Wrongful Death Scott County Native Indicted in Death of Toddler

A Scott County native has been indicted by a grand jury in Abilene, Texas in connection with the death of her toddler.

Tiffany Klapheke, 22, called 9-1-1 back in august after finding her 22-month-old daughter, Tamryn, unresponsive. A preliminary autopsy showed Tamryn was severely malnourished, dehydrated and had suffered chemical burns from her own waste.

Tamryn’s two sisters, Tatum and Taberlee, suffered similar injuries and were hospitalized.

Klapheke’s husband, Thomas, was deployed in the Middle East at the time of the toddler’s death and filed for divorce after he returned.

Accident Reconstruction Investigation Shows Firefighter at Fault in Pedestrian’s Death

A preliminary police traffic collision report says that a Lexington firefighter who was driving a fire truck that hit and killed a pedestrian last weekend was at fault in the incident.

Police say 27-year-old Lauren Woodall Roady of Washington, D.C., died shortly after being struck Saturday night near Triangle Park. She was in town for a running competition.

The driver of the fire truck, firefighter Christopher Presley, has been put on paid administrative leave. Police say the fire truck was on a non-emergency run and making a left turn when Roady was hit.

The police report says that Presley failed to yield to Roady, who was already in the crosswalk. That means she had the right of way when Presley turned into her path and struck her.

Lexington Police say the investigation is still ongoing. At this point, the results of the toxicology test and medical examiner’s report are still pending, but police say there is no information or evidence to indicate that any charges will be placed against Presley.

Insurance Fraud 7 Indicted in MO for Fraud Involving BCBS

KANSAS CITY, Mo. — Federal prosecutors say that six Kansas City Missouri municipal employees and a Jackson County employee have been arrested in connection to an alleged insurance fraud scheme.

Crystal Burgin-Woods, 42, an employee of the KCMO Municipal Court; Matt Stivers, 41, of the KCMO Information Technologies Department; Kim Blair, 36, and Sylvia Sims, 37, both of the Parks and Recreation Department; Matt Tholen, 29, an emergency medical technician; Michael King, 30, of the Water Department; and Michael Olukotun, 39, a corrections officer for the Jackson County Jail were charged in a 21-count indictment returned by a federal grand jury on Wednesday.

The defendants were each charged with three counts of wire fraud.

According to prosecutors, the defendants engaged in a scheme to defraud their healthcare provider – Blue Cross and Blue Shield of Kansas City – through a benefits program called Points to Blue. Under the program, members would receive points in exchange for engaging in healthy activities, and for every 1,000 points earned members would earn one dollar of credit towards either a gift card or preloaded debit card, up to an annual limit of $250 per member.

More points were awarded for more strenuous activities – for instance, running a marathon or triathlon could earn up to 10,000 points.

Prosecutors say that within the first six months of the program, the accused public workers began falsifying entries on the Points to Blue website in order to obtain the maximum gift card. The defendants would, in addition to making false entries on their own behalf, solicit coworkers to engage in the fraud scheme as well – submitting false activities on the behalf of a coworker or a coworker’s dependent in exchange for a portion of the $250 award.

According to the indictment: Burgin-Woods fraudulently received 383 gift cards totaling $185,655. Stiver fraudulently received 248 gift cards totaling $39,070. Blair fraudulently received 238 gift cards totaling $30,485. Tholen fraudulently received 144 gift cards totaling $17,600. Olukotun fraudulently received 71 gift cards totaling $16,480. King fraudulently received 79 gift cards totaling $12,745. Sims fraudulently received 90 gift cards totaling $8,925.

Prosecutors allege that as a result of the fraud scheme, 1,253 fraudulent gift cards were issued, totaling $310,960.

According to prosecutors, Burgin-Woods, Stivers, Blair, Tholen and Olukotun allegedly claimed that young children (often five years old or younger) competed in multiple marathons and triathlons. King allegedly claimed that he participated in three duathlons, three marathons, two half-marathons, an Olympic lifting competition and four triathlons.

In a statement, the City of Kansas City said that they were cooperating fully with the investigation, stressing that no public funds were misappropriated as a part of the alleged fraud.

“We are very saddened with the allegations brought upon a small group of City employees. These alleged actions do not represent the majority of City employees who adhere to the City’s ethical standards,” said City Manager Troy Schulte in a statement.

If convicted, each defendant could face up to 60 years in prison and a $750,000 fine.

Missing Person John Matthews of Washington, DC

The Metropolitan Police Department is seeking the public’s assistance in locating 88-year-old John Mat­thews, who was last seen in the 1400 block of Oglethorpe Street, NW, on Monday, December 10, 2012 at approximately 10:15 pm.

Mr. Matthews is described as an 88-year-old male, 5’9” in height, 155 pounds, with brown eyes, gray hair, and medium complexion. He was last seen wearing brown pants, a blue sweater, and maroon vest. Mr. Mathews suffers from dementia and may be in need of his medication.

Private Detective Madison County Couple Offer Daughters For Sex

A Madison County couple accused of selling their own daughters for sex pleaded not guilty in the case Thursday.

Anthony and Kathy Hart face human trafficking charges after their arrests in 2011. Both were indicted for setting their 13- and 14-year-old daughters up with men.

According to court documents, Kathy Hart would approach men in stores and ask if they would like to spend time with her girls. Berea Police say the Harts would exchange their daughters for money, food and clothing.

Arson Investigation Woman Sentenced to 25 Years for Fire that Killed 2 Children

LOUISVILLE, Ky. — A sobbing mother was sentenced Thursday to 25 years in prison for setting fire to her home and killing two of her children at Fort Campbell, in what prosecutors described as a scheme to escape a rocky marriage and collect on her soldier husband’s life insurance policy.

In a tearful plea for leniency, 39-year-old Billi Jo Smallwood showed photo albums and her son’s toy chest while professing her innocence to a crime that could have put her in prison for the rest of her life.

“Those are my children, my babies that grew inside of me,” she told U.S. District Judge Thomas B. Russell. “I love them so much.”

Family, friends and even her jail guards portrayed her as caring, selfless and deeply religious during nearly an hour of testimonials in support of Smallwood, who wept during many of the presentations.

Assistant U.S. Attorney James R. Lesousky Jr. described Smallwood’s actions as “premeditated and devious” that justified a life sentence.

“She turned her back on those children, and when she did so, she lost two of them,” he said.

Smallwood was convicted by a federal jury in Paducah of maliciously setting fire to the two-story housing unit in 2007 while her children slept inside. Prosecutors argued her intent was to kill her husband and cash in his $400,000 insurance policy.

She was convicted of one count of malicious damage and destruction by fire to property owned by the United States, resulting in the two deaths on the Army post straddling the Kentucky-Tennessee border.

The blaze killed 9-year-old Sam Fagan and 2-year-old Rebekah Smallwood.

Smallwood’s husband, Wayne Smallwood, a Fort Campbell soldier at the time, and their young daughter survived.

Russell mentioned the “powerful and sincere” remarks by Smallwood’s defenders while handing down the sentence. Russell also ordered Smallwood to pay $209,000 in restitution for damage caused by the blaze.

Evidence presented at trial indicated she purchased a gasoline container about 12 hours before the fire was set. Remnants of the container were found by investigators in the first-floor dining room, where gasoline had been poured and ignited.

Prosecutors also pointed to evidence showing Smallwood fabricated her claim that she received a threatening phone call meant for her husband on the eve of the fire. Her intent, they said, was to divert attention from herself as a suspect.

“The telephone call never happened,” Lesousky said Thursday. “It was part of her cover up.”

Smallwood said she wasn’t the person portrayed by prosecutors.

She talked of her devotion to her husband and of being thrilled when she found out she was pregnant with her oldest child. She talked about the children in personal terms while describing scrapbook photos.

Her mother and her aunt offered tearful statements asking for leniency.

Brenda Napper, a sergeant at the Marion County Detention Center, where Smallwood has been held, said she believes Smallwood’s claim of innocence. Napper said it’s the first time she’s ever felt an inmate was innocent.

Mitchell Embry, a volunteer chaplain who has gotten to know Smallwood during her incarceration, called her “the most faithful, deep-thinking, spiritual person I’ve been around.”

Defense attorney Laura Wyrosdick declined to say whether Smallwood will appeal.

Smallwood’s trial had been delayed several times over evidentiary issues and appeals.

Missing Person Angelica Gray of Helena, MT

The Montana Department of Justice has issued a Missing/Endangered Person Alert for Angelica Melody Gray of Helena.

Gray, 22, was last seen on Monday, December 11th at approximately 5 p.m. She is 5’11”, 145 pounds, with green eyes and brown hair, and was last seen wearing a grey skirt, gold-colored shirt, and calf-high boots.

Gray has been staying at the Helena YWCA located at 501 North Park Avenue since May with her two young children. On Tuesday morning, her keys and children’s car seats were found next to her pickup truck in the snow outside the building, and her children were left unattended in her room.

Helena Police Chief Troy McGee said, “The children appeared at one of the other residents knocking on their door. They are three years old and one is nine months old, and had been alone all night and indicated they didn’t know where there mother was. The car seats for the children were outside on the sidewalk. The keys for her vehicle are in the car seat. The vehicle is still there. Her purse is still there, her cell phone is still there, and we’re asking for the public’s help on trying to locate her.”

Late Tuesday afternoon, Lewis & Clark County Sheriff Leo Dutton activated the county search and rescue team to assist in trying to locate Gray.

Sheriff Dutton says searchers will start at the YWCA and work their way out on foot to try and locate her; he says searchers will also begin looking in various locations surrounding Helena, including Grizzly and Oro Fino Gulches and Davis Gulch among others.

He says these areas are nearby rural locations they would like to rule out.

Angelica’s husband Joshua Gray is currently in the Lewis & Clark County Jail; he was involved in a domestic dispute with Angelica back in March where he shot himself during a struggle with police. Angelica was unharmed in that incident.

The couple’s children are currently being cared for through child protective services.

Wrongful Death Man Pleads Not Guilty in Oct. Lexington Murder

A Lexington man pleaded not guilty Thursday in connection with a deadly shooting.

Develgio Lax, 29, was arrested Wednesday afternoon after he checked in with his parole officer and found out a warrant was out for his arrest. Police say three people got into a fight back in October at a nursing home and that Maurice Ward, Jr. shot and killed 31-year-old Anthony Beaumont, Jr.

Investigators say on that day that Lax provided the means and opportunity to commit murder. His bond was set at $100,000 full cash.

Accident Reconstruction 1 Driver Taken to Hospital in New Circle Rd. Crash

One driver was taken to the hospital after a two-vehicle accident along New Circle Road early Thursday morning.

The accident happened along the outer loop between Versailles Road and Harrodsburg Road around 5:30 a.m. It remains unclear how the vehicles collided. One car flipped up on its side and a second vehicle hit the cable barrier in the median. EMS took the woman driving the car that flipped to UK Hospital. Officials did not release any information on her condition.

The driver of the other vehicle was treated at the scene.

Police say an officer suffered a minor injury to his eye getting the woman out of the overturned car. He was treated at the scene and is expected to be OK.

Police blocked the outer loop for a short time as crews cleared the scene. The road is now back open.

Missing Person Tommy Lynn Fonville Missing From Artesis, NM

Eddy County – In cooperation with the Artesia Police Department, please note that the following person is considered a Missing Person-Endangered.

Tommy L. Fonville (63) was last seen in Artesia, NM on November 25, 2012. Tommy is a 5’9” male; weighs 150 pounds with hazel eyes and black hair.

Tommy was last seen driving a 1996 blue colored Ford f-150 truck with unknown license plates. It is believed he may be traveling to Arizona or California.
