Wrongful Death Man Sentenced to 40 Years for Killing Clay County Sheriff

A judge sentenced a man convicted of killing a Clay County sheriff more than 40 years ago to life in prison Monday.

A jury convicted Oran Brumley of shooting Sheriff Matt Sizemore five times with a high-powered rifle as he was serving warrants in the Ephram Creek area on June 1, 1969.

Prosecutors say Brumley admitted killing Sizemore, but retracted the confession during his trial last month. It took the jury just two hours to reach its verdict.

Brumley was already serving time in an Ohio prison for a 2004 knife attack that killed an 80-year-old man.

Private Detective Kids Found Sleeping in Room with Drugs and Dead Body

Police arrested a woman after they found her children asleep in a room with drugs and a man dead from an overdose in Madison County.

Police responded to a home on Dixie Plaza around 8:30 a.m. Friday after a report of an unresponsive 24-year-old male. Police say officers arrived and found a man on the bedroom floor not breathing and without a pulse. They were not able to revive the man.

Police say their investigation revealed the man took several different drugs overnight and determined he might have died from an overdose.

Kristen Johnson, 22, of Franklin, Ohio, was also present. Police say she told them she was the man’s girlfriend. Officers say they found crack cocaine in plain view on a bedside table, along with drug paraphernalia. Police say they also found a glass pipe in Johnson’s purse, and a syringe containing liquid residue in her boot.

Johnson’s 4-year-old and 6-year-old children were asleep in the bedroom with the drugs and the dead body.

Police arrested Johnson and charged her with possession of a controlled substance, wanton endangerment and possession of drug paraphernalia.

Missing Person Body of Missing Indiana Man Found

A body found in central Indiana wooded area has been identified as that of a 21-year-old man who was reported missing in August.

The Henry County Sheriff’s Department says a hunter spotted the body on Sunday in a wooded area in the northwestern part of the county. The Courier-Times reports authorities used dental records to confirm the body as Jordan Bragg of Middletown.

Henry County Coroner Stephen Hacker says Bragg’s death appears to be a suicide and no signs of foul play were found in the area about 15 miles southwest of Muncie.

Bragg was last seen Aug. 11 after having an argument with his girlfriend. Bragg’s body was found about a mile from his home.

Identity Theft Exeland, WI Man Pleaded Guilty

A man from Exeland, Wis., pleaded guilty last week to allegations he stole from the U.S. Treasury by stealing the identity of others, according to U.S. Attorney John W. Vaudreuil of the Western District of Wisconsin.

Jason T. Procknow, 40, entered the plea in U.S. District Court in Madison. He pleaded guilty to the theft of funds from the U.S. Treasury and aggravated identity theft for his scheme to file false tax returns and demand tax refunds using the stolen identities of other individuals.

As described by the assistant U.S. attorney at the plea hearing, Procknow’s conduct involved sending blank forms to prison inmates throughout the country, promising them assistance with their legal difficulties. The forms required the inmates to provide personal identifying information, including social security numbers. Procknow then used the identity and social security numbers of the inmates to file fraudulent tax returns, directing the refunds deposited to his personal bank account.

U.S. District Judge William M. Conley scheduled sentencing for Feb. 13.

Procknow faces a maximum penalty of 10 years in federal prison and a $250,000 fine, and will be required to pay immediate restitution to the United States in connection with the theft of government funds.

In addition, due to the aggravated identity theft, committed by using the identifying information of another person to commit the felony theft of government funds, he will also face a mandatory two-year sentence, consecutive to any time imposed for the theft of funds.

“This case was successfully investigated and prosecuted because of the exceptional cooperation between federal and local law enforcement,” Vaudreuil said.

“Today’s guilty plea by Procknow exemplifies the IRS’ intense focus on the pursuit of identity thieves who victimize our tax system,” said Kelly R. Jackson, Special Agent in Charge of the IRS Criminal Investigation office in Madison. “These are serious financial crimes for which we continue to aggressively pursue and prosecute those responsible.”

IRS Criminal Investigation, Federal Bureau of Investigation, and Eagan Police Department in Minnesota investigated the case and Assistant U.S. Attorney Robert A. Anderson serve as prosecutor.

Missing Person Jamisha Gilbert of Lynchburg, Virginia

Dozens of officers combed the Concord Turnpike area Monday afternoon near the industrial area where officers found the wrecked and abandoned car of a missing Lynchburg teenager.

Jamisha Monique Gilbert, 18, last was seen by friends early Friday morning but disappeared under what investigators are calling “suspicious circumstances.”

Her wrecked burgundy 2002 Honda Accord was found near the intersection of Concord Turnpike and Winston Ridge Road a few hours after she was last seen.

Officers used a state police helicopter, tracking canines and boats to search the James River for clues to find Gilbert on Monday evening. The search stretched from Garnet Street to U.S. 460, through industrial areas, woods, a train yard and the river.

Gilbert was reported missing on Sunday by her mother, Norma Gilbert-Eldridge.

Monday, the Lynchburg Police Department issued a missing person alert as they searched the area.

“We are concerned for her welfare and her safety,” Lynchburg police Lt. Dave Gearhart said. However, he said he did not think there was a threat to the public.

Gilbert-Eldridge is holding out hope that her daughter will return home soon.

“It’s stressful. It’s hard. It’s unbelievable. … It just doesn’t seem real,” she said from her College Hill home Monday evening. “I’m just going to keep hope alive.”

She spoke of her daughter with pride, saying Gilbert was an honor roll student every semester at Heritage High School, where she graduated in May.

Gilbert enjoys poetry and has been playing piano since she was 5 years old, her mother said.

The teenager has been living near Lynchburg College where she was caring for an ill relative. She planned to go to Central Virginia Community College in the spring, before continuing on to the University of Maryland to earn her bachelor’s degree on her way to becoming a lawyer, her mother said.

In a video posted to YouTube in February, Gilbert expressed her happiness at being accepted into the University of Maryland and proudly displayed her acceptance letter.

Investigators have released little information about the search for Gilbert. Gearhart declined to answer questions about evidence gathered during Monday’s search, the condition of her car, where she may have been heading or whether investigators believe any crimes have been committed.

When asked whether they suspect foul play, the lieutenant said only that officers with the department’s Criminal Investigations Division have classified her disappearance as “suspicious,” and do not believe Gilbert is a runaway.

Investigators have found no evidence linking Gilbert’s disappearance to that of Alexis Murphy, the 17-year-old reported missing from Nelson County in August. Murphy has not yet been found. Randy Taylor of Lovingston has been arrested and charged with abduction in connection with her disappearance.

He remains in jail awaiting trial.

In a news conference late Monday, Gearhart said officials still were deciding how the search for Gilbert would continue in the coming
days.

Until then, he asked that anyone who may have information about her disappearance come forward.

She is described as a black woman of medium complexion, standing 5 feet 5 inches and weighing about 140 pounds. She has brown eyes and black hair and was last seen wearing a white shirt, black jacket and brown
boots.

Missing Person Remains Found in El Dorado, KS

Police believe a body found last week in El Dorado is that of a man who had been missing for about a month.

On Thanksgiving, a passerby found the body of a man on the south edge of El Dorado near a river.

Police believe the body is that of 43-year-old Gary Fields, who went missing early last month. Fields’ family reported him missing on November 2, concerned because he had medical conditions that required treatment.

They’re waiting on final test results to verify his identity and cause of death.

Pedophile Tracking Men Arrested in Child Sex Sting

A Crane man is set to appear before a federal judge in January after being charged with enticing a minor into sexual activity from a cell phone and email.

Michael Scott Tilley, 32, is one of five men who were arrested by federal authorities in a sting where the men were all accused of trying to have sex with minors.

According to a federal complaint, Tilley was sending emails to a person he believed was a 12-year-old girl, asking for pictures and a cell phone number and had further conversation that delved into questions about the girl’s body and whether she was a “wild child.”

Tilley then got even more explicit through email and text messages, saying the two would have sex and described some of the things they would do to each other, according to the complaint.

Then when Tilley arrived to the meeting place in Midland, according to the complaint, Tilley was arrested and told officers he “screwed up.”

Tilley agreed to speak with officers, according to the complaint, and told them “did not intend to have sexual intercourse with the girl he was messaging and further stated he intended to tell the child’s parents what she was doing.”

According to the complaint, Tilley said he’s met with teenagers three times before, but never called police about the encounters despite saying he wanted to help the teenagers.

Tilley is married with three children, 13 years old, 10 years old and 8 years old, according to the complaint.

Previously, the man pleaded guilty to a class C misdemeanor after being arrested for assault causing bodily injury to a family member and was placed on three months probation, according to the complaint.

In similar circumstances, several other men were also arrested for this crime.

Daniel Nickless, 24, Clarence Johnel White, 38, David Ernesto Martinez, 39, and DeAnte Savonne Johnson, 20, were also arrested and charged with enticing and coercing a minor. All five men have been indicted in federal court.

If convicted, the men could face between 10 years and life in federal prison.

Wrongful Death Los Angeles Man Pleads Guilty for Murder of Glendale Woman

A 55-year-old Los Angeles man pleaded guilty Monday to charges that several years ago he killed two missing women, including one from Glendale whose body was discovered in trash bags along a roadside in Rosarito, Mexico.

Aurangzeb “Simon” Manjra took a plea offer in exchange for pleading guilty to the first-degree murder of Glendale resident Esperanza Torio, and the second-degree murder of 44-year-old Los Angeles resident Maria Santos, according to Jane Robison, a spokeswoman for the Los Angeles County District Attorney.

“We are very pleased to bring justice and closure to the families after so many years,” said Prosecutor Habib Balian of the district attorney’s Major Crimes Unit.

As part of the plea deal, prosecutors dropped a special-circumstance enhancement, which meant he could have been sentenced for life without parole, Robison said.

Manjra faces a maximum sentence of 25 years to life in prison, she added.

Manjra was arrested in May 2010 on suspicion of killing the women who he reportedly dated before they went missing, Glendale police said. While some of Torio’s remains were found in Mexico, Santos’ body remains missing.

Torio’s sister reported her missing on Aug. 16, 1996, when she failed to return to their Chestnut Street home in Glendale, police said.

As a single mother, Torio, 39, raised two teenage boys and had recently landed a new full-time job. She was preparing to move into a new apartment in Glendale, but suddenly disappeared.

Police detectives investigated her disappearance, but there were few leads.

Manjra, who was a salesman, was a suspect, but investigators were unable to immediately link him to her disappearance.

But two days after Torio was reported missing, Mexican authorities found her remains in three black trash bags in Rosarito. Her head and feet were missing.

During a preliminary hearing, a Mexican officer testified that the cuts appeared to be have made recently. However, Mexican authorities didn’t know Torio was reported missing, so they didn’t make a connection.

Nearly a month later, a road worker found a black plastic bag containing a head with long black hair buried in some sand dunes, not far from where the body parts were found.

The following year in 1997, a Modesto police officer traveled to Mexico to get DNA samples from the body parts because she was investigating another missing person’s case in her area and was trying determine whether it was the person she was seeking.

But the DNA evidence didn’t match in her case. Still, the evidence was stored in a law enforcement database and remained there for years.

Then in 2009, Glendale detectives were investigating cold cases and reopened Torio’s case.

They took DNA samples from her family members and discovered that the samples matched the body parts found in Mexico.

Detectives began investigating Manjra again and discovered that he also dated Santos in 2004 — the same year she was reported missing to the Los Angeles police. But Santos was never found.

Manjra is scheduled to be sentenced Jan. 29 for the women’s deaths.

Private Detective Human Remains Found in Houston County, TN

Houston County Sheriff Darrell Allison and his investigators are waiting for an identification of human remains found in a remote, densely wooded area on Thanksgiving Day.

The remains have been sent to the Tennessee Bureau of Investigation’s Nashville lab, and Allison said the latest he’s heard is identification could take several weeks because DNA testing will be necessary.

“The remains were pretty extensively decomposed,” Allison said.

The sheriff declined to speculate if the remains are those of Leamom Luffman, who has been missing from his Bateman Branch Road residence since Oct. 7.

Allison said, out of respect for Luffman’s family, he would not comment on the missing 65-year-old man until a positive ID has been obtained.

Luffman is Houston County’s only open missing person case.

“Other surrounding counties have missing person cases, but we have no information that they would be in and around our county,” Allison said.

The discovery was made by a hunter on Thanksgiving morning in a heavily wooded area off Highway 231, which is also known as McEwen Highway.

The sheriff said the body was in a deep hollow that was a mile to 1½ miles from a paved roadway. The recovery team drove about two miles in a vehicle, and about another mile on four-wheelers before they had to proceed on foot into the thick woods of the hollow.

The area is part of a 2,000-acre hunting reserve that is under lease. Timber on the land has been harvested in some areas, while other locations are dense with mature trees and underbrush.

Luffman’s home on Bateman Branch Road appears on a map to be possibly two miles north of the area where the body was found.

Allison said there were no obvious signs of foul play at the scene, but some evidence was collected although it “was nothing substantial to help with the ID,” such as a wallet.

“The weather had taken a toll on the body,” Lt. Brian Hooper said regarding how long the body might have been in the woods. “Once we find out who it is, we can narrow that down.”
