Accident Reconstruction Rowan County Teen Killed in WV Crash

Investigators say a group of friends in West Virginia crashed early Wednesday morning, killing a Rowan County High School senior and hurting 10 others.

The accident happened around 4 a.m. along Route 36 in Clay County, West Virginia. West Virginia state police say six people were in the truck’s cab and five were in the bed when it hit a guardrail and flipped, landing upside down in a creek.

Kara Conley, 17, was killed. State police believe she was in the bed when it flipped.

Investigators say a small amount of marijuana was found in the vehicle.

Wrongful Death Marty Roe Murder Case UPDATE

Testimony continued Wednesday in a high-profile murder case in Lexington.

On Monday, the prosecution told a jury of eight women and six men, a total of 12 plus two alternates, that Marty Roe, accused in the shooting death of Dr, Martha Post in 2011, was obsessed with Post, to the point that he left numerous phone messages and had a tattoo with the words, “forever and a day” and two hearts, one with “Martha” in it and “Marty” in the other.

On Wednesday, Catherine Dunaway, who worked in Post’s building as a medical assistant, talked about the day Post was killed. She said she hadn’t seen Roe in a while, but before, if she would see him, she would call Post or Doctor Robert Truitt, Post’s husband, to tell them. Prosecutor asked why, and Dunaway said because “they were scared of Roe.”

Later Wednesday morning, Pruitt took the stand. The prosecution asked him, “Did you have anything to do with the murder of your wife?” and Truitt replied, “No, I did not.”

Truitt also talked about the gun he had bought because he was, “afraid for his wife’s safety because she kept getting phone calls from him,” referring to Roe. “I had been afraid something was going to happen for months and months,” he said, “It was always in the back of my mind Marty was going to do something.”

Roe has maintained his innocence since the shooting, and just a few months ago sent several letters to the judge in his case.

Roe told the judge that the charges against him were part of a conspiracy and he needed to get out of jail to find the people who would come to his defense. His request was denied.

Police say Post and her husband befriended Roe, and gave him a job at the office, doing renovation work. Investigators say Post fired him because of his drinking problem and that’s when Roe became obsessed with Dr. Post.

Private Detective Pirated Software May Contain Malware

You decide to order some software from an unknown online seller. The price is so low you just can’t pass it up. What could go wrong?

Plenty. Whether you’re downloading it or buying a physical disc, the odds are good that the product is pirated and laced with malicious software, or malware.

Is Your Software Pirated?

Possible signs of what to look for:

No packaging, invoice, or other documentation…just a disc in an envelop
Poor quality labeling on the disc, which looks noticeably different than the labeling on legitimate software
Software is labeled as the full retail version but only contains a limited version
Visible variations (like lines or differently shaded regions) on the underside of a disc
Product is not wrapped correctly and is missing features like security tape around the edges of the plastic case
Typos in software manuals or pages printed upside down
User is required to go a website for a software activation key (often a ploy to disseminate additional malware)

Today, the National Intellectual Property Rights Coordination (IPR) Center—of which the FBI is a key partner—is warning the American people about the real possibility that illegally copied software, including counterfeit products made to look authentic, could contain malware.

Our collective experience has shown this to be true, both through the complaints we’ve received and through our investigations. It’s also been validated by industry studies, which show that an increasing amount of software installed on computers around the world—including in the U.S.—is pirated and that this software often contains malware.

As in our above scenario, pirated software can be obtained from unknown sellers and even from peer-to-peer networks. The physical discs can be purchased from online auction sites, less-than-reputable websites, and sometimes from street vendors and kiosks. Pirated software can also be found pre-installed on computers overseas, which are ordered by consumers online and then shipped into the United States.

Who’s behind this crime? Criminals, hackers and hacker groups, and even organized crime rings.

And the risks to unsuspecting consumers? For starters, the inferior and infected software may not work properly. Your operating system may slow down and fail to receive critical security updates.

But the greater danger comes from potential exposure to criminal activity—like identity theft and financial fraud—after malware takes hold of your system.

Software Buying Tips for Consumers

When buying a computer, always ask for a genuine, pre-installed operating system, and then check out the software package to make sure it looks authentic.
Purchase all software from an authorized retailer. If you’re not sure which retailers are authorized, visit the company website of the product you’re interested in.
Check out the company’s website to become familiar with the packaging of the software you want to buy.
Be especially careful when downloading software from the Internet, an increasingly popular source of pirated software. Purchase from reputable websites.
Before buying software off the beaten path, do your homework and research the average price of the product. If a price seems too good to be true, it’s probably pirated.

Some very real dangers:

Once installed on a computer, malware can record your keystrokes (capturing sensitive usernames and passwords) and steal your personally identifiable information (including Social Security numbers and birthdates), sending it straight back to criminals and hackers. It can also corrupt the data on your computer and even turn on your webcam and/or microphone.
Malware can spread to other computers through removable media like thumb drives and through e-mails you send to your family, friends, and professional contacts. It can be spread through shared connections to a home, business, or even government network. Criminals can also use infected computers to launch attacks against other computers or against websites via denial of service attacks.

To guard against malware and other threats, read our tips on how to protect your computer. If you think you may have purchased pirated software (see sidebar on how to spot it), or if you have information about sellers of pirated software, submit a tip to the IPR Center or the Internet Crime Complaint Center.

And know this: Pirated software is just one of the many threats that the IPR Center and the FBI are combating every year. The theft of U.S. intellectual property—the creative genius of the American people as expressed through everything from proprietary products and trade secrets to movies and music—takes a terrible toll on the nation. It poses significant (and sometimes life-threatening) risks to ordinary consumers, robs businesses of billions of dollars, and takes away jobs and tax revenue.

Wrongful Death Distrurbing Details Revealed in Winchester Murder Case

Disturbing details were revealed in a hearing Wednesday for a Powell County man accused of murdering a Winchester woman.

39-year-old Lonnie Martin is accused of killing 25-year-old Kyla Kline after investigators believe he picked her up in his van as she walked along a downtown Winchester street in early July.

Montgomery County authorities found Kline’s body buried on a farm. During Wednesday’s hearing, it was revealed that Kline was stabbed four times and hit in head with a mechanical object. Logs and tree limbs were then thrown on top of her.

Police say they have a tape of Martin on video giving Kline a ride in Winchester. Police say they tracked Kline to the farm her body was discovered on by by using her cell phone’s GPS coordinates.

Earlier in the day, Martin was also charged with murder in the death of Joseph Bradley Martin, his cousin, who died after being hit by a train back in October 1995. The death was originally ruled accidental, and Lonnie Martin was listed as a witness in the case, but police now say evidence links Lonnie Martin with the death. Police believe Martin threw his cousin off of the Washington Street bridge into the path of the train.

Records also show Martin served ten years of a 15-year sentence for assaulting a woman in Estill County in 1997.

Missing Person Update on San Diego Siblings

The father of two children possibly abducted by a man suspected of killing their mother pleaded Tuesday with his friend to release his daughter and turn himself in.

“Jim, I can’t fathom what you were thinking,” said Brett Anderson, addressing his short statement at a news conference to his friend James Lee DiMaggio, the subject of a growing manhunt. “The damage is done.”

Anderson also pleaded with his missing daughter, 16-year-old Hannah Anderson, who authorities said was in grave danger, to run away from DiMaggio if she got the chance.

“Hannah, we all love you very much. If you have a chance, you take it. You run. You’ll be found,” Anderson was quoted as saying by Fox5SanDiego.com.

Anderson did not make reference to his 8-year-old son Ethan, who was also missing.

The remains of a child were found in a burned house near the U.S.-Mexico border with the children’s mother, 42-year-old Christina Anderson.

An autopsy was performed Tuesday, but authorities said it could still take a few days for DNA testing to determine if the child was Ethan.

“It is a possibility that it’s Ethan,” said sheriff’s Lt. Glenn Giannantonio. “Right now we just don’t know. And we’re praying that it isn’t Ethan.”

The San Diego County Sheriff’s Department has said DiMaggio and Christina Anderson had been in a close, platonic relationship.

Sheriff’s officials referred to Brett Anderson, who arrived from out of town to talk to investigators Tuesday, as her ex-husband, but he told The Associated Press that the couple had still been married.

On Sunday night, authorities found Christina Anderson’s body near a dead dog when they extinguished flames at the rural home of DiMaggio in Boulevard, a remote hamlet 65 miles east of San Diego.

The child’s body was found later as they sifted through rubble.

An Amber Alert advised freeway motorists, television viewers and mobile phone subscribers about a blue Nissan Versa with California license plates that DiMaggio was believed to be driving. The California Highway Patrol said the suspect could be headed to Texas or Canada.

Giannantonio told Fox5SanDiego.com that investigators had been receiving calls from the public throughout the day Wednesday.

“Realistically, we don’t know where they’re going,” Giannantonio told the station. “We’re keeping a wide net, and hopefully we’ll find them. We’re looking everywhere. … We’re going to work on this case until we find them.”

The FBI joined the search and the Amber Alert was later extended to Mexico’s Baja California state, which borders Boulevard.

Monday marked the first time that mobile phone users were notified of a statewide Amber Alert in California through their phones, CHP spokeswoman Jamie Coffee said. The alert system, which was introduced in December, sends messages automatically, based on the phone’s location, not the phone number.

Christina Anderson grew up with her mother and stepfather in the east San Diego suburb of Santee, and she aspired to a career in child psychology, said her ex-husband, James Chatfield of La Grande, Ore. The marriage lasted four years, until 1992, and Chatfield said he lost touch.

“She was a high school sweetheart,” he said. “It was a marriage of convenience that just didn’t work out.”

Chatfield said he helped Anderson’s current husband move to The Dalles, Ore., in the early 1990s, but they lost contact.

DiMaggio is believed to be driving a blue Nissan Versa with a California license plate of 6WCU986. A reward of up to $1,000 is being offered for information leading to an arrest. Anyone with information is asked to call (858) 974-2321.

Fraud Investigation Jackson, MS Sentenced in Food Stamp Fraud

A federal judge has sentenced a man to six months in prison for food stamp fraud.

Stanley Jones was charged with lying on food stamp applications in 2008 by representing that nobody in his household had been convicted of a drug-related felony since 1996.

Anyone convicted of a drug related felony after August 22, 1996, is prohibited from receiving benefits under the Supplemental Nutrition Assistance Program, commonly known as food stamps.

He pleaded guilty in U.S. District Court in Jackson in April.

U.S. District Judge Carlton Reeves sentenced Jones to the prison term, three years on supervised release and ordered him to pay restitution of $8,282.

Court records say the case originated in Jackson.

Missing Person Duncan Templer of Hillsboro, ND

Authorities in the Badlands have called off the search for a Hillsboro man missing since July 24.

McKenzie County Sheriff John Fulwider decided to end the active search for 51-year-old Duncan Templer, according to a news release from the sheriff’s office.

Templer’s unoccupied semi truck was found at a U.S. Highway 85 overlook about 22 miles south of Watford City after his stepson and the semi’s owner, Trans Systems of Great Falls, Mont., asked the sheriff’s office to do a welfare check on Templer.

A family member reported that Templer was upset upon learning that he had cancer, according to the news release, which described Templer as “possibly suicidal.”

Sheriff’s deputies searched the area on foot that evening. Subsequent searches by air, foot, motorized vehicles, search dogs and horses were conducted until July 31 without success, the release stated.

After talking to Templer’s family, the county’s emergency manager and other law enforcement officers, Fulwider “has decided he has exhausted all resources and has called off the active search for Mr. Templer in the area that he was known to be in,” the release stated.

Fulwider did not return a phone message Tuesday.

Templer is considered a missing person, and the sheriff’s office will continue to investigate, the release stated.

Accident Reconstruction Man Hurt in Lexington Motorcycle Crash

A man was transported to UK Hospital Tuesday night with life-threatening injuries after police say he crashed his motorcycle into a tree.

The accident happened on Delong Road, between Armstrong Mill Road and Walnut Hill Road in Lexington around 9:15 p.m.

Police say the man was wearing a helmet. They say they don’t believe there are any contributing factors to the accident as of now. However, there’s a hill and the road curves left right before the area where the crash happened.

Arson Investigation Philadelphia Pastor Arrested

A Philadelphia pastor is facing charges after he allegedly set fire to his own car and lied to an insurance company.

On March 20, 2013, police received a call about a car on fire on the 2700 block of Emerald Street.

Officers arriving at the scene discovered a 2004 Nissan Quest fully engulfed in flames under the Conrail railroad tracks.

Using the VIN number, officers were able to contact the owner, 57-year-old Teofilo Santiago, who reported that the vehicle had been parked in front of his house on the 1800 block of N 6th Street around 9:10 p.m. and that he was unaware it was missing.

The following day, Santiago contacted Nationwide Insurance and reported his vehicle had been stolen and recovered by police as a burnt shell. He described the car as being in sound mechanical condition with no prior damage, and said he had two sets of keys to the car which were in his possession at the time of the alleged theft. Santiago also identified himself as a pastor at a local Pentecostal church.

The Nissan was examined by the Fire Marshall’s Office, which determined the fire originated in the passenger’s compartment when an open flame had been applied to combustible material. The fire was determined to be arson.

Santiago’s Nissan also had an electronic anti-theft system, and an examination of that system as well as the ignition, lock and start switch revealed no evidence of force or manipulation. It also determined that the key with the correct transponder code was used to operate the Nissan.

Nationwide determined that Santiago’s Nissan was valued at $7,547, and the damage to the car from the fire far exceeded its value, making the vehicle a total loss. At the time of the fire and alleged theft, Santiago owed a balance of $4,700 to his lien holder on the Nissan.

In April, Santiago met with a Nationwide Investigator and insisted that the car had been stolen and had been in perfect condition before it was stolen.

When Santiago was presented with the results of the investigation, he withdrew his stolen auto claim with Nationwide and admitted the Nissan was in poor mechanical condition and needed expensive repairs. He also admitted that he had conspired with another person to destroy the vehicle, report it stolen and collect the insurance.

Santiago was arrested and is now facing charges of Arson, Insurance Fraud, Attempted Theft by Deception, Conspiracy and Causing or Risking a Catastrophe.

Wrongful Death San Diego Police Search for Siblings After Mother Found Slain

Authorities searched on Tuesday for a man they suspected of setting fire to his Southern California home, killing a woman thought to be a close friend and abducting one or both of her children before trying to flee the state.

The remains of the woman and an unidentified child were discovered at the house, whose owner, 40-year-old James Lee DiMaggio, was believed to be headed for either Texas or Canada, law enforcement officials said.

“It’d be safe to say he is a very dangerous person, armed or not,” San Diego Sheriff’s Lieutenant Glenn Giannantonio said of DiMaggio. “We’re asking any members of the public who may believe they see him, don’t attempt to contact him … just call 911 and have law enforcement make the contact.”

DiMaggio is suspected in the slaying of Christina Anderson, 44, with whom he apparently had a “close, platonic relationship,” Giannantonio said, and is believed to have kidnapped one or both of Anderson’s children, 16-year-old Hannah and 8-year-old Ethan.

Giannantonio said Hannah and Ethan were last seen on Saturday. He said the children’s father was aware that they are missing and that a child’s body was discovered in the rubble outside of the burned house.

“We don’t know who that is who was found in the rubble,” Giannantonio said. “It’s a possibility that it is Ethan, it’s a possibility that it’s another child that we haven’t identified yet or don’t realize is missing yet.”

Christina Anderson’s body was also discovered by firefighters sent to DiMaggio’s burning home in the unincorporated desert community of Boulevard, east of San Diego near the Mexican border.

Investigators did not release details of how Anderson, a resident of the San Diego suburb of Lakeside, had been slain. The cause of the child’s death was not yet determined.

A dog was also found killed in the same building, the sheriff’s office said.

Giannantonio said authorities hoped to identify the remains of the child found in the next day or two. He said an autopsy of the body of Christina Anderson was completed on Tuesday, but he did not release its findings.

Giannantonio said authorities recovered weapons from the scene of the crime, but he did not disclose the type or number of weapons.

An Amber Alert child-abduction notice was issued for both Anderson children. Giannantonio said it was possible that DiMaggio had shaved his or the children’s heads or changed their appearances in some other way.

Authorities did not say whether they have any theories on a possible motive in the case
