Wrongful Death Man Accused in Death of Scott Co. Bus Driver Tries to Get Case Tossed

The man accused in the murder of a Scott County bus driver is trying to get his case tossed because he claims he won’t be able to get a fair trial.

Nick Willinger is accused in the beating death of Sue Jones back in 2010. Willinger says that state police lost critical evidence in the case. Willinger’s attorney asked retired KSP Detective Buck Brennan lots of specific questions about the case, such as who he talked to the day of the murder.

Willinger’s attorney is trying to prove that because two of the detective’s notebooks are missing, key evidence in the case has been lost.

The main evidence comes from Willinger’s alleged accomplice Ciji Jefferson, who pleaded guilty to complicity to commit burglary in the case in exchange for her testimony against him at trial.

The defense says Brennan lost notes on Jefferson  when she did not implicate Willinger in the murder. Prosecutors say they believe the case will go to trial.
