Insurance Fraud Christina Denise Simmons

Baltimore, MD – Attorney General Douglas F. Gansler announced today that Christina Denise Simmons, 36, of Upper Marlboro, was arraigned in the Frederick County Circuit Court on one count of insurance fraud and one count of felony theft. Bail was set at $10,000. A trial date has not yet been set.

The charges allege that from Nov. 16, 2005 through March 30, 2006, Simmons sent false documents and made false oral statements to State Farm Insurance Company in support of a fictitious stolen automobile claim. Consequently, on Jan. 5, 2006, State Farm issued a check in the amount of $21,563, payable to the vehicle’s lien holder.

A fraudulent insurance claim of $300 or more is a felony and is punishable by a maximum sentence of 15 years incarceration and a $10,000 fine. Theft of at least $10,000 but less than $100,000 is a felony punishable by up to 15 years incarceration and a $15,000 fine.

A criminal charge is merely an accusation of wrongdoing and the defendant is presumed innocent unless the State proves her guilt beyond a reasonable doubt.
