Wrongful Death Judge Rejects Recommended Sentenced of Man Accused Of Killing Great Grandmother

Jesse James Durham was supposed to be sentenced Friday after admitting to killing his great grandmother with a hammer.

However, the judge wasn’t about to let that happen. Last month, Durham pleaded guilty to beating and killing his great-grandmother at her Campbellsville home and Friday he stood before a judge to learn his sentence.

However, the judge chose not to accept the prosecution’s recommendation for Durham to spend 40 years in prison. He had initially accepted the sentence last month, but changed his mind after reading a letter written by the victim’s son.

http://liarcatchers.com/wrongful_death.html

In the letter, the victim’s son recalled walking into his mother’s home days after she was murdered. He recalls just how horrific that was. Her son wrote to the courts to say that 40 years in prison is insufficient punishment for the crime.

Now another court date for a pre-trial conference is set for December 2 to discuss his options. Durham will have the option to withdraw his guilty plea, let the judge sentence him or have a jury decide.

Before Durham pled guilty last month he was facing charges for murder, tampering with physical evidence and theft by unlawful taking.

Now some neighbors are out thousands of dollars and police are trying to track down whoever is responsible. Officials believe the burglaries happened in broad daylight.

“For us to have 5 or 6, in the same vicinity in the same day, real unusual, and it’s obvious whoever did it tried to catch people away from their homes gone to work or wherever,” says Gilbert Acciardo, Public Affairs Deputy for the Laurel County Sheriff’s Office.
