Craig Anthony Ellis, 32, was sentenced in his absence on Monday in the Brisbane District Court to a total of eight years’ jail for sexually assaulting a three-year-old girl.

He will be eligible for parole after serving half that time.

Despite having pleaded guilty earlier this year to breaking and entering a dwelling with intent and two counts of indecent treatment of a child under 12, Ellis claims his arrest and prosecution was a conspiracy.

“I’m a goddamn victim, b****,” he shouted at prosecutor Vicki Loury from the secure dock on Monday.

He repeatedly denied having a pedophilic nature, describing the psychiatrist who assessed him and made the assertion as a “sick piece of s***”.

Ellis then called Judge Michael Rackemann, Ms Loury and the victim’s mother pedophiles.

He was ejected from the court and the sentencing hearing continued in his absence.

This was not the first time Ellis’s outbursts have seen him kicked out of court.

In August he accused the child’s mother of having raped her own daughter and then threatened to use chainsaws to kill police who “framed him”.

The matter was adjourned at that time so Ellis could undergo a psychiatric assessment.

The court heard on Monday that Ellis had been diagnosed as a pedophile, with the doctor ruling he had committed the crimes to satisfy his “deviant sexual drive”.

The court heard Ellis broke into his victim’s home at Aspley in January 2009 and took photos of the semi-naked girl as she lay in her bed.

He also sexually assaulted her before being tackled by the girl’s father, who was woked by her muffled cries, as he tried to leave the house.

The girl’s mother struck Ellis with an ornamental samurai sword as he tried to flee.

The girl’s family, who were in court on Monday, were visibly upset when Ellis insisted he was innocent and that they would die for their part in his prosecution.

Ellis has said he would appeal the sentence and was confident he would receive a multimillion-dollar payout.

vandalized Spierer posters missing person

BLOOMINGTON – Volunteers spent Saturday replacing posters of a missing Indiana University student that had been torn down.

Thousands of people have helped with the search for Lauren Spierer, putting up posters and searching nearly every inch of Bloomington. Recently, an anonymous letter was sent to Spierer’s parents, criticizing the poster of their daughter as littering up the town.

“It is kind of hard to understand how a person could tear down posters of a missing person when, you know, this person has a family that is searching for them. How can you be heartless enough to tear down those posters?” said volunteer Joe Bailey.

During the past five months, thousands of posters with Spierer’s picture, detailed information on where she was last seen and a police phone number have been placed all over Bloomington. Recently, hundreds of the posters have been taken down, followed by the letter to the missing IU junior’s parents, critical of the search effort and the posters.

“That is what I said one time. For every poster they take down, there is 5-10 more that will put it back up. Take ’em down and we will put them right back up,” said volunteer Maryanne Ryan.

And put them up they have. A new stack of posters went quick Saturday afternoon.

“No matter what happened, they deserve to know what happened to their daughter. Ultimately, in the end, they deserve that. Every parent deserves that,” said another volunteer.

The volunteers admit some of the posters did not survive the weather, but they had a message for the person that tore the other posters down.

“Help us find the answers and the posters will come down,” Ryan said.

Spierer was last seen early in the morning of June 3, near the intersection of 11th and College in Bloomington. Her parents are asking if you have any information to call the Bloomington Police Department.

Will County sheriff’s deputy accused of breaking man’s neck

A Will County sheriff’s deputy is accused in a lawsuit of breaking the neck of a private detective last year while responding to a dispute over a classic Pontiac Trans Am.

Matt Griebel, 30, is accused not only of fracturing a vertebra in Donald Swanson’s neck, but also of pummeling him so severely his liver was damaged and clamping handcuffs on so tightly they severed the ulnar nerves in Swanson’s wrists, according to a federal lawsuit filed last week against Griebel and the Will County Sheriff’s Office.

St. Louis Man Missing

ST. LOUIS (KMOX) – St. Louis city police are asking for the public’s help in locating a missing person with a medical condition.

Ben Carter is an 83-year-old African-American man who’s six-feet-tall and weighs about 200 pounds.

He was last seen wearing a navy blue long-sleeved shirt with beige elbow patches and Dockers-type blue pants.

He also had on white tennis shoes and a tan wool hat.

Prescription Fraud Investigation

federal investigation resulted in charges against 17 people in California, including a doctor and several pharmacy owners, allegedly involved in a prescription harvesting scheme that attempted to defraud Medicare and Medi-Cal of $18 million. Allegedly, Manor Medical Imaging Clinic, Glendale, CA, recruited Medicare and Medi-Cal beneficiaries, and used their beneficiary information to bill for illegitimate medical services and prescriptions for expensive anti-psychotic drugs.

The drugs were dispensed by pharmacies allegedly involved in the scheme and were diverted to black market wholesalers and back to the pharmacies where they were re-labeled, re-packaged, and re-dispensed, with new bills submitted to Medicare and/or Medi-Cal. More than $18 million in fraudulent claims were submitted as part of the scheme, with $7.3 million in claims paid out. As explained in a US Attorney’s Office press release, “This is the first case in the nation alleging an organized scheme to defraud government health care programs through fraudulent claims for anti-psychotic medications, a type of scheme that investigators say is on the increase around the nation. Court documents outline a conspiracy in which Manor operated a bogus clinic authorized to make claims to Medicare, employed a doctor to write prescriptions, and had close relationships with pharmacies and a fraudulent drug wholesale company that was used to funnel prescription drugs back to the pharmacies participating in the scheme.” All 17 defendants named in the federal criminal complaint are charged with conspiracy to commit health care fraud, a charge that carries a statutory maximum penalty of 30 years in federal prison.

Magnificent “Anonymous” strikes against pedophiles again

A notorious hacktivist group’s war against those who access child porn online continues.

Late last month, Anonymous claimed that it crashed several child porn sites and shamed those who allegedly patronized them.

Late last week, Anonymous released the IP addresses of nearly 200 visitors to child porn sites, using information collected from the sites it had shut down. An IP address is the unique number used by every device that connects to the Internet.

According to msnbc.com, Anonymous captured the IP addresses of visitors to child porn sites by tricking them into downloading a fake update to Tor software, which can be used to obscure a user’s identity. The update routed traffic to a server controlled by Anonymous that logged incoming IP addresses and destinations.

The site said that Anonymous posted this message on Pastebin to the accused child porn viewers it had exposed: “To the pedophile community, based on the evidence and forensics, that We Anonymous gathered, there is no need for you to troll anymore, mmmkay? We have already ID’d you despite ‘the myth’ of Tor ‘Anonymity.’ We ‘pwned’ and ‘hacked’ Freedom Hosting and Lolita City. If your names for your sick trade consist of ‘Lolita’ and ‘pedo bear,’ pedophiles are called ‘Britney’ and ‘squealer’ in jail.”

Tracy Williams missing person

Technorati needs your immediate help. Our employee and friend, Tracy Williams, went missing on November 2, 2011. We are extremely concerned about her well being and reaching out to our community to spread the word and find her.

At this stage, here is information we can share:

Tracy was last seen at 7:45pm PDT on Wednesday evening at the Whitehorse Bar located in San Francisco. She was there with colleagues from Technorati Media. During this time, friends went outside for a “smoke”. When they returned inside the bar, Tracy was gone. They simply thought she was heading to North Beach to meet a friend and not concerned.

After leaving the bar, we believe Tracy texted a friend to let him know she was going home.

On Thursday, November 3, 2011, Tracy did not show up for work. Many of our employees tried to contact Tracy through email and phone without success. A close friend was alerted about the situation and went over to her apartment, in the Tenderloin section of San Francisco. There were no signs that Tracy returned to her apartment the prior evening.

Tracy is 40 years old, dark wavy hair that she usually wears back in a ponytail, prominent freckles on her face, brown eyes, light brown skin, athletic build, 5’8 inches tall, approximately 135 pounds and was wearing blue jeans, a black hoodie and carrying a small bag.

We have notified the San Francisco Police department and hospital checks are being conducted.

A senior police officer had a narrow escape at a shoot out in Sivasagar on Friday. But his body guard sustained bullet injured in the incident.

The incident took place near Barhat where three motorcycle born ULFA men started indiscriminate firing on a sub divisional police officer at around 7 in the evening. The senior police officer escaped unhurt but his personal security guard Kamal Nath sustained bullet injury. He was rushed to the hospital. The incident took a couple of days after ULFA’s Paresh Baruah faction threatened to launch massive attack.

Doctor abused fmale patient caught by PI

Dr. David Lambert of Mississauga has been found guilty of professional misconduct after a hidden camera caught him touching the breast of a private investigator who was posing as a patient.

The investigator was identified only as “Ms. X” in a decision issued by the discipline committee of the College of Physicians and Surgeons of Ontario.
“Dr. Lambert intentionally touched the breast of Ms. X, thus committing sexual abuse of a patient,” said a statement released by the College.
The disciplinary committee also found that the general practitioner committed further misconduct by violating an earlier ban on treating female patients, seeing patients for services not covered by OHIP and for recommending skin care products in which he had a commercial interest.
His medical licence remains suspended, pending a penalty hearing.
The College acknowledged Lambert was “not behaving in a flirtatious or seductive fashion” with the two female investigators during an undercover investigation.
His licence was temporarily revoked in 2002 after he was found guilty of sexually abusing three female patients.
In June 2009, four months before the sting, the College ordered him not to treat women or minors, do procedures not covered by OHIP or try to sell his own cosmetic products to patients. The undercover operation found him guilty of violating all three conditions.
In June, Lambert pleaded guilty to four of the five professional misconduct charges against him, but he had adamantly denied the alleged sexual abuse.

OPINION AND ORDER

BARBARA B. CRABB, District Judge.
In this civil suit for damages and injunctive relief, plaintiffs Barbara Michalczyk and WBAJ, Ltd., shareholders of defendant Baraboo, Inn, Inc., contend that defendants Jerry Maslyk and Elizabeth Wdowiak have mismanaged defendants Baraboo Inn, Inc. and Bonzos, Inc. by appropriating corporate earnings for personal use, using corporate personnel for non-corporate endeavors, failing to hold shareholder meetings, eliminating payment of dividends to plaintiffs and failing to pay mortgage payments and real estate taxes. Plaintiffs filed this suit on July 18, 2011, seeking various forms of relief, including an order enjoining defendants from managing Baraboo Inn, an order dissolving Baraboo Inn, Inc. under Wis. Stat. § 180.1430(2), an order appointing a receiver under Wis. Stat. § 180.1432 and monetary damages. Plaintiffs also filed a motion for a temporary restraining order, which I denied in an order dated July 19, 2011. In that order, I concluded that plaintiffs’ motion had no merit. Additionally, I noted that the jurisdictional allegations in plaintiffs’ complaint were inadequate.
Plaintiffs allege that this court has jurisdiction pursuant to 28 U.S.C. § 1332(a)(1) because the parties are completely diverse and the matter in controversy exceeds $75,000. However, plaintiffs had failed to identify their own citizenship properly, alleging only that plaintiff Barbara Michalczyk is a “resident” of Illinois and that plaintiff WBAJ, Ltd. is an Illinois corporation. As I explained in the July 19 order, these allegations are inadequate because plaintiffs failed to identify Michalczyk’s citizenship and failed to identify WBAJ, Ltd.’s principal place of business. Meyerson v. Harrah’s East Chicago Casino, 299 F.3d 616, 617 (7th Cir. 2002) (holding that it is citizenship, not residency, of individual persons that matters for diversity jurisdiction purposes); 28 U.S.C. § 1332(c)(1) (corporation is “citizen of any State by which it has been incorporated and of the State where it has its principal place of business”). Similarly, plaintiffs had failed to identify the citizenship of defendants Jerry Maslyk and Elizabeth Wdowiak and had failed to identify the state of incorporation and principal places of business for defendants Baraboo Inn, Inc. and Bonzos, Inc.

Although it has been more than three months since I explained the deficiencies in plaintiffs’ jurisdictional allegations, plaintiffs have failed to submit any additional information regarding the parties’ citizenship. Plaintiffs should have provided this information to court as soon as possible after the July 19 order. However, because I did not give plaintiffs a deadline in that order by which they were required to provide this jurisdictional information, I will give them one more opportunity to do so.
Plaintiffs’ jurisdictional allegations are not the only problem in this case. Defendants have filed a motion to dismiss the case under Fed. R. Civ. P. 12(b)(5) for insufficient service of process, dkt. #13, and after reviewing the motion I agree that plaintiffs have failed to serve defendants properly. On August 8, 2011, a process server brought copies of the summons and complaint to the Best Western Baraboo Inn in West Baraboo, Wisconsin. The employee working at the front counter did not have authority to accept service on behalf of any defendant and said so to the process server. Nonetheless, the process server placed the summons on the counter and left. Plaintiffs filed affidavits of service with the court for all of the plaintiffs on September 2, 2011.
The service requirements are set forth in Fed. R. Civ. P. 4. Rule 4(e) sets out the rules governing service of process on an individual, allowing parties to accomplish service by
