Pastor sentenced to life

Convicted pedophile Albert Alexander Whyley was sentenced to life in prison yesterday for raping a nine-year-old girl.

While handing down the sentence, Senior Justice Hartman Longley told the 60-year-old clergyman the sentence was based on evidence given by the psychiatrist who has classified Whyley as a pedophile who is still considered a threat to children.

His wife and the mother of his young victim sat in separate benches in the court gallery.

The ex-cop was found guilty back in September of having unlawful sexual intercourse with the minor on February 6, 2011.

It was his second conviction in 18 years for the same offense. The first was perpetrated on his daughter for which he served four years.

His sentencing for the latest crime, however, which was set for November 11, was delayed after his attorney Carlson Shurland failed to show for court.

Yesterday, the court heard reports from a probation officer, psychiatrist and a psychologist during Whyley’s sentencing hearing.

Probation Officer Andy Laing, of the Department of Rehabilitative Services, Grand Bahama, revealed that Whyley, the father of 11 children, had readily admitted guilt and expressed a desire to apologize to the victim and her mother for the pain he caused and hoped that they can recover from the experience.

As Prosecutor Erica Kemp attempted to delve deeper into the probation report, at one point, Attorney Shurland strongly objected, insisting that the content was not relevant to the mitigating factors.

He charged that the prosecution was trying to draw a picture that was not clear.

Referencing his interview of Whyley’s wife, Christina, Laing told the court that she admitted she had knowledge of her husband’s past conviction regarding his daughter and said that since that time he has been impeccable around the children.

According to Laing, Mrs. Whyley said she was shocked and confused when she learned of his implication in the latest offense.

Whyley’s wife of 20 years, and mother of three of his children, said, however, that a custodial sentence would not be in his best interest and recommended that he instead be given a probation sentence and an opportunity to receive counseling, Laing told the court.

The probation report further revealed that all but one of the people he interviewed, described Whyley as a kind, thoughtful and caring individual who pursues the things of God.

The other person, the victim’s mother, however, described him as “a lying and deceitful old man who deserves to die in jail”.

Whyley has confessed to raping the young girl back in February.

She told the court that the incident occurred after her mother dropped her off at Whyley’s house on February 6, 2011.

She testified that Whyley had taken her and three other children to a relative’s party and after they got something to eat and drink, he dropped the kids home and took her back to his house.

The girl revealed that the two of them were alone and in the front room when he raped her.

The girl said he took her back to the party and told her to say he went to use the bathroom if anyone asked where he was.

The next day, the little girl wrote a letter to her mother about the ordeal and the matter was reported to the police.

Laing revealed yesterday that Whyley confessed on September 13 — hours after he was convicted.

Dr. John Dillett, a psychiatrist at the Sandilands Rehabilitation Centre, told the court Whyley has since admitted to having flashbacks of the latest incident and has urges of having sex with children since being incarcerated.

When asked if Whyley posed a risk to society in his present state, Dr. Dillett said there is a probability that he may commit the offense again while noting that it was difficult to say to what degree.

When questioned by Defense Attorney Shurland, Dr. Dillett revealed that there was no facility in The Bahamas where Whyley could receive treatment for his pedophilia, which is a mental illness.

Wrapping up her submissions, Attorney Kemp pointed out why a custodial sentence would be appropriate for the convicted pedophile.

“He is a danger. He is a risk to society; he is a risk to the most vulnerable in our society — our children,” she said, adding that the church elder is a repeat offender.

Kemp said Whyley was a deceptive person who deceived everyone around him in believing he was living a God-fearing life.

Advocating for his client to receive treatment for his illness, Shurland said there were good mitigating factors that came out in the probation report which lend to the belief that his client should get the help he needs.

After hearing from both sides, Justice Longley told Whyley that based on the psychiatric report he remains a threat to objects of his condition; therefore the appropriate sentence is life imprisonment.

As Whyley’s sentence falls under the old sexual offenses law, it does not mean he will definitely spend his natural life at Her Majesty’s Prison.

However, should he be granted pardon after serving his sentence and is released from prison, he has to remain crime free for the rest of his life.

SAT Cheating case

The Metro and education reporters Jenny Anderson and Winnie Hu provide an update in Wednesday’s Times on the Long Island SAT fraud investigations, which began two months ago after a college freshman was caught impersonating high school students on test day and sitting for the exam under their names.

This week, The Times reports, 13 students in the region — in addition to the seven first charged in September — were accused of accepting payment or paying others to take the SAT or ACT over the last three years.

The students said to have commissioned others to bubble in their answers under a false identity came from at least three area high schools: Great Neck North High School, North Shore Hebrew Academy High School and Roslyn High School.

The names of those high school students accused are protected, as the students are or were at the time of the incidents under 18; but the names of at least five accused fraudulent test-takers have been released, identifying students original to the region and now enrolled at Emory University, Indiana University, Tulane University and SUNY Stony Brook.

As Ms. Anderson and Ms. Hu report, the broadened scope of investigation has authorities looking to assign responsibility for the breaches and institute reforms to prevent future violations. They write:

At a State Senate meeting on Oct. 24, legislators and school officials accused the College Board and Educational Testing Service of having lax security and a system that failed to punish cheats.

… Educational Testing Service has said that a New York law prohibits the company from releasing information about cheating. Prosecutors say the law simply prohibits disclosure of the investigation: Once cheating has been proven, they maintain, the testing service has full authority to report the outcome to third parties. Prosecutors and legislators have said that the law should be re-examined and that proven cheats should face consequences.

Wife Hacks Hubby Computer

The estranged wife of a multimillionaire New York investor admitted she hacked into her husband’s private computer to prove he had spent hundreds of thousands in ‘allowances’ for young women.
Linda Simon used a private investigator to allegedly discover her husband David had been accessing the website sugardaddy.com to conduct extramarital affairs.
Mrs Simon also claimed her husband gave $250,000 in ‘hush money’ to a woman he had a child with last year.

The couple are in the middle of a divorce at Westchester Family Court where Mrs Simon filed a protection order to have her husband kicked off their estate in Purchase, New York.
Mr Simon is believed to have been living at the Setai Hotel, New York since the end of July.

In August, Mr Simon, who is a frequent commentator for CNBC, sued his wife and her divorce lawyer Jason Advocate for $25 million at Manhattan Civil Court.
He alleged they had copied his hard drive which contained ‘trade secrets’ from his company Twin Capital Management and his personal financial information.

The lawsuit said he was the only person with the password and his company’s computer-monitoring service showed someone accessed his PC after he left home.
Responding to the claims for the first time, Mrs Simon admitted that she broke into the computer with the help of surveillance firm T&M Protection Resources.
She said she only did so to find out about her husband’s affairs and the money he lavished on young women.
According to the filing obtained by The New York Post, Mrs Simon stated: ‘Simon was a ”sugar daddy” to several young women through a Web site called sugardaddy.com and was spending thousands of dollars per week paying these women ”allowances” to be at his beck and call.’

Sugardaddy.com has more than 1.5 million members and aims to set up rich, older men with young attractive women, so called ‘sugar babies’.
Mr Simon’s hedge fund tried to have Mr Advocate removed as Mrs Simon’s lawyer as he was also been sued in the hacking case.
Mr Advocate was unavailable for comment when contacted by MailOnline today.
The motion to have him dismissed as Mrs Simon’s attorney was denied at Manhattan Civil Court yesterday by Judge Jeffrey Oing.

Trenton NJ DMV workers stole identity

Two area residents who work at the state Motor Vehicle Commission have been charged with official misconduct, bribery and identity theft for allegedly selling the confidential information of New Jersey drivers, prosecutors announced Tuesday.

Sherilyn Rivera, 28, of Reeves Avenue in Hamilton and Johnny Semmon, 31, of Center Street in Trenton, have been suspended without pay from their jobs pending the outcome of the charges, state officials said.

Both are accused of providing the names, addresses, dates of birth and Social Security numbers of unsuspecting residents that they obtained through their employment.

They were charging as little as $200 per identity, prosecutors said.

Each faces a potential sentence of up to 10 years in state prison with a five-year period of parole ineligibility.

Two additional area residents were charged in connection with the scheme. Lee Daniel Roberts, 37, of Eaton Road, Bordentown, and Abdulah Sumo, 55, of Hinsdale Lane, Willingboro, are each charged with identity theft and trafficking in personal identifying information pertaining to another person. Each faces a potential sentence of up to 10 years in state prison with a five-year period of parole ineligibility.

Both men allegedly were selling the names, addresses, dates of birth, Social Security numbers and credit history reports of victims obtained through their respective jobs.

Roberts is a tax preparer working out of an office on Heil Avenue in Trenton, and Sumo is employed by Imani Realty Co. in Willingboro, according to prosecutors.

The investigation was launched after prosecutors got a tip that Motor Vehicle employees were selling confidential information, according to Casey DeBlasio, a spokeswoman for the prosecutor’s office.

At the time of Sumo’s arrest, in June 2011, a search of his vehicle revealed documentation containing the personal identifying information of more than 60 individuals, she said.

Roberts remains in the Mercer County Correction Center in lieu of $50,000 bail. Both Rivera and Semmon are free on $50,000 bail. Sumo is free on $100,000 bail.

Florida mom, missing after ‘People’s Court’

A missing person’s report has been filed for Michelle Parker, a 33-year-old Florida mother who disappeared after taping an episode of “People’s court” with her former fiancé, Dale Smith. On November 21, 2011, the case received national attention after being covered by ABC’s Good Morning America. The show was taped in June but aired on Wednesday, November 16, 2011. Parker was last seen on November 17, 2011 in the Waterford Lakes area of Orlando. A command post has been established in the Orlando area and search crews have combed through the area where looking for any sign of the missing Florida mom.

Michelle Parker is the mother of three children, an 11-year-old son from a prior relationship and three-year-old twins born during her relationship with her ex, Dale Smith. She was last seen dropping the children off at Smith’s home on Thursday, November 17, 2011.

An official Facebook page has been started to help find Michelle: Michelle Parker Missing Person . At this time, Smith has not been declared a person of interest or suspect in Parker’s disappearance. Both Smith and Parker made statements they were upset following the taping of the show. Smith made them to the court reporter after taping and Michelle Parker described the experience as “humiliating” to her mother (see video report to left).

Michelle Parker’s mother, Yvonne Stewart released a public statement saying, “This isn`t a wallet. This isn`t just a purse. This is my baby girl. We need to find her, and we need help.”

Authorities found Michelle Parker’s car in one area of Orlando and traced her iPhone through pings to a different location, approximately seven miles away. That area is now the command center: Oakland Road in Orlando, Florida. The pair appeared on the People’s Court to settle a dispute regarding Parker’s engagement ring. Michelle Parker threw the ring off a balcony due to arguments with Smith. The two had a tumultuous relationship, and Michelle Parker had previously filed a restraining order against Smith.

Volunteers from Texas Equusearch, the non-profit organization that helped search for Caylee Anthony, has joined the search’s efforts.

Yvonne Stewart has suggested that Michelle Parker may have been the victim of a random crime. No suspects have been named in the case and authorities say they have every reason to believe that Michelle Parker is alive.

“If anybody has her and are holding her hostage, please let her go. Let her come home so she can raise her babies,” Yvonne Stewart pleaded in a media appeal.

His disciplinary hearing, which was held in private, heard lurid details of how Mr Johnson’s wife cheated on her husband with his bodyguard. To spare their blushes, the former minister, his wife and aide were not called as witnesses.
The panel heard how the officer arranged to meet the MP’s wife for secret trysts when he was off duty.
Mr Johnson has been married to Laura, his second wife, for almost 20 years. Her affair with the policeman is said to be over but the Johnsons’ marriage has been damaged beyond repair.

Missing daughter in AZ

Glendale Police Sergeant Brent Coombs said Monday that the little girl’s mother, Jerice Hunter, was “placed under arrest for child abuse directly related to her daughter, Jhessye Shockley,” and said that with the passage of time, he doesn’t expect they’ll find the little girl alive.

Coombs said at the news conference Monday that new information in the past few days led police to serve another search warrant on Hunter’s Glendale apartment and arrest her Monday. He wouldn’t elaborate.

Coombs said Hunter has refused to take a polygraph test

Hunter was booked Monday at the Maricopa County jail. A sheriff’s spokesman said Hunter was unable to talk to reporters because she had not yet been assigned a housing unit. She was scheduled for her first court appearance Monday night.
Hunter has previously been critical of police handling of her daughter’s case.

Last month Jhessye’s mother, Jerice Hunter pled for her daughter’s safe return saying, “Please bring my baby back … Her safe return is all I want … She belongs to this family … She’s somebody’s child … Mine … Please bring her home.” Read: Arizona mom pleads for 5-year-old daughter’s return, police scale back search.

And now, this mother has been arrested, once again on charges of child abuse – this time to her youngest daughter, Jhessye.

It is astounding at the number of mothers who have recently been the focus of their children’s disappearances. The most recent who come to mind are Baby Lisa Irwin, Baby Tyler Dasher,Baby Sky Metalwala, Hailey Dunn, Caylee Anthony, Sophie Parker Pederos, Camden Hughes,Kyron Horman (step-mother), Zahra Baker … there are undoubtedly many more that don’t make national headlines.

“Our investigators are still working diligently to locate Jhessye,” Coombs said. “This is a step down that path.”

He said that none of the leads about Jhessye’s disappearance have panned out but that information about Hunter proved to “have substance to the investigation and have proven to be accurate, as far as we can tell.”

Prior abuse charges

Jhessye (pronounced Jesse) went missing Oct. 11. Her mother, Jerice Hunter, said she returned from running an errand and discovered her daughter missing from their Glendale home. She said she left Jhessye in the care of her three older daughters – ages 13, 9, and 6 – who claimed to have no knowledge of where she was. The little girl has not yet been found.

Sgt. Coombs said previously that all three girls were interviewed separately by experts and have maintained they do not know what happened to Jhessye.

Hunter and her then-husband, George Shockley, were convicted of child abuse and served time in prison in 2006 for abuse inflicted on their children in 2005. It was reported they inflicted “cruel and inhuman” corporal punishment and injury on all four children, including the mother who “whipped one of her children with an extension cord.” Read: Missing Arizona girl’s parents convicted of child abuse, CPS removes sisters.

Hunter’s mother, Shirley Johnson, insisted her daughter had changed and is now a loving mother who is pregnant with her fifth child.

While Hunter is the main focus of their investigation, Sgt. Coombs said, “We’re not so shortsighted to think that there may not have been an additional person or persons who may … have helped,” CNN reports.

Coombs said with the passage of time, he doesn’t believe Jhessye will be found alive.

Sgt. Coombs said the reward information leading to Jhessye and those responsible for her disappearance has increased to $25,000.

Lexington Doctors Surveillance video?

Police believe the man accused of killing a Lexington dermatologist was the person caught on surveillance video approaching the doctor’s van the night she died, according to a detective’s testimony Tuesday.
Marty Lee Roe, 62, was charged with murder in the death of Dr. Martha Post, 55, who was shot outside her Huguenard Drive office while she was in her van preparing to leave. She was pronounced dead at 8:25 p.m. on Sept. 1 after she was found in her van in the road.
Roe’s case was waived to the grand jury Tuesday in a Fayette County court hearing that also revealed a few more details about the case.
Detective Bill Brislin testified police had obtained surveillance video from a day-care center near Post’s practice. The recording showing a man approach the driver’s side of Post’s van before the van reversed out of a parking space. Police believe the man was Roe, Brislin said.

However, bushes blocked a clear view of what occurred once the man got to the van.
Roe was arrested at a bar in Lakeview, Ohio, on an outstanding warrant for harassing communications stemming from phone calls he made to Post, according to an arrest warrant. He was later charged with murder and tampering with evidence after police interviewed him and found a gun and bullets in the engine compartment of his van.
The gun was wrapped in a plastic bag in the van, hidden behind the battery in the engine compartment, Brislin said. In addition to the bullets, police found multiple cell phones. Forensic testing was pending on the guns and bullets.
Roe fought extradition to Fayette County.

Officers with the Monroe Police Department were dispatched to Wendy’s on North 18th Street in reference to an alarm Sunday.

During the investigation, police made contact with Lenard R. Smiley, 32, 1302 Auburn Ave., who was riding a bicycle in the area. A background check revealed an active warrant with Monroe police. When police searched the suspect they found a loaded automatic pistol concealed in his left back pocket.

At Ouachita Correctional Center, Smiley was charged with illegal carrying of a weapon, $2,500 bond, and held on a detainer for the warrant.

Glendale florist identity theft case

A Glendale florist and his wife pleaded not guilty Monday to multiple charges for allegedly stealing bank information from their customers to buy Visa gift cards at Target stores that they later redeemed at their own store, officials said.

Vahik Ghookasian and his wife, Hilda, both 60, face 14 felony counts of identity theft for allegedly buying $1,900 in Visa gift cards at Target stores in Glendale and Burbank with account information from two Glendale residents who patronized Daisy Florist, on the 1400 block of Glenoaks Boulevard, according to a Los Angeles County Superior Court criminal complaint.

The couple is being held in lieu of $700,000 bail, police officials said. They are expected to appear Wednesday in the Los Angeles County Superior Court in Glendale for a bail bond hearing.

Authorities refrained from pursuing charges against the couple’s son, Peter Ghookasian — who allegedly had dozens of re-encoded gift cards attached to notes with a handwritten three-digit PIN number in his car — because they planned to conduct a follow up investigation, Glendale Police Det. Ralph Garcia said.

The couple and their son were arrested Thursday at their hillside home on the 1600 block of Ridgeview Drive after detectives served a search warrant and found re-encoded cards scattered throughout their home.

Police also seized blank credit cards, computers, hard drives, embossing and printing equipment inside their home. Detectives also served a search warrant at the flower shop, where they found a credit card skimming device, police said.

The couple allegedly recorded customer bank account information when they swiped their cards for a purchase. Police said the couple re-encoded the information onto other cards, which they used to buy the Visa gift cards. Prosecutors allege the Ghookasians later “purchased” items at their flower shop in exchange for the money.

The fraudulent charges allegedly occurred between Oct. 6 to 22.

“The Glendale Police Department won’t tolerate attacks on the wallets and bank accounts of its citizens,” Garcia said.

The alleged fraud could be extensive due to the couple’s access to customer information, he added.
