Private Detective: Louisville Chiropractor and Office Assistant Charged with Health Care Fraud

A Louisville chiropractor and his office assistant were charged by federal grand jury today with health care fraud, conspiracy to commit health care fraud, mail fraud, identity theft and obstruction of a criminal investigation for their roles in billing private insurance companies and government health care agencies with services that were never performed, announced David J. Hale, United States Attorney for the Western District of Kentucky.

According to the 25 count indictment, Devin Thauberger, age 44 , and Trish Muir age 27, conspired to submit fraudulent claims to Medicare, Passport, Anthem, Humana, Geico, Shelter, Nationwide, and other insurance carriers, that falsely and fraudulently sought reimbursement for services which were never provided to patients, including times in which Thauberger was out of the country and unable to provide services.

Between April 2009 and March 2014 the defendants are charged with submitting claims for services, which the indictment charges were never performed. According to the indictment false claims were submitted and billed on at least eleven occasions and totaled nearly $200,000.

Further, according to the Indictment, the identities of patients, along with their personal information was used to fraudulently charge insurance companies and government health care agencies for services that were not performed.

Also, beginning in August 2013, and continuing until at least July 2014, the defendants are charged with willfully obstructing the criminal investigation of Federal health care violations by altering or causing patient records to be altered and attempting to influence the testimony of witnesses.

During all times relevant to this indictment, Thauberger was a doctor of chiropractic, licensed to practice in the state of Kentucky, and had been a chiropractor for approximately nine (9) years. Thauberger Chiropractic, P.S.C. (TCP) was a Kentucky corporation located at 8511 Preston Highway, in Louisville, Kentucky. Defendant Thauberger was the president and sole owner of TCP from 2005 through all times relevant to this Indictment. Beginning in 2010, the defendant, Trisha Muir, became employed by TCP and reported directly to defendant Thauberger. By April 2011, Muir was responsible for billing for services purportedly provided by TCP, which included submitting reimbursement claims to insurance companies and patients for chiropractic services purportedly provided by TCP.

If convicted at trial the defendants face no more than 10 years for counts one and two, no more than 20 years for each count of mail fraud, no more than two years for each count of aggravated identity theft, no more than five years for each count of obstruction of a criminal investigation and a fine of $6,250,000.00.

A Laurel County child is in critical condition at the University of Kentucky Hospital after, his family says, he was hit by a car while riding his skateboard.

The 12-year-old’s mother, Tonya Landry, says she’s thankful it was a nurse behind the wheel, who could help the boy on scene after the accident.

Landry says her son was riding his skateboard with his cousin around noon Tuesday when he was hit by a car near Second and Spring streets in London.

Arson Investigation Warrant Issued For Woman Accused Of Setting Home on Fire

A Dawson County woman said a fire that destroyed her house was an accident, but now a district attorney has issued a warrant for her arrest. The woman is facing felony charges.

Nancy Phillips’ home was destroyed in March when a when a propane explosion destroyed her house on Wildwood Court in Dawsonville.

Phillips told Channel 2’s Diana Davis that the home had been up for sale for more than a year. Six weeks ago, she showed Davis a letter from her insurance company. Allstate denied her entire claim, saying they believe the fire was set intentionally.

http://liarcatchers.com/arson_investigation.html

“They believe that I had something to do with it, starting the fire, or arranging to have the fire started,” said Phillips.

Tuesday the Dawson County district attorney issued a warrant for Phillips’ arrest on insurance fraud charges, which is a felony.

“The state fire marshal investigation shared information with the insurance company, and we’ve just put all that together,” said Tim Satterfield with the Dawson County Emergency Services.

In September, Davis asked Phillips if she was in any financial trouble when the house burned. She admitted she had lost large monthly Social Security payments to her children. She was cut off once they turned 18.

“Their father was deceased and I knew my income was going down in the future,” said Phillips.

In tears, she insisted she had nothing to do with the explosion or the fire.

“That was my life. This is my children’s life. It was everything. This was everything I own,” said Phillips.

The State Fire Marshall and other investigators say her statements don’t add up. Phillips is now in Florida. The county called Phillips’ lawyer informing her of the warrant.

“They now have the option to come back. If not, we’ve also contacted the state fire marshal in Florida to assist in picking her up,” said Statterfield.

The insurance fraud warrant may be the first of several more for Phillips.

“Other warrants are pending at this time,” said Statterfield.

Those additional charges against Phillips are expected to be filed in the next few weeks.

Divers returned to Laurel Lake today searching for a man reported missing more than two years ago.

32-year-old Clarence Holmes was boating on Laurel Lake during the Fourth of July weekend, when severe storms swept through the area.

“Somebody’s got to get him. Somebody’s got to find him. He’s here. We know he is. We have the evidence he was here. If we didn’t when we brought the k9s in we’d be saying ‘look we’re not sure where he is but we’re not finding anything.’ But we know he is. Nobody else is missing out here,” says Mark Michaud, a diver on the search mission.

Divers will continue to explore Laurel Lake through Friday.

Drug Dog Sweep $565k Seized in Drugs Across AZ

Customs and Border Protection officers seized about $565,000 in drugs and arrested six in separate smuggling incidents across Arizona’s ports of entry this weekend, authorities said.

In Nogales, CBP officers seized five pounds of cocaine and 78 pounds of methamphetamine in three separate incidents between Oct. 31 and Nov. 1.

On Friday, officers working at the Mariposa Port of Entry arrested a 21-year old man from Nogales, Sonora after a secondary inspection turned up 18 pounds of methamphetamine worth close to $54,000 hidden in the bumper of his Mercury sedan, a news release said.

The same day, officers at the Dennis DeConcini crossing arrested a 62-year old woman also from Nogales, Sonora after a drug dog alerted to the presence of drugs in her Isuzu SUV. An inspection revealed nearly five pounds of cocaine worth $52,000 and 46 pounds of meth worth almost $137,000 hidden in the vehicle’s rear quarter panels.

On Saturday, officers at Mariposa arrested a woman from Goodyear, Ariz. after a drug dog helped officers find 14 pounds of meth worth more than $42,000 in the rear seats of her Dodge sedan, the release said.

In Naco, officers arrested a 26-year old Mexican man for attempting to smuggle 60 pounds of marijuana through the port on Saturday.

Customs and Border Protection officers arrested Jose Humberto Osuna-Carvajal after officers turned up 57 packages of marijuana worth an estimated $30,000. A drug dog helped officers find the marijuana hidden compartments in the floor of his Mercedes sedan.

Meanwhile in Douglas, officers arrested two people for smuggling attempts on Saturday.

Officers arrested Douglas resident Rosalylya Espinosa-Lopez, 30, when a drug dog detected nearly 246 pounds of marijuana worth $123,000 hidden in the bumper and body of her Pontiac sedan.
