Wrongful Death Lexington Man Pleaded Guilty

A Lexington man has pleaded guilty to manslaughter in the beating death of another man.

According to the Jessamine Journal, Curtis Lee Flora, 36, entered his plea in September and was sentenced to 15 years behind bars earlier this month.

Flora is accused of beating James Dean Wallace to death in a car in Jessamine County on New Year’s Eve.

Flora was originally charged with murder, but the charge was later amended to manslaughter.

Missing Person Brenda Hall of Killeen, TX

The Killeen Police Department is investigating the report of a missing person and is asking the community and surrounding areas of the state if anyone has seen an elderly female who has not been heard from by her family since October 11.

Family members of Brenda Hall reported to officers that a neighbor last saw her on Saturday, October 12, traveling in her wheelchair eastbound in the 400 block of Church Avenue in Killeen.

Brenda Hall, 65, is approximately 5’5” tall and weighs approximately 220 pounds. She has black hair and brown eyes; wears glasses and has bi-lateral scars on each ankle. Brenda has limited use of her left side after suffering a stroke a year ago which has confined her to a wheelchair.

Detectives are asking anyone who sees Brenda Hall or knows her whereabouts to contact the Killeen Police Department at 254-200-7905 or in the event she is somewhere other than Killeen to contact the local law enforcement agency.

Missing Person Lisle, IL Teen

The Lisle Police Department is investigating a missing or endangered person case involving a 16-year-old Lisle resident.

Hannah Andrzejewski left her home in Lisle around 1:30 p.m. on Monday and has not returned home since.

She is described as having brown hair and brown eyes, is 5-foot-5 and weighs 130 pounds. She is possibly wearing a black and white striped sweatshirt, gray yoga pants and a Chicago Blackhawks baseball hat.

Hannah was last seen in the area of Lockwood and Archer avenues near Midway Airport in Chicago around 2:30 p.m. Tuesday. When last seen she was wearing the clothing described above.

Pedophile Tracking Colorado Springs Man Indicted for Toddler Porn

A 32-year-old Colorado Springs man has been indicted for the sexual exploitation of children along with child porn charges by a federal grand jury. A forensic analyst said he had one of the largest collections of toddler videos he had ever seen.

Justin Craig Smith was also indicted on the charges of Distribution and Possession of Child Pornography along with the Sexual Exploitation of Children.

According to the indictment, Smith is accused of attempting and using two minors to engage in sexually explicit conduct for the purpose of producing child porn. He is accused of doing that from July 2010 through April 2011.

Smith is also accused of knowingly distributing and attempting to distribute child porn.

Additionally, authorities said he was found to be in possession of child porn.

It was Dec. 2012 when a local law enforcement agency did a search warrant at Smith’s Colorado Springs home. This was after an investigation found that he was using a peer-to-peer system to share child porn, authorities said.

The investigation also revealed that Smith had photographed his sexual assault of a minor child that was 8 years old, authorities said. He is also accused of taking ‘lascivious’ photographs of another child, who is now 12 years old, for a period of years.

Authorities said Smith made his young victims watch the tapes of child porn.

Forensic evaluation of Smith’s computer found not only images of his sexual molestation but also one of the largest collections of toddler videos that the forensic analyst had ever seen.

Smith was arrested on molestation charges after the search warrant execution. That case is still pending, authorities said.

 “Mr. Smith engaged in the sexual assault and exploitation of two young children to produce child pornography,” said U.S. Attorney John Walsh.  “This case should send a strong message to those who sexually prey on our children that they will get caught and they will be punished.”

“Only those predators who produce child pornography really know what perverted logic they use to rationalize the horrific trauma they permanently inflict on innocent children,” said Kumar C. Kibble, special agent in charge of HSI Denver.  “However, our special agents with Homeland Security Investigations derive great satisfaction from rescuing these children from their living nightmare, and pursuing prosecution against their victimizers.”

Should Smith be convicted of sexual exploitation, he faces 15-30 years in federal prison in addition to a fine of up to $250,000 for each count. For the distribution of child porn charge, he faces 5-20 years in prison and a fine of up to $250,000. The child porn possession charge is punishable by up 10 years in prison and up to a $250,000 fine.

Insurance Fraud Colorado Woman Sentenced for Work Comp Fraud

A Colorado woman who operated a tax and insurance business received an 18-month deferred sentence and was fined $3,000 for helping a client avoid paying worker’s compensation premiums on a construction project in Montana, the state Department of Justice said.

Sandra Armstrong, 50, of Thornton, Colo., entered an Alford plea last week to felony accountability to employer misconduct. Under the plea, Armstrong acknowledges prosecutors had enough evidence to gain a conviction.

Prosecutors say Armstrong helped Mexican contractor Efrain Cruz avoid paying some worker’s compensation premiums. Prosecutors say Cruz forced a Mexican citizen who was living and working illegally in the United States to declare he was an independent contractor, who could then waive worker’s compensation coverage. Armstrong helped the worker complete his paperwork to obtain an independent contractor exemption, court records said.

Cruz did have coverage on some of his employees, the Justice Department said.

The crime was discovered when the employee fell from a second-story truss and suffered a serious head injury while building a house in Big Sky in June 2008. Armstrong and her company, All Rates Insurance & Taxes in Westminster, Colo., then submitted a claim indicating the injured man was an employee of Cruz’s and entitled to worker’s compensation benefits for medical treatment and lost wages, officials said. The claim was paid.

Cruz has since returned to Mexico.

Missing Person Body of TN Man Missing For 3 Years Found in Lake

Authorities have found the body of a Middle Tennessee man reported missing three years ago in a lake.

The Daily News Journal cited a statement from the DeKalb County Sheriff’s Office in reporting that the body of Joseph Loupe of Rutherford County was found this month in Center Hill Lake. Loupe was reported missing on Nov. 2, 2010 after renting a pontoon boat and not returning it. The boat was found with no one aboard and authorities searched at the time but did not find Loupe.

Tennessee Wildlife Resources Agency scanned the banks by boat and dragging operations by the rescue crews didn’t cease until dark.

“As soon as he went missing, we did a missing person report on him,” Ray said. “We entered him into the National Crime Information Center as missing (person) and over the last three years we did our investigation work and also checked tips we received but nothing ever came from it.”

A fisherman noticed the badly decomposed body in the lake on Oct. 11 and called authorities.

“The (state medical examiner) was able to take (X-rays) to make a positive identification,” said DeKalb County Sheriff Patrick Ray. “The autopsy revealed that Loupe was the victim of a drowning.”

He said no foul play is suspected.

Ray said in the statement that he hadn’t heard of a body surfacing after being in a lake for that long.

“We believe he either fell or jumped into the water from the pontoon boat that he had rented,” Ray said. “A fanny pack was on the body that contained Loupe’s identification, but since the remains were so badly decomposed, we couldn’t tell who he was.”

Missing Person 13 Year Old From Allegan County, Mich.

Deputies and detectives in Allegan County are looking for a missing Hamilton teen. Investigators say that she may be in the company of a 34-year-old man who she met online. Rachel Marie Baker was last seen around 11:00 p.m. Monday night. She was discovered to be missing early Tuesday morning. She is known to have been in contact with a man from California. Police say that the man had come to Michigan two weeks ago and has been in contact with Baker. Rachel’s mother found a letter left by her indicating that Rachel wished to be with this subject and it is believed they might have left the area together. Police tracked the girl with a K-9 from her bedroom window to a location across the street where is appears she may have gotten into a vehicle. Baker’s mother says that the girl has run away overnight in the past, but returned. Police are trying to locate her and 34-year-old Joseph Young Arpin. He is a white male with brown hair, 5’10” tall and weighs about 280 pounds. He is from San Jacinto, California and may be driving a 1999 Ford Mustang, burnt orange in color, and bearing expired California registration of 4GLK114. Baker is described as a 13-year-old Native American. She is about 5’4″ tall, weighs about 140 pounds and has short collar length dyed multi-color hair (pink, yellow, green and blue). She was last wearing blue pajamas, black hooded sweatshirt with Kentucky printed on front, and grey boots. Wrongful Death Prosecutors Seek Retrial for Father Accused in Baby’s Death

A prosecutor says she will retry a Hardin County father charged with killing his 1-month-old son.

An assistant commonwealth’s attorney says she will continue pursuing charges against Jarrod Davis.

His trial ended last week with a hung jury. Davis was charged with murder in the death of his infant son, Ja’vion Davis, in January.

The medical examiner discovered blunt force trauma to the baby’s head along with several other injuries.

Davis said he was burping his son when he dropped the infant.

Missing Person Dayton LaRay Hathaway of Harrison County, TX

Harrison County Sheriff’s Office is seeking information regarding the whereabouts of Dayton LaRay Hathaway, 19, who is listed as a missing person with our office. Dayton’s last known whereabouts were when his vehicle was located near his residence in the 6700 block of US Highway 80 East on Thursday. He has also not reported to his work since Thursday and his family has not had communication with him.

Dayton is described as a white male, 6’2”, 160 Lbs,  with short brown hair, brown eyes. He has a tattoo with a Chinese symbol on his chest and a tattoo on his left forearm written in German.
