Insurance Fraud 7 Charged in Life Insurance Scheme

BATON ROUGE, LA—United States Attorney Donald J Cazayoux, Jr announced today that seven area residents have been charged for their role in a life insurance fraud scheme. The United States Attorney has charged Timothy R Schlatre, 34, of Denham Springs, with mail fraud, money laundering, and asset forfeiture. Schlatre faces a maximum sentence of 30 years in prison and fines of up to $500,000 or twice the gross gain or loss from the offense, whichever is larger.

The United States Attorney has also charged Jason Paul Austin, 32, of Walker; Jodi Marie Austin, 34, of Walker; Ricky J Austin, 49, of Denham Springs; Jimmy O Cassels, 33, of Denham Springs; Todd D Cummings, 34, of Walker; and Dena A Gaudet, 33, of Denham Springs, each with conspiracy to commit mail fraud. These individuals each face a maximum sentence of five years in prison and a fine of up to $250,000.

The bills of information allege that Schlatre, using his position as a life insurance agent for New York Life and Lincoln Financial, devised a scheme to defraud New York Life and Lincoln Financial in order to fraudulently receive commission payments by selling life insurance policies based on false statements and representations.

Specifically, Schlatre submitted false information to the companies regarding the applicant’s net worth and annual income, thereby defrauding New York Life and Lincoln Financial into approving the policies and issuing the commission payments to Schlatre to which he was not entitled. Because the policy values were so large, the applicants could not afford to make the premium payments. In order to effectuate his scheme, Schlatre further agreed to provide the premium payments on behalf of the applicants. This process, known as “rebating,” was prohibited by both company’s policies as well as state law.

In order to conceal that he was the source of the premiums, Schlatre deposited money directly into the individual applicant’s bank account. Schlatre further misrepresented the source of the premium payments by falsely declaring that he was not paying or allowing the rebating of any premiums.

The bills of information further allege that Jason Austin, Jodi Austin, Ricky Austin, Jimmy Cassels, Todd Cummings, and Dena Gaudet each conspired with Schlatre to obtain life insurance policies by making false statements regarding their net worth and annual income. All are alleged to have provided false information in their written applications as well as in subsequent phone interviews as part of the underwriting process.

The bills of information allege that Schlatre defrauded New York Life and Lincoln Financial into issuing life insurance policies in excess of $100 million dollars. This resulted in the receipt of commissions to which he was not entitled in excess of hundreds of thousands of dollars.

United States Attorney Donald J Cazayoux, Jr stated, “This ongoing investigation is another example of how close cooperation between our federal and state partners results in the effective investigation and prosecution of significant fraudulent schemes.

We will continue to pursue all who seek personal benefit through deception.”

“This investigation should be a clear reminder that federal law enforcement’s reach into white-collar crime extends beyond traditional health care, investment, and corporate fraud to bring those responsible to justice,” stated FBI Special Agent in Charge Michael J Anderson.

“People who conspire to create elaborate insurance fraud schemes run a very high risk of prosecution,” stated James C Lee, Special Agent in Charge, IRS-Criminal Investigation. “IRS is committed to working diligently with the Department of Justice to dismantle these organizations.”

Louisiana State Inspector General Stephen Street stated, “Mr Schlatre and his cohorts engaged in a fraud scheme over a period of several years and will now be held accountable. This case is the latest example of success in OIG’s ongoing partnership with the United States Attorney, FBI, and IRS in investigating corruption cases.”

The investigation of this matter was conducted by the Federal Bureau of Investigation, the Internal Revenue Service-Criminal Investigation, and the Louisiana Office of Inspector General. The Louisiana Department of Insurance assisted in the investigation.

The cases are being prosecuted by Assistant United States Attorney Rich Bourgeois who serves as Deputy Criminal Chief.

A bill of information is a determination by the United States Attorney that probable cause exists to believe that offenses have been committed by a defendant. The defendants are presumed innocent until and unless proven guilty at trial.

Private Detective Lois Berry Attacks Children with Pepper Spray

An elderly woman is accused of attacking several people, including children, with pepper spray outside a Madison County home.

The incident happened late Tuesday night on North Powell Avenue in Berea.

Lois Berry, 72, was arrested and charged with wanton endangerment and fourth-degree assault.

“I think she’s crazy. She needs to go to an insane asylum,” said Jessica Depute, 17, one of Berry’s six alleged victims. “She got down and was spraying people in the faces… Your eyes hurt so bad and you can’t see anything and it’s the worst, but then your skin starts burning.”

“I started coughing really bad and then my eyes started burning,” said Sage Depute, 14, another victim.

According to Berea Police, Berry told officers her daughter, Sherry Rees, who was also arrested, got into a fight with someone at the house. Berry claimed she tried to put a stop to it with that pepper spray. But the Deputes said the attack came out of nowhere.

“That was premeditated. She knew she was gonna get us,” said Jessica.

Paramedics were even called to the scene after Sage suffered breathing problems due to his asthma.

“He was at that point where he was freaking out and he couldn’t breathe and couldn’t catch his breath,” Jessica said.

Lois Berry and Sherry Rees were released from the Madison County Detention Center Wednesday afternoon.

Missing Person April Pickens of Asheville

ASHEVILLE — Priscilla McLaughlin prays for her missing cousin every morning. She goes for a walk and then gets on the phone, trying to do something — anything — to help find out what happened to April Pickens.

This has been McLaughlin’s routine since Pickens, a 30-year-old mother of five, went missing in December.

“I just can’t sit still and wait knowing this child is missing,” McLaughlin said.

Pickens’ family recently recruited the help of a private investigator.

Tom Chickos started working on the case last week and made new fliers for the family to post in West Asheville and Arden.

Chickos said so far he has talked with Asheville Police Department detectives, who have built a few hundred pages of statements and supplements.

“They’ve done an outstanding job,” he said. “I’m basically duplicating everything they’ve done and hoping I get a different result. I’m trying to find things they haven’t, and I haven’t come up with anything so far.”

Chickos, a private investigator since 1996, said he’s talked with family members to see if they can remember any new details.

But nothing new has been discovered, he said.

On the afternoon of Dec. 26, Pickens set out to meet a male friend. She stopped by her sister’s apartment to borrow perfume but didn’t say whom she was meeting. Family members say they haven’t heard from her since.

Although family and police have been cooperative, Chickos said the community has not been helpful.

“I’ve been tracking down the same leads the police department has, hoping they’ll be more forthcoming with me than they have with them,” he said. “So far, that has not happened.”

McLaughlin is pleading with the community to cooperate with Chickos. She believes someone did something to Pickens and somebody in the area has information that can help the case.

“We’re trying to do everything we can to find April, but nobody is working with us,” she said. “We just need to know some names to pass on to this detective.

“He’s not out there for harm. He’s looking for April,” she added. “This man is doing it pro bono. He needs a break.”

Chickos said family members plan to submit DNA samples to the police department today. Detectives will then register the samples with National Missing and Unidentified Persons System, a database that tries to match DNA samples of family members with unidentified bodies.

McLaughlin thinks she’s getting closer and closer to getting answers. She’s determined to bring some closure to the situation for everyone involved, especially Pickens’ children.

She has been reaching out to different agencies and businesses, trying to get school clothes and supplies that the family can’t afford.

McLaughlin received $75 in gift cards Monday at Walmart. “It’s not a whole lot, but it’s a start,” she said.

Chickos said any new information, no matter how small, may help the case.

“I do prefer they contact the Asheville Police Department first and me second with any information about the case,” he said.

Missing Person Ethiopian Man Found

An Ethiopian man who had become separated from family members Monday during a visit to Center City was found safe by police wandering along the northbound lanes of Rte. I-95.

A Pennsylvania State Trooper on routine patrol found Kifleyohanesse Tessema, 62, walking along the highway at 7 a.m. Tuesday and took him to Episcopal Hospital. From there, he was transferred to a shelter for the homeless.

Towamencin Township police had circulated a news release Tuesday describing Tessema as missing. They were notified Tuesday night that he had been located. Tessema’s family lives in the township.

Once Tessema was positively identified as the missing person, he was transported by State Police to SEPTA police headquarters and turned over to a family member.

When he vanished Monday, Tessema had no money and no identification on him. He does not speak English. Tessema disappeared near the Market Street East Station after he and his family rode the regional rail line into Center City.

Missing Person 2 Teens Missing from Detroit

Detroit— The families of two missing teenagers will resume their search for them Wednesday afternoon, hopefully with help from hundreds of volunteers.

Westland residents Jacob Kudla, 18, and his buddy, Jourdan Bobbish, 17, have been missing since Sunday night when they headed to a relative’s home on the east side of Detroit.

The boys haven’t been seen or heard from since, but police did find Kudla’s abandoned and vandalized 2001 Chevrolet Cavalier near an abandoned apartment building on the west side of Detroit.

“We don’t have any new news, but I am determined that we are going to find our boys today,” said Virgie Kudla, Jacob’s mother. “Yesterday, I was desperate; today, I am determined.”

Items were taken from the car and were traced to two people inside the abandoned building, whom police arrested, Virgie Kudla said police told her.

“Right now we’re still trying to determine whether a crime was committed,” DPD spokeswoman Yvette Walker said.

It wasn’t immediately clear if they were being linked to the disappearances.

As time passes, families of both friends say they fear the worst.

“I have a lot of thoughts flying … some you don’t want to think about,” said Mike Bobbish, Jourdan’s father. “There are a million thoughts.”

Kudla said members of both families will continue to search the area around Beechwood and Linsdale streets — where Jacob’s car was found — starting at about noon Wednesday.

“We’re waiting for clearance from the Detroit Police Department so members of the Detroit 300 coalition can join us,” Kudla said.

Jacob Kudla is a student at Schoolcraft College while Jourdan Bobbish attends Churchill High School in Livonia. According to Virgie Kudla, the boys have known each other for about five years.

“Both are good boys who haven’t been in trouble,” Virgie Kudla said. “Not like some the kids you read about. Jacob is a boy who always comes home at night and has never not kept in touch with me.”

On Monday, Virgie Kudla filed a missing persons report in Westland and a second report to Detroit police on Tuesday.

Westland police consider the case to belong to the DPD since the missing boys were last seen at an uncle’s house in the city and the vandalized car was also found there.

Family members canvassed neighborhoods in Detroit on Tuesday, passing out flyers and talking to residents.

“The community that lives in the area where the car was found have cooperated beyond our expectations,” Virgie Kudla said. “We have been absolutely astonished at the outpouring of car and support from the neighborhood. It’s been wonderful and we are grateful.”

Missing Person Jawhar Aziz II of New Braunfels

(New Braunfels, TX) — A New Braunfels family is looking for a relative that they say has been missing since last Friday.

New Braunfels Police confirm that 20-year old Jawhar Aziz II, of New Braunfels, is considered a missing person after his family called police on Sunday and filed a missing person report.

Aziz, a 5-foot 8-inch tall black male weighing about 160 pounds with an athletic build was last seen around 2:30 Friday afternoon when he left his home in the 62-hundred block of Iris Run, which is off of FM 482 on the far south side of New Braunfels.

He was on his way to a job training event but has not been heard from since. His family is concerned about his health and safety, especially because of previous health concerns, and New Braunfels Police say they consider him a missing and endangered individual.

Police officials say Aziz may be in a 2007 Ford Edge with Texas license plate CH8J363.

Anyone with information on his whereabouts is asked to call New Braunfels Police at 221-4100.

Missing Person Police Searching for Foreign Visitor

Police are investigating the disappearance of an Ethiopian man who went missing earlier this week in Center City Philadelphia.

Police Chief Paul T. Dickinson of the Towamencin Township police said KIFLEYOHANESSE TESSEMA, 62, was visiting relatives in Montgomery County when he went missing on July 23 on a trip into the city.

On Monday, Tessema rode with family members into Center City on the regional rail line. At about 10 a.m. Tessema became separated from his party in the area of Market East Station. His family immediately searched the area for him, but could not find him.

Tessema speaks no English, has no means of support, was carrying no identification on his person, and suffers from high blood pressure which requires medication. The family has not seen or heard from him since he vanished Monday.

The missing man is described as a black male, of medium complexion, 5-feet 6-inches tall, 150 pounds, and with gray hair. He was wearing gray pants, a white shirt, and a red and white baseball cap.

SEPTA and Philadelphia police are assisting Towamencin with the missing-person investigation.

Background Checks in Denver for Guns on the Rise After Shooting

DENVER (Reuters) – The number of people in Colorado applying for background checks to purchase firearms has surged in the aftermath of the movie theater shootings in Aurora, law enforcement officials said on Tuesday.

In the three days after the rampage, 2,887 people were approved for gun buys, compared with 2,012 the weekend before, a 43.5 percent increase, according to data supplied by the Colorado Bureau of Investigation.

The bureau has an online background check system that tracks and processes gun permit applications. The system does not show how many guns were actually sold.

A gunman clad in tactical body armor and a gas mask and carrying three guns opened fire at a midnight showing of the new “Batman” film early on Friday, killing 12 people and wounding 58 others.

Suspect James Eagan Holmes, 24, was arrested minutes later behind the theater and made an initial court appearance on Monday.

Brandon Baker, owner of Rocky Mountain Guns & Ammo in Parker, Colorado, about 15 miles from Aurora, said business had been brisk since the shooting.

“Our gun sales have gone up, but we’ve had more requests for training,” said Baker, a certified firearms instructor. “I’m booked up for the next 2 1/2 months.”

Most of the people seeking firearms or training had been women, Baker said, adding his training included “situational awareness” in addition to firearms proficiency.

Identity Theft State Mistake Puts People at Risk

Madison – The state Department of Revenue acknowledged Tuesday posting online by mistake the tax numbers of tens of thousands of businesses and consumers – at least the fourth time in six years the state has released confidential information and raised the fear of identity fraud.

The confidential information was posted on the agency’s website as part of a report on the sales of property in the state in 2011. The release involved 110,795 taxpayer identification or Social Security numbers, though not all of those would be consumers’ personal numbers that could be used for identity theft such as false credit card applications.

There is no sign that any criminals gained access to the information, but as a safeguard the state will offer free credit monitoring to consumers affected by the mistaken release – at a cost of up to $600,000, agency spokeswoman Stephanie Marquis said.

“We know the individuals who downloaded this file are using it for their own business purposes and have no malicious intent, yet we will be offering free credit monitoring for a year for the individuals who may have been impacted by this situation,” Revenue Secretary Rick Chandler said in a statement.

The online report, which contains information on property sales in 2011, is used by real estate professionals such as appraisers and Realtors to track property sales and advise their clients.

From April 5 to July 23, the people who downloaded one version of the report had access to a second data file embedded in the report that contained the confidential information, though they may not have realized this, Marquis said. The report in question was downloaded 138 times.

No income, corporate or other tax information was affected and the agency’s computer system remains secure, Revenue officials said.

Marquis said the agency was working to do a breakdown on how many of the 110,795 numbers were Social Security numbers, which are sensitive numbers that thieves could potentially use if they did gain access to them.

The taxpayer identification numbers of businesses are publicly available and so their release would not be harmful, she said.

The agency will be mailing out a letter to home sellers who were affected by the release of information. In the meantime, home sellers who are worried that they may be affected can call the agency at (888) 947-3453 or send an email to realestate@wisconsin.gov to learn more.

Chandler acknowledged that his agency had not followed its internal procedures in posting the confidential information.

The mistake echoed three incidents in 2006 and 2008 when the state sent out mailings with exposed Social Security numbers on them. A Department of Revenue vendor in 2006 inadvertently printed Social Security numbers on the outside of about 171,000 tax booklets, making them visible to potential identity thieves.

The state offered free credit monitoring to affected people in that incident, which cost taxpayers more than $500,000.

In 2008, the Department of Revenue sent tax forms to about 5,000 people in which Social Security numbers were visible through address windows on the envelopes.

Also in 2008, about 260,000 participants in Medicaid programs were sent a mailing that included the recipients’ Social Security numbers above their name on the address labels.

In at least the two prior disclosures by the Revenue Department, there were no reported cases of identity theft, Marquis said.

Wrongful Death Patient in Ambulance Died in Crash

An SUV crashed head-on into an ambulance in Gallatin County Tuesday morning, leaving a man dead.

The accident happened at about 10 a.m. on Highway 127 North. Officials say 22-year-old Hunter LeGrand was driving under the influence and crossed over the center line and hit the ambulance. Two EMT’s and a patient were in the ambulance. The EMT’s were taken to local hospitals for their injuries.

The patient, 59-year-old John Little, was killed.

Charges against LeGrand are pending.
