Wrongful Death Murder-Suicide in Pulaski County

Police in Pulaski County have identified a husband and wife who died Tuesday afternoon in a murder-suicide.

Pulaski County’s 911 Center received a report of a shooting incident at a home on Hunters Camp Road in eastern Pulaski County at about 1 p.m.. The caller reported one person had shot another and then shot himself. Upon arrival, responding units found two persons deceased inside the home

The investigation into the shooting found that Vernon Barnes, 34, and his wife, Paula Barnes, 33, were having marital problems and Paula Barnes was making plans to separate from her husband. Those plans lead to an apparent argument at the home.

After examining the crime scene and interviewing witnesses, investigators believe Vernon Barnes shot his wife once with a .22 rifle. He then turned the weapon on himself and took his own life. Both were pronounced dead at the scene by the Pulaski County Coroner’s Office.

Accident Reconstruction Pulaski County Man Charged with Murder in DUI Crash

Policed in Pulaski County on Tuesday charged a man accused in the DUI death of a Pulaski County High School senior with murder.

Jacob Ebenstein, 19, was riding his motorcycle home from work at Culver’s Monday night. At about 10:30 p.m. on Kentucky 635, sheriff’s deputies say William Wesley, Jr. was driving under the influence of alcohol and crossed the center line, colliding with the Ebenstein’s motorcycle.

Ebenstein died at UK Hospital. Wesley had originally been charged with DUI, but those charges were upgraded to murder and DUI Tuesday.

A funeral service for Ebenstein will be held Thursday at 2 p.m. at Morris and Hislope Funeral Home. He will be buried at Double Springs Cemetery.

Pedophile Tracking Macon County, NC Faces 6 Charges

A Macon County man is behind bars on child sex charges.

Christopher Lee Burk, 50, of Matlock Creek Road, was charged with six counts of first-degree sexual exploitation of a minor, according to a news release from Sheriff Robert Holland.

Burk was arrested Friday at Asheville Regional Airport. Holland said the investigation is continuing.

“Because this is an ongoing investigation I will not be releasing any other details,” Holland said. “I will ask the public to report any information regarding this investigation to my office. I am confident that my detectives will conduct a thorough investigation and present all the facts for the prosecution of this case.”

Burk is being held at the Macon County Detention Center under a $500,000 bond.

Pedophile Tracking Glencoe, AL Man Arrested on 4 Charges

Etowah County investigators have arrested a Glencoe man on four charges related to sexual abuse of a child.

Barry Todd Morgan, 52, was arrested Friday, Etowah County Sheriff Todd Entrekin announced. He is being charged with facilitating solicitation of unlawful sexual conduct with a child, traveling to meet a child for an unlawful sex act, second degree sodomy and second degree rape.

Investigators say Morgan had a sexual relationship with a 14-year-old girl in Glencoe. The department worked with the James M. Barrie Center for Children during the investigation.

“It is alarming that these types of crimes continue to happen against our youth,” Entrekin said. “I applaud our investigators for their hard work in putting abusive individuals in jail.”

Morgan is currently being held in the Etowah County Detention Center on $100,000 bond.

Pedophile Tracking Gainesville Man on Trial

Jurors in the child molestation trial of a Gainesville man heard about text message exchanges Monday between the defendant and the then-10-year-old boy he is accused of molesting.

Detective Jerrald Leak, with the Gwinnett County Police Department, took the stand Monday afternoon, reading the messages. He was the lead investigator in an August 2010 kidnapping case involving the boy and Christopher Thomas Ray, 31.

Leak testified the 10-year-old was found at Ray’s house, even as Ray was sending messages to family members that suggested he didn’t know where the boy was.

Ray is charged with more than 20 counts of child sex crimes, in addition to charges of controlled substance violations. Ray pleaded not guilty to all charges involving the alleged victims, who were brothers aged 10 and 12 at the time.

The text messages read in court were mostly between Ray and the younger boy. The text messages started in July of 2010 and contained many expressions of endearment between the defendant and boy. The 10-year-old would text pictures of kisses to Ray and called him “daddy.”

A text back on one occasion, from what Leak identified as Ray’s cellphone, said the boy didn’t have to call him “daddy,” but “it means a lot to me.”

The cellphone information from both the boy and Ray showed the two texting “ly” or “lyt,” to each other, which the detective testified meant “love you” and “love you too.”

Leak also read text messages identified as between Ray and another man. The prosecution alleges Ray was seeking to buy prescription drugs, including oxycodone, for himself and the victims. Ray also faces one count of possession of Lorazapam, a tranquilizer, with intent to distribute and one count of attempt to violate the Georgia controlled substances act.

Leak also testified that Ray had pictures of the 10-year-old on his phone when they downloaded the cellphone data. In the pictures, the 10-year-old was shown in the shower, although the photos were not explicit. There were also videos of the boy in bed fully dressed.

Psychologist Jada Tidwell, who provided treatment to the boys, testified about their behaviors after the incident.

The boys went into foster care after the August 2010 incident.

Tidwell said the younger boy was quick to get angry, fidgeted and blamed himself, symptoms often seen in sexual abuse cases. The older boy called himself stupid for allowing the incident to happen, she said.

Both victims demonstrated a need for control, and the older boy dreamed the defendant took him or others close to him.

Brett Willis, senior attorney at the public defender’s office, asked Tidwell about comments both boys made about the alleged abuse, including a statement the then-12-year-old made that he would not be able to go home if he said he had been abused. Both children said they had been abused in February 2011, but denied molestation before then. Tidwell said the younger boy felt that when he said he had been abused, he would not be able to go home. The 10-year-old made the admission by accident, she said. He also said he didn’t remember some of the details.

“He said ‘Chris is going to go (to jail) for a long time due to kidnapping and abuse,’” Tidwell said. “I said ‘What abuse?’”

Willis asked the therapist if it made sense to her that the older boy laughed when he admitted he had been abused. She said the boy suffered from severe anxiety and that can cause nervous laughter.

Prosecutors objected several times, saying the defense was trying to get testimony from the psychologist that included what people other than the children had told her.

The defense made a motion for a mistrial, on the basis, Willis said, that Tidwell opined about the truth of the victims’ statements. The motion was denied by presiding Judge Bonnie Oliver.

Testimony continues today.

Missing Person Google’s Person Finder Helps Track Loved Ones

Hours after two blasts went off near the finish line of the Boston Marathon, Google updated its Person Finder tool to help those searching for friends and family members who may have been at the scene. Google’s nonprofit arm Google.org launched the tool after the January 2010 Haiti earthquake. (The American Red Cross has a similar tool on its site.)

Below is a walk-through of how the tool works for anyone who is looking for a missing person or seeking a way to post information about themselves or someone they have found. Given the delicate nature of the situation, we’ve used Foursquare co-founder and CEO Dennis Crowley as an example. Crowley ran in today’s marathon and confirmed on Twitter that he is safe.

Pedophile Tracking Lexington Man Arrested for Child Porn

A Lexington man faces charges relating to child pornography.

Police searched an apartment on Lindenhurst Drive on Monday. According to court documents, Brian Buckles, 36, admitted to downloading and distributing child pornography.

Police arrested Buckles and charged him with distribution and possession of matter portraying sexual performance by a minor.

Identity Theft South FL Reps File Bills to Crackdown

It’s no secret that South Florida is a hot bed for identity theft, but many people don’t realize that the state also leads the nation when it comes to federal tax return identity theft.

So on Tax Day, April 15th, several congressional representatives met with tax payers, and voters, talk about what they’re doing to combat the problem.
U.S. Representatives Joe Garcia (D, FL) announced at his Miami office that he and and Trey Radel (R, FL) planned to introduce a bipartisan bill which would make it more difficult for identity thieves. The SAFE ID Act would amend the Internal Revenue Code. Instead of an employee’s full social security number on their W-2 form, the IRS would require the use a truncated social security number as the taxpayer’s identification number.

Under present law, employers must include an employee’s complete social security number on mailed W-2 forms.

Garcia said the IRS has already done a trial run of the program.

“We are trying to do small things and one of those small things is taking off the Social Security number from people’s tax returns. It leads to massive fraud and it’s required by law,” said Garcia. “The IRS did a test pilot program in the last few years and it was tremendously successful in reducing fraud. So today on Tax Day, when everybody is thinking about taxes, we wanted to make sure that we introduce this.”

In Ft. Lauderdale, U.S. Representative Debbie Wasserman Schultz met with taxpayers at a Volunteer Income Tax Assistance site to talk about a bill she’s filed to combat identity theft. Her bill, the Stopping Tax Offenders and Prosecuting Identity Theft Act (STOP Identity Theft Act), would strengthen penalties for identity thieves, as well as expand the definition of an identity theft victim to include not only individuals, but also businesses and organizations that have had their identities stolen for phishing schemes in an attempt to get sensitive information from consumers.

At the same time, her bill also stresses the need for the Department of Justice to concentrate on areas of the country where the crimes are happening in significant numbers – like in South Florida.

In 2011 alone, a Treasury Department’s inspector general for tax administration report found that the Internal Revenue Service found 938,664 tax returns involving identity theft and $6.5 billion in fraudulent refunds

Wrongful Death 3 Killed and 130+ Injured in Boston Marathon Bombing

The deadly bombing at the Boston Marathon that killed at least three and injured more than 130 is believed to be an act of terrorism, senior White House officials told Fox News.

Two explosions tore through the finish line of the world-famous race just before 3 p.m., going off simultaneously as throngs of onlookers watched runners complete the 26.2-mile trek. The timing of the blasts immediately sparked suspicions of a deliberate act.

“When multiple devices go off, that’s an act of terrorism,” a senior administration official told Fox News, just moments after President Obama delivered a statement to the nation and did not use the word “terror.”

The official stressed that it was unclear whether a foreign entity like Al Qaeda was behind it or whether it was home-grown terrorism, prompting the president’s caution in characterizing the bombing.

A first responder source confirms to Fox News that five total explosive devices were found in the Boston area, including the two that exploded. Authorities spent the next several hours sweeping the area for additional devices.

The Associated Press reported early Tuesday police are searching an apartment in the nearby Boston suburb of Revere as part of the investigation into the explosions. Massachusetts State Police confirmed that a search warrant was served Monday night but provided no further details.

Authorities are guarding a person of interest at a local hospital, according to a New York Post report confirmed by Fox News.

The person, who sources said was 20 years old, had severe burns, but authorities had not determined whether the person was a victim or a perpetrator. Sources say the person of interest is reportedly a Saudi national in the United States on a student visa.

“There is no suspect,” said Boston Police Commissioner Edward Davis. “There are people we’re talking to.”

Davis said at an evening press conference the bombing killed “at least three,” and multiple reports said one of the dead was an eight-year-old child.

A first responder source tells Fox News all of the victims were either bystanders or marathon runners, and that two of the deceased were adults.

In addition to the deaths, more than 130 people were injured – including up to 10 with amputated limbs. Boston Police Commissioner Edward Davis said during a press conference that no suspect is in custody. The first two explosions occurred at 2:50 p.m. – nearly five hours after the marathon began – about 50 to 100 yards apart, according to Davis. A third explosion occurred near the John F. Kennedy Presidential Library and Museum in the Columbia Point section of Dorchester, several miles southeast of the marathon’s finish line, at around 4:15 p.m. Police could not say if it was related to the earlier explosions.

The horror unfolded as the city marked the 238th annual Patriot’s Day, commemorating the anniversary of the Battles of Lexington and Concord at the beginning of the Revolutionary War. Competitors and race organizers were crying as they fled the bloody chaos, while some witnesses reported seeing victims with lost limbs.

“Somebody’s leg flew by my head,” a spectator, who gave his name as John Ross, told the Boston Herald. “I gave my belt to stop the blood.”

At Massachusetts General Hospital, Alisdair Conn, chief of emergency services, said: “This is something I’ve never seen in my 25 years here … this amount of carnage in the civilian population. This is what we expect from war.”

The FBI, which was treating the bombing as a terrorist investigation, was analyzing video from several area surveillance cameras.

Twenty-six people were transported to Brigham and Women’s Hospital, including a 3-year-old, who was then taken to a children’s hospital. A doctor at the hospital said at least two of the patients there are in critical condition and that some have burns and injuries that will likely require amputations.

“They just started bringing people in with no limbs,” said runner Tim Davey of Richmond, Va. He said he and his wife, Lisa, tried to shield their children’s eyes from the gruesome scene inside a medical tent that had been set up to care for fatigued runners, but “they saw a lot.”

“They just kept filling up with more and more casualties,” Lisa Davey said. “Most everybody was conscious. They were very dazed.”

Witnesses heard booms that sounded like two claps of thunder near the finish line inside the Fairmount Copley Plaza Hotel, according to multiple local reports. Video of the scene showed a number of emergency crews in the area tending to victims and blood on the ground near the finish line.

“I saw two explosions. The first one was beyond the finish line. I heard a loud bang and I saw smoke rising,” Boston Herald reporter Chris Cassidy, who was running in the marathon, told the newspaper. “I kept running and I heard behind me a loud bang. It looked like it was in a trash can or something…There are people who have been hit with debris, people with bloody foreheads.”

“There are a lot of people down,” said one man, whose bib No. 17528 identified him as Frank Deruyter of North Carolina. He was not injured, but marathon workers were carrying one woman, who did not appear to be a runner, to the medical area as blood gushed from her leg. A Boston police officer was wheeled from the course with a leg injury that was bleeding.

About three hours after the winners crossed the line, there was a loud explosion on the north side of Boylston Street, just before the photo bridge that marks the finish line. Another thunderous explosion could be heard a few seconds later.

Runner Laura McLean of Toronto said she heard two explosions outside the medical tent.

“There are people who are really, really bloody,” McLean said. “They were pulling them into the medical tent.”

Cherie Falgoust was waiting for her husband, who was running the race. “I was expecting my husband any minute,” she said. “I don’t know what this building is … it just blew. Just a big bomb, a loud boom, and then glass everywhere. Something hit my head. I don’t know what it was. I just ducked.”

While the White House does in fact believe terrorism was at play, lawmakers were increasingly reaching the same conclusion.

Sen. Dianne Feinstein, D-Calif., chairwoman of the Senate Intelligence Committee, reportedly said her understanding it “that it’s a terrorist incident.”

Sen. Saxby Chambliss, R-Ga., top Republican on that committee, also said that “as the evidence mounts that this was a terrorist attack, our intelligence and law enforcement agencies must do whatever is necessary to find and interrogate those responsible so we can prevent similar attacks.”

Authorities in New York, meanwhile, are deploying counter-terrorism vehicles around landmark sites in Manhattan, including prominent hotels, according to the New York City Police Department.

Nearly 25,000 people, including runners from around the world, competed in Boston’s celebrated 26.2-mile race, attracting huge throngs of onlookers, especially near the finish line.

“This is a horrific day in Boston,” Massachusetts Gov. Deval Patrick said in a statement. “My thoughts and prayers are with those who have been injured. I have been in touch with the President, Mayor [Thomas] Menino and our public safety leaders. Our focus is on making sure that the area around Copley Square is safe and secured. I am asking everyone to stay away from Copley Square and let the first responders do their jobs.”

Wrongful Death Missing North LIttle Rock Teen’s Body Found

Authorities have identified the body found in a field in North Little Rock Friday.

North Little Rock police says the body found in a field at Saunders Drive and Campbell Road is that of 15-year-old Austin Addie. Police say he died of at least one gunshot wound.

Addie was reported missing April 7 to the North Little Rock Police Dept. and entered into a state-wide system as missing.

Addie’s body was found Friday afternoon by someone riding a 4-wheeler in the field.
