Wrongful Death Man Found Dead in Logan County, OK

The Logan County sheriff’s office identified a man found dead Sunday at his home in south-central Logan County.

James Fox, 65, was discovered dead at 8300 Holly Hill Drive after a neighbor called 911 about 7 p.m. to file a missing person report, Chief Deputy Richard Stephens said.

The state medical examiner’s office said Fox died as a result of blunt force trauma to the head. The death has been ruled a homicide.

The homeowner’s vehicle also is missing, authorities said Tuesday. The car, which may have been taken by the person sought in connection with the death, is a white 1999 Cadillac Seville with damage to the driver’s side mirror.

The car has a trailer hitch, which makes it distinctive, Stephens said.

The Oklahoma license plate is 006LJN, but the tag may have been changed, Stephens said in a news release.

Arson Investigation Frankfort Man Indicted for Burning Down Woman’s House

Frankfort police say that a man indicted for setting a woman’s home on fire, did so because she spurned him on social media. Now, that woman is trying to rebuild her life from the ashes.

Joanie Yount’s Hillview Drive home was set on fire in November. James Graham, 37, was indicted by a grand jury Tuesday and is now facing charges of arson. Police say the entire incident started after Graham added Joanie Yount on Facebook and began sending her messages.

Yount says that she and Graham were only acquaintances but that he began wanting something more.

“He was writing on all my pictures talking about how beautiful I am and let him take me out. I had actually told him to stay off of my Facebook, so he may have gotten offended over that ,” says Yount.

Police say Graham was offended enough by Yount’s rejection, that he started a fire in her home.

Thankfully, Joanie and her 3-year-old son weren’t home when neighbors noticed smoke coming from her house.

“You can actually see from my window standing up on the couch, you could actually see inside there and you couldn’t see no flames, all you could see was smoke,” says Samantha Begal, Joanie’s neighbor and sister.

Police were able to figure out, through collected evidence, that Graham was their suspect.

According to Joanie, Graham wasn’t shy about admitting his wrongdoing.

“He was walking around bragging about it and saying he wouldn’t have to pay the price,” says Yount.

Police now say he will pay for his actions, but the price Yount is facing is far worse.

“She’s got to start from the bottom. She has nothing,” says Samantha Begal.

Joanie and her son are staying with family. She did not have insurance and is starting over from scratch.

Fraud Investigation Seven Indicted For Fraud Involving Shaker Hts Center

A five-count indictment was filed charging seven people and a Florida company for their roles in a multi-million dollar health-care fraud conspiracy involving an experimental form of chiropractic manipulation, law enforcement officials said.

Indicted are: Physicians Surgical Group (PSG), a medical billing company headquartered in Boca Raton, FL.; Christopher Liva, 36, Edward Liva, 64, Carolyn Via, 51, all of Boca Raton, FL; Mark Fritz, age unknown, of Coral Springs, FL.; John Nickels, 60, Highland Heights; John Fortuna, 41, of Avon, and Antony Simone, 40, of Cleveland.

The Livas, Fritz, Nickels, Fortuna, Simone and the company are charged with one count each of conspiracy, wire fraud and health care fraud.

Those six people are also charged with one count of money laundering. Ed Liva, Chris Liva and Via face an additional count of money laundering.

PSG was owned by Christopher Liva, Edward Liva and Carolyn Via. Those three people, along with four others not named in the indictment, also owned Shaker Heights Surgical Center, located at 3235 Lee Road.

Fritz was the chief financial officer at PSG. Fortuna and Simone were licensed chiropractors while Nickels was a medical doctor and anesthesiologist, according to court documents.

The defendants deceived various private insurance companies to pay millions of dollars on behalf of patients who underwent an experimental form of manipulation under anesthesia at Shaker Heights Surgical Center.

Manipulation under anesthesia is an aggressive form of therapy typically reserved for patients who had failed with conservative chiropractic care. There were serious risks associated with it, according to the indictment.

Because of the pain involved, patients were put under conscious sedation and it was recognized as a surgical procedure. It was not performed in an office setting but rather an outpatient surgical facility and typically generated three types of insurance claims — for professional fees, facility fees and fees for anesthesia services, according to the indictment.

Beginning in 2008, Chris Liva and others began marketing Shaker Heights Surgical Center and the manipulation under anesthesia procedure to chiropractors in Ohio, typically at restaurants in downtown Cleveland or the Youngstown area. In return for referring patients to Shaker Heights Surgical Center for the manipulation under anesthesia procedure, chiropractors were paid a flat fee of $4,000 per patient referred for a three-day session of procedures. Patients were advised they would not have to pay anything for the procedure, according to the indictment.

The defendants disregarded diagnoses, used false diagnoses, submitted false billing claims, represented that procedures were performed by osteopathic and medical doctors when in reality they were performed by osteopathic doctors and chiropractors, waived patients’ required co-payments and deductibles, and took other steps as part of the criminal conspiracy. This took place between 2007 and 2010, according to the indictment.

Prosecutors are also seeking to seize property derived from the criminal conspiracy, including two properties in Boca Raton, FL., a Royal Oak Offshore Chronograph watch and 4.18-karat diamond stud earrings, as well as money, according to the indictment.

“This group bilked insurance companies through a series of false claims and diagnoses to get money, diamonds and expensive homes,” said Steven M. Dettelbach, U.S. Attorney for the Northern District of Ohio.

“This clinic was established not to help the sick and injured, but for the purpose of stealing insurance money,” said Stephen D. Anthony, Special Agent in Charge of the Federal Bureau of Investigation’s Cleveland office. “The individuals charged provided patients with a false diagnosis and submitted inflated claims to insurance companies – all in an effort to line their own pockets. The FBI, along with our federal, state, local and private industry partners, is committed to prosecuting these health care fraud schemes.”

“These defendants went to great lengths to try and hide their ill-gotten cash,” said Kathy Enstrom, Special Agent in Charge, Internal Revenue Service, Cincinnati Field Office. “The IRS will continue to follow the money trail in criminal conspiracies.”

The case is being prosecuted by Assistant U.S. Attorneys Michael L. Collyer and Christos N. Georgalis following an investigation by the FBI and IRS-CI.

Private Detective: Boyle Co. Man Charged with Indecent Exposure

Deputies have arrested a Boyle County man accused of exposing himself to his neighbors. LEX 18 wants to warn you that the details of this story are disturbing.

According to officials, Jimmy Holman was arrested and charged with indecent exposure after an incident in his bedroom window.
Investigators say that Holman would masturbate while standing in a window of his home, holding a flashlight to get the attention of neighbors.

Holman’s arrest warrant shows he did this at least six different days this month. Holman’s wife Rita said it a disturbing ritual she witnessed quite frequently.

“This door would be shut like it is now and he’d stand there and look out,” says Rita. “I couldn’t ever figure it out. He always looked over there at the neighbors.”

A postal worker who delivers mail in the area said she had seen the behavior before.

“He quit for a while and he’d start up again,” said the postal worker who wished to remain off-camera.

Holman’s wife says Jimmy wouldn’t listen to her when she tried to get him to stop. She’s extremely embarrassed about the situation.

Jimmy Holman initially agreed to an on-camera interview, but quickly changed  his mind.

Private Detective: Grant County School On Lockdown As Police Search For Attack Suspect

An elementary school in Grant County is on lockdown Wednesday morning as officials search for a man they say attacked six people inside a home where his teenager girlfriend lives. Crittenden Mt. Zion Elementary School is on lockdown as officials search for 42-year-old Eric Unthank, who they say entered a home on Ten Mile Drive around 7:30 a.m. and attacked six people. One of the victims as young as seven years old.

Grant County Sheriff  Chuck Dills says the 42-year-old suspect was dating a 17-year-old girl, whose grandmother lives in the home and fosters special needs children.

Deputies say Unthank walked up to house looking for the teen and then just walked on in the house. He demanded her phone number and when those inside couldn’t find it, he started beating them.

When the bus driver pulled up, the grandmother and a 7-year-old ran out of the garage bloody and injured. Unthank also came out and that’s when the bus driver got involved, deputies said.

A third victim is a special needs 21-year-old woman, deputies said. Sheriff Dills says the attack may have gone on if it weren’t for the school bus driver who pulled up.

“He acted quickly, got off the bus, tried to help the victim,” said Sheriff Dills. “He was able to grab the club and then the victim ran.”

The bus driver usually doesn’t work this route and was just filling in, officials said.

Unthank  is described as Hispanic, 5-foot-7, 175 pounds with an “M” tattoo on his neck.

Three of the victims were taken to the hospital with head trauma.

Private Detective: Lexington Police Search for Bank Robbery Suspect

Lexington Police have obtained an arrest warrant for a suspect they say robbed two Lexington Banks.

Officers are attempting to locate Cody Arnett in connection with robberies at the People’s Exchange Bank and United Bank. Police say that Arnett robbed the People’s Exchange Bank on November 25.

According to witnesses, a white male walked into the People’s Exchange Bank with a note demanding money. The suspect fled on foot with the stolen cash.

On December 16, police say that the same man walked into the United Bank wearing a ski mask. He approached a teller with a note demanding cash. The man fled on foot from that scene as well.

Responding officers were able to determine a description of the suspect vehicle: a red, Toyota Tacoma with distinctive stickers on the rear window. After conducting a traffic stop, they managed to detain a passenger in the vehicle but the driver fled the scene on foot.

Through their investigation, police have determined the suspect to be Arnett and they have issued two warrants for Robbery in the First Degree.

Wrongful Death Body Found in Car of Missing Pregnant Sacramento Mother

Police Monday night found the body of a woman inside the car belonging to a missing and pregnant Sacramento mother.

Police did not confirm Tuesday if the dead woman inside the car is Aubrey Andrews, who has been missing for more than a week.

The car was found in a parking lot near the 8400 block of Elk Grove Boulevard in Elk Grove, which is about 4 miles from her home in the 5900 block of Jacinto Avenue.

An investigation is underway, and there was no obvious sign of foul play, according to Sacramento police. As of late Tuesday morning, the police were still treating the woman’s disappearance as a missing person investigation.

Andrews, who is nine months pregnant, was last seen alive about 10 p.m. Dec. 6 near her home.

Police said Sunday that Andrews, 20, was reportedly distraught when she drove away from her home in a white Toyota Prius. Family and friends in Sacramento said her disappearance was unusual and told police that she may have traveled to Southern California where she has friends.

On Saturday, police officials took to Twitter, posting Andrews’ photo and asking Los Angeles and Orange County authorities to be on the lookout for the missing woman.

According to California court records, Andrews filed for divorce from her husband, Edward Andrews, in May. The divorce was dissolved by the county about a month later when the couple did not not show up for court-ordered mediation. A civil claim of domestic violence made almost one year ago alleged online harassment and verbal abuse and resulted in a temporary restraining order that explicitly banned Edward Andrews from engaging in any abuse toward his wife and outlined a temporary child custody arrangement involving the couple’s 2-year-old son.

The couple, who were married in December 2011, had been living separately for several months, according to court records.

Missing Person Cris Beltran-Monroy of Chicago

A woman who was reported missing from the Loop may be near Midway Airport.

Cris Beltran-Monroy, 26, was reported missing from the 0-100 block of East Washington Street, according to a missing person alert from Chicago Police.

Beltran-Monroy, who also goes by Stefania, is described as a 5-foot-2, 140-pound Hispanic woman with brown hair, brown eyes and a light brown complexion.

She was last seen Friday wearing a black jacket, brown sweater and blue jeans and carrying a gray tote bag.

Police said she frequents the area near Midway Airport and the 3700 block of West Fullerton.

Accident Reconstruction Six Firefighters Hurt in Anderson County Crash

Six firefighters were injured when their fire truck crashed in Anderson County.

It happened around 6:30pm on Puckett Road near the intersection with Alton Station Road near Lawrenceburg.

The firefighters were headed to an accident when police believe they ran off the road hitting a large tree.

“We heard this loud crash and come out the back door here and seen the fire truck into the tree down here by the house,” who Noal Cotton, who was just sitting down to dinner when the impact of the truck hitting the tree shook his home and others along Puckett Road.

“They hit it so hard it knocked the top out of it,” said James Goodlett, who lives nearby.

All six firefighters were taken to the hospital. Their conditions are unknown.

“Three of them got out and they cut the guy in the front passenger side out. He was trapped inside so they had to work about an hour to get him out,” said Cotton, who went to help.

Battalion Chief Chris Harrod was on his way to the initial accident when he ran up on the wreck involving his firefighters.

“That’s our worst nightmare, something that’s always on our minds of how we’re going to handle that,” said Battalion Chief Harrod.

He now asks for prayers as his crew recovers.

“They put their lives at risk on every run that they make and this is just another example of things that can happen while we’re responding,’ said Battalion Chief Harrod.

Kentucky State Police continue to investigate the crash.

The battalion chief says the first accident firefighters were responding to was a driver who rear-ended another driver sending a vehicle into a cow pasture. He didn’t know about any injuries because his crew never made it to that accident.
