Wrongful Death Men Accused in Murder of UC Professor Plead Not Guilty

Two men charged in the murder and disappearance of a University of Cincinnati professor from Grant County were in a Fleming County court Thursday.

Charles Black and Kevin Howard are indicted on several charges, including murder, theft and kidnapping. They are accused in the murder and disappearance of Randall Russ from earlier this year. They’re also accused of moving the Grant County man’s body to a shallow grave along the river where police later found human remains.

Black’s attorney entered a not guilty plea for his client after the judge read the charges and how much time they could carry.

Black’s attorney also asked for a bond reduction, which was denied, and that Black be moved from Mason County jail to either Fleming County or Montgomery County.

Howard’s attorney also entered a not guilty plea for his client and asked that Howard be moved to Mason County Detention Center to be closer to his law office.

Howard’s bond is still set at $1 million.

The Commonwealth says the two cases are proceeding separately, and will have future discussion about a joint trial with Charles Black. It’s also not clear as to whether they will seek the death penalty for either suspect.

A status hearing for both Howard and Black is schedule for Feb. 6, 2014.

Accident Reconstruction EKU Student Dead in Madison Co. Accident

Richmond police are investigating a multi-vehicle accident which the state highway department is now calling a fatality.

It happened Friday afternoon in the 2000 block of Ivrine Rd. The coroner says that 22-year-old David Nelson Lee III was heading to work and was turning out of the gas station parking lot when he was hit by a car.

Lee was a student at EKU.

Officials tell LEX 18 that the accident involved three vehicles. No other injuries have been reported.

Missing Person 8 Year Old Letcher County Boy

An 8-year-old Letcher County boy is missing and his family believes he’s with his father who is a murder suspect.

Lillie Mae Adams last saw her 8-year-old grandson on October 9. Her son, Floyd Sexton packed his bags and left with Nicholas. It was nearly a month later that the news came out that Sexton was wanted for murder and the two were nowhere to be found.

“It’s just very hard to believe everything right now. It’s hard. I can’t hardly eat or sleep or anything,” says Adams.

Police say that Sexton fatally shot Bill Collins in Floyd County on November 5 and has been on the run with Nicholas and girlfriend Jennifer Jernigan ever since.

“He was raised in church and his daddy was a minister and this is a shock to us that he would do this,” says Adams.

Reeling with uncertainty and a heavy heart, Adams has searched desperately, begging the Letcher County Sheriff’s Office to help issue an Amber Alert. Unfortunately, she was told that the situation doesn’t fit the criteria for an alert because Sexton had custody of Nicholas.

That was changed Tuesday when a judge granted Adams sole custody of Nicholas. Now they must wait for the paperwork to be filed so that a nationwide search for the young boy can commence.

“I’m hoping that they’ll catch him and whatever he’s done he’ll have to pay the price for what he’s done and bring Nicholas back home,” says Adams.

Missing Person Juanita Daniels of Amherst, NY

Amherst Police officers are asking for your help locating Juanita Daniels, 74, who has been missing since Monday.

Police say she has not been seen since leaving her apartment complex on Princeton Avenue the morning of December 1. She recently suffered a stroke and does not get around very well. She has also mentioned trying to visit a relative somewhere in North Carolina.

She was wearing a black and white sweater, black pants, black shoes, black hat with rhinestones, and dark sunglasses. She has a patch over her left eye.

The Lincoln County Interior Journal reports 46-year-old David Brummett has been sentenced to 66 months in prison after pleading guilty to illegally possessing 140 firearms and stealing an estimated $70,000 from the social security administration.

Private Detective: Louisville Woman Found In Deplorable Conditions, Daughter Arrested

Police say a Louisville woman was found living in filth and now her daughter faces neglect charges after leaving her mother alone for days. Police describe the conditions as so deplorable that the air had to be tested.

Police say that the floors were covered in waste when they found a 63-year-old woman, dehydrated and crying for help.

“It was just real deplorable conditions in which she was living,” says Officer Dwight Mitchell.

The victim’s daughter and caregiver, Melissa Self, is currently in jail facing charges of neglecting an adult after police claim she left her mother alone for days.

Melissa Self’s daughter claims that the police have it wrong and that her grandmother, the alleged victim, was abusing them and refusing to go to the hospital.

“My mom was there the whole, entire time. My mom is not responsible for what a grown woman does. Y’all need to let her out. She didn’t do anything,” says Ashley Griffith.

National statistics show that 90 percent of elder abuse occurs at the hands of a family member. Because of this fact, up to 85 percent of cases go unreported.

The woman in this case was removed from the apartment, which had to be inspected by the health department due to the deplorable conditions.

She is now recovering in a nursing home.

Arson Investigation Historic Building Destroyed in Nicholasville Fire

A pregnant woman was pulled from a fire that destroyed a Nicholasville building built more than 200 years ago.

It happened near North First Street and West Walnut in downtown Nicholasville.

The nearest fire station is about a minute and a half from the historic building, but when firefighters arrived the whole bottom floor was engulfed in flames. That’s led investigators to label this fire suspicious.

With fire moving fast, firefighters made a quick sweep of the building where they found a pregnant woman.

“Crews along with a sheriff’s officer pulled a lady from the front room on the first floor. Got her out successfully,” said Nicholasville Fire Battalion Chief David Johns.

The extent of her injuries is unknown.

With the building clear, firefighters went to work trying to stop the fire that spread quickly through the historic building.

In addition to the Nicholasville Fire Department, firefighters from Jessamine County, Wilmore and Lexington helped fight the fire.

According to the Jessamine County circuit clerk, the log cabin portion was built in 1804 making it the second oldest building in Nicholasville.

Since then its been added on to and converted into apartments, which made fighting the flames difficult.

“It’s cut up and just a dangerous place for firefighters to fight fire,” said Battalion Chief Johns.

With the structure unstable, crews had to go into defensive mode using ladder trucks to fight the fire from above. Smoke filled downtown Nicholasville as flames shot from the old building.

“When we got upstairs and looked out our side window you could see the flames shooting as high as the ladder had already reached its height,” said Margaret Landis, who lives on Main St. and spotted the fire from her home.

“There’s no hope. That place is gone,” she said.

The building is considered a total loss and it’s still unclear what caused the fire.

Crews will be out at the scene throughout the night and into the morning as they continue their investigation.

Private Detective: Lexington Tanning Salon Robbery

Lexington police are on the scene of a robbery.

Officials say the Southern Rays Tanning Salon on Richmond Road was robbed around 9:41 p.m. Thursday evening. They say that a white male, described as 5 feet 9 inches tall, walked into the store and implied that he had a weapon.

The suspect fled the scene on foot towards Locust Hill with an undetermined amount of money.He was last seen wearing a black and white flannel shirt and black pants.

Private Detective: Perry Co. Man Arrested After Flashing Drivers

Perry County deputies are saying that a man who has been flashing drivers for weeks has been arrested.

Frank Fraley has been exposing himself to the cars for a while along Highway 80.

The complaints vary, but all have the same thing in common, deputies say that in the past couple of weeks several complaints have come from this stretch of Highway 80. Callers describe a naked man hiding behind the guard rail here, and then jumping out into traffic.

“We’ve had complaints on him doing that on Cold Harbor Mountain here for quite some time. He was hiding behind a guard rail or getting behind some weeds and jump out, and most of the time he wasn’t clothed,” says Chief Deputy Tony Eversole.

A woman who called 911 was able to point to the bushes where Fraley was hiding.

Deputies promptly arrested him and admitted that they’ve had a long history with him. Early in the year, the deputies had evicted him from a hole-in-the-wall, hillside dwelling that he was living in next to East Perry elementary school.

Fraley is also known for throwing chairs onto the same highway.

Ultimately, when Fraley is released from jail, deputies are hoping that he will find someplace else to live.

Private Detective: Lexington Police On Scene of Home Invasion

Lexington police are on the scene of home invasion where a man was tied up.

It happened on Squires Way, around 9:00 p.m. Thursday evening. Officials say that a man was returning home and one or two people grabbed him from inside his home as he was entering.

The suspect or suspects detained the man and bound his hands and gagged him before tying him to a piece of furniture.

The man managed to make it to a phone and called 911. He was unharmed.

Neighbors tell LEX 18 that they heard screaming.

Police are searching the area but have not yet given a description of the suspect. They haven’t been able to figure out if anything was taken from the scene.
