The Forensic Spotlight is a new department in the FBI Law Enforcement Bulletin (LEB) that highlights current and noteworthy developments in the forensic sciences. Articles in the Forensic Spotlight focus on topics such as fingerprinting, ballistics, toxicology, paint analysis, document validity, and other laboratory-based technology used in crime solving. Laboratories willing to share new and interesting information in the various fields of forensic science can submit their articles to the LEB at leb@ic.fbi.gov for review and possible publication in the Forensic Spotlight.

Two college freshmen arrive at a local emergency room one Sunday morning. Looking terrified, the young ladies approach the admissions desk, and one informs the triage nurse that her friend was raped. The nurse immediately takes them to a private room and pages the on-call forensic nurse. When the forensic nurse arrives and begins talking to the victim, she notices that the young woman has fragmented memories of the previous night. The nurse suspects that the girl was drugged. She asks the young lady if she is willing to undergo a rape examination that includes the collection of blood and urine for toxicology screening. The young woman is hesitant because she is underage and was drinking the night before, but she agrees to the evidence collection. The forensic nurse submits the specimens to the local crime laboratory, along with the rest of the rape kit, for forensic testing.

This scenario describes a typical drug-facilitated sexual assault (DFSA) case. DFSA cases occur when a victim is under the influence of alcohol or other drugs. Due to the effects of the drugs, the victim is unable to resist sexual advances. A DFSA can happen when an individual has been slipped a drug without consent, has voluntarily consumed alcohol or other drugs, or has ingested a combination of both. Despite the frequency of situations, such as this, the appropriate toxicology evidence is not always collected. This could be because the victim does not report the crime—in a timely manner or at all—or chooses not to donate toxicology specimens, possibly for fear of being identified as a drug user. In other cases, due to hospital policy or local laws, hospital personnel must wait for a victim to become sober and consent to evidence collection. Sometimes in a DFSA case, individuals who encounter the victim do not recognize the importance of collecting toxicology evidence.

Certain signs and symptoms indicate that a victim may have been impaired during an assault. In these cases toxicology evidence should be collected.

  1. Memory loss—a total loss of a period of time (blackout) or difficulty piecing segments of time back together (fragmented memories)
  2. Loss of consciousness
  3. A hangover that is inconsistent with the recalled amount of alcohol or other drugs the individual knowingly consumed
  4. Dizziness or light-headedness
  5. Nausea or vomiting
  6. Feeling or appearing more drunk than appropriate for the level of alcohol consumed

Toxicology specimens should be obtained within certain time periods and under specific conditions. Urine always should be collected if 120 hours (5 days) or less have passed since the alleged assault. In addition to urine, blood should be drawn if it has been less than 24 hours since the incident. Hair can be submitted if it is too late to take blood or urine specimens. It is best to wait at least 1 month after the alleged assault, and collect hair as directed by the lab that will be performing the forensic testing. Not all forensic laboratories offer testing of hair for drugs. Individuals must contact the lab for guidance prior to submitting hair specimens.

Toxicology evidence should be sent to a forensic laboratory that has experience analyzing suspected DFSA cases. Most hospital laboratory screening is not appropriate for DFSA testing, and not all forensic toxicology laboratories are experienced in DFSA analysis. If the local laboratory is not able to perform toxicology testing in DFSA cases, the FBI Laboratory can assist. FBI laboratory services are free of charge for law enforcement agencies if local services are not available. There is no fee for expert testimony in criminal cases where a proficient FBI professional has performed testing. The turnaround time for toxicology testing at the FBI Laboratory for DFSA cases typically is less than 60 days.

Pedophile Tracking Mayfield, NY Man Pleads Guilty

One of the men accused of producing child pornography in Fulton County has admitted to child sexual abuse.

Richard Hastings, 19, pleaded guilty to sex abuse charges on October 2, according to court officials.

Hastings, along with his older brother, Richard Hastings, is accused of making and distributing a pornographic video involving a young girl. They were arrested in August 2013.

The brothers were indicted by a Grand Jury on federal charges.

Authorities say Richard Hastings made sexually explicit images involving a young victim and posted them online. He was caught when he emailed them to an undercover investigator in Australia.

Robert is also facing charges of receipt of child pornography.

The brothers are both expected to appear again in federal court this December

Missing Person Two Year Old Missing in Montana

A MISSING and ENDANGERED PERSON ALERT was issued Monday afternoon for a 2-year-old Browning boy.

The Alert states:

Blackfeet Tribal Police is requesting a Missing Endangered Person Advisory for 2 year old Hunter Crossguns. Hunter, who is in the care of his grandparents, was taken on October 3, 2014 by his father Tyler Crossguns. Tyler uses Methamphetamines and there is concern for Hunter’s welfare. Tyler Crossguns is a 31 year old Native American male, 5 ft 7, 175 lbs, with black hair and brown eyes. Tyler is believed to be driving either a white 1994 Ford F150 Pickup – Montana license 38-9841A or a white 1990 Chevrolet Pickup, unknown plate. Hunter Crossguns is a 2 year old Native American male, 2 ft 6, 35 lbs, with brown hair and brown eyes. He was last seen wearing a gray and black shirt, wrangler blue pants, yellow jacket and black tennis shoes. If you have any information on the whereabouts of Hunter or Tyler Crossguns, please call Blackfeet Tribal Law Enforcement at (406) 338-4000.

The Alert also states the boy is missing from Browning, and the incident occurred on Friday at 10 p.m.

Wrongful Death Man Indicted in TN Double Murder Arrested in Louisville

A man indicted for murdering two people in Tennessee has been caught in Louisville.

21-year-old Michael Wright, Junior is charged with two counts of murder for the shooting deaths of Gregory Johnson and Daresha Cole.

Police say Wright killed the pair in February following an attempted robbery.

Wright is in jail in Louisville awaiting extradition to Tennessee.

Pedophile Tracking Farmington, NM Man Arraigned

A 28-year-old Farmington man was arraigned Monday in district court on multiple counts of child sexual assault.

Theo R. Jones was charged in October 2013 in Aztec Magistrate Court with one count of first-degree criminal sexual penetration of a child and one count of second-degree criminal sexual penetration.

Chief Deputy District Attorney Dustin O’Brien said that the charges were not brought to district court sooner because Jones was charged with an additional four counts of first-degree criminal sexual penetration of a child on June 24.

“If we change or modify a charge, or if we add an additional charge, they have a right to a preliminary hearing on the new or additional charges,” he said.

Jones appeared at a preliminary examination hearing to answer to the additional charges on Sept. 4, according to court records.

According to an arrest warrant affidavit, deputies from the San Juan County Sheriff’s Office were contacted by high school officials in Farmington in September 2013 after a student said that she was sexually abused by Jones.

She told detectives from both the Farmington Police Department and the sheriff’s office that she had been sexually assaulted by Jones on multiple occasions beginning when she was 12 years old, the affidavit states.

She said the abuse occurred at residences located in both Farmington and in unincorporated San Juan County, according to the affidavit. She said that Jones would force her to have sex with him while she baby-sat his children, but did not report the abuse for fear of getting into trouble, the affidavit states.

She said the final time he forced her to have sex was in November 2012, the affidavit states.

She said that her grandmother was made aware of the abuse, but asked the girl’s mother not to report the abuse to law enforcement, the affidavit states.

The girl’s mother told detectives that she decided to tell school officials about the abuse because her daughter was “acting up” and was “very depressed,” the affidavit states.

Deputies encouraged the girl to call Jones while they recorded the conversation. During the phone call, Jones allegedly told the girl to lie and say that she made up the story, the affidavit states.

Court records do not indicate when Jones will next appear in court.

Missing Person Tabitha Badillo of Wenatchee, WA

The Wenatchee Police Department said Monday it is investigating the missing person case of Tabitha Badillo, 26, of Wenatchee, as suspicious.

Last Thursday night, Badillo’s family members reported her as missing after they could not find her but discovered her cellphone lying on the sidewalk adjacent to their residence. There were no personal items of Tabitha’s missing from the residence, indicating she did not take any clothes with her, police said.

Tabitha was last seen on the porch at about 3:45 p.m. Thursday.

On Monday, “Tabitha has not been located and the Wenatchee Police Department is investigating this missing person case as suspicious,” the department said.

She is described as 5-foot-1, 160 pounds, with blue eyes and brown hair. She was last seen wearing a white shirt and blue skirt.

Accident Reconstruction Single Vehicle Fatal Crash in Powell Co.

The victim of a single-vehicle fatality in Powell County has been identified.

Troopers confirm John C. Lane, 60, of Lee County died in the crash. The single-vehicle fatality was most likely caused by a medical emergency, officials say.

It happened around 5:00 p.m. Monday. on Natural Bridge Road in Powell County. Police say Lane was very slowly driving his red GMC truck near Middle Fork Campground when he hit the guardrail then drove partially up the side of the hill, according to witnesses.

Rain was not the cause of the accident though it is thought to have hindered clean-up.

Two bystanders, who were members of the Air Force attempted to render aid, but they were too late.

Missing Person 57 Year Old Compton, CA Man With Dementia

Sheriff’s detectives in Compton asked for the public’s help Monday in finding a 57-year-old man with dementia reported missing Sept. 30.

Ronald Darnell Gary was last seen walking on Long Beach Boulevard near the 105 Freeway about 10:30 a.m., a sheriff’s deputy said.

Gary recently suffered a stroke and needs medicine, according to deputies with the Sheriff’s Headquarters Bureau.

Gary, who is black, was described as about 5 feet 7 inches and 200 pounds, with brown eyes, short black hair and prescription glasses. He was wearing a black jogging suit with a lime-green polo shirt and black tennis shoes. He also wears a gold-colored chain with an eagle medallion.

Arson Investigation Two Dead in Harrison County House Fire

Two people have died in a house fire in Harrison County Monday morning.

It happened at a home on Grays Run Pike south of Cynthiana. KSP arrived on scene around 11:30 a.m.

Coroner Tom Ware said one of the people is a man, but has not been able to identify him. The gender of the other person is unknown. Autopsies will be performed Tuesday.

The bodies were found in center of house near the living room where firefighters believe fire started.

Two children who also live in the house were at school when the fire happened. They are now in the care of family members. Officials said it appears a couple of animals were also killed in the fire.

The majority of the roof has been destroyed by the fire and the siding of the home has melted from the intensity of the flames.

Several personal cars have lined up along Grays Run Pike and are gathering at a neighboring home where people are seen hugging each other.

KSP is handling the investigation. They have not said what caused the fire but are not ruling out foul play.

Private Detective: Police Search For Whitaker Bank Robbery Suspect

Lexington police are looking for a suspect connected to an early morning bank robbery.

It happened around 9:50 a.m. at the Whitaker Bank on West Lowry. Police say a white man entered the bank, implied a weapon and demanded to be given money.

He grabbed the money from the teller counter and left the bank on foot headed toward Nicholasville Road, police said.
