Pedophile Tracking Farmington, NM Man Arraigned

A 28-year-old Farmington man was arraigned Monday in district court on multiple counts of child sexual assault.

Theo R. Jones was charged in October 2013 in Aztec Magistrate Court with one count of first-degree criminal sexual penetration of a child and one count of second-degree criminal sexual penetration.

Chief Deputy District Attorney Dustin O’Brien said that the charges were not brought to district court sooner because Jones was charged with an additional four counts of first-degree criminal sexual penetration of a child on June 24.

“If we change or modify a charge, or if we add an additional charge, they have a right to a preliminary hearing on the new or additional charges,” he said.

Jones appeared at a preliminary examination hearing to answer to the additional charges on Sept. 4, according to court records.

According to an arrest warrant affidavit, deputies from the San Juan County Sheriff’s Office were contacted by high school officials in Farmington in September 2013 after a student said that she was sexually abused by Jones.

She told detectives from both the Farmington Police Department and the sheriff’s office that she had been sexually assaulted by Jones on multiple occasions beginning when she was 12 years old, the affidavit states.

She said the abuse occurred at residences located in both Farmington and in unincorporated San Juan County, according to the affidavit. She said that Jones would force her to have sex with him while she baby-sat his children, but did not report the abuse for fear of getting into trouble, the affidavit states.

She said the final time he forced her to have sex was in November 2012, the affidavit states.

She said that her grandmother was made aware of the abuse, but asked the girl’s mother not to report the abuse to law enforcement, the affidavit states.

The girl’s mother told detectives that she decided to tell school officials about the abuse because her daughter was “acting up” and was “very depressed,” the affidavit states.

Deputies encouraged the girl to call Jones while they recorded the conversation. During the phone call, Jones allegedly told the girl to lie and say that she made up the story, the affidavit states.

Court records do not indicate when Jones will next appear in court.
