Wrongful Death Lexington Shooting Victim Identified

The Fayette County Coroner has identified a man who died shortly after being found with a gunshot wound Wednesday morning.

Officials say 47-year-old Anthony Carter is the man found lying on the street at Fourth and Chestnut streets around 5:40 a.m. He was pronounced dead at 6:16 a.m. shortly after being taken to the hospital.

His death is being investigated by Lexington Police as a homicide and police have not yet named a suspect in the case. They say they’ve heard from witnesses who described a man on a bicycle leaving the scene right after a single shot was fired.

As the investigation continues, the flashing lights and police tape in the area are an unfortunate sign of a step backward in the progress so many have made to clean up this part of town.

“We love this neighborhood,” said Billie Mallory. “People live here because they love it. And we want people to be able to stay here.”

Mallory came out to check on a friend who lives on the street, and she’s also part of a group called Central Kentucky Council for Peace and Justice. They’ve organized clean-ups, meetings with police and council members – anything to make the area safer.

She called what happened there Wednesday morning unsettling and counter productive.

Wrongful Death Shooting at a Portland, Oregon High School

A teenage gunman armed with a rifle entered a high school outside of Portland, Oregon Tuesday morning and fatally shot a student and injured a teacher before he likely killed himself, police said.

The gunman, whom police have not publicly identified, was found dead in a bathroom at Reynolds High School in Troutdale. It was not clear how he died.

Officials used a robot with a camera to investigate the scene before determining the suspect was dead, police said.

Troutdale Police Department Chief Scott Anderson confirmed the deaths and called the events a “tragic day” for the community.

Troutdale Police Sgt. Carey Kaer told Fox News that the shooter was a teenage boy, but it was not immediately clear whether the gunman was a student at the school.

His victim was identified as freshman Emilio Hoffman, who was “loved by all,” Anderson said at a Tuesday news conference. He said Hoffman was found in the boys’ locker room.

A girl who used to be Hoffman’s girlfriend said he was “a good kid” and a “down-to-earth guy.”

“He was very caring, he loved to joke around,” said Savannah Venegas, 16.

Hoffman lived with his mother and had an older brother and two younger sisters, both in elementary school, Venegas said.

Anderson said he spoke with Hoffman’s family, saying they had a difficult road ahead and sought privacy.

Hoffman didn’t have enemies and “didn’t stir up trouble,” Venegas said.

“They wouldn’t have just picked him,” she said. “It had to be, just, random.”

Anderson said authorities are in the process of notifying the gunman’s family.

The teacher, Todd Rispler, had injuries that weren’t life-threatening, and he was treated at the scene. Rispler, a 50-year-old physical education instructor and former track coach, went to the office and initiated the school lockdown, Anderson said. The attack panicked students and they were told to go quietly to their classrooms.

About 2,800 students attend the school, located in a quiet tourist town of 15,000 near the Columbia River, about 16 miles east of downtown Portland.

The Multnomah County Sheriff’s Office said authorities responded to reports of shots fired at the school around 8:07 a.m. local time, on the next-to-last-day of classes.

Students told The Associated Press they were informed over the intercom that there was a lockdown and to quietly go to their classrooms.

Freshman Morgan Rose, 15, said she was hunkered down in a locker room with another student and two teachers.

“It was scary in the moment; now, knowing everything’s OK, I’m better,” she said.

The wife of a vice principal at the school also told KPTV that she had received a text message from her husband that said there was an active shooter.

Around 100 police and sheriff’s units arrived at the scene in addition to medical personnel and the FBI, according to KOIN 6.

Doug Daoust, the mayor of Troutdale, told Fox News that SWAT teams evacuated classrooms one at a time. TV news broadcasts showed students being escorted away from the school with their hands on their heads, The Associated Press reports.

Freshman Daniel DeLong, 15, said after the shooting he saw a physical education teacher with a bloodied shirt.

“I’m a little shaken up,” DeLong told The Associated Press. “I’m just worried.”

He said he was texting friends to make sure they were all OK.

“It just, like, happened so fast, you know?” he said.

Parents reunited with students at the Fred Meyer supermarket in Wood Village. A reporter from The Oregonian, who was at the supermarket, tweeted that employees brought out water and cookies for parents.

Mandy Johnson said her daughter called from a friend’s phone.

“I thank God that she’s safe,” said Johnson, who has three younger children. “I don’t want to send my kids to school anymore.”

Linda Florence, the superintendent of Reynolds School District, said this day is “one that I had hoped would never, ever be part of my experience.”

Daoust believes that an active shooter drill that students went through earlier this year helped save lives in this situation.

The Oregon violence came less than a week after a gunman opened fire on a college campus in neighboring Washington state, killing a 19-year-old man and wounding two others.

The Tuesday shooting was the first fatal school shooting in Oregon since May 1998 when 15-year-old Kip Kinkel killed two students and wounded 25 others at Thurston High School in Springfield near Eugene. He killed his parents prior to the attack and is serving an 111-year prison sentence.

Reynolds is the second-largest high school in Oregon, with about 2,800 students. Its students come from several communities.

Missing Person Lea Chali Porter of Westminster, CO

Westminster Police issued a missing person bulletin Tuesday for 19-year-old Lea Chali Porter. Porter, who was reported missing by her mother on June 5, lives in Pueblo County but was visiting friends in the Westminster area when she disappeared.

Porter is 5-foot-5 inches tall and weighs 90 pounds. She has brown hair and brown eyes, has a tattoo on her right wrist and a piercing in her lower lip.

Missing Person Michael P Meagher of Cape Coral, FL

Cape Coral Police Detectives are currently working a missing endangered person case and are asking for the Public’s assistance.

58 year old Michael P. Meagher left his wife at a gas station last night after an argument.

Today,  his wife located their vehicle on Veterans Parkway, just west of the tolls on the shoulder of the eastbound lane.

 

His wife stated that he told her that he can no longer live.

Meagher was last seen between 12:12 and 12:30 AM Tuesday.

Drug Dog Sweep Teacher Arrested After Marijuana Found in Car at a Delaware high school

Delaware State Police arrested a Seaford High School teacher after marijuana was located in his parked vehicle on school grounds Monday afternoon.

On June 9, troopers assigned to Delaware State Police K9 Division as well as a K9 assigned to Dover Police Department were requested by the Seaford School District to conduct a search of the building and vehicles in the parking lot for drugs, state police spokesman Cpl. Gary Fournier said.

While conducting a search in the south parking lot of the school, one of the K9s alerted to the presence of drugs in a Jeep Liberty.

School administrators conducted an administrative search of the vehicle with the registered owner, Ryan A. Harris, 33 of Mechanicsburg, Pa., present.

Located in his Jeep was a bag containing 20.8 grams of marijuana, a digital scale, and a glass pipe used to smoke the marijuana.

All evidence was turned over to the Delaware State Police School Resource Officer assigned to the high school.

Mr. Harris was transported to Seaford Police Department and formally charged with possession of marijuana with an aggravating factor (School Zone), and two counts of possession of drug paraphernalia. He was arraigned at Justice of the Peace Court 3 and released on $1,000 unsecured bond.

A prepared statement from Seaford School District spokesman Dr. Stephanie Smith stated “we had a positive experience yesterday at Seaford High School in that we participated in a Delaware State Police canine search exercise and our school was found to be free of drugs.

“Unfortunately, a staff member was arrested for items found in their automobile. As this is a personnel matter we will offer no further comment. The employee in question is suspended pending the outcome of the investigation,” said Dr. Smith.

Missing Person Police Search for Runaways in Winston-Salem

On Tuesday morning patrol officers with the WSPD responded to a reported missing person on Barnes Road Lot 27. Upon the officers’ arrival, the reporting person, Alma Orocco Ubaldo told police that her daughter, 14 year-old Alma Saria Ubaldo, left their home at approximately 3:30 a.m. Tuesday and has not been heard from since. Her mother informed authorities that Alma may be in the company of her boyfriend, 15 year-old Rodrigo Nieto Burgos.

Alma was last seen wearing a black “My Chemical Romance” t-shirt, blue jeans that are black in the rear, and leopard print Van shoes. She is described as being 5 feet, 4 inches in height and weighing 100 pounds.

Officers then responded to 820 Gibbons Street, where Rodrigo Burgos lives. His father confirmed for police that Rodrigo was missing also. Mr. Olea advised that Rodrigo had been missing from the home since 11:00 p.m. Monday night. Rodrigo was last seen wearing an unknown colored t-shirt and blue gym shorts. Rodrigo is described as 5 feet, 7 inches in height and weighing 190 pounds. Mr. Olea also thinks the young couple is together. At this point, police are treating this as if the children ran away.

Wrongful Death Family Of Woman Sexually Abused After Medical Emergency Files Wrongful Death Lawsuit

The family of a woman sexually assaulted during a medical emergency at a Lexington strip club is now suing for wrongful death.

Melissa Smiley’s husband is seeking an undisclosed amount of money from Fillie’s Gentleman’s Club, where she was sexually abused before her death; Clyde Sexton, the man accused of sexually assaulting her; and several others for allegedly failing to stop the attack. The victim’s father is also suing on behalf of her two young children.

Police say 37-year-old Melissa Smiley passed out from a respiratory disease in July 2013 at Fillie’s Gentleman’s Club, and rather than calling for help, they say 71-year-old Clyde Sexton sexually abused her. Smiley later died.

The lawsuit recently filed says she could have been treated if she’d been helped immediately.

Police said the female victim had a pre-existing medical condition that included a history of fainting. The owner of the club said she was a former employee, but was not working there at the time.

In Oct. 2013, the exact cause of death remained unclear. The coroner had said he’s not sure if drugs or asphyxiation killed Smiley.

Sexton is awaiting trial for sexual abuse and evidence tampering.

Police say some of what happened to the unconscious woman was captured by a surveillance camera. Police say it shows Clyde Sexton moving Smiley’s body in the women’s locker room, sexually assaulting her in multiple ways, and then it shows Sexton covering up the surveillance camera with a white sheet.

Private Detective, Elderly Woman Wakes Up to Half-Naked Man in Bedroom

A Clark County man left behind a key piece of evidence while trying to flee an elderly lady’s apartment after she woke up to him standing next to her bed with his pants down.

It wasn’t hard for police to identify 22-year-old Travis Asher – who they say was standing in an 80-year-old woman’s bedroom around midnight Tuesday – because, police say, he left behind his wallet.

Officers say the victim screamed and Asher took off dropping his wallet in the woman’s Buckner apartment. Police say they found Asher nearby on Broadway, hiding in some bushes.

Asher is charged with attempted rape is now in the Clark County jail from where he declined an interview. Officials say he could face additional charges in this case.

Asher was in court Tuesday morning on an unrelated charge. His arraignment on attempted rape is scheduled for Wednesday.

Missing Person Thomas Simpson of Jenks, OK

The Jenks Police Department announced it is searching for a missing elderly man.

Thomas Simpson, 80, reportedly was last seen at the Church Hill Park area in Jenks on Monday and has multiple respiratory health issues, the department said in a post on its Facebook page.
