FBI Law Enforcement Bulletin August 2013

Driving under the influence of alcohol can lead to many consequences, such as an encounter with law enforcement, an automobile accident, injury or loss of life, and suspension of driving privileges. This act impacts the life of the driver and possibly the lives of others, especially if an accident has occurred.

In accident situations, compelling and competing interests arise. At the scene law enforcement officers respond to a chaotic situation in which time proves crucial. Glass and car parts litter the road way. Emergency vehicles with flashing lights race to the injured so personnel can render aid. First responders must act effectively and efficiently because the scene must be cleared, injured persons require treatment and transportation, and officers need to collect evidence. Investigators must assess their need and ability to collect a blood sample to assess alcohol content.

Recently, the U.S. Supreme Court in Missouri v. McNeely addressed the Constitution’s requirement that all searches must be reasonable in the context of a nonconsensual warrantless blood-draw incident to support an arrest for driving under the influence.[1] This article discusses that case and its practical impact and provides a historical overview of the authority of law enforcement officers to collect such evidence without a warrant.

The incident happened at about 9 a.m. North Grande Avenue in Fort Thomas. Police say a man waited for his wife to go to work, and then shot up the building. They say the shooter chased his wife into a medical building where she works then shot her multiple times before turning the gun on himself.

According to police, the shooter apparently parked at a nearby building and waited for his soon to be ex-wife to arrive at work.

The gunman was pronounced dead on the scene. His wife was transported to University of Cincinnati Medical Center in what officers called “grave condition.”

Missing Person Rowan County, NC Teen Missing Since 2011

Erica Parsons is a 15-year-old from Rowan County; she was adopted as a baby.

On Monday night, her grandparents said that no one has seen her since 2011 — yet she is just now being reported as missing.

They told Eyewitness News they thought she was visiting other family.

http://liarcatchers.com/missing_persons_investigations.html

Erica Parson’s grandparents told Eyewitness News they’ve been asking their son or daughter where the teenager was, but they just learned two weeks ago that Parsons was missing.

It has been two years, and according to deputies, no one has seen or heard from 15-year-old Parsons.

Rowan County deputies said she disappeared from a Salisbury home she shared with her adoptive parents back in November of 2011.

Deputies said she was just reported missing about two weeks ago.

Eyewitness News talked to Parson’s grandparents on Monday.

They said they are sick not knowing what happened to her.

“That is my fear that something happened and nobody is telling us. I am not talking about the law, I am talking about my boy and daughter-in-law,” said Steve Parsons.

“I am so worried, I am so worried,” said Janet Parsons.

On Monday night, Eyewitness News knocked on the door of Erica Parsons’ home and no one answered.

Earlier on Monday, Eyewitness News was told the parents of Erica had turned photos of the teenager over to law enforcement, but had been advised by their lawyers not to comment.

Eyewitness News asked neighbors if they had ever seen Parsons.

Elizabeth Cardona said she saw a lot of police activity at the Parsons home last week. She said something else struck her as strange.

“I saw two ladies yelling at each other and I saw a moving truck but I didn’t know what was going on,” said Cardona.

Erica was adopted by the Parsons when she was just 2 weeks old and she could not have been reported missing by her school because she was also homeschooled.

Caylee’s Law was introduced in several states after the mother of a Florida toddler was acquitted.

Casey Anthony failed to report her 2-year-old daughter missing for nearly a month in 2008. The girl’s body was later found in some nearby woods.

North Carolina’s version of the law goes into effect in December. Any parent who does not report a child missing within 24 hours will be charged with a felony.

Anyone else who suspects a child is missing and doesn’t report it faces a misdemeanor.

Again Erica Parsons is 15 years old, but police said she is small for her age. She is four and a half feet tall and about 85 pounds. She has brown hair and brown eyes.

If you have seen her or have any information, police asked that you call them right away.

Insurance Fraud Man Pleads Guilty in New Jersey

A former employee for a now-defunct Camden County construction company pleaded guilty in Superior Court in Mount Holly for his role — damaging South Jersey homes in order to then repair them and collect the insurance money — in a fraud scheme.

Marcin Gradziel, 34, of Lake Worth, Fla., who lived in Norristown, Pa., at the time of the crime, pleaded guilty Friday to second-degree insurance fraud before Judge Terrence Cook, who will sentence him Oct. 18, acting New Jersey Attorney General John J. Hoffman said.

http://liarcatchers.com/insurance_fraud.html

Under the plea agreement, the state will recommend that Gradziel be sentenced to seven years in state prison.

“This defendant inflicted unnecessary damage to homes and caused an unwarranted financial burden on innocent homeowners,” Hoffman said in a statement Monday. “This office will continue to investigate and prosecute those who seek to take advantage of New Jersey homeowners for their own, selfish purposes.”

In pleading guilty, Gradziel admitted that in December 2010, acting on behalf of Precision Network Solutions, doing business as Precision Builders of Voorhees, he caused fraudulent insurance claims to be submitted to Travelers Insurance Co., for property damage to three homes in Gloucester and Camden counties purportedly caused by hailstorms. The company also had an office in Evesham, investigators said.

An investigation determined that representatives from Precision Builders canvassed neighborhoods, claimed that homes had been damaged in a hailstorm, and advised homeowners that they could get new siding and roofing at no cost. Several homeowners told investigators that they were unaware of any hail damage to their residences before being solicited by Precision Builders, authorities said.

After homeowners filed claims with their insurance carriers, Gradziel would visit and damage the properties prior to adjusters’ inspections, according to the Attorney General’s Office.

On March 26, 2012, Gradziel’s co-defendant, Dominik Sadowski, 37, of Sellersville, Pa., pleaded guilty to third-degree insurance fraud. Sadowski was sentenced to four years of probation and 100 hours of community service. In addition, Precision Network Solutions pleaded guilty to second-degree insurance fraud. Precision Builders paid $68,720 in restitution before being sentenced. The company went out of business as a result of the investigation.

“Schemes such as this one defraud not only the victim but also drive up the cost of insurance premiums for the rest of us,” acting Insurance Fraud Prosecutor Ronald Chillemi said. “As illustrated by this guilty plea, such conduct will not be tolerated in New Jersey.”
