a private electrician hired by Siemens to install fire safety equipment. Brandolph pleaded guilty to one count of theft by deception and one count of engaging in criminal conspiracy, after he admitted to helping Lopez swindle hundreds of thousands of dollars to line their own pockets from condo owners.
