Wrongful Death Suit Filed in Lincoln Co. Bus Crash

A wrongful death lawsuit in the case of a Lincoln County man who died in a school bus crash is closer to going to trial.

William “Otis” Coleman was hit head-on by a school bus in May of last year. The bus had went into the wrong lane to avoid another bus.

Coleman’s family filed a wrongful death lawsuit against the bus driver, the superintendent, the district’s transportation director and two mechanics.

“There’s a thing in Kentucky called qualified immunity and it says that any public official that makes discretionary policy type decisions and supervises other people is entitled to immunity if they are claimed to have done something wrong in making those decisions,” said Attorney David Tremble.

In court Friday, attorneys argued whether the superintendent and transportation director should remain as defendants in the case.

“We think the superintendent is directly responsible for this tragedy and she should be a defendant in this case at trial, and the jury should decide what she did or did not do correctly,” said Tim Bates, the attorney for the Coleman family.

The judge will make about the superintendent and transportation director by November, which is when the trial will be.
