Fraud Investigation Commerce Township, MI Medical Office Raided

A medical office in Commerce Township was raided by U.S. Drug Enforcement Administration agents Tuesday morning in connection to a large-scale health fraud investigation involving 13 suspects in the U.S. and Canada.

St. Joseph Mercy Oakland Hospital’s Dr. Rajat Daniel, 47, of Union Lake Medical Center, has been implicated in the ring, along with 12 other physicians, marketers and pharmacists.

Representatives of the FBI, the Inspector General of the Department of Health and Human Services and the DEA joined Michigan U.S. Attorney Barbara McQuade in naming those that were indicted in the fraud and drug distribution plot.

The suspects were included in a 2011 indictment involving the owner of 26 pharmacies statewide who provided kickbacks, bribes and other illegal benefits to physicians to coax them to participate in a closed medical billing and prescription fraud ring.

Babubhai Patel, the original owner indicted, is also accused of a “conspiracy to distribute controlled substances at the Patel pharmacies to facilitate the submission of false and fraudulent claims to Medicare, Medicaid, and private insurers,” according to a media release from the U.S. Attorney’s office. “The controlled substances included … oxycodone (Oxycontin), … hydrocodone (Vicodin, Lortab), … alprazolam (Xanax), and … cough syrup with codeine.”

According to the indictment, prescriptions for these drugs were written outside the course of legitimate medical practice, said the attorney in the release.

The indictment goes on to say that Patel and the pharmacists in his fraud syndicate would distribute the drugs to people who didn’t really need them in exchange for fraudulent billing to customers’ insurance companies.

Of the 26 defendants originally charged, six, including Babubhai Patel and four pharmacists, were convicted at a trial last summer. Fifteen additional defendants, including six pharmacists and two doctors, have pleaded guilty in the case.

The five remaining defendants whose charges were renewed in the superseding indictment are set for trial on June 10, said McQuade. On Feb. 1, Babubhai Patel was sentenced to 17 years imprisonment by U.S. District Judge Arthur J. Tarnow.

“Taxpayers fund Medicare and Medicaid to provide health care for needy citizens,” McQuade said. “We hope that doctors and pharmacists will take note that if they exploit these programs for personal profit, they will face serious consequences.”

Robert L. Corso, Special Agent in charge of DEA’s Detroit Field Division, said Tuesday’s indictments were significant.

“It is alleged … these individuals abused their positions of trust and endangered the lives of countless people by illegally distributing opiate painkillers and depressants throughout southeast Michigan,” he said in McQuade’s release.

Tuesday morning’s raid in Commerce Township — at the Union Lake Medical Center on Union Lake Road — led to St. Joseph Mercy Oakland doctor Rajat Daniel being included in the grouped case. He’s one of the physicians listed at the facility.

Late Tuesday, St. Joseph Mercy media relations personnel sent out a prepared statement with the hospital’s reactions to Daniel’s alleged involvement in the drug fraud scheme.

President and CEO Jack Weiner said drug fraud is strongly condemned and is contrary to the mission that St. Joseph Oakland tries to purvey.

“We expect all members of our organization to act with integrity and comply with all DEA regulations and practices. We are deeply dismayed by the allegations related to Dr. Daniel,” Weiner said in the release. “At this time, we have limited information about the situation. As we learn more, we will follow established policies as they relate to his future medical staff privileges.”

Before the raid in Commerce, reports indicated that an office in Macomb County — the Macomb Medical Center, located on 19 Mile Road — underwent a similar investigation. Ruben Benito, 72, has been accused at the Clinton Township office. Both offices were closed for the day. Commerce Township’s Daniel could not be reached for comment.

Of all the 13 indicted Tuesday, new defendants included five doctors, four pharmacists, and a home health agency owner.

Daniel, in addition to Vinod Patel, 40, of West Bloomfield, and physician Javaid Bashir, 59, Madison Heights were those charged in Oakland County. Two from Canada, two from Canton, two from Detroit, one from Jackson and one from Grand Blanc are also included in the drug fraud ring.

Missing Person Teacher Still Missing in New Orleans

The mother of a missing New Orleans-area school teacher said it is time to broaden the nearly three-week search for her daughter.

“It should be nationwide now,” Toni Enclade of Long Beach, Calif., said. “As a mother, my instincts were leading me to know that she is not in any of the areas where they’ve been searching. I feel and believe that someone has Terrilynn.”

Police are in their third week of searching for second-grade teacher Terrilynn Monnette, 26.

Originally from Long Beach, Monnette was last seen March 2 with friends at a bar called Parlay’s in the Lakeview section of New Orleans. She left the bar around 4 o’clock that Saturday morning with a male acquaintance, ABC New Orleans affiliate WGNO-TV reported, telling her friends that she was going to take a nap in her car before driving home because she’d had a few drinks.

The bar manager told WGNO that Monnette and the man were talking in the parking lot “for a little while,” but the bar’s video surveillance showed they left in separate cars. “He went one way, she went the other,” the manager said.

The man has been cleared by police, who say they have no suspects or persons of interest as their investigation continues.

Police detectives are searching for Monnette’s car, a three-door, black Louisiana-registered Honda Accord with license plate number WUN494, according to a missing person’s flier.

An independent search team operated by the nonprofit group Texas Equusearch Search and Recovery Team had been assisting New Orleans police by searching local waterways but today called off the effort, according to the police department.

Monnette’s longtime friend Lezette Montion has organized several searches and says the more time passes, the more frustrated family and friends have become.

“There are just so many bodies of water to search,” Montion said. “During a search for her car last weekend, the sonar even broke.”

It was a disappointing setback, Montion says.

U.S. Customs and state police have also assisted in the search for the school teacher, bringing in helicopters to conduct an aerial search around the Crescent City and Lake Pontchartrain, according to the New Orleans Police Department.

The search for Monnette has gained national attention. An anonymous donor Tuesday gave $1,000 to add to the reward money. That pocket now totals $3,600.

“It’s just not enough incentive to motivate someone to come forward with information,” said friend Montion, who has organized a golf tournament and silent auction for April 7 at the Belle Terre Country Club outside of New Orleans.

Montion, the missing teacher’s sorority sister, hopes to continue to raise the reward total and is also in touch with the House of Blues in New Orleans and hopes the venue will play host to a concert after the golf tournament. Montion is also working to organize a fundraiser in Monnette’s home state of California.

Monnette had been teaching in the New Orleans area for two years, and recently became a second-grade teacher at Woodland West Elementary school in Jefferson Parish. Woodland West Principal Amy Hoyle said Monnette showed outstanding promise.

“She came after the school year started, which is usually hard for teachers. But she handled it great, and she emerged quickly as a teacher-leader,” Hoyle said.

“She took the lowest-performing classes, and in a matter of four months, she turned those students into some of our highest achievers.”

Hoyle said Monnette’s colleagues and second-grade students were “all very aware that this is going on.”

Woodland West Elementary has provided grief counselors.

Wrongful Death Head of Colorado Department of Corrections Killed

The head of the Colorado Department of Corrections has been shot and killed on his own doorstep.

Authorities in Monument, north of Colorado Springs, are warning that the gunman is still on the loose.

They are are looking for a dark-coloured “boxy” car seen near Tom Clements’ house on Tuesday night.

He was shot at around 8.30pm when he answered his front door.

The vehicle’s engine was running and a witness reported seeing one person driving away in the car.

A family member called the emergency services to report the shooting of the 58-year-old.

“We have no known suspect at this time,” Sheriff’s Lt. Jeff Kramer told reporters.

“Whether he was specifically targeted or this was random, we don’t know,” he added.

“We know of his position and realise that it is a possible motive for a crime such as this.”

Search dogs were brought in to search a surrounding wooded area, while police went house-to-house trying to find out what neighbours knew about the shooting.

Colorado Governor John Hickenlooper appointed Mr Clements in 2011.

“I can hardly believe it, let alone write words to describe it,” he said in a statement to corrections department staff early on Wednesday.

“As your Executive Director, he helped change and improve DOC in two years more than most people could do in eight years. He was unfailingly kind and thoughtful, and sought the “good” in any situation,” he added.

Prior to his move to Colorado, Mr Clements served for more than three decades in the Missouri Department of Corrections.

He is survived by his wife, Lisa, their two daughters and their family.

Flags will fly at half-mast at all public buildings statewide until the day after his funeral.

The shooting came just hours before Governor Hickenlooper signed new gun laws for Colorado.

They are aimed at limiting ammunition magazines and expanding background checks, in light of the Aurora movie theatre massacre last July.

Insurance Fraud 4 Arrested in South Dakota

South Dakota Attorney General Marty Jackley says four people from the Rapid City area have been indicted and arrested on insurance fraud charges stemming from a 6-month investigation by the Division of Criminal Investigation.

According to a release, the investigation found over $30,000 in fraudulent claims or loan payments from different insurance/financial institutions. 27-year old James Boyce of Box Elder is charged with three counts of fraudulent insurance acts. Three people from Rapid City, 24-year old Amanda Boyce, 23-year old Tyler Whay and 21-year old Kyle Packman, are each charged with one count of fraudulent insurance acts. That is a class-4 felony, punishable by up to 10 years in prison with a $20,000 fine.

Private Investigator Corbin Man Arrested After Pouring Gas on Wife

Corbin police say they arrested a man after he poured gasoline over his wife and threatened to set her on fire over the weekend.

Police say on Saturday, they received a call from a juvenile saying her father was pouring gas in her mother’s eyes and trying to kill her. When officers arrived, they found a man had poured gas on himself and his wife, and was holding a lighter, threatening to light them both on fire. Police say the man also poured gas around the house, threatening to light it as well. Firefighters on the scene ended the standoff when they managed to direct a stream of water at the man, knocking him to the ground.

Officials say officers took Russell L Knickerbocker, 48, into custody and had him admitted to the Trillium Center at Baptist Health for evaluation. He was arrested Wednesday and charged with attempted murder, attempted arson, disorderly conduct and resisting arrest.

Private Investigator Former Frankfort Officer Pleads Guilty to Drug Charges

A former Frankfort Police Department sargent and ATF employee has entered a guilty plea on several drug charges, according to the State Journal.

Police arrested Jack Hazelwood, 55, last month. Troopers say they found 32 marijuana plants, along with processed pot and drug paraphernalia in two rooms of a home along Dreyfus Road in Madison County last month.

Hazelwood is scheduled for sentencing on May 24.

Arson Investigation 2 Suspicious Fires in Bath County

Kentucky State Police arson investigators will head out to the scene of two suspicious fires in Bath County Wednesday.

A vacant mobile home and a two-story house about two miles apart along US-60 burned at he same time early Tuesday morning. Fire destroyed both homes.

Officials say firefighters were responding to the house fire around 1:30 a.m. when they spotted the burning mobile home.

Officials say they found a vehicle stuck in the mud with the lights on and the keys still in the ignition at the house. Police say there was a “large amount” of evidence and drugs inside the vehicle.

There were no reported injuries.

Pedophile Tracking Nampa, ID Man Arrested After Standoff

A Nampa man who held police at bay in a four-hour standoff before being arrested on child sex-abuse charges is being held on $250,000 bond.

Magistrate Judge James Schiller set bond Monday for 52-year-old Patrick Michael Massie on charges of lewd conduct and sexual abuse of a minor.

Massie told the judge during his video arraignment that he is a “stand-up guy” who made a bad choice.

Prosecutors say in court documents the alleged victim said Massie inappropriately touched her between 2009 and early this year, and that she had become pregnant.

The Idaho Press-Tribune reports the girl told investigators that Massie purchased pills to terminate the pregnancy.

The court documents say Massie denies ordering the pills and says there was no sexual contact besides some inappropriate touching.

Pedophile Tracking Newtown, CT Man Sentenced to 20 Years

David Csanadi, the 36-year-old Newtown man who filmed himself as he sexually abused children as young as 18 months old, was sentenced to 20 years in prison Tuesday by a judge in U.S. District Court in New Haven.

The term was less than the maximum 25-year sentence that federal prosecutor Nareej Patel previously said he would seek, but more than the 15-year mandatory minimum term sought by Csanadi’s lawyer, federal public defender Paul Thomas.

Judge Janet Bond Arterton also ordered 15 years of probation for Csanadi after he is released.

Csanadi has been in either state or federal custody since April 2011, a month after Newtown police, acting on information developed by police in Monroe, seized his home computer and discovered not only child pornography he downloaded from the Internet, but also footage of him having sex with children ranging from 18 months to 6 years old.

Investigators said the victims were the children of his friends and the abuse occurred in 2006 and 2007.

Police said Csanadi also surreptitiously filmed children getting off school buses, playing at local parks and shopping with their parents at area stores, focusing his camera on their genitals.

Csanadi pleaded guilty to a single count of production of child pornography in federal court in November and to charges of first-degree sexual assault, illegal sexual contact with a minor and possession of child pornography in state Superior Court in Danbury in January.

At the time, Superior Court Judge John Blawie said he would impose a 20-year term, to run concurrently with Csanadi’s federal term, when he is sentenced on the state charges next month.
