Wrongful Death Body Found in Nevada Backyard ID’d

 

Detectives believe a retired U.S. Army colonel killed his wife in Nevada and buried her in a “sophisticated grave” in their backyard before he made up a story about her death, then committed suicide two weeks later when police started questioning him about her disappearance.

Washoe County sheriff’s deputies confirmed on Friday the body they excavated from a nearly 3-foot-deep grave at the Spanish Springs home north of Reno is that of Colleen Muhl, 56. She hadn’t been seen since Feb. 17.

Gerald Muhl, 51, fatally shot himself on March 3, the day after investigators had confronted him about holes in his story about his wife’s purported death in Southern California. At one point he had claimed he had moved some rocks around in his backyard for “therapeutic reasons,” Lt. Tom Green said Friday.

An autopsy determined Colleen Muhl died from a gunshot wound, Green said. Her husband is the lone suspect in an ongoing homicide investigation, he said.

Investigators believe she was killed sometime between 3 p.m. on Feb. 17 and 4 a.m. the next day when Gerald Muhl flew out of Reno-Tahoe International Airport on a business trip.

“What to date has been a missing person investigation continues now as a homicide investigation,” Green said at a news conference at the sheriff’s office in Reno. “Unfortunately, the two people who can tell us the most about this case are deceased.”

Gerald Muhl had a “distinguished” 27-year career in the U.S. Army before he retired and had been working for a private contractor based in California, Green said. He had told other family members and police that his wife had died of heart attack during a visit to Southern California on Feb. 22.

Authorities got a tip that Gerald Muhl had been moving rocks in his backyard after his wife last was seen Feb. 17, Green said.

Cadaver dogs missed the body in initial searches, but they hit on a spot in landscaped area of the year on Wednesday.

“The grave site was sophisticated,” Green said about the hole that was more than 30 inches deep.

“It was not only deep, but plastic and concrete and rocks were used to conceal her body … a combination of landscaping rocks and river rock mixed in with concrete,” he said, adding her body was intact and she was identified based on fingerprint records.

Colleen Muhl’s cellphone was turned off on Feb. 17 shortly after the couple returned home from a trip to visit her sister Sharon Jones in California, investigators said.

Jones told authorities that Gerald Muhl told her Colleen had died of a heart attack at a friend’s home in Southern California on Feb. 22. Jones said she investigated the claim, became suspicious and called the sheriff’s office on March 2.

Detectives interviewed Muhl at the couple’s home that day, and he told them the same story. They questioned him again at the sheriff’s office later that night and suggested his story wasn’t adding up. He fatally shot himself the next morning.

Green said investigators believe the homicide occurred at the home. They are testing potential blood samples found in the home, he said.

They are exploring “potential motives” and have some “working theories,” Green said, but declined to elaborate. There is no indication anyone else was involved in the homicide, he added.

On their initial visit to Muhl’s home, detectives questioned him about a pile of rocks covering an area about 4 feet by 10 feet, Green said. He told them at that time he’d been doing some landscaping work.

Later they learned Gerald Muhl had told one of his wife’s relatives that he was “moving rocks because he did that for therapeutic reasons … after he returned to town and concocted the story about her being deceased,” Green said. He also told detectives in a follow-up interview he would “move rocks back and forth in the yard for therapeutic reasons.”

Investigators have recovered firearms from the home that belonged to the couple but have not connected any of them to her death.

Fraud Investigation Nicholasville Woman Found Guilty

A federal jury has found a Nicholasville woman guilty of defrauding the Social Security Administration for approximately a decade and fraudulently filing for bankruptcy, among other charges.

On Thursday a jury convicted 51-year-old Sheryl Bruner of one count each of theft of government money, failure to disclose assets, and bankruptcy fraud. She was also convicted of ten counts of money laundering and two counts of making false statements. The jury returned the verdicts after approximately two and a half hours of deliberation, following four days of trial.

The evidence at trial established that from 2003 until 2013, Bruner fraudulently claimed that she was disabled and had no funds or source of income to qualify for financial assistance from the Supplemental Security Income program.

SSI is an income assistance program designed to provide financial assistance to elderly and disabled individuals who meet the program’s eligibility requirements. Bruner failed to disclose and concealed from the SSA that she owned multiple companies, which collectively earned millions of dollars during the time she was receiving financial assistance.

Bruner worked primarily as a Medicaid service provider.

Officials say the evidence also established that on May 16, 2013, Bruner filed for bankruptcy despite the fact that she had more than a million dollars in assets.

Bruner had tried to hide the amount of cash she had on hand, at the bank and trust accounts she maintained or controlled, and vehicles and real estate she owned, officials said.

Bruner is scheduled to appear for sentencing in June 2014.

The money laundering offenses carry a maximum of 20 years in prison, the theft of government property offense carries a maximum of 10 years, and the other offenses each carry a maximum penalty of five years. However, any sentence would be imposed by the Court, after consideration of the United States Sentencing Guidelines and the federal statutes governing the imposition of sentences.

Arson Investigation Car Set on Fire in Lexington

A car was intentionally set on fire in front of a duplex in Lexington Friday morning.

Neighbors on Radcliffe Road say they heard a lot of arguing coming from the duplex, and that the suspect left the area only to return Friday morning, when they saw flames.

“I actually got a call from my sister-in-law up the street that there was something on fire outside my house, and I opened the door and there was flames everywhere,” said Latiphia Brewer.

It didn’t take long for Lexington firefighters to put out the flames, but now they have an investigation on their hands to find out who set the car on fire and why.

Brewer says she moved to the duplex in February with her son, but now she’s having second thoughts.

“I’m not going to be able to go back to sleep not knowing what happened and know if someone is going to come back and set the house on fire, I don’t know what to think now,” she said.

Lexington fire officials said they do know someone set the car on fire intentionally. The investigation is in the early stages, no arrests have been made yet.

Private Detective Richmond Man Arrested After Forging 17 Checks

A Richmond man was arrested and charged in connection to several stolen checks in the area.

Brian K. Johnson, 33, was arrested Wednesday after he stole and forged 17 checks in the past two months, according to police.

Officers say they arrested Johnson Wednesday as he was attempting to cash a stolen check in the amount of $500.00 at U.S. Bank on Main Street. Police say Johnson had cashed at least 15 stolen and forged checks on that same account totaling $3,095.

Police said Johnson ingested four oxycodone pills before he was taken into custody trying to avoid being charged for possession of the drugs.

He was taken to Baptist Health and medically cleared before being taken to the Madison County Detention Center, police said.

Johnson is also accused of passing two stolen checks at the Relax Inn on Northgate Drive in February. An employee told police each check was written for $250.00 and drawn on a closed account that belonged to someone else.

Police later learned the checks had been stolen and the account holder’s signature had been forged.

The checks Johnson used at the hotel in February is from a different account from the one Johnson had forged the checks totaling more than $3,000, police said.

Johnson is charged with three counts of receiving stolen property under $500, 17 counts criminal possession of a forged Instrument second degree, forgery second degree, possession of a controlled substance first degree, tampering with physical evidence and theft by deception under $10,000.

Police say a bench warrant from the Jackson Circuit Court was served on Johnson for failure to appear in connection with an indictment charging him for four counts theft by deception under $10,000.

Pedophile Tracking 13 Arrested in Connection to Child Porn

Lexington Police announced Friday more than a dozen arrests were made in connection with an overwhelming number of leads involving the distribution and sharing of child pornography.

It has been six weeks since Lexington police formed the Internet Crimes Against Children Task Force. In that time, investigators say they’ve made 13 arrests, four of them juveniles.

Charges vary from possessing and distributing child pornography to using electronic means to contact minors.

The task force, formed in late January, is made up of officers from all over the Lexington Police Department. Resources were shifted to help tackle what investigators call a very serious problem.

During a news conference Friday afternoon, the task force announced the arrests, also discussing that they’d partnered with state police, even Fayette County public school law enforcement, to put a stop to the illegal acts.

Along with the 13 arrests, more than 50 electronic devices were seized, as well as more than 1,000 images and videos containing child porn.

Police say the investigation isn’t over yet; the next phase involves adding more manpower.

Private Detective Army Soldier Sentenced in KY on Bribery Charges

A U.S. Army soldier was sentenced to serve 12 months and one day in prison for his role in stealing fuel at Forward Operating Base (FOB) Fenty near Jalalabad, Afghanistan.

Acting Assistant Attorney General Mythili Raman of the Justice Department’s Criminal Division and U.S. Attorney David J. Hale of the Western District of Kentucky made the announcement after sentencing by U.S. District Court Judge Thomas B. Russell in the Western District of Kentucky.

According to court documents, in May and June 2010, U.S. Army Sergeant Kevin Bilal Abdullah, 40, of Clarksville, Tennessee, was involved in overseeing the delivery of fuel from FOB Fenty to other military bases. Abdullah created fraudulent documents called Transportation Movement Requests purporting to authorize the transport of fuel from FOB Fenty to other military bases, even though no legitimate fuel transportation was required. After the trucks were filled with fuel, these fraudulent documents were used by the drivers of the fuel trucks at FOB Fenty’s departure checkpoint to justify the trucks’ departures. In truth, the fuel was simply stolen, and Abdullah and his co-conspirators received payment in cash from a representative of the Afghan trucking company that allegedly stole the fuel.

Abdullah pleaded guilty on August 29, 2013 to receiving payments from a representative of the trucking company in exchange for facilitating the theft of fuel in approximately 25 fuel trucks. He pleaded guilty to conspiracy to commit bribery and to the substantive count of bribery. At sentencing, he was ordered to pay $466,250 in restitution.

Abdullah’s sentencing was the fourth conviction arising from this investigation of fuel thefts at FOB Fenty. On August 3, 2012, Jonathan Hightower, a civilian employee of a military contractor who had conspired with Abdullah and others, pleaded guilty to similar charges. After cooperating with the government, he was sentenced on October 28, 2013, to serve 27 months in prison. On October 10, 2012, Christopher Weaver, another conspirator, pleaded guilty to fuel theft charges and, after cooperating with the government, was sentenced on October 28, 2013, to serve 37 months in prison. On September 5, 2013, former Specialist Stephanie Charboneau pleaded guilty, and on February 4, 2014, she was sentenced to serve 87 months in prison. Weaver, Hightower, and Charboneau were prosecuted in the District of Colorado.

These cases were investigated by the Special Inspector General for Afghanistan Reconstruction (SIGAR), the Department of the Army-Criminal Investigation Division, the Defense Criminal Investigative Service, and the FBI.

The Abdullah case was handled by Special Trial Attorney Mark H. Dubester of the Criminal Division’s Fraud Section, on detail from SIGAR, and Assistant U.S. Attorney Michael A. Bennett from the Western District of Kentucky.

Wrongful Death Man Pleads Guilty to Killing Morehead State Student

A man charged with shooting a Morehead State University student to death last March has pleaded guilty in the case.

Casey Shay pleaded guilty to killing Cassandra “Cassie” Owens in her home last March.

Investigators say Shay shot her twice as she slept inside the bedroom of her Christian Street home. The 21-year-old’s body was found a day later. Police say Shay went to the Rowan County Detention Center and confessed he murdered the mother of his child.

Sentencing is scheduled for April 14. The recommended sentence is 38 years.

Shay’s attorney called his client “remorseful,” but didn’t want to discuss the plea.

Pedophile Tracking Wichita Man Charged

A 54-year-old Wichita man this week was charged with aggravated human trafficking and three counts of commercial sexual exploitation of a child.

A complaint filed in Sedgwick County District Court accuses Shailesh D. Bhakta of trafficking a 16-year-old between Oct. 26 and Nov. 7, then offering or receiving sex acts from the teen in exchange for valuables. He is also accused in the documents of allowing property he had an interest in to be used to sell sex acts with the 16-year-old during that same nearly two-week stretch in October and November.

Bhakta made his first appearance in court Tuesday on the charges. He is free on $100,000 bond and is due back in court for a preliminary hearing March 25.

Authorities arrested Bhakta Feb. 20 in downtown Wichita on suspicion of aggravated human trafficking, patronizing a prostitute and promoting prostitution, jail booking records show.

One of the state’s witnesses listed on his charging document is also facing human trafficking and commercial sexual exploitation of a child charges in Sedgwick County District Court.

Pedophile Tracking Bridgewater, Mass. Man Sentenced for Child Porn

A Bridgewater man was sentenced yesterday for possessing more than 2,000 images and videos of child pornography.

Kevin J. Balzarini, 38, was sentenced by U.S. District Court Judge Rya W. Zobel to 36 months in prison and five years of supervised release. In December 2013, Balzarini pleaded guilty to possession of child pornography.

An officer, acting in an undercover capacity, signed onto a peer-to-peer network and observed that Balzarini was offering files indicative of child pornography to share with network users. The officer requested and received an image containing child pornography. A search warrant was then executed at Balzarini’s residence, where computer media containing more than 2,000 images and videos of child pornography was seized. At the time of the search, Balzarini admitted to agents that he had been looking at child pornography for a number of years and stated that his interest was in children 13 years old and younger. Printed images of child pornography were recovered from Balzarini’s bedroom, as well as a container of girls’ underwear that Balzarini admitted he took from homes when he made deliveries as part of his employment.

United States Attorney Carmen M. Ortiz; Vincent B. Lisi, Special Agent in Charge of the Federal Bureau of Investigation, Boston Field Division; Colonel Timothy P. Alben, Superintendent of the Massachusetts State Police; and Bridgewater Police Chief Christopher D. Delmonte, made the announcement today. The case was prosecuted by Eve A. Piemonte Stacey of Ortiz’s Major Crimes Unit.
