Missing Person Body Found of Houston, TX Man

Harris County officials on Monday confirmed the identity of a body found in northeast Houston over the weekend to be that of a man reported missing since New Years Eve.

Jesus “Jesse” Leal, of Houston, had been last seen December 31.

Acting on an anonymous tip Saturday, investigators were led to a residence in the 5200 block of Mohawk where they discovered the victim’s body buried beneath a chicken coop.

Pasadena police detectives were called to the scene to determine whether the body found was connected to the disappearance of Leal, who was reported last seen in Pasadena on New Year’s Eve.

On Monday, officials with both Harris County and the Pasadena Police Department confirmed that the body had been identified.

Harris County investigators had been following the case for weeks and referred the case to Pasadena detectives early last week after reports that Leal, 41, had last been seen in Pasadena.

Shortly after, the Pasadena Police Department obtained and then released video surveillance footage of a person using the victim’s credit card at a convenience store.

From there, according to Pasadena police spokesman Vance Mitchell, the anonymous tip led officials to the address in Houston.

Wrongful Death Body Found Buried in Leesburg, FL Backyard

Lake County deputies confirm a body found buried in the backyard of a Leesburg home Saturday is that of a missing man.

The body of 63-year-old Jesse Wachter was found behind a home on North Lake Drive at the Mid-Florida Lakes retirement community. Deputies confirm he was murdered.

The investigation began around 8 p.m. Saturday when deputies received a report from a neighbor who said someone was at the home, loading items onto a trailer.

The Lake County Sheriff’s Office said Wachter, the home’s owner, was last seen two or three weeks ago.

When deputies arrived, they found Wachter’s son, Jesse Jordan, 28, using his father’s truck to load up Wachter’s motorcycle, his golf cart and appliances.

Jordan’s girlfriend, Jessica Thigpen, 28, was in the truck with him.

Deputies discovered they both had drugs, and after admitting they were drug addicts, they were arrested for possession and taken to the Lake County Detention Center.

After feeling something was off, deputies continued to investigate.

“A cadaver dog was brought up to the home at which point he alerted on the property,” explained Lake County Sheriff’s Office Lt. John Herrell.

“Crime scene personnel were then brought up to begin the excavation process. I can tell you at this point a body has been found on the property and detectives are working hand in hand with the medical examiner’s office and crime scene personnel to exhume the body and eventually turn it over to the medical examiner for an autopsy to take place,” Herrell continued.

Crime scene investigators have been at the home since Saturday night and have been removing a lot of evidence from the home including a shovel and a sealed garbage can that was so heavy two men struggled to load it into the van.

On Monday, deputies said mulch was used to cover the spot where Wachter was buried. Detectives believe the person or persons responsible for burying him purchased several bags of cypress mulch, likely from a Home Depot store.

Missing Person Tara Poe of South Charleston, WV

The West Virginia State Police is asking for help from the community to find a woman who has been missing for more than a month.

Tara Renae Poe, 40, was last seen at Highland Hospital in Kanawha City on Dec. 11.  She is from the Logan and Mingo County area.  Poe was reported missing to the South Charleston Detachment of the West Virginia State Police on Dec. 30.

Missing Person 2 Teens Missing in Nicholas County

Nicholas County police are looking two missing 16-year-olds who were last seen at their individual homes Sunday around midnight.

The teens are named Josie Isaacs and Austin Padgett.

Isaacs is a 5’5” female, approximately 130 with shoulder length brown hair. Padgett is a 5’10” male approximately 130-140 pounds with short black hair.

The federal trade commission is sending a warning, as we close in on tax season.

The FTC says people claiming tax identity theft has doubled in the last two years, and all that those looking to steal your return need is phone number and address.

Missing Person Justino Fernando of Buena Park, CA

The Buena Park Police are searching for an 88-year-old resident missing since Jan. 1 of this year.

According to the Missing Person Bulletin, Justino Daguro Fernando was last seen at around 2:15 p.m. that day at his home in the 7400 block of 8th St.

Fernando usually walks the area to collect recyclables. His normal route is 8th St. to Western Ave., Western Ave. to Orangethorpe Ave., Orangethorpe Ave. to Knott Ave., and Knott Ave. to 8th St.

Fernando is described as about 5’2”, 140lbs., with black hair and brown eyes, and last seen wearing a blue shirt, dark jacket, cream color pants, and black shoes. He has friends in the area and does not drive. He also takes medication for his thyroid and high blood pressure.

Insurance Fraud Former HealthEssentials Solutions Inc. Exec. Ordered to Pay

Michael R. Barr, former chief executive officer of Louisville, Kentucky-based HealthEssentials Solutions Inc., has paid $1 million to resolve allegations that he knowingly caused HealthEssentials to submit false claims to Medicare between 1999 and 2004, the Justice Department announced today. Norman J. Pfaadt, HealthEssentials’ former chief financial officer, also agreed to pay $20,000 to resolve similar allegations. HealthEssentials provided primary medical care to patients in nursing facilities, assisted living facilities, and other settings from 1998 until it filed for bankruptcy and ceased operations in 2005. Barr founded HealthEssentials and served as its president, chief executive, and board chairman. Pfaadt served as HealthEssentials’ senior vice president and chief financial officer.

“Healthcare executives should lead by example and create cultures of compliance within their companies, not pressure their employees to cheat the taxpayers,” said Assistant Attorney General for the Civil Division Stuart F. Delery. “We will continue to hold health care executives personally accountable for their dealings with Medicare.”

“Pursuing health care fraud is a priority of this office and the Department of Justice,” said U.S. Attorney for the Western District of Kentucky David J. Hale. “We will continue to work with the Department of Health and Human Services and the public to ensure that fraudulent claims are investigated and those responsible are required to pay.”

In March 2008, HealthEssentials pleaded guilty to submitting false statements to Medicare relating to services it provided to patients in assisted living facilities and entered into a civil settlement with the government. In May 2011, HealthEssentials’ former director of billing, Karen Stone, pleaded guilty for her role in the company’s billing scheme.

The settlement announced today resolves Barr’s and Pfaadt’s alleged liability under the False Claims Act for their roles in HealthEssentials’ false billings. The government alleged that, between 1999 and 2004, HealthEssentials billed for services that were inflated or not medically necessary and that Barr and Pfaadt pressured HealthEssentials employees to inflate the company’s billings, despite having been advised by attorneys and others that doing so would be improper. The government further alleged that Barr pressured HealthEssentials employees to conduct special medical assessments on patients, without regard to whether the patients required the assessments, solely to increase the amount that HealthEssentials could bill for the visits. As part of the settlement, Barr has agreed to a three-year period of exclusion from participating in federally funded health care programs.

“Executives cheating taxpayers and patients—as alleged in this case—should beware of exclusion from Medicare, Medicaid, and all other federal health programs, as well as criminal and civil liability,” said Inspector General of the U.S. Department of Health and Human Services Daniel R. Levinson. “Vulnerable beneficiaries deserve protection from potentially harmful, medically unnecessary services.”

The allegations that were resolved by the settlement arose in part from a lawsuit filed by former HealthEssentials employees Michael and Leigh RoBards under the qui tam, or whistleblower, provisions of the False Claims Act, which allow private citizens to bring suit on behalf of the government and to share in any recovery. Mr. and Mrs. RoBards will receive a total of $153,000.

This settlement illustrates the government’s emphasis on combating health care fraud and marks another achievement for the Health Care Fraud Prevention and Enforcement Action Team (HEAT) initiative, which was announced in May 2009 by Attorney General Eric Holder and Health and Human Services Secretary Kathleen Sebelius. The partnership between the two departments has focused efforts to reduce and prevent Medicare and Medicaid financial fraud through enhanced cooperation. One of the most powerful tools in this effort is the False Claims Act. Since January 2009, the Justice Department has recovered a total of more than $17 billion through False Claims Act cases, with more than $12.2 billion of that amount recovered in cases involving fraud against federal health care programs.

The case was handled by the Commercial Litigation Branch, Civil Division, U.S. Department of Justice and the U.S. Attorney’s Office for the Western District of Kentucky, with assistance from the Department of Health and Human Services Office of Inspector General and the Federal Bureau of Investigation.

The claims settled by this agreement are allegations only; there has been no determination of liability.

Private Detective 3 Arrested in Johnson County Meth Lab

Three people were arrested after deputies discovered two first stage meth labs at a home in Johnson County Friday.

Johnson County Sheriff’s Deputies were assisting the Kentucky Department of Probation and Parole with a home visit on Caudill Branch in Sitka, KY, when they found the two stage meth labs at the home, as well as what appeared to be methamphetamine, small baggies, scales, smoking pipes, various meth precursors, and a small amount of cash.

Michael D. Castle, 41, who was on probation for manufacturing of methamphetamine, was taken into custody and charged with manufacturing methamphetamine, possession of meth, trafficking meth, possession of meth precursors and possession of drug paraphernalia.

Also arrested were Gary B. Branham, Jr.,38, of Staffordsville, for possession of meth, possession of meth precursors, and possession of drug paraphernalia; and Janna N. Blanton, 29, of Swamp Branch for possession of a controlled substance, possession of drug paraphernalia, and possession of marijuana.

Castle, Branham, and Blanton were taken into custody and lodged in the Big Sandy Regional Detention Center.

Wrongful Death Missing Autistic Houston Boy Killed by Drunk Driver

A 12-year-old autistic boy reported missing was killed after being hit by a truck while walking on an overpass Saturday night in southwest Houston, police said.

According to the Houston Police Department, a 12-year-old autistic boy left his home, and his parents called police once they realized he was gone.

Around 8 p.m., the boy was walking along the northbound lanes of the South Post Oak overpass near South Main Street and was hit by a black pickup, police said.

The 12-year-old died at the scene of the accident, police said.

Police said the driver of the pickup was arrested on a driving while intoxicated charge, but has not been said whether he will face charges related to the boy’s death.

Pedophile Tracking Leicester, NC Man Faces Multiple Felony Charges

A Leicester man is facing multiple felony sex charges including rape of a child.

Claude William Thomason, 23, of 38 Castlebay Drive, was charged today with two counts of first-degree rape of a child and two counts of disseminating obscenity, according to warrants at the Buncombe County magistrate’s office.

Thomason is accused of having sexual intercourse with a girl younger than 13 on two occasions, on Dec. 30 and Dec. 31 of 2011, according to warrants.

He’s also accused of sending photos of his private parts in messages to a juvenile from his cell phone on two occasions, on April 23 and April 29 of 2013, according to warrants. Buncombe sheriff’s officers investigated.

Thomason is being held at the Buncombe County Detention Facility under an $80,000 secured bond.
