Identity Theft 6 Arrainged in Montgomery Theft Ring

MONTGOMERY, Ala. (AP) — Six people were arraigned Wednesday for their involvement in an identity theft ring.

The U.S. Attorney for the Middle District of Alabama says members of the identity theft ring conspired to fraudulently obtain credit cards by diverting mail to a phony mailbox at a Montgomery post office.

A postal worker diverted mail, which included credit cards, to the dubious mail box and the suspects ran credit reports on victims before opening accounts in their names.

Officials say about $600,000 total was stolen from innocent victims.

The six who were arrested are from Alabama and Georgia, and are charged with identity theft, wire fraud and bank fraud.

They may be sentenced to up to 30 years in prison and may have to pay a fine of up to $1 million.

Insurance Fraud and Arson Investigation Franklin Man Charged

The owner of the Franklin home that caught fire twice in one day is being held on $50,000 cash bail on four felony charges, including arson, related to the second fire.

Philip Rudolph, 50, was arraigned in Franklin’s district court yesterday following his arrest Monday. In addition to arson, he is charged with insurance fraud, reckless conduct and being a convicted felon in possession of a weapon. Rudolph does not yet have a lawyer and could not enter a plea because all four charges are felonies.

Rudolph’s home at 308 Salisbury Road, which he owns with his wife, Maureen Rudolph, caught fire twice Nov. 15. The first fire started in the basement about 11 a.m. and was quickly extinguished. The house then caught fire again about 4 p.m., and was destroyed. Rudolph’s charges are related to the second fire, but the state fire marshal’s office is continuing to investigate in collaboration with the Franklin police and fire departments.

In court, Rudolph appeared agitated and repeatedly tried to defend himself, saying he didn’t know what the charges were about. He then blamed the police for badgering him and said they tried to manipulate his wife. He added, “I know the people that are behind this.” Judge Mark Weaver told him several times that the point of the arraignment was not to discover the truth of the charges, and advised Rudolph to remain silent until he has a lawyer.

“I love my family, this is ludicrous,” Rudolph said, approaching tears at several points. His wife was in the courtroom with her head in her hands for most of the arraignment. They have two children, ages 8 and 12. Rudolph is disabled and does not have a job, he said in court.

Rudolph has one previous felony conviction, for robbery in the early 1980s, and has faced numerous criminal charges since 2007, including criminal mischief and several violations of probation, protective orders and bail conditions. Maureen Rudolph temporarily had a protective order against him, and he violated it in September 2011, according to court records. He was sentenced to 76 days in jail and was subject to two years of good behavior and a mental health evaluation, according to records. The two have since reconciled and were living together at the time of the fire.

He has also been arrested for operating a motor vehicle without a license and failure to obey inspection requirements.

Prosecutor Chris Ahern requested $100,000 bail and said Rudolph posed a risk to the community and was a flight risk. Weaver decided on $50,000 cash bail with several conditions. Among them is that Rudolph is not allowed on the property at 308 Salisbury Road. He is being held in Merrimack County Jail.

Rudolph and his wife purchased the single-family, two-story home with three bedrooms in 2001, according to city records. The property was assessed at $167,800 in April 2012.

In 2010, LRG Healthcare, Lakes Region General Hospital and Franklin Regional Hospital filed a petition to attach a $24,000 lien on the property, records show.

Rudolph also owns a house at 127 Flaghole Road in Andover, according to records. That property was last assessed at $89,200.

He is scheduled to appear in court for a probable cause hearing Dec. 4.

Missing Person Marvin Swarsbrick of Houston

Harris County Sheriff’s authorities are seeking the public’s help in locating a missing man.

Marvin Bernard Swarsbrick was last seen in the 10900 block of Ranchstone Drive Wednesday morning.

HCSO authorities also state that Swarsbrick was wearing an orange jacket, blue shirt and blue jeans. He also owns a 2002 four-door, brown Chevy Trailblazer. The plate reads: 121PVM.

He also has a scar on his right knee as well as a scar on his right forearm. Eighty-two-year-old Swarsbrick is also described as a white male who has gray hair.

Identity Theft Ring Ran from Avenal State Prison, Inmates Get 25 Years

Two men associated with the Armenian Power gang were each sentenced to 25 years in federal prison Wednesday on charges of perpetrating a sophisticated identity theft ring from lockup, according to the United States attorney’s office.

Angus Brown, 36, whose nickname is “Homicide,” and Arman Sharopetrosian, 33, known as “Horse,” were two of the 20 defendants named in an indictment last year related to an identify theft scheme that looted at least $8 million, authorities said.

Under the scheme, which involved the Armenian Power gang working in concert with other street gangs, bank insiders were bribed to steal personal information from mostly elderly victims whose signatures were forged, with big checks deposited into phony accounts, authorities said.

Brown and Sharopetrosian had been convicted of running the identity theft ring from Avenal State Prison in the Central Valley.

Brown had already been serving time at the prison for identity theft, authorities said, while Sharopetrosian had been serving time for shooting at an occupied vehicle and carrying a concealed weapon.

Prosecutors said the fraud ring picked elderly victims because they were less likely to keep watch of their accounts by the Internet.

All 20 defendants were convicted and most are expected to be sentenced in the coming months, authorities said.

Identity Theft Shredded Police Documents Used as Confetti in Macy’s Parade

Macy’s Thanksgiving Day Parade viewers were surprised to find shredded police report information with addition to the normal parade confetti.

An investigation by Jay Foley of ID Theft Info Source on Nov. 26 resulted in the discovery that the records that landed on spectators at Macy’s Thanksgiving Day parade were brought to the parade by a Nassau County Police Academy department employee. The employee has not been named by investigators.

Confetti collected by spectators near 65th Street and Central Park West revealed arrest records, incident reports and personal information and that identified undercover officers. There was also information of Mitt Romney’s motorcade route to and from the final presidential debate at Hofstra University.

“There were phone numbers, addresses, Social Security number, bank account number and license plate numbers,” said Ethan Finkelstein of Manhattan who gathered up some of the confetti with friends. “And then we find all these incident reports from police.” The papers were shredded horizontally, not vertically, leaving text visible.

Nassau County Police are considering upgrading to cross cut shredders for future use. Paper documents can easily be used to commit identity theft, even more easily than computer documents.

This is not the first incident of inappropriate papers tossed from offices during a “ticker tape” parade. On Nov. 7, 2009, New York City office workers got carried away during the Yankees victory parade and began tossing files and documents out the window when they couldn’t get their hands on confetti.

An auditor found all sorts of personal financial documents in the mountains of shredded paper tossed from skyscrapers as the players rode up Broadway. Papers included pay stubs, personal financial information, trust fund balance sheets, banking data and even court files.

Pedophile Tracking 2 Madison County Men Charged

Two Madison County men have been charged in an underage sex abuse case

The Madison County Sheriff’s Office said they received a complaint by Social Services and after a three month investigation, they arrested Eric Kelley on November 19 and arrested Robbie Uhrim on November 20. Both are charged in the alleged sex abuse of an 11-year-old girl.

Kelley is charged with first-degree rape, first-degree sodomy and two counts of first-degree sexual abuse. Uhrin is charged with first degree sexual abuse.

Both men are being held in the Madison County Detention Center. Their cases have been sent to a grand jury.

Missing Person Owensboro, KY Man Missing for 2 Weeks

Police in Owensboro are searching for a man who has been missing for two weeks.

On November 21, a family member reported to police that Wilbur A. “Willy” Pate has been missing. The initial report states that Pate was last seen on November 14 at the Walmart on Frederica Street.

Police say Pate, 56, drives a 2004 Ford Escape SUV with Kentucky license plate 056 KNZ. They say the front grill of the SUV is missing.

Pate is described as a white male with salt and pepper hair, hazel eyes and is 6-foot-tall and weighs 150 pounds.

Accident Reconstruction Louisiana Woman Killed in Pulaski County Accident

A Louisiana woman was killed in an accident in Pulaski County early Wednesday morning.

According to the Facebook page of the Somerset Police Department, the accident happened at about 4:45 a.m. at the intersection of US 27 and KY 80 Bypass. Police say Amber Moore, 27, of Denham Springs, Louisiana was driving a 1997 Plymouth Breeze westbound on the East KY 80 Bypass and was approaching the US 27 intersection. Moore told officers she tried to apply her brakes for the red light, but slid into the intersection.

Moore’s car was struck in the driver’s side by a 2003 Dodge Caravan that was northbound on US 27. It was being driven by David Brashears, 48, of Bronston.

Moore and her passenger, Patricia Racca, 52, also of Denham Springs, were treated at the scene by the Somerset Fire Department and the Somerset-Pulaski County EMS. Both were transported to the Lake Cumberland Regional Hospital. Racca was later transferred to the University of Kentucky Hospital, where she was pronounced dead of her injuries at about 6:30 a.m.

Police say Moore, Racca, and Brashears were all wearing their seat belts at the time of the accident.

Police say the accident is still under investigation.

Identity Theft Florida Woman Accused in Massive Identity Theft Scam

ST. LOUIS (AP) — A Florida woman formerly from the St. Louis area is accused of being the ringleader in an identity theft ring that tried to cheat the government out of nearly $1.5 million.

Federal prosecutors in St. Louis charged 27-year-old Tania Henderson of Wesley Chapel, Fla., on Tuesday, the same day that a search warrant was executed at her home. Authorities say they found cash, debit cards and personal identification information of several people.

The criminal complaint alleges that 191 fraudulent tax returns in the names of identity theft victims — both living and dead — were filed from a computer in Henderson’s home. The refunds, including some already paid, amounted to nearly $1.5 million.

Prosecutors say Henderson used a network of accomplices and would share proceeds with them.

Wrongful Death Pittsburgh Man Sentenced to 119 Years in 2007 Pizza Driver Killing

PITTSBURGH (AP) — A man has been sentenced to 119 to 238 years in prison for the ambush slaying of a pizza delivery driver in a crime-ridden Pittsburgh suburb in 2007.

Allegheny County Judge David Cashman imposed the sentence Tuesday on 22-year-old William Mitchell, of Wilkinsburg.

Prosecutors say Mitchell and another man, Lance Dempster, called for a pizza to be delivered to an abandoned house where they shot and robbed the delivery driver, 48-year-old Boston Smithwick, of Duquesne, on April 19, 2007.

Dempster took a plea bargain this summer and was sentenced to 10 to 25 years in prison.

Mitchell contested the charges and was convicted in May on charges of second-degree murder, robbery and conspiracy.
