Drug Dog Sweep US Supreme Court Limits Warrantless Use

The Supreme Court of the United States ruled last week 5 to 4 to limit law enforcement’s use of drug sniffing dogs in situations where police did not possess probable cause or a warrant. The ruling upheld a Florida Supreme Court decision finding that police violated the Fourth Amendment of the US Constitution when they allowed a drug identification dog to sniff around the front door of a private home absent a search warrant specifically authorizing them to do so.

Writing for the majority, Justice Antonin Scalia opined: “The police cannot, without a warrant based on probable cause, hang around on the lawn or in the side garden, trawling for evidence and perhaps peering into the windows of the home. And the officers here had all four of their feet and all four of their companion’s, planted firmly on that curtilage – the front porch is the classic example of an area intimately associated with the life of the home.”

Justices Clarence Thomas, Ruth Bader Ginsburg, Sonia Sotomayor and Elena Kagan joined in the opinion.

Writing for the minority, Justice Samuel Alito opined that law enforcement’s use of the dog “did not constitute a trespass and did not violate respondent’s reasonable expectations of privacy.”

The case is Florida v. Jardines.

The Supreme Court in 2005 had previously ruled (Illinois v. Caballes) that an alert from a police dog during a traffic stop provides a constitutional basis for law enforcement to search the interior of the vehicle.

According to a 2011 study published in the scientific journal Animal Recognition, the performance of drug-sniffing dogs is significantly influenced by whether or not their handlers believe illicit substances are present. International statistics indicate that drug dogs are prone to false alerts, with data indicating an 80 percent failure rate in some cases.

Private Detective Meade County Man Arrested After Shooting Ex-Wife

A woman was shot Friday and now her ex-husband is behind bars.

The shooting happened on Rabbit Run Road in Meade County, near Fort Knox.

Kentucky State Police say Jackie Cook shot his estranged wife, Magdelena Cook, at her home.

Police say Magdelena ran next door to her neighbor’s house for help. The neighbor says she’s thankful she was there.

“He kept shooting at her, She made it to my door and I got her in the door, got her lay down on the ground. Then he came over here trying to get back to her. I told him I wasn’t letting him in the house with a gun because my kids were in there,” remembers the neighbor, who did not want to be identified.

The neighbor also says Magdelena was shot in the legs and was alert when emergency crews took her to the hospital.

Jackie Cook surrendered to police after a brief stand off and was then arrested.

Missing Person Kyle Konkler of Woodbury, MN

White Bear Lake police need your help finding an 18-year-old Woodbury, Minn. man who is on the autism spectrum, but described as high-functioning.

Kyle Konkler left work at the White Bear Lake Police Department early Thursday afternoon and never returned home. Police are concerned he may get himself into potentially dangerous situations.

Konkler may falsely believe he is in trouble, but police and his family are only concerned with his safe return.

Konkler is known as a “smooth talker” and may convince strangers for help. He knows few people in the area and is poor with directions and likely won’t know how to get around.

Konkler was last seen wearing blue jeans, a navy blue t-shirt with a WBLFP Supporters

logo. He is 6 feet tall, 215 pounds with brown hair and hazel eyes.

Missing Person Abducted 3 wk old Baby Found in Lakeside, CA

The search for an abducted 3-week-old baby came to and end at 7:50 p.m., on Friday when a San Diego Border Patrol agent with the Border Patrol Search, Trauma and Rescue (BORSTAR) located the baby with a K-9, confirms the sheriff’s officials. They were located in dense brush west of state Route 67, south of Lakeside Drive and north of Channel Road.

Debra Fowler, 46, took 3-week-old Anissa Von Goerlitz from her Spring Valley home where she lived with her grandmother, reported CBS 8 news.

The vehicle that Fowler was driving was later found in the 1000 block of Vine Street in Lakeside. Authorities concentrated their search to that area at the end of the street which is a dead end. The area includes part of the San Diego River bed and has Highway 67 on one side and a horse ranch to the north.

The authorities spent most of the day and into the night searching for the baby and the Missing Person Examiner joined the search around 6 p.m.

The area is known to be the home of several homeless camps. The thick trees and shrubbery make it a perfect place to hide.

The Sheriff’s Dept. was alerted to where several homeless encampments were located and where Fowler may have gone to hide by Dawson Dean, who is knowledgeable of the area.

“I told the Sheriff’s Deputies and BORSTAR about several camps around the area and pointed out several trails that may have been used by the suspect,” said Dean. “The Sheriff’s Deputies immediately acted on the information.”

During the search for the baby, two new stuffed animals with tags still on them were found off of the trail by the Examiner, and the authorities were notified. It is unknown if those stuffed animals belonged to the baby or not.

A Search and Rescue team, the Border Patrol and the Sheriff’s Dept. joined together to search until just before 8 p.m. when the baby and Fowler were found.

The baby is fine and is being evaluated by paramedics. She will be taken to a hospital for checkup.

Identity Theft Lafayette, LA Woman Charged

A Lafayette woman is charged with four counts of identity theft after police say she stole over $4,000 from another person’s bank account. Police say Yvonne Trahan took the funds between January and March, but they did not specify how Trahan was able to access the account. Trahan is also charged with unauthorized use of an access card.

Identity Theft San Bernardino Woman Wanted

One of two San Bernardino women who police say tried to go on a spending spree with stolen identities was captured Thursday, April 4, when she returned to a Riverside County car dealership to complete a purchase.

Monique Desiree Martinez, 27, of San Bernardino, was arrested by San Bernardino police. Norra Bannatt Mokhtar, 31, of San Bernardino, remained at large Thursday. They are suspected of stealing hundreds of people’s identities. Martinez is accused of using those IDs to buy expensive vehicles.

The shopping started on Feb. 8 at a Riverside County Mercedes dealership, Sgt. Travis Walker said.

Martinez, accompanied by Mokhtar, financed a $40,000 Mercedes Benz with a stolen identity. They also opened lines of credit at numerous local businesses, according to the sergeant.

Their spree appeared to have ended when police arrested Martinez at a San Bernardino dealership trying to buy a $20,000 motorcycle with a stolen identity, Walker said. Witnesses reported that Mokhtar was with her, but she was not arrested.

But Martinez posted bail, and a week later on Feb. 19, she bought a $39,000 pickup truck at a dealership in Fontana with a stolen identity, according to Walker.

On Thursday, an employee of the undisclosed Riverside County dealership told police that he recognized Martinez from the photo distributed to the media when Martinez entered the business Wednesday, Walker said. When Martinez returned Thursday to complete the purchase, police were waiting for her.

“This one’s a little different than usual identity theft (cases),” Walker said, saying the suspects are more brazen than most. “We arrest (Martinez) on Friday, and the following Friday she’s back out trying to buy a new car.”

Police caught Mokhtar in the stolen Mercedes Benz on March 12 and arrested her, according to Walker. She posted bail a short time later.

Police served a search warrant on the women’s residences and found “evidence of identity theft, tax fraud, methamphetamine and equipment used to make fraudulent credit cards,” according to a San Bernardino Police Department news release.

Arson Investigation Osceola County, Mich. Woman Charged

An Osceola County woman is charged with attempting to burn down her own home to collect the insurance money.

The investigation began in May 2008 when Marion Fire Department responded to a house fire in Middle Branch Township. The fire chief contacted the Osceola County Sheriff Department and the Michigan State Police Fire Marshal Division. Investigators have now determined the fire is a case of arson.

Terry Lynn Leach, 59, of Marion was arrested at her home on April 2. She was arraigned in the 77th District Court on multiple charges including arson and insurance fraud.

A 46-year-old man was also taken into custody in connection with the case. He was arrested in Dekalb County Georgia and will be sent back to Michigan.

If convicted, both individuals face up to 20 years in prison.

Identity Theft Patients of Florida Medical Clinic Possible Victims

The University of Florida has notified almost 15,000 patients of a medical clinic that they may have fallen victim to identity theft.

Letters were sent Tuesday to 14,339 patients of UF & Shands Family Medicine at Main following the arrest of a man who once worked at the clinic.

The Gainesville Sun (http://bit.ly/12kBv0m ) reports 25-year-old Arthur Thomas was arrested Tuesday following an investigation that began in October.

A Jacksonville Sheriff’s Office reports says Thomas was stopped for speeding and officers found a duffel bag with about 1,600 personal identities on a computer-generated appointment information sheet. Officials allege that he acquired insurance information from patients and may have shared it with a third party.

The university says patients at the practice between March 2009 and October 2012 may be a victim.

Missing Person Martrellis Deon Autry of Fayetteville, NC

Authorities are looking for a Fayetteville man they believe may be in the Greenville area.

The Fayetteville Police Department is asking area residents to help locate Martrellis Deon Autry, 20.

A news release stated Autry, who goes by Trey, was last seen on Jan. 3 at 1026 Tyler Drive in Fayetteville by his mother. At the time, he was leaving to come to Greenville.

On Jan. 26, Autry told his mother on the phone he was in the Greenville area, but she has not been able to make contact with him since then. His mother filed a missing person report with Fayetteville police.

Autry is 5-foot 9-inches to 5-foot 11-inches tall and weighs between 145 pounds and 155 pounds.

He was last seen wearing blue jeans, a casual shirt, a black jacket and size 10 sneakers.

He is described as a muscular, dark-skinned man with black hair and brown eyes. He also has a scar on his chin.

Wrongful Death Scott County Man Gets 45 Years in Parent’s Death

A Scott County man was sentenced Friday afternoon to 45 years in prison for the 2007 killing of his parents.

The jury in the case had recommended Anthony Gray serve 45 years behind bars. That includes 20 years in the death of Vivian Gray, 20 years in the death of James Gray and 5 years for tampering with evidence. The jury recommended Gray serve that time consecutively, and become eligible for parole in 20 years.

Police say Gray gunned down his parents in their Scott County home to collect insurance money back in 2007.

This was Gray’s second trial in the case. In the first trial, a judge declared a mistrial in January of 2012 after the jury failed to reach a verdict.

Gray took the stand in his own defense in the latest trial, and testified that police tricked him into confessing to the murders of his parents. He said police made him believe they had evidence linking him to the shootings. Gray claimed after five and a half hours of interrogation, a Scott County detective gave him no choice but to confess to the crime he says he didn’t commit.
