Fraud Investigation Car Sales Fraud in Rock Hill, SC

Since the story broke on the arrests at a local used car dealer, Rock Hill police said Thursday that the phones are ringing all day with calls from past customers of Big A’s Auto Sales.

The Cherry Road car dealer is shut down. Its managers and several employees were arrested in what police called a far-reaching fraud investigation.

Police say Big A’s was selling cars that had liens on them, and the buyers didn’t even know it.

Here’s how police said it worked. Big A’s managers, Bernard and Mia Gaston, ran the day-to-day operation of the dealership. Police said family members and friends would take out title loans on some cars and give the loan money to the Gastons. Then Big A’s would sell the cars to unsuspecting customers, never giving them the title because the title loan companies had it.

Bernard and Mia Gaston face numerous charges, including disposal of a property under lien and permitting the misuse of a certificate of title.

Police said they could’ve made roughly $500,000 over a period of several years, largely through title loan applications on cars they had already sold.

When those title loans went into default, repo companies were called to find the cars and repossess them. The problem is — the people who were driving the cars were not the ones who defaulted on the loans.

“It’s frustrating. It hurts everyone involved” said Brent Hulderman, a repo man from Charlotte looking for at least four of the cars sold at Big A’s Auto Sales.

Hulderman said he’s spent days searching for the cars, but since the innocent customer driving the car doesn’t even know there’s a lien, it makes it tough.

“These cars are registered to the people involved in this fraud ring, but then resold to random people who are out driving those cars, and there’s no way to find out who those people are,” he said.

On Thursday, Eyewitness News spoke to Anthony Neely, owner of Big A’s Auto Sales. Neely was also charged in the case, but said he didn’t run the business, has another full-time job and has nothing to do with what happened.

“I never even knew what a title loan really was until all this stuff came out,” Neely said. “I don’t want to be known as a fraud or defrauding anybody out of anything. To me, my reputation is everything.”

Neely admitted he knew about past charges related to other car lots against the Gastons when he went into business with the Gastons. He called Bernard Gaston a long-time friend who deserved another chance.

On Wednesday, Channel 9 spoke to Bernard Gaston. He said he did nothing wrong and called the accusations against him “lies.”

“Nobody lost any money and nobody lost a car. I want my side of the story to come out. The truth,” he said.
Gaston said he was eager to explain everything when his lawyer gave him permission to talk about it.

During the 10-month investigation, the Department of Motor Vehicles and South Carolina Law Enforcement Division were also involved. They served 45 arrest warrants on a dozen different people involved with Big A’s. Many of them were friends and family members of the Gastons. Two more of them turned themselves in on Thursday.

Channel 9 also learned that both Bernard and Mia Gaston were arrested in February of 2012 in Charlotte. They were charged with multiple counts of altering car titles and selling cars without a license. Several of the charges were dismissed, and both took a plea deal and were given probation.

Identity Theft Philadelphia Ringleader Gets 12 Year Prison Sentence

Lawrence Fudge, 47, of Philadelphia, was sentenced today to 144 months in prison for running a fraud and identity theft ring in Philadelphia for at least six years. Fudge pleaded guilty in December 2012 to conspiracy, six counts of bank fraud, eight counts of access device fraud, and 18 counts of aggravated identity theft. Through the course of the scheme, Fudge recruited bank employees and an insurance company employee to abuse the trust placed in them by their employers and pass on to him the bank account and personal information of dozens of victims. He insulated himself from the actual fraudulent transactions by recruiting others to find sources of victim information and by finding “check runners” to conduct the fraudulent transactions at the banks, to open the fraudulent retail store credit accounts, and to make the purchases at the retail stores with those fraudulently opened accounts. With others, he traveled within and outside Pennsylvania to run his fraud and identity theft scheme. In addition, Fudge admitted that he committed additional crimes of the same nature between September 1, 2011 and November 14, 2012, while he was on pretrial release on this case.

Found in Fudge’s red Toyota truck at the time of his initial arrest, on August 30, 2011, were a number of documents and other items, including driver’s licenses and documents with personal and bank account information in the names of individuals who had not previously been identified by law enforcement as victims. The intended amount of fraud and attempted fraud that is attributed to the illegal activities of Lawrence Fudge and his ring—from conducting fraudulent transactions against victims’ bank accounts and opening retail store credit accounts in victims’ names and then making purchases with those accounts—is more than $357,030.

Examples of Fudge’s fraud include: in August 2011, accounts at Home Depot, Lowe’s, and Target were opened using the identity of victim C.S. More than $8,000 in purchases were made with those fraudulent accounts and more than $1,500 was fraudulently withdrawn from her Bank of America bank account. In that same timeframe, accounts at Lowe’s, Target, and Sam’s Club were opened using the identity of victim M.W. with more than $15,000 in purchases made with those fraudulent accounts, and additional accounts at Best Buy and Staples attempted to be opened. Also in that same time frame, accounts at Home Depot, Lowe’s, Best Buy, and Target were opened using the identity of victim P.V. with more than $10,000 in purchases made with those fraudulent accounts.

Several of the victims have detailed the emotional distress and negative impact these crimes had on their lives. They describe their fear, their feelings of violation, and the lack of safety they now feel and, indeed, may always feel. One victim, who is a widow, described how the theft of the identity of her deceased husband left her “shaken to the core,” with the realization that her husband’s insurance policy, meant to protect his family, was the means of the theft of his identity and her security.

In addition to the prison term, U.S. District Court Judge Lawrence F. Stengel ordered restitution of $311,878, a special assessment of $3,300, and 10 years of supervised release.

The case was investigated by United States Postal Inspection Service and Federal Bureau of Investigation, with the assistance of multiple local police departments. It was prosecuted by Assistant United States Attorney K.T. Newton.

Private Investigator Montgomery County High Graduate Missing Class Ring

A class ring was found in a store in Vietnam, but who does it belong to? Some people in Montgomery County think it may belong to an alum of the high school.

“If the ring could talk, what would it know? What has it seen? Where has it been?” wonders Donna McGuire with Montgomery County Schools.

If you’ve ever doubted it’s a small world after all, a class ring’s story might change your mind. An international businessman working in Vietnam found a 1970 class ring with a red stone in a display case at a Vietnamese grocery store. He bought it because it piqued his interest. He’s from Montgomery County, Maryland. Later, he realized it was probably from the other side of the mountains. It has the word “Indians” engraved on it, and that is the mascot for Montgomery County High School.

“This ring has our school colors, and it has an Indian on it, and we have not found another Montgomery County Indians as of yet,” says McGuire.

McGuire is pretty sure the ring belongs to a Kentuckian, but who? The businessman mailed the ring to the school, and a posting was put on facebook about it, but so far no one has claimed it. It’s silver, with a shield, and a red stone, which indicates maybe the owner is from Camargo, because Camargo used to have a seperate high school, which featured a red stone in their class ring.

“It’s a neat story to think a ring was found in Vietnam and made its way back to Montgomery County.”

A journey that perhaps has only just begun.

Identity Theft Portland, OR Man Found Guilty on 94 Counts

A man has been found guilty on 94 counts related to identity theft.

Officer Barbara Glass, an identity theft investigator with the Portland Police Bureau, said the verdict was handed down Wednesday afternoon.

Thomas Berndt Jr. was arrested in February 2012 at a home in the 900 block of Northeast 117th Avenue.

Officers from the Neighborhood Response Team served a search warrant after learning Berndt was responsible for breaking into gym lockers in January of that year.

Glass said Berndt would break into health clubs throughout Portland and Milwaukie. He would steal credit cards to make fraudulent purchases.

He will be sentenced on May 17, 2013.

Drug Dog Sweep Leads to Arrest of North Haven, CT Man

A joint investigation into narcotic activities by both the North Haven and Wallingford Police Departments led to the issuance of a search and seizure warrant for a residence on Turner Drive in North Haven.

The warrant was executed by both departments, with assistance from North Haven PD narcotic detection K9 “Koda”.

The search led to the seizure of 2.8 ounces of Cocaine, over 250 prescription pills, $4000.00 cash and an automobile.

Thirty-seven-year-old James Plano Jr. was arrested on scene and was charged with Illegal Possession of Narcotics, Possession with Intent to Sell Narcotics, Illegal Possession of Prescription Drugs, Possession of Prescription Drugs with Intent to Sell, Possession of Drug Paraphernalia, Failing to Keep Drugs in Original Container, Possession with Intent to Sell within 1500 feet of a School (2 cts.).

Plano was held on a $100,000 bond and was later arraigned in Meriden Superior Court (GA 7) on 03/12/2013.

Wrongful Death Letcher County Husband Charged in Wife’s Death

The husband of a woman found dead along the side of a road in Letcher County early Thursday morning has been arrested.

Officials say Connie Elswick, 35, was found dead along Cram Creek Road in Mayking around 3:30 a.m. Letcher County police said that her husband, Roger Elswick, has been arrested and charged with first-degree wanton endangerment in the case.

LEX 18 has obtained an arrest citation which says Roger Elswick’s husband told state police that he and his wife got into a fight and he left heir home in his vehicle. The document says Connie Elswick held onto the trunk of his vehicle and he kept driving. At some point, he says his wife fell off onto Cram Creek, where she was found dead.

An autopsy is scheduled for Thursday in Frankfort.

Wrongful Death 4 Killed in Upstate New York

Four people have been shot dead after a gunman in Upstate New York went on a shooting spree Wednesday morning. Police remained in a standoff with the suspect into the evening.

Police believe 64-year-old Kurt Myers of Mohawk, NY opened fire Wednesday near a car wash in Herkimer County, New York, halfway between Syracuse and Albany. Two people were shot dead on the scene, and two others were fatally wounded nearby at a local barbershop, State Police press liaison Jack Keller told the Little Falls Times.

Authorities say six people were shot in all, with four succumbing to their wounds as of 11:18 a.m. Wednesday morning. Police were still searching for their suspect into the afternoon, but the latest reports courtesy of a local newspaper suggest the authorities may have narrowed in on a possible culprit.

Harry Montgomery, 68, and Michael Rancier, 57, were killed at the barbershop, police said, while Thomas Stefka, who was described as “in his 60s” by local press, and Michael Renshaw, who was “in his 40s,” were killed at the car wash.

Local officials warn that Myers should be considered “armed and extremely dangerous,” though he is not suspected to have taken any hostages.

As officials were preparing for a press conference at around 1:30 Wednesday afternoon, eight shots were reportedly fired in the area where police had been searching for Myers earlier in the day. Police are now investigating that incident as well.

The Utica Observer-Dispatch reports that SWAT teams and a police helicopter had surrounded a jewelry store in downtown Herkimer, NY, but could not confirm whether Myers was inside. The paper added that Mohawk officials believed at that time that the suspect may have been on foot, with other reports citing the possibility that he had been picked up by a taxi.

Ilion, NY resident Jason Ackler, 39, tells the Utica OD that he thinks the suspect is “trying to prove a point.” Ackler’s friend was among the six shot Wednesday morning, and his condition is unknown. He says, however, that he thinks the suspect began the shooting spree with clear intention as to what he wanted to accomplish.

“It definitely seems like he knew what he was doing,” adds Ackler.

Speaking to the Associated Press, the Herkimer Village Police would only say that there was a shooting and a manhunt, and would not offer any further official comment. Area schools including Herkimer County Community College were placed on lockdown following the incident.

Police also believe the suspect may have been responsible for an apartment building fire that was reported to authorities in Mohawk, NY at around 9:45 a.m. The Utica Observer-Dispatch reports that the fire was extinguished by around 11 a.m., and law enforcement authorities were able to remove “about half a dozen long guns” from the residence. The Utica OD says preliminary reports suggest the suspect responsible for the four deaths resided in that unit.

The suspect has been described in early reports as a 50- to 60-year-old white male last seen wearing a flannel shirt.

Private Detective Louisville Man Arrested After Licking Woman’s Neck

A Louisville man was arrested for allegedly frightening a woman and other nearby people when he screamed “I am not a pedophile, I am a rapist” and inappropriately touched that woman.

According to police, Terrance Roach made those remarks at the Save-A-Lot on Portland Avenue in Louisville Tuesday evening. Police say he then followed a woman to a nearby liquor store and licked her on her neck before running from the scene.

The victim called police after Roach left the store and was able to give a detailed description of the man, which led to his arrest.

Roach is charged with Harassment and Disorderly Conduct.

Wrongful Death One Killed in Floyd County Shooting

One person was killed and another injured in a shooting in Floyd County Tuesday.

The shooting happened in the McDowell community of Floyd County. Kentucky State Police Troopers responded to the scene and located two victims inside a residence with gunshot wounds. Both victims were transported to McDowell ARH. Famer Halbert, 54, of McDowell was later pronounced deceased by Floyd County Coroner Greg Nelson.

Lorene Halbert, 50, of McDowell was treated and released for a single gunshot wound.

Ronald Wright was located at Saint Joseph hospital with gunshot wounds. Wright was later transported to Saint Mary’s Medical Center in West Virginia. Warrants for Wright have been obtained for one count of Murder and one count of attempted murder. Loretta Wright was arrested and charged with complicity to murder. Loretta Wright was transported and lodged in the Floyd County Detention Center.

This incident remains under investigation by State Police.

Wrongful Death Body Found in Lexington Motel

A bizarre find is under investigation by Lexington Police after officers went to look into a call about a body at a Lexington motel Wednesday morning.

Lexington Police assisted the fire department with a deceased person at the Knights Inn on Stanton Way. Police say they found what they call an “adult child” dead inside the room and two others around the same age who appeared to be emaciated. Those two were taken to UK Hospital to be treated.

Meanwhile, detectives began an investigation into who all were staying there, and if there was any reason to suspect neglect. A this point, police say they’re not sure if anything criminal will come of this, but they’ll continue to look into it.

Police say they are also waiting for the coroner to determine how the other person died. They say all three appeared to have developmental or other disabilities.
