Insurance Fraud NH Resident Sentenced to Prison

The New Hampshire Insurance Department announced that a Nashua, N.H., resident pleaded guilty in Hillsborough County Superior Court on Oct. 9 to two charges of felony insurance fraud and one felony charge of bail jumping, stemming from a fraudulent insurance claim he had filed with Travelers Insurance Co.

The department announced that in September 2012, after the roof of his home was damaged by high winds, Mark Kelley sought reimbursement from Travelers Insurance Co. by submitting two receipts that he claimed showed he had paid a local contractor for repairs.

Subsequent investigation by Travelers, and later by a senior investigator at the New Hampshire Insurance Department, revealed that Kelley had not made any such payments to the contractor and that many of the alleged repairs had not been completed.

After being indicted in October 2013 for insurance fraud, Kelley failed to appear at a scheduled hearing in February 2014, and he was arrested in May 2014. He was sentenced to two concurrent 12-month prison sentences on the insurance fraud charges, with six months of each sentence suspended on good behavior for two years. Kelley also was sentenced to one and a half to three years for failing to appear in court, with the entire sentence
suspended on good behavior for two years.

“Insurance fraud is a crime that affects not just the insurance companies but New Hampshire residents, who end up paying higher premiums,” said NH Insurance Commissioner Roger Sevigny. “I am very proud of our Fraud Investigation Unit, which works tirelessly to protect consumers by prosecuting those who break the law.”
