Private Detective: Tobacco Warehouses Raided in Mt Sterling

Federal Agents have raided multiple tobacco warehouses in Mt. Sterling Wednesday morning,

Three warehouses owned by Fred Wilson were raided by federal agents.

LEX 18’s Investigative Reporter Richard Essex spoke with Wilson. Wilson says that the agents didn’t tell him or his lawyer why they were there or what they were looking for.

Four I.R.S Criminal Investigators removed boxes from one warehouse. At a second location, agents swarmed the building and parking lot but wouldn’t say why they were there.

Wilson owns a small retail farm store that was locked and secured by the agents.

He is not sure if he is allowed to operate.

The US District Attorney is expected to release all of the information concerning this case later in the week.

Wrongful Death Man Accused of Stabbing Dispatcher Pleads Not Guilty

The man accused of killing a Madison County dispatcher at a party last week appeared in Estill County District Court Wednesday morning.

Investigators say that Dustin Sparks, 25, was at a house party on Fairgrounds Road in Owsley County Friday night when he stabbed 28-year-old Benjamin Brewer of Beattyville.

According to documents, Brewer and Sparks got into an argument at the party, that’s when witnesses say Brewer threw a punch at Sparks and Sparks then allegedly swung a knife back at Brewer, cutting his neck.

Brewer died at the scene.

“I was sad, just felt real bad,” said Justin Young, a friend of both Brewer and Sparks.

Young says he was not at the party but talked to Sparks about 30 minutes before the stabbing allegedly took place.

“He was just all happy just talked about our friends, seems like he was in real great mood,” Young told LEX 18’s Evan Gorman.

Sparks pleaded not guilty Wednesday morning.

He is due back in court on Thursday, December 17 at 1:00 p.m. in Owsley County.

Private Detective: Lexington Real Estate Agent Accused of Stealing Jewelry From Home

A popular Lexington real estate agent is now accused of stealing thousands from a home he had listed.

Bo Howell was well respected and highly reviewed. He had built a reputation for himself in Lexington, one that was tarnished last week.

The 38-year-old is accused of stealing thousands of dollars in jewelry from a home, selling it and then having it destroyed so he couldn’t be identified, all details in the citation from his arrest Friday.

Howell was an independent contractor agent for Bluegrass Sotheby’s for three years.

The company tells LEX 18 that after the allegations against Howell came to light, his contract was immediately terminated and he is no longer associated with the agency in any way.

The agency says they have not received any reports of missing jewelry.

The Bluegrass Association of Realtors says that homeowners should treat the sale of their home like it is an open house each time it is shown, make sure all valuables are locked up. They say that Howell no longer has access to any of their office buildings or any homes that are currently on the market.

Private Detective: Pulaski Sheriff’s Dept. Targets Dealers in Drug Roundup

The Pulaski Co. Sheriff’s office began the third countywide drug roundup this year.

Pulaski County Sheriff Greg Speck along with deputies from his office were assisted by several law enforcement agencies including the Drug Enforcement Administration (DEA London Office), Federal Bureau of Investigation (FBI London Office),  United States Marshall’s Service, Kentucky Attorney General’s Office, Kentucky State Police, Kentucky Probation and Parole,  Lake Cumberland Area Drug Task Force, Somerset Police Department, Burnside Police Department, Ferguson, and Eubank Police Departments.

Officers from the various agencies divided up into teams early this morning in search of approximately 80 individuals wanted on District Court Warrants for various drug offenses.  The majority of the offenses were for Trafficking in a Controlled Substance.

In April of 2015, the Sheriff’s Office drug roundup targeted 47 individuals who were indicted on 70 felony drug charges.  That operation was followed in June with a predominately heroin trafficking roundup of 18 suspects charged with 33 felony offenses related to drug trafficking.

By the end of this year the Pulaski County Sheriff’s Office Narcotics Division will have opened approximately 250 drug related cases according to Sheriff Speck.  The breakdown of those 250 cases reveals 24% heroin, 24% methamphetamine, 35% oxycodone, 14% other prescription drugs, and 3% marijuana related arrest warrants.

Sheriff Speck stated that his office will continue the aggressive pursuit of those individuals involved in the illegal drug trade in Pulaski County.

Individuals arrested in today’s roundup were processed at the Hal Rogers Fire Training Center and transported to the Pulaski County Detention Center by the Pulaski County Jailer.

Arson Investigation Lexington Structure Fire

Lexington Fire investigators are investigating a case of arson and are turning to the public for information.

On Thursday, Lexington Fire Department responded to a structure fire at 541 Haskins Ave. The fire caused damage to the structure, however there were no injuries. Investigators have determined the cause of the fire to be arson.

Missing Person Michael J Walker of Mechanicville, NY

Mechanicville Police are investigating a report of a missing person by the name of Michael J Walker.

Walker is described as a 39 year old white male standing about 5 feet 10 inches tall, about 230 lbs, with brown hair and hazel eyes. He was last seen wearing black sweatpants, black sneakers and a red hoodie.

The last contact anyone had with Michael was at his residence in Mechanicville on Saturday. Dec. 5, 2015. He has not been heard from since. Family members state this is very unusual behavior for him. Michael may be driving a 2015 Gray Jeep with a personalized license plate of “SHAQBINO”. Anyone with any information on his whereabouts is asked to contact the Mechanicville Police Department Investigations Unit at 518-664-7383.

Private Detective: Lexington Police on the Lookout for Violent Robbers

Lexington Police are on the lookout for two violent robbers who committed two robberies on the same day and one again this weekend.

“This guy just kinda comes in, takes over, takes control, gets what he wants and then flies out the door,” Detective Mark Thomas with the Lexington Police Department told LEX 18’s Kristen Pflum.

The three recent robberies were all within a couple of miles of each other. In each case the man is wearing the same hoodie and carries a gun.

At the Marathon on West Main Street he didn’t cover his face though, giving detectives the biggest lead they have yet.

“He explodes through the door with a gun already drawn in his hand.  He runs up to the counter, he’s pointing it directly at the clerk extremely dangerous pointing it at his face and head and demanding ‘give me the cash, give me the cash,’” said Thomas.

Police say the same two people hit stores on West Main, The H&M Market on Limestone and a Marathon on Martin Luther King.

“We see this over and over with these young guys, is they feel like they need to walk around with loaded weapons.  They’re gonna point these in people’s faces and one touch of the trigger, especially in these high adrenaline situations, could end up with somebody dead then everyone’s lives have changed,” said Thomas.

Even though his partner just acts as a lookout, he is looking at just as much jail time.

“Anytime you’re an accomplice in a robbery like this you’re going to prison just like the guy pointing the gun in someone’s face.  You’re responsible just the same way he is and we’re gonna put that guy in jail as well,” said Thomas.

Wrongful Death Body Found in Bell County Connected to Homicide in WI

KSP in Harlan County located a body in Bell County that is linked to a homicide that occurred in Wisconsin Tuesday.

Authorities from Wisconsin and Georgia contacted KSP about the homicide and gave them a location where they thought a body was located.

While responding to the location on Industrial Road in Bell County, troopers found two large boxes over an embankment.

Detectives began processing the scene and contacted the Bell County Coroner’s Officer.  They were able to locate a deceased individual in one of the boxes.

The body is being sent to Frankfort for identification.

The investigation continues.

Fraud Investigation CA Woman Found Guilty of Multi-Million Dollar Mortgage Fraud Scheme

After a 16-day trial, a federal jury Friday found Vera Kuzmenko, 45, of Loomis, and Rachel Siders, 40, of Roseville, guilty of multiple counts of mail and wire fraud associated with their involvement in a mortgage fraud scheme that cost financial institutions over $16 million, United States Attorney Benjamin B. Wagner announced.

Vera Kuzmenko was also found guilty of witness tampering and money laundering associated with the scheme.

According to evidence presented at trial, from late 2006 through early 2008, the defendants engaged in a mortgage fraud scheme involving over 30 properties in the Sacramento area. The defendants were responsible for securing more than $30 million in residential mortgage loans on more than 30 homes purchased through straw buyers. Records introduced at trial showed Vera Kuzmenko received millions of dollars and Rachel Siders received hundreds of thousands of dollars.

Vera Kuzmenko, who had been a licensed real estate agent for part of the scheme, created fraudulent loan applications on behalf of the straw buyers. The loan applications contained materially false information as to the straw buyers’ income, employment, assets, and intent to occupy the residences. The loan paperwork also hid from lenders millions of dollars of payments that went to the defendants. Vera Kuzmenko also served as a straw-buyer herself. With respect to the witness tampering count, the evidence showed that after Kuzmenko learned the FBI was investigating her, she told various witnesses to lie to the FBI and blame a dead woman for the fraud.

Rachel Siders ran the Rocklin office of the escrow company used on the majority of the transactions. She helped funnel millions of dollars to the defendants, which was not disclosed to the lenders.

“Vera Kuzmenko was a major figure in a network of fraudsters responsible for a wave of mortgage fraud that hit the Sacramento area,” said U.S. Attorney Benjamin B. Wagner. “As the guilty verdicts in this case demonstrate, mortgage fraudsters who believe they can escape accountability for their crime by blaming others and offering false alibis are mistaken.”

“Vera Kuzmenko and her associates intentionally victimized their community, abusing trust to significantly damage the financial wellbeing of victims and negatively impact regional economy. This greed-fueled, multimillion dollar fraud scheme had a lasting, negative effect on the regional real estate market,” said Assistant Special Agent in Charge Manuel Alvarez of the FBI’s Sacramento field office. “We hope today’s verdict serves as a warning to would-be fraudsters that the FBI will aggressively pursue perpetrators of large, complex financial fraud to protect regional economies and ensure justice for their victims.”

“Mortgage fraud is an incredibly destructive crime that leaves many victims in its wake,” said IRS-Criminal Investigation Acting Special Agent in Charge, Andrew Toth. “The impact on homeowners and communities is devastating. While this verdict cannot reverse the damage caused by these defendants, it highlights the ongoing commitment of IRS-CI to hold accountable those involved in these types of crimes.”

This case is the product of an investigation by the Federal Bureau of Investigation and the Internal Revenue Service-Criminal Investigation. Assistant U.S. Attorneys Lee S. Bickley and Michael D. Anderson and Special U.S. Attorney David J. Ward are prosecuting the case.

The defendants are scheduled to be sentenced by United States District Judge John A. Mendez on March 15, 2016. Each defendant faces a maximum statutory penalty of 20 years in prison on each of their counts of conviction for wire and mail fraud. Vera Kuzmenko faces an additional 20 years for each count of conviction for witness tampering and money laundering. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.

On October 20, 2015, Judge Mendez sentenced co-defendants Peter Kuzmenko, 37, of West Sacramento, to 19 years in prison; Aaron New, 41, of Sacramento, to 11 years and three months in prison; Nadia Kuzmenko, 36, formerly of Loomis, to eight years in prison; and Edward Shevtsov, 51, of North Highlands, to eight years in prison. They were found guilty on February 13, 2015, after a 21-day trial, of multiple counts of mail and wire fraud associated with the mortgage fraud scheme. In addition, Peter Kuzmenko, Edward Shevtsov, and Aaron New were found guilty of money laundering associated with the scheme, and Nadia Kuzmenko was found guilty of witness tampering.

Accident Reconstruction Man Arrested After Crashing Into Deputy’s Cruiser

A Boone County hit and run crash involving a deputy’s cruiser, sent four people to the hospital.

On Monday, December 7, 2015 the four-vehicle collision including a Boone County Sheriff’s cruiser happened on westbound I-275 at the 3.3 mile marker in Hebron, Kentucky.

29-year-old Deputy Jacob Ganshirt was parked in the right emergency lane with his overhead emergency light bar on behind two other cars that had been involved in a collision.  Ganshirt was sitting in his cruiser collecting information on the prior collision when a 2006 Chrysler 300M driven by 18-year-old Jose Rodas slammed into the rear of his cruiser propelling it into the car in front of him and that car into the one in front of it.

Rodas fled on foot but was soon captured near the Cincinnati/Northern Kentucky International Airport where he was arrested.

Ganshirt was trapped in his patrol car for a short while until arriving Airport police officers assisted him out.  Rodas was charged with Reckless driving, failure of owner to maintain required insurance, no operators license, operating a motor vehicle under the influence of alcohol, possession of open alcoholic beverage container in motor vehicle, wanton endangerment, assault and leaving the scene of an accident-failure to render aid or assistance.

All four parties were taken to the hospital for treatment.
