Wrongful Death Mount Sterling Man Faces Charges after DUI Crash

A Mount Sterling man faces murder charges after an alleged DUI crash in Powell County late Thursday night.

The wreck happened at about 10 p.m. on Kentucky 11 in Powell County. Martha Vivian, 79, of Clay City, was driving a 1999 Ford Taurus when she lost control and traveled into a ditch. While standing next to her disabled vehicle, Vivian was struck by a 1982 GMC pickup driven by Johnny Moore, 34. The impact caused fatal injuries to Vivian.

Moore is charged with operating motor vehicle under influence of alcohol/drugs/etc., and murder with aggravating circumstances first offense.

Moore is being held at the Powell County Detention Center. The accident remains under investigation by Kentucky State Police Morehead.

Missing Person Ashley Murray, 16, of Peconic, NY

The search for a Peconic teen missing since Monday went viral this week, as local appeals to find her were shared over social networking sites across the country and beyond.

Ashley Murray, 16, was last seen at 8:30 a.m., the time she normally leaves her home on Spring Lane to catch the school bus.

She never arrived at school.

“You just keep hoping that the game is up and she’ll come walking through the door,” her mother, Charlotte, said in an interview Tuesday afternoon.
Ms. Murray learned of her daughter’s disappearance after receiving a call from school officials who told her social workers got word from students who had received texts from Ashley that said she would kill herself. Her mom later found a note from her daughter, which she called a “suicide note,” saying it made reference to a “watery grave.”

“This was all thought out and planned the night before,” Ms. Murray said.

Southold Police initially employed a marine patrol, its canine unit and a Suffolk County Police helicopter to perform a physical search Monday morning, but later focused their investigation on the possibility that she may have left the area. They then ended the active local search Monday afternoon and began to concentrate on examining phone and computer records, and interviewing close friends and family, police said.

Police did not release an official missing person report until Wednesday morning, more than 50 hours after Ashley’s disappearance. Law enforcement officials said Ashley’s case does not fit criteria for an “Amber Alert,” since she is not believed to have been abducted.

That did not stop local residents from conducting their own searches and using social media to reach thousands of concerned web surfers from across the country.

A missing poster created Tuesday night by the Facebook page “Missing,” which has a reach of about 125,000 Facebook users, was already shared by more than 14,000 people the following morning, with an additional 1,200 people “liking” the poster and another 1,000 users commenting.

“Shared in Ottawa, Ontario Canada,” one user wrote.

“I encourage everyone to pray for this young girl,” said another commenter.

Locally, friends of Ashley created a Facebook page called “Ashley Come Home,” which was already followed by more than 1,000 Facebook users just hours after its creation. Users shared their photos of Ashley and the page, where they made desperate pleas for their friend to return safely.

“If anyone knows ANYTHING that could help lead to Ashley’s safe return please tell someone as soon as possible! We need to know as much as we can so we can find this beautiful young lady!” the moderator of the page wrote.

Many of her classmates posted that they were out searching locally for their friend, , who they said was often bullied in school.

Ashley is 5-foot 4-inches and 140 pounds with reddish-brown hair, her mother said. She was last seen wearing red sweatpants “four sizes too big,” black boots and a zip-up sweatshirt with a hood, Charlotte Murray said. Police added that she has a scar on her right wrist and wears hearing aids in both ears.

“She didn’t even leave with a winter coat,” her mom said, and she left behind medication she must take for anemia.

Ashley’s mom also said her daughter has never run away from home before.

“I’d like for her to come home,” Ms. Murray said, adding that she hadn’t slept since her daughter went missing Monday morning.

Ms. Murray said her daughter’s phone is turned off or not working.

Southold Superintendent David Gamberg said the district has been cooperating with the Southold Police Department since the investigation began Monday.

“We have deep, deep concerns about her whereabouts and her safety,” Mr. Gamberg said. “Anything and everything we can do we will do.”

Missing Person 2 Missing in Houston

Police were searching for two missing people in unrelated cases Thursday morning.

Margarito Juarez, 86, was last heard from about 1:30 a.m. Wednesday when he got off at the wrong Metro bus stop.

Juarez is described as being about 5 feet 2 inches tall and weighing about 140 pounds. He has gray hair and brown eyes. He was wearing a faded black cap with an emblem of a World War II veteran on it. He also wore wrap-around sunglasses, a long-sleeve shirt, a denim vest and pants.

In an unrelated case, police were also searching for 60-year-old Pauline Rideaux, who was reported missing after she was last seen Wednesday at a Wal-Mart at 2400 S. Kirkwood.

Rideaux, whose nickname is Collard, is described as being 5 feet 10 inches tall and weighing 180 pounds. She has black hair and hazel eyes. She was last seen wearing an orange Longhorn, black-and-blue windbreaker, black pants and blue shoes.

Officials said Rideaux has dementia and early stage Alzheimer’s.

Wrongful Death Minn. Man Charged in Missing Wife’s Murder

A missing Minnesota woman’s husband was charged Thursday with murder, after investigators found blood on the floor, furniture, walls and stairs of the couple’s home as well as evidence of an extensive effort to cover it up.

Authorities said they have not found 30-year-old Kira Trevino’s body, but they believe she’s dead because of the amount of blood found in her car and in the couple’s St. Paul home, and because it wasn’t like her to disappear without telling anyone.

Jeffery Dale Trevino, 39, made an initial court appearance Thursday on two counts of second-degree murder in his wife’s death, which investigators believe happened last Thursday or Friday. Bail was set at $1 million.

Trevino’s attorney, John Conard, said he believes his client is innocent and that Trevino has no idea where his wife is.

According to police, Trevino called Sunday to report that he hadn’t heard from his wife since Friday morning, when he said she went to run errands. He told officers she was going through a “mid-life crisis” and had been leaving for up to three days at a time and lying about where she was staying.

Kira Trevino didn’t stop in at her job at the Mall of America on Friday or work her scheduled Saturday shift. Her car was found in the back corner of a parking lot at the mall.

According to the criminal complaint, investigators searched the couple’s home and found “copious” amounts of blood evidence and signs of an extensive effort to clean it up. A carpet cleaner had what appeared to be blood and human tissue on it, and investigators also found bleach and bleach-stained towels in the kitchen, and a mop and bucket in the hall.

In the bedroom, forensic examiners found blood on the floor and wall, box spring, bed frame, closet, and book shelf, the complaint said. There was also blood evidence in the living room, kitchen, hallway, basement, and in the laundry area _ where authorities found freshly washed towels.

Investigators found a blood stain shaped like a human head and torso under the bedroom carpet. They said the amount of blood spatter is consistent with “more than one forceful blow.”

Ramsey County Attorney John Choi said he is confident prosecutors can prove Kira Trevino was killed, even without a body.

“All the schemes and his efforts to cover up his crime have been foiled by a lot of hard work by the investigators involved in this case,” Choi said.

Police in Bloomington recovered video from the Mall of America showing Kira Trevino’s car entering the parking lot Friday morning. The video isn’t clear enough to show who was in the car, but someone can be seen throwing what appears to be a trunk liner away from the car.

The person then got into a cab, which had a GPS tracker, and was dropped off near Trevino’s home, the complaint said.

After her car was found in the mall parking lot, St. Paul police ordered it towed, and the tow truck operator saw what looked like blood around the trunk. Police also found a trunk liner near the car, which tested positive for blood, the complaint said.

Family members and friends told police that Kira Trevino had been unhappy and had talked about moving out over the past few months.

Kira Trevino’s family members were in court Thursday, and her sister clapped as the bail was set. They left without passing by reporters. Her mother, Marcie Steger, told The Star Tribune that Jeffery Trevino’s alleged role in the case was hard to understand.

“The fact that we trusted him to take care of (Kira), to be there for her. It’s anger. It’s shock. You just don’t even want to go there,” Steger said.

Jeffery Trevino’s family members, many of whom traveled from Arkansas for the hearing, sobbed during the court appearance and had no comment as they left.

“They are grieving. His wife was like a daughter to them. … They love her,” Conard said. “They are hoping and praying that she will be found and found alive, and that if not, they hope the police go and find whoever did this.”

Conard said Jeffery Trevino has no criminal record and he has served in the Army, where he was stationed in Germany.

Wrongful Death Anthony Gray Found Guilty by Scott County Jury

A Scott County jury has found a man guilty of killing his parents in 2007.

The prosecution and defense completed their closing arguments Thursday morning in the case of Anthony Gray, who is accused of gunning down his parents, James and Vivian Gray, to collect insurance money back in 2007. Thursday night, the jury returned a guilty verdict on two counts of Murder and one count of Tampering with Physical Evidence.

Gray took the stand in his own defense Tuesday. Gray testified that police tricked him into confessing to the murders of his parents. He says police made him believe they had evidence linking him to the shootings. Gray claims after five and a half hours of interrogation, a Scott County detective gave him no choice but to confess to the crime he says he didn’t commit.

In Gray’s first trial, a judge declared a mistrial in January of 2012 after the jury failed to reach a verdict.

Pedophile Tracking Man Arrested in Clay County, FL

CLAY COUNTY, Fla. — A man has been arrested on a charge of sexual battery on a child.

Nelson Ross Summerall, 34, was arrested on Feb. 25 on a charge of sexual battery on a victim less than 12 years of age, according to Clay County Sheriff’s Office inmate records.

He was transported from the Avon Park Correctional Institute to the Clay County.

The victim first told her mother about the abuse in July 2012 and the abuse was reported to law enforcement a few months later.

The victim told her mother that Summerall had forced her to touch his private parts and he had touched her private area, according to the arrest report.

The victim told her mother that Summerall said that if she told anyone about the incident, “he would hurt her.”

Summerall had left Clay County and went to Orlando, which is why the victim felt comfortable telling her mother.

Summerall also has served time in prison in 2008 and 2009 for failing to comply with the public safety information act as a sex offender. He also has a sex offender registry entry from Tennessee.

John Harrell from the Florida Department of Children and Families said the agency investigated in summer 2012 and a warrant was placed for Summerall’s arrest.

The victim will remain with the family and is being offered counseling by DCF, Harrell said.

Identity Theft Aspen Man Arrested

A local man was arrested on identity theft charges Tuesday after the rightful owner of a Social Security number he had allegedly obtained and used fraudulently sought to claim benefits.

Alex M. Canas, 37, of Basalt, was advised Wednesday that he faces a class 4 felony count of identity theft. He is being held on a $2,500 bond and also has been placed on an immigration hold. Canas turned himself in and is cooperating with police, according to department spokeswoman Blair Weyer.

The case began when a 47-year-old woman in Mesa, Ariz. applied for Social Security benefits because she was unable to work due to medical issues. Her claim was denied because the government found that her Social Security number was attached to wages being earned in Aspen, at the Hickory House restaurant.

“[The victim] denied ever working in Colorado,” according to an arrest warrant affidavit written by Aspen police detective Walter Chi.

She made a report to Mesa police last month, who contacted authorities in Aspen. Police here got in touch with the restaurant staff, who determined that the Social Security number in question was used by Canas on an I-9 form he filled out when he began working there a few years ago.

Canas came in for an interview with police Tuesday, and through an interpreter, said he obtained falsified documents allowing him to work, including the Social Security number, for $150 in MacArthur Park in Los Angeles, a notorious trading post for fake IDs. He told police he was in the country legally at one time about six years ago, but that authorization had expired, according to the affidavit.

The victim was still unable to collect Social Security benefits when she was interviewed by Aspen police, according to Chi’s affidavit.

Canas will be back in court next month.

Pedophile Tracking Texan Gets 40 Years for Trafficking

A Central Texas man has been sentenced to 40 years in prison for using cellphones and the Internet to recruit girls into prostitution.

A federal judge in Waco on Wednesday sentenced 27-year-old Jerome Maurice Cole of Killeen. Cole in November pleaded guilty to sex trafficking of children.

Investigators say Cole since 2011 ran a prostitution ring using computers and websites to lure girls and then advertise their sexual services.

Killeen police last May responded to a call from a 16-year-old runaway who was at Cole’s home. Police rescued her and during the investigation identified another 16-year-old girl who was forced into prostitution and a third child being recruited.

Wrongful Death Anthony Grady Murder Trial Goes to Jury

The retrial of a man accused of killing his parents in Scott County went to the jury Thursday.

The prosecution and defense completed their closing arguments Thursday morning in the case of Anthony Gray, who is accused of gunning down his parents, James and Vivian Gray, to collect insurance money back in 2007.

Gray took the stand in his own defense Tuesday. Gray testified that police tricked him into confessing to the murders of his parents. He says police made him believe they had evidence linking him to the shootings. Gray claims after five and a half hours of interrogation, a Scott County detective gave him no choice but to confess to the crime he says he didn’t commit.
