Identity Theft Tampa Man Sentenced to 4 Years

A Tampa man was sentenced to four years, three months in federal prison on Thursday after pleading guilty to mail fraud and aggravated identity theft.

Nedal Faisal Ahmad, 35, must also pay $35,989, proceeds of the criminal conduct, the U.S. Attorney’s Office said in a news release.

According to court documents, through his business and other means, Ahmad negotiated U.S. Treasury checks and reloadable debit cards containing fraudulently obtained tax refunds. For instance, Ahmad “swiped” reloadable debit cards at his business, Al-Wafaa Trading, knowing that the funds on the cards were fraudulently obtained tax refunds, court documents showed. He then kept a large portion of the cards’ value as a fee for processing the illegal funds, the news release said.

Ahmad processed more than $60,000 in fraudulently obtained tax refunds through his business, the U.S. Attorney’s Office said.

Ahmad was also involved in cashing fraudulent U.S. Treasury checks, the news release said. The Treasury checks were tax refunds that were fraudulently obtained by others, court documents showed.

Beginning in October 2011, Ahmad began sending fraudulent Treasury checks via the U.S. mail and other delivery services to an individual in New York, according to court documents. Ahmad instructed the individual to pay him 60 percent of the funds from the check, while the associate could keep the remaining 40 percent, the U.S. Attorney’s Office said.

During an undercover investigation, Ahmad sent the associate nine fraudulently obtained U.S. Treasury checks, totaling over $95,000 of stolen money, the U.S. Attorney’s Office said.

Ahmad pleaded guilty March 8.

Insurance Fraud 3 NY Residents Sentenced in $1M Scheme

Three New York residents were sentenced and ordered to pay restitution for their roles in a $1 million insurance fraud scheme involving a staged auto accident.

Utica residents Joseph Demme, Joseph Dellerba and Cynthia Morgan were sentenced separately for staging a crash in March 2006 and a subsequent health care benefit scheme. Dellerba and Morgan submitted false insurance claims, including claims for personal injuries, no fault benefits and disability benefits.

Geico, Metropolitan, Mutual of Omaha and Old Republic were among the insurers that were defrauded.

Demme was sentenced to 15 months imprisonment; Dellerba received a 30 month sentence; and Cynthia Morgan was sentenced to 27 months. All three were ordered to pay $1.4 million each in restitution and will serve three years of supervision following release from prison.

Pedophile Tracking Marion County, FL Man Faces Charges

A 62-year-old man, already arrested twice for attempting to have sex with a 15-year-old boy, is facing even more charges.

On Friday, Marion County investigators arrested Kenneth Devore, charging him with five counts of lewd and lascivious battery, 11 counts of manufacturing child pornography and 11 counts of possession of child pornography.

Five of those charges are related to the original case where Devore was arrested for traveling to meet a minor for sex, interfering with child custody, solicitation of a minor for sex using an electronic device and conspiracy to commit lewd and lascivious battery.

While executing a search warrant, detectives said they found video files and images of child porn on his computer.

They also said detectives discovered Devore has other victims.

Devore remains in the Marion County Jail on $540,000.

Identity Theft Police Looking for 2 Woman in Suffolk, VA

Police are looking for two women in connection with an identity theft investigation in the City of Suffolk.

The two women were seen using a stolen credit card for purchases at various places in the City of Suffolk, according to a news release from the City of Suffolk. Surveillance video shows both women pushing toddlers in shopping carts.

Fraud Investigation Case Worker Arrested in Las Vegas

Metro detectives have arrested a case worker with Catholic Charities in connection to a fraud investigation.

Omar Driver, 41, of Las Vegas was charged with burglary, possession of a credit card without owner’s consent and two counts of fraudulent use of a credit card.

In a news release from Metro, officers responded May 7 to the 1500 block of Las Vegas Boulevard North to investigate a report of unauthorized withdrawals from a debit card containing Social Security funds. The victim frequently resides at this location and had requested the card be sent to his case worker at Catholic Charities.

When the victim called to check the balance on the card, he learned the account had been accessed the day before and funds withdrawn from the account. An investigation conducted by fraud detectives resulted in Driver’s arrest.

Catholic Charities has cooperated fully in the investigation.

Missing Person Remains Found in Michigan City Belong to Missing Wife and Mother

Authorities in northwest Indiana announced this afternoon that human remains located on the western edge of Michigan City in May belong to missing wife and mother Candi Sue Brown Morris.

Morris disappeared around 1:00 a.m., on Sunday, August 26, 2012.

The Michigan City Police Department issued the following statement a few hours ago on the department’s Facebook page:

On Friday May 3rd 2013 numerous agencies came together to investigate human remains which were located in the area of County Line Road and Chandler Road. The Michigan City Police Department, with the assistance of the LaPorte County Prosecutor’s Office, LaPorte County Coroner’s Office, the Indiana State Police, and the LaPorte County Sheriff’s Department investigated the human remains. It has been determined through DNA comparison that the human remains are that of missing person Candi Brown. Candi Brown was reported missing as of August 7th (sic) 2012 by her husband David Morris. Candi was last seen August 25th 2012 in the evening.

This investigation is still ongoing and the Michigan City Police Department is asking if anyone has information regarding this investigation please call Cpl. Jason Holaway at (219) 874-3221 Ext. #346 or the Crime Tip Hotline (219) 873-1488.

Police Chief, Mark Swistek and Mayor Ron Meer would like to express our appreciation for everyone’s help in this effort and their condolences to the family.

Despite those condolences, David Morris, Candi’s husband, is “devastated” to learn his wife has been found deceased, and remains frustrated by the lack of communication coming from authorities. In a phone interview from his home in Michigan City, an emotional Morris told The Examiner he was not notified that the remains belong to his wife, and he learned of the identification from an extended family member in a phone call.

It’s a damn shame I wasn’t told that these remains belong to my wife,” Morris said. “I should have been the first person notified on all levels; but, once again, I was told nothing.”

The “once again” Morris is referring to is the original discovery of his wife’s remains on May 3, 2013. Morris learned of that discovery when he read about it in his local newspaper.

Today’s announcement came after authorities notified Candi’s mother, who then informed the rest of her family. It was through that grapevine David Morris learned his wife had been declared deceased.

Upon learning of the positive identification, David Morris contacted the MCPD, and was reportedly told investigators had their hands full with a murder which took place yesterday, and hadn’t had a chance to notify him that his wife’s remains had been identified.

Missing Person Ohio Man Faces 329 Charges in Missing Women Case

A man accused of holding three women captive in his run-down home in Cleveland for a decade and fathering a child with one of them has been indicted on 329 charges including murder, kidnapping and rape, prosecutors said.

A Cuyahoga County grand jury returned the indictment Friday against Ariel Castro, a former school bus driver fired last fall.

Castro, 52, is accused of kidnapping Amanda Berry, Gina DeJesus and Michelle Knight and holding them captive along with a 6-year-old girl he fathered with Berry.

The grand jury charged Castro with two counts of aggravated murder related to one act, saying he purposely caused the unlawful termination of a pregnancy. Castro also was indicted on 139 counts of rape, 177 counts of kidnapping, seven counts of gross sexual imposition, three counts of felonious assault and one count of possession of criminal tools.

Castro’s attorneys have said he would plead not guilty to any indictment. Castro, during his brief arraignment last month, tried to hide his face, tucking his chin inside his shirt collar and did not speak.

Castro is being held on $8 million bail. He has been taken off suicide prevention watch, jail officials said this week.

He was arrested May 6, shortly after Berry broke through a locked door, yelled to neighbors for help and escaped with DeJesus and Knight.

Berry, 27, told officers that she was forced to give birth in a plastic pool in the house so it would be easier to clean up. Berry said she, her baby and the two other women had never been to a doctor during their captivity.

Knight, 32, said her five pregnancies ended after Castro starved her for at least two weeks and “repeatedly punched her in the stomach until she miscarried,” authorities said.

She also said Castro forced her to deliver Berry’s baby under threat of death if the baby died. Knight said that when the newborn stopped breathing, she revived her through mouth-to-mouth resuscitation.

The women had vanished separately between 2002 and 2004, when they 14, 16 and 20 years old. They haven’t spoken publicly since their ordeal.

Castro’s two brothers were arrested with him but later were cleared of involvement in the case and were released.

The Associated Press does not usually identify people who may be victims of sexual assault, but the names of the women were widely circulated by their families, friends and law enforcement authorities for years during their disappearances and after they were found.

Insurance Fraud 25 Yr Cass County, Michigan Sheriff’s Deputy Charged

A 25-year Cass County sheriff’s deputy has been charged faces felony charges for allegedly staging a car-deer crash then lying about it in a police report so a friend could collect insurance money for a new car.

Steven Thomas Keene, 48, of Dowagiac, is charged with one count each of conspiracy to commit insurance fraud, insurance fraud, tampering with evidence and obstruction of justice, Kalamazoo County Chief Assistant Prosecutor Carrie Klein said.

Klein’s office has been assigned to the case because of Keen’s status as a law enforcement officer in Cass County. Keene also works part time for the police department in Cass County’s Silver Creek Township.

The charges against Keene, which were authorized May 20 by prosecutors, stem from an investigation done by the Southwest Commercial Auto Recovery Unit, a multi-jurisdictional auto theft team.

Klein said the charges of insurance fraud and tampering with evidence stem from incidents alleged to have occurred in February and March.

“The idea was (his friend) wanted a new car, wasn’t going to get much in return if she simply sold the car she had, so the two of them worked together to stage a one-car accident and make it look as if they could get the insurance payout and go get her a new car,” Klein said of the allegations.

Keene’s Kalamazoo attorney, Mike Hills, declined to comment for this report, citing the ongoing case. “We’re at the beginning of this thing,” Hills said.

The felony complaint authorized by prosecutors in May alleges that Keene committed insurance fraud by preparing “an oral or written statement knowing or believing that it would be presented by or to an insurer or an agent of an insurer, knowing that it contained false information concerning a fact material to an insurance claim …” or by helping (his friend) to commit insurance fraud “by preparing a false State of Michigan Traffic Crash Report and/or staging a ficticious car/deer accident …”

Klein said the obstruction of justice charge stems from allegations that, in a separate incident, Keene “was aware of someone else who had committed a crime and he was involved in trying to obscure the proof to help that individual out.” The complaint charges, specifically, that Keene provided “inaccurate, incomplete, misleading information to police” about a Feb. 5 motor vehicle crash involving another driver.

Asked whether others may face charges from the investigation conducted by Michigan State Police, Cass County Prosecutor Victor Fitz said only that “other individuals are being investigated.”

Prosecutors said some of the charges against Keene stem from incidents that are alleged to have occurred while he was on duty as a police officer.

Cass County Sheriff Joseph Underwood Jr. said his understanding is the offenses alleged to have occurred while Keene was on duty occurred while he was working his part-time job with the Silver Creek Township Police Department.

“He was not on duty working for the Cass County Sheriff’s Office,” Underwood said.

Underwood said Keene was suspended without pay from the sheriff’s office March 18 after the sheriff received preliminary information from state police about their investigation. He said Keene will remain suspended without pay pending completion of an internal investigation of the allegations brought forth by MSP.

Underwood confirmed that Keene was booked into the Cass County Jail on the felony charges last week and was released on a $10,000 cash/surety bond.

Keene is scheduled to be back in Cass County District Court on June 20 for a probable-cause hearing on evidence against him.

If convicted, Keene could face up to 10 years in prison and/or a $50,000 fine for conspiracy to commit insurance fraud, the most serious charge against him.

Insurance fraud, tampering with evidence and obstruction of justice are punishable by maximum prison sentences of four to five years.

Pedophile Tracking Louisville Man Pleads Guilty to Child Porn

A Louisville man pleaded guilty in United States District Court before Magistrate Judge Dave Whalin to a six-count federal grand jury indictment charging him with violating federal child pornography laws including the possession of child pornography announced David J. Hale, United States Attorney for the Western District of Kentucky.

Philip Haering, admitted in court to using a peer to peer file sharing network to download images of child pornography between May 19, 2006 and May 3, 2011. According to the factual basis found in the plea agreement, an FBI agent utilizing the same peer-to-peer file sharing network downloaded several password protected files from Haering. During the download, the agent was able to preview one of the files, a movie, that contained child pornography.

The FBI obtained and executed a federal search warrant on August 16, 2011, for Haering’s home address. During the execution of the search warrant Haering admitted to viewing child pornography. He also admitted to downloading child pornography since 2003 and claimed to have filled a laptop, two external hard drives, and 44 thumb drives with files of child pornography.

A forensic examination revealed over 20,000 files of child pornography. The thumb drives had a total of 2,103 known files of child pornography. The one terabyte hard drive had 4,764 known files of child pornography. The 500 GB hard drive had 4,446 known files of child pornography, and both laptops had a total of 3,784 known files of child pornography. The forensic examination also revealed that Haering received child pornography on May 19, 2006; September 7, 2008; and August 15, 2011.

Haering faces a statutory mandatory minimum sentence of five years in prison. The maximum potential penalties are 110 years in prison, a fine of $1,500,000, and a period of supervised release of at least five years and could be for the remainder of his life. Sentencing is scheduled before Judge Whalin on August 29, 2013, in Louisville.

This case is being prosecuted by Assistant United States Attorney A. Spencer McKiness and is being investigated by the FBI.

Missing Person in Clearfield, CA Upgraded to Homicide

An ongoing missing person investigation has been upgraded to that of a homicide, according to Clearfield County District Attorney William A. Shaw Jr.

Ronald Bruce Ford Jr., 40, of San Diego, Calif. was reported missing by family to the Pennsylvania State Police in February after he’d failed to contact them. Ford was last seen between 11 p.m. Feb. 21 and 11 a.m. Feb. 22.

An intense investigation into the missing person report led to the state police’s recovery of human remains Monday in a wooded area located off of Rolling Stone Road in Covington Township. Although positive identification is expected in the immediate future, Ford’s family has been notified of the state police’s recovery, said Shaw.

Dr. Dennis Dirkmaat, chairman of the Department of Applied and Forensic Sciences at Mercyhurst College and his team of 30 people surveyed the scene Monday and recovered evidence. Although he declined to identify any of the items collected from the scene, Shaw said multiple search warrants were served Tuesday in Clearfield and Centre counties to seek evidence to support criminal charges.

According to Shaw, this investigation has involved several police agencies. He said those assisting in this investigation include the Pennsylvania State Police at Clearfield and Rockview and members of the Troop C Vice Unit, agents of the Attorney General’s Bureau of Narcotics and the Clearfield County Drug Task Force.

“This is most likely a specific issue event,” said Shaw. However, he encourages citizens in the Rolling Stone Road area to exercise personal judgment regarding their safety. “Many, many officers are working on this case, and I am hopeful that criminal charges will be filed in the near future.”

Shaw thanked all of the police agencies that have been assisting with the investigation.
