Wrongful Death New Details in Lexington Shooting

Shocking new details have emerged about a deadly shooting involving a Lexington woman.

Shayna Hubers is accused of shooting her boyfriend, 29-year-old Ryan Poston, in the face at his northern Kentucky apartment. At a preliminary hearing, a detective testified that Hubers told him Poston was vain and wanted a nose job. Detectives say she shot him in the face to give him the nose job he always wanted.

Hubers is expected to claim the shooting was in self-defense, but detectives say there was evidence Poston locked himself in the bedroom before he was shot.

Wrongful Death Body of Des Moines Man Found by River

A body found near the Des Moines River is now being called a homicide. On Wednesday, police combed the area near Vine Street and Southwest 1st Street after a passerby found the body of 56-year-old Stanley Golinsky of Des Moines.

“Where he was located at was between a bridge and a barrier of the river,” said Des Moines Police Sgt. Chris Scott. “Not a lot of people, unless they get off that bike trail and really walk close to the river, would have discovered this person.”

He was spotting by someone walking on the bike trial who told a near-by construction worker, who then called police. After further investigation Wednesday night, police believe the injuries found on Golinsky’s body were signs of a homicide.

“What detectives were able to do was have a better idea of what the injuries on this person were and they are certain those injuries would have come from someone else,” said Scott. “They are still trying to determine the nature what had caused those injuries.”

Police are not sure exactly how long the body had been by the river but they believe it could have been up to 24 hours. If you or someone you know saw Stanley between Tuesday at 4 p.m. and Wednesday, police would like to talk to you. Call detectives at 515-283-4865.

Arson Investigation Vinson Higginbotham Arrested in Huntington, West Virginia

HUNTINGTON — City police have arrested a local man and charged him with setting a fire that damaged a vacant house next door to his own residence.

The incident happened just after 8 a.m. Wednesday at an abandoned, brick structure in the 1300 block of Charleston Avenue. No injuries were reported.

The suspect, Vinson R. Higginbotham, 27, was charged with felony first-degree arson and released on bond, according to court documents.

Huntington Police Capt. Rick Eplin said video surveillance played a critical role in identifying a suspect.

Investigators believe the assailant thought the building was an eyesore and that setting it on fire would push it closer to demolition, Eplin said.

The captain took exception with any such line of thinking, calling it illegal and dangerous.

“It just presents so much of a danger to everybody around there,” he said. “It creates a dangerous situation for (the firefighters) potentially, the people that live next door who could suffer from property damage or loss of life if the fire spreads.”

A nearby surveillance camera twice spotted a man outside of the abandoned residence just before the fire. He then implicated himself to police as being the person who ignited it, according to a criminal complaint filed in Cabell County Magistrate Court.

Firefighters arrived on scene Wednesday to find smoke coming from the second floor. Once inside, they discovered fire smoldering inside of the wall. It was quickly extinguished and contained to that one area.

Quick detection and a quick response from city firefighters were credited with limiting damage. Otherwise, police and fire authorities estimate flames could have engulfed the building in 10 minutes and endangered neighboring houses in 20 minutes.

Eplin said investigators believe Wednesday’s fire was an isolated incident.

They do not think it is connected to many other suspicious fires in the city.

Missing Person Body Found at San Gregorio Beach is Missing Richmond Girl

SAN MATEO COUNTY, Calif. —

The body of a girl found washed ashore at San Gregorio State Beach in San Mateo County last weekend was identified Thursday as missing Richmond girl Cathy Qiu, according to the San Mateo County coroner’s office.

The San Mateo County coroner’s office had been having difficulty tracking down the girl’s identity since a couple walking along San Gregorio State Beach Sunday afternoon spotted the body.

Following media reports this week, a student at Albany High School told a school administrator today that the unidentified body resembled a missing classmate.

Qiu, 16, had been missing out of Richmond since Sept. 29, Richmond police Lt. Bisa French said.

A coroner’s deputy was contacted and the coroner’s office was able to confirm the body using information from Richmond police and Cathy’s family, including dental records.

The circumstances behind Cathy’s death and her connection to being found in San Mateo County are under investigation, according to the San Mateo County Sheriff’s Office.

Wrongful Death Woman Arrested for Killing Husband in Lincoln County, KY

Authorities in Lincoln County have arrested a woman who they say shot her husband to death as he slept.

The incident apparently happened either Monday night or early Tuesday at a home on New Lane Road in Waynesburg.

According to the Lincoln County Sheriff’s Office, Tamara Richie, 50, went over to her sister’s house located in Stanford and told her she had shot her husband, David Richie. Tamara’s sister then called police.

Deputies and the sheriff responded to Tamara Richie’s home and found her husband, David Richie dead in his bed. He had been shot in the head once with a handgun.

Deputies took Richie into custody at her sister’s house without incident. They said they recovered a handgun they think is the murder weapon.

The husband and wife had been married for 27 years.

Private Detective 2 Harlan County, KY Man Convicted on Kidnapping Charges

WASHINGTON—A federal jury late last night convicted two Harlan County, Kentucky men on federal kidnapping charges and conspiracy charges, exposing them to a maximum of life imprisonment. The jury also acquitted the men of violating the sexual orientation provision of the Matthew Shepard James Byrd, Jr. Hate Crimes Prevention Act. David Jason Jenkins, 37, and Anthony Ray Jenkins, 20, were convicted on the kidnapping and conspiracy charges for their roles in kidnapping and assaulting 28-year-old Kevin Pennington, a gay man.

The federal jury in London, Kentucky, convicted the defendants for their conduct related to the April 4, 2011 assault of Pennington. Testimony at trial established that the defendants, who are cousins, carried out the crime with help from two other relatives—Mable Ashley Jenkins, 20; and Alexis LeeAnn Jenkins, 19—who both pleaded guilty to aiding and abetting kidnapping and aiding and abetting the hate crime assault against Kevin Pennington prior to trial and testified against the defendants. Both women pleaded guilty to federal hates crimes charges, representing the first federal convictions under the sexual orientation provision of the Matthew Shepard James Byrd, Jr. Hate Crimes Prevention Act.

The evidence established that the defendants and their female co-conspirators planned in advance of the assault to kidnap Pennington, take him to a remote location, and beat him to death. After luring Pennington by false pretenses into a truck being driven by Anthony Jenkins, the group drove Pennington up a deserted mountain road into Kingdom Come State Park, where they dragged Pennington into the road and beat him.

The evidence also established that Pennington escaped while the defendants were searching in the back of the truck for a tire iron to use to kill Pennington. Pennington ran off the road and threw himself over a ledge, where he hid behind a rock until the defendants finally gave up searching for him and drove away. Pennington staggered part-way down the mountain, where he found a ranger shack, broke a window, and called 911.

The defendant’s co-conspirators, Ashley and Alexis Jenkins, both testified that they and the defendants had agreed in advance to lure Pennington into the truck, drive him to a deserted area, and beat him because of his sexual orientation. The women also testified that during the beating, the defendants and their co-conspirators used anti-gay slurs and yelled, “Kill the f—t!” and that the group intended to kill Pennington.

The jury heard six days of testimony, after which it deliberated for hours before returning yesterday’s guilty verdicts. U.S. District Court Judge Gregory F. Van Tatenhove will sentence the defendants on February 21, 2013.

“As the jury recognized through its verdict, this kidnapping and assault was a vicious and criminal act. The Department of Justice will continue will continue to use every tool in our arsenal to vindicate the rights of victims of violent crimes,” said Thomas E. Perez, Assistant Attorney General for the Civil Rights Division. “The department will also continue to vigorously investigate hate crimes allegations and support state and local law enforcement in their efforts to identify these crimes.”

“We are pleased that all those who participated in this cruel criminal episode have been convicted of serious offenses,” said Kerry B. Harvey, U.S. Attorney for the Eastern District of Kentucky. “We expect that the punishment will reflect the severity of the crimes. Our trial team and law enforcement partners are to be congratulated for their excellent work in this matter.”

This case was investigated by Special Agents Anthony Sankey and Mike Brown with the FBI and was prosecuted by Assistant U.S. Attorney Hydee Hawkins from the U.S. Attorney Office for the Eastern District of Kentucky and Trial Attorney Angie Cha from the Civil Rights Division.

Missing Person Golden Alert for Amber Foster in Hardin County, KY

A Golden Alert has been issued for mentally-challenged Hardin County woman.

Amber M. Foster is a 28-year-old white female with shoulder length hair, blue eyes, and medium build. She is 5’2 and 125 lbs. She was last seen wearing blue jeans, a light blue winter coat with hood, black tennis shoes and a knit animal cap with bear ears.

Foster was last seen on foot in the vicinity of Cheddar’s Restaurant on Dixie Avenue. She has some mental challenges and is also taking medication for seizures. When she left home she did not take an extra clothing with her nor did she have her medication.

Missing Person 78 Yr Old Brooklyn, NY Man

Authorities are searching for a man in his late 70s who has dementia and was reported missing.

Granville Waithe, a Brooklyn resident from Barbados who is about 78 years old, was scheduled to take an Amtrak train from New York City to Buffalo, where his son lives, on Tuesday, said city police Detective Sgt. Walt Horton.

Waithe apparently got off the train in Poughkeepsie and was found Tuesday on the Vassar College campus. He was brought to a homeless shelter, where he spent the night, and a person from the homeless shelter drove him back to the station Wednesday.

Amtrak called city police this morning to inform the agency that Waithe’s luggage had arrived in Buffalo, he said.

It’s unclear if Waithe got on the train in Poughkeepsie, or if he stepped off the train somewhere between Dutchess County and his destination.

Identity Theft Conn. Man Convicted in Credit Card Theft

A Connecticut man has been convicted in an identity theft ring that involved crawling across movie theater floors to rob customers of their credit cards, Greenwichtime.com reports.

Anthony Johnson, 49, would use the credit cards to then buy merchandise including iPods, cellphones, designer sunglasses and $1,000 gift cards which he in turn sold at a discount.

A U.S. District Court jury convicted Johnston Monday on seven charges of using a stolen credit card and two charges of identity theft. He faces up to 10 years in prison on each property theft count and a mandatory two-year consecutive sentence on each of the identity theft charges.

He will be sentenced on January 14.

According to Greenwichtime.com, Johnson is formerly from Philadelphia where he was known on the streets as “Hustlin’ Tone.” The paper also reports that last week two accomplices in the scheme, Jamie Lynn McGowan and Lashirelle Bryant, testified against him in court.

McGowan described Johnson as slithering “like a snake” across movie theater floors before reaching inside partially opened purses and stealing credit cards. Then, he testified, they would leave the theater in their rented van and create an identity card using the victim’s name and McGowan’s photograph. McGowan would then go on a spending spree to buy items to sell at a discounted price.

“A good weekend was $50,000 to $70,000,” McGowan told the jury. “Thirty (thousand) to $40,000 was a bad weekend.”

McGowan added the trio primarily preyed on people at movies such as “Eat, Pray, Love,” “The Curious Case of Benjamin Button;” and “Twilight Eclipse” because “there’d be a lot of white women there … He said these were million-dollar movies.”

The thefts occurred in movie theaters in Fairfield County in southern Connecticut.

Both accomplices pleaded guilty to one count each of using a stolen credit card and aggravated identity theft.

“This was not the outcome that Mr. Johnson hoped for,” said Frank Riccio II, his court-appointed lawyer. “None of the victims who testified could identify Mr. Johnson as the thief. His accomplices did identify him, but they were motivated by their cooperation agreement with the government,” he told Greenwichtime.copm

Riccio says that Johnson intends to appeal the conviction..

Private Detective Police Investigating Bomb Threats in Monroe County, KY

Police in Monroe County responded to a bomb threat at Tompkinsville Elementary School Thursday morning.

The call to State Police came at about 8:20 a.m. The caller advised that the bombs were set to detonate in 15 minutes from the time of the call. No detonation occurred. Additional bomb threats were called in to Sonic and McDonald’s Restaurants and to the local Walmart in Tompkinsville.

All businesses have been evacuated and school has been cancelled for the day. The public should recognize that there may be significant delays in regards to local traffic and are asked to avoid, if possible, the potential threat areas.

Troopers and detectives from Post 15 along with KSP K-9 Units are investigating.
