Drug Dog Sweep Second Suspect Arrested in Waco FedEx Drug Delivery

A second suspect in a FedEx drug delivery was arrested Monday, about nine months after he and his co-defendant are accused of picking up a package with more than 10 pounds of marijuana and 655 grams of promethazine from a FedEx location in Waco, arrest affidavits state.

Omar Foster, 32, was arrested Monday on a third-degree felony charge of unlawful possession of a firearm by a felon, a second-degree felony charge of possession of a controlled substance and a third-degree felony charge of possession of marijuana. Police said Foster and Jeremy Tate, then 25, picked up a drug package in late June 2016.

An employee at the FedEx location at 6601 Imperial Drive reported the odor of marijuana coming from an improperly sealed package June 25, according to an arrest affidavit.

Waco police responded with a drug dog, which indicated the odor of narcotics in the package, the affidavit states.

Police waited for the package to be picked up, and Foster drove to the FedEx store with Tate, who picked up the package and put it in the car, according to the affidavit.

Both Foster and Tate were detained while police and searched with vehicle. Officers found a stolen gun in the car but did not arrest Foster and Tate at FedEx as they later executed a search warrant on the package, according to the affidavit.

Officers found 10.8 pounds of marijuana and 655 grams of promethazine, the arrest affidavit states. Promethazine is a strong sedative.

Police arrested Tate in August. He posted $15,000 bond and was released from jail Aug. 18.

Foster was arrested Monday and remained in McLennan County Jail on Tuesday evening. Completed bond information was not immediately available.
