JUNEAU — A Mayville man is suspended from his job at a Dodge County cheese factory while his case is being tried in Dodge County Circuit Court.

Miguel Hernandez Ramirez, 20, is charged with identify theft after he tried to open a bank account at Mayville Savings Bank Sept. 28 using the Social Security number of a dead man.

Hernandez Ramirez told investigators he was in the country illegally for the past 11 years and had gotten the bogus card from his father who has returned to Mexico, according to the criminal complaint.

Mayville investigators notified officials at Immigration Customs and Enforcement that Hernandez Ramirez had used the Social Security number of a man who had passed away in April 2010 in order to obtain employment at Old Fashion Cheese in Mayville and to open a bank account.

If convicted, Hernandez Ramirez faces up to six years imprisonment.

Hernandez Ramirez is due in court on Dec. 1 for a preliminary hearing.

Croydon benefits claimant being caught sailing

A benefits claimant who said he was too sick to work is under investigation after he was caught sailing his private yacht across the Atlantic Ocean.

Graham Axford from Croydon, received incapacity benefit for 15 years after injuring his back in a motorcycle accident in 1996.

But an investigation by the BBC’s Panorama which aired last night, revealed the injury caused no problems for the 57-year-old, as he tackled dangerous waters sailing 43ft Crumpet Too from America to the Azores.

According to programme makers the former Liberal Democrat council candidate is a keen sailor who has embarked on several journeys since first making his benefit claim.

Accompanied by one crew members, he sailed via the West Indies, before combating big Atlantic swells to make the month long crossing in 2003. It is believed he then sailed from the Azores to France.

Mr Axford was given a council flat in 1997, after he failed to tell authorities he half-owned a farmhouse in Normandy.

He then held on to his council property while living in France and the US, where he admits to being based for the last seven years.

During this time he continued to receive payments of incapacity benefit, housing benefit and council tax benefit. His claims are now being investigated by Croydon Council.

Fraud investigator Andrea Corderey said: “He’s got a property in France and also we discovered that he owns a yacht.

“He is in receipt of incapacity benefit based on a bad back. We are not quite convinced what he’s told us about his disability is true.”

Mr Axford’s solicitor said he had never fraudulently misrepresented the nature or extent of his back injury.

He added his eligibility for incapacity benefit had been assessed and verified by medical professionals and that having an ongoing back condition was not incompatible with travelling in a boat with assistance.

MISSOULA, Mont. (AP) — An investigation into the former Frenchtown Rural Fire District chief found several employees backed up a volunteer firefighter’s claims that John Bibler sexually harassed and threatened her.

Jenny Ross accused Bibler of threatening her life and the lives of her children and dog in front of others at the department while twirling a bullet in his fingers. She claimed Bibler also made inappropriate sexual advances and comments.

A report by a private investigator released this week shows other firefighters verified those claims. Bibler denies them, but resigned after the fire district’s board received the report in February.

Bibler says Ross did not comply with training requirements. She was suspended after making her complaint about Bibler in late 2010. She filed a complaint with the Human Rights Bureau in May

A private investigator is making a second attempt to gain access to 911 calls that were made when a Fayette County teenager was killed two years ago in a vehicle accident.

Ewing Marcus Marietta II, 18, of South Connellsville, died July 15, 2009, three days after the accident in North Union. Police said Marietta was ejected from his car when it hit a concrete barrier on Route 40 East near Hopwood and rolled over.

Although police said only one vehicle was involved, the family hired an accident reconstructionist, James E. Baranowski, who has determined there “was another vehicle or vehicles involved,” according to a civil lawsuit.

Filed in July in the prothonotary’s office in Fayette County, the civil lawsuit names four unknown individuals as defendants: the drivers and owners of as many as two other vehicles that Baranowski believes were involved in the accident.

Citing Baranowski’s findings, the family’s attorney, Mark A. Rowan of Connellsville, filed a motion on Thursday seeking access to the 911 records.

“As the investigation of Mr. Baranowski indicates that Marcus may not have died from the collision itself, as the police report indicates, completing the investigation would require reviewing the 911 transcript, the recording, and being able to contact the callers,” Rowan wrote in the filing.

Baranowski concluded that Ewing, at 6 feet 4 inches tall, was too tall to have been ejected through the window of his 2001 Ford Mustang, the filing contended. Baranowski found that the driver’s side door and window were crushed as the vehicle rolled, making it even more unlikely Ewing was ejected.

Ewing’s shoes would have been thrown randomly from the vehicle if the teen had been ejected, according to the filing. But they were found near each other at the rear of the vehicle, which Baranowski found to be “consistent with a pedestrian being struck by another vehicle.”

Baranowski questioned whether police followed procedures when they interviewed witnesses at the scene.

“The police stated to Marcus’ father that they had spoken with two individuals who were parked below the location where Marcus was laying at the scene of the accident, but the police stated that these individuals did not offer information of value to the investigation, and they were not identified on the report,” Rowan wrote. “According to Mr. Baranowski, who is a retired Pennsylvania state trooper, this is contrary to standard police procedures.”

Other results of Baranowski’s investigation, according to the filing, include a finding “that the initial caller to 911 gave the operator a false name,” and that a person at the scene was worried his breath smelled of alcohol.

The request marks Baranowski’s second attempt to gain access to 911 records pertaining to the accident. In a petition filed through the criminal courts last year, Baranowski made similar arguments in an attempt to review the records.

In a one-line order issued in May 2010, Judge Ralph Warman rejected the request.

West’s family wants criminal investigation

Sharon West’s family said they hired private investigator Chuck Foreman because they felt Jefferson County deputies weren’t digging deeply enough into her missing person’s case.

Foreman said the family believes there’s foul play involved and said there’s a clue that could lead them to a person of interest.

Foreman said if the sheriff’s office doesn’t move toward a criminal investigation, there will be a protest.

The Jefferson County Sheriff’s Office still hasn’t publicly confirmed that the dental records of Sharon West match human remains located near Fannett, but Foreman said the family was told by county investigators that a match was made.

Foreman said he plans to do another search, for the cell phone, if the Jefferson County Sheriff’s Office does not.

MOUNT PLEASANT — Authorities revealed today that accused child molester Louis “Skip” ReVille served as a state-sanctioned foster parent who hosted four children in his home over a two-year period.

The state Department of Social Services placed the children with ReVille between 2004 and 2006, agency spokeswoman Marilyn Matheus said. She would not reveal the ages or genders of the children, but people who know the well-traveled coach and educator said at least of two of the kids were adolescent boys
Matheus said ReVille opted out of foster parenthood in 2006 of his own accord. DSS received no complaints about his conduct during the two-year period he took in kids, she said.

The agency, however, plans an internal investigation and is working with local law enforcement in light of allegations against ReVille that have surfaced in recent days, Matheus said.

Mount Pleasant police have charged ReVille, 32, with molesting five teenage boys, and detectives have indicated that more charges are expected in the coming days.

The most recent charges involve allegations that ReVille fondled a 13-year-old boy about 10 times and performed a similar act on another boy, 14, according to arrest affidavits. The documents indicate the acts occurred “on the roadways of Mount Pleasant” and police Capt. Amy McCarthy said they appear to have taken place in ReVille’s car.

ReVille appeared in Charleston County bond court this morning on two charges of committing a lewd act on a child under age 16. Wearing a striped jail jumpsuit, an unshaven face and dejected look, he said nothing beyond providing his home address and answering “yes” or “no” to the judge’s questions.
Magistrate Linda Lombard set his bail on the charges at $400,000, bringing his total bail in the molestation cases to $1,000,075.

ReVille’s attorney, Craig Jones, said ReVille is “extremely remorseful” for his actions and plans to continue cooperating with investigators in his molestation case.

“He is sorry for all the pain he has caused,” he said.

Jones said ReVille told him from the start that he wants to continue cooperating with the investigation in the hopes that will bring some comfort to the victims. “There is obviously no way that he can repair the damage that has been done.” Jones said.

Jones would not comment about specifics of the charges or how many potential victims there could be in the case.

The latest victims are identified in affidavits as victim #4 and victim #8. McCarthy said the numbers were assigned by the investigating detective to help her track the victims in the paperwork and are not indicative of the number of victims in the case.

McCarthy said every effort is being made to protect the privacy of the reported victims.

“Considering the sensitive nature of this investigation, and in an effort to protect the victims in this case, details available for release are limited due to their confidential nature,” she said.

The case broke last week when officials from the Dee Norton Lowcountry Children’s Center notified police of numerous possible sexual assaults involving juveniles whom ReVille had coached, affidavits stated. He was charged Friday with performing sex acts on three boys.

His arrest came just hours after he attended sexual abuse prevention training at Coastal Christian Preparatory School, where he worked as a vice principal. The school has since fired him from his job.

ReVille is being held in protective custody, which is standard procedure for high-profile inmates who could be subjected to violence if placed in the general population, said Chief Deputy Mitch Lucas, the jail administrator. ReVille is housed in a cell by himself, Lucas said.

McCarthy said detectives have fielded several calls on the case and are busy tracking down leads, with a likelihood that the case will spread to other jurisdictions. “We have a team of people working on it. We have investigators solely working on this case because it’s so vast,” she said.

ReVille has had access to hundreds of children over the past decade while working in a variety of positions around the tri-county area, primarily in private schools and youth sports.

At The Citadel, for example, he served as senior counselor at a summer camp attended by some 500 children in 2003. School officials reported this week that a camper accused ReVille in 2007 of inappropriate behavior, but the incident didn’t involve physical contact. The school refused to reveal further details.

Police in Charleston, where The Citadel is located, have no active cases under way concerning ReVille, police spokesman Charles Francis said. It is unclear which other jurisdictions might be involved.

The allegations have shocked people whose kids have been coached by ReVille, who is married and recently became the father of triplets.

Charleston attorneys Mullins McLeod and Mark Tanenbaum, who represent some victims in the case, released a statement Wednesday praising the victims for coming forward and reminding people that publishing the names of sexual assault victims is illegal under state law.

“The allegations in this case involve the worst form of criminal conduct,” the statement read. “We commend the families for having the strength and the courage to come forward with their stories.”

McCarthy said police continue to ask the public for information relative to the investigation.

Busts a move while stealing a dress

If the man is apprehended, police said, he will face a retail theft charge.

Palmview medical equipment supplier fraud

The owner and manager of a Palmview medical equipment supplier are under indictment for alleged healthcare fraud and identity theft.

A grand jury indicted Ace Medical Equipment and Supplies owner Velma Alaniz on nine counts of conspiracy, healthcare fraud and aggravated identity theft. Also under indictment is her brother, Valente Alaniz III, who works as the durable medical equipment company’s manager, court records state.

The sister and brother under indictment are siblings of Palmview City Manager Johnn Alaniz, who is also a member of the La Joya school board.

Prosecutors allege Velma and Valente Alaniz submitted thousands of dollars worth of fake claims to Medicare and Medicaid when they sold power wheelchairs to the federal insurance programs’ beneficiaries between July 2008 and June 2010.

Rather than deliver the power wheelchair prescribed by the patient’s physician, the company allegedly sold them less expensive models but billed the federal government for the more expensive model.

Prosecutors list five instances where the company used the same Medicare and Medicaid billing code for power wheelchairs between March 2008 and September 2009. Each of the five claims resulted in about $4,900 in false proceeds received from the federal government, the indictment states.

Healthcare fraud and conspiracy to commit healthcare fraud each carry the same maximum punishment — up to 10 years in federal prison and a $250,000 fine. Each count of aggravated identity theft carries a minimum two-year prison term that must be served consecutively to any other prison sentences.

Each suspect made an initial appearance before U.S. Magistrate Judge Peter Ormsby on Wednesday in federal court. A detention hearing for each person is set for Thursday.

The U.S. Department of Health and Human Services-Office of Inspector General, the U.S. Secret Service and the Texas Attorney General’s Medicaid Fraud Control Unit investigated the case.
