Wrongful Death Woman Pleads Guilty To Death of Her 2 Year Old Daughter

Tessica Nelson, 31, of Gilbertsville last week accepted a plea agreement to serve nine years in prison for the death of her 2-year-old daughter.

The Marshall County Tribune Courier reports that Nelson had been indicted by a Marshall County grand jury in July on charges related to the death of the toddler. Last week, Nelson pleaded guilty and accepted the Commonwealth’s offer to serve nine years in prison.

The grand jury charged that on or about May 15, Nelson committed manslaughter 2nd degree, a class C felony, by administering a lethal dose of Benadryl to the 2-year-old.

The grand jury had also charged Nelson with tampering with physical evidence for allegedly deleting text messages with the intent to impair the availability of them in an official proceeding.

Per the Commonwealth’s offer, the tampering with physical evidence charge was dropped.

Nelson will return to Marshall County Circuit Court Dec. 7 for sentencing.

Wrongful Death Rowan County Man Accused of Shooting Brother

The case of a Rowan County man accused of shooting his brother will be sent to a grand jury.

The Rowan County Sheriff says Robert Jent shot and killed his brother Phillip on Tuesday night. Relatives say the two had fought for years over land, which led to the fatal argument at the family’s property along Cold Springs Hollow.

According to the sheriff, Robert claims he tried to shoot his brother in the arm to subdue him, but accidentally shot him in the chest.

Several relatives tell LEX 18 they don’t believe him.

“It’s not self defense when you get in your vehicle, then you go down to somebody else’s home and you take a gun with you knowing what you’re taking that gun with you for,” said Georgina Reed, the victim’s niece.

No charges have been filed, but investigators say the case will be presented to the grand jury later this month.

The family of Phillip Jent is raising money for funeral expenses. To donate, you can click here.

Public Information Assistant Richelle Bailey of the McDowell County Sheriff’s Office said Cecil Scott Byrd, 41, of Bad Creek Road, Bakersville, was arrested on an outstanding warrant. He was transported to the McDowell County Jail for questioning as of deadline Wednesday.

“We received information this afternoon concerning the whereabouts of Byrd. He had an outstanding warrant in McDowell County for identity theft,” she said. “Through the information we received, authorities knew he was going to be on 221 North.”

Bailey said Byrd’s mother had picked him up at a location on U.S. 221 and he was stopped by authorities near Baxter Healthcare.

“A vehicle stop was initiated by McDowell, Mitchell and SBI,” she said. “He was a passenger in the vehicle and was taken into custody for the identity theft warrant.”

Deputies issued a BOLO on Tuesday for Byrd’s whereabouts in reference to missing person Sarah Denise Riddle from McDowell County. He was also wanted for questioning in the October disappearance of Lisa Ann Robbins.

WLOS-TV reported Wednesday afternoon that both Mitchell, McDowell and SBI officials discovered human remains along Highway 226 near the Tennessee state line. The news station said authorities were collecting evidence along the side of the road that were sent for DNA analysis. Mitchell County Sheriff Donald Street told WLOS-TV reporters Byrd’s black Chevy truck had been recovered and was in police custody.

Private Detective: Three Charged After Richmond Police Officer’s Shooting

A police officer was shot while investigating a robbery. According the Richmond Mayor, the officer was shot at an apartment building on Ballard drive and has life threatening injuries. The shooting suspect was shot in the arm and the chest.

A police escort was set up to get the injured officer to UK Hospital as fast as possible.

The officer’s name is Daniel Ellis, he has been with the Richmond Police Department for seven years. He is still at UK hospital with life threatening injuries.

http://liarcatchers.com/contact.php

This all started with an attempted personal robbery just before 7 a.m. at the Gulf Station on Main Street. The victim was able to get away and gave police a description of the suspect and the suspect’s vehicle.

That led the two officers to Ballard Street around 10:00 a.m. The two officers knocked on the door of Gregory Ratliff’s home, they were looking for Raleigh Sizemore in relation to the robbery. Ratliff let the officers in and told them he was home alone and that there were no guns in the home, according to the arrest citation, Ratliff later admitted both of those things were lies. Apparently before the officers arrived, Sizemore said that he had spent half his life in prison and wasn’t going back.

The citation says that Sizemore was in a bedroom with Rita Creech, he had a gun in his hand. When Officer Ellis crossed the threshold into the room, Sizemore shot him.

The second officer shot Sizemore, that officer was not injured.

25-year-old Gregory Ratliff has been charged with complicity to commit murder of a police officer. He was uninjured and is in the Madison County Detention Center.

Rita Creech, 44, has been charged with the robbery and is in the Madison County Detention Center.

Sizemore, 34, has been arrested and charged with attempted murder and unlawful imprisonment.

“There really aren’t any words to try to put on what it’s like to have a fellow colleague and somebody that you know and work with in a small community suffering from these kinds of injuries and being at the hospital,” KSP Trooper Robert Purdy said in a press conference. “It really just is a scary thing.”

Wrongful Death Fight Between Brothers Turns Deadly

The Rowan County Sheriff says a fight between two brothers took a deadly turn. It happened along Cold Springs Hollow Tuesday night.

Deputies investigating the case say Robert Jent told them he didn’t mean to fatally shoot his brother Phillip. Robert told deputies that he got into a fight with Phillip and was trying to shoot his brother in the arm to subdue him. But the bullet hit Phillip in the chest and killed him.

http://liarcatchers.com/wrongful_death.html

51 year old Phillip Jent was the owner of Jent’s Garage near the shooting scene. Family members say the brothers had been involved in a property dispute for years and this was the end result.

“It’s not self defense when you get in your vehicle, then you go down to somebody else’s home and you take a gun with you knowing what you’re taking that gun with you for,” said Phillip’s niece Georgina Reed.

So far no charges have been filed and deputies say the case will be presented to a grand jury later this month to see if Robert Jent will be charged.
