Private Investigator Pulaski County Sheriff’s Deputy Indicted on Civil Rights Violations

United States Attorney for the Eastern District of Kentucky Kerry B. Harvey and Assistant Attorney General for the Civil Rights Division Thomas E. Perez announced today that Stephen Molen, a sheriff’s deputy with the Pulaski County Sheriff’s Office, was indicted by a federal grand jury on two counts of violating the civil rights of victims by using excessive force in October 2009 and October 2011.

Count one of the indictment alleges that on October 2, 2009, Molen assaulted a victim identified in the indictment as “D.W.,” resulting in bodily injury. Count two of the indictment alleges that on October 7, 2011, Molen assaulted a victim identified in the indictment as “G.C.,” resulting in bodily injury.

If Molen is convicted of these charges, he will face a maximum punishment of 10 years of imprisonment for each count.

The investigation was conducted by the FBI. The case will be prosecuted by Assistant United States Attorneys Pat Molloy and Ron Walker of the Eastern District of Kentucky and Civil Rights Division Trial Attorney Ali Ahmad.

The charges set forth in an indictment are merely accusations, and the defendant is presumed innocent until proven guilty.

Identity Theft PA Soldier Pleads Guilty

A man who was AWOL from his Army post in Louisiana used a computer at a job center in Pittsburgh to obtain a debit card in the name of billionaire Paul Allen, the co-founder of Microsoft, and attempted to access more than $1.6 million, a federal prosecutor said Thursday.

Brandon Lee Price, 30, of Pittsburgh, pleaded guilty to four counts of bank fraud and must return for sentencing Sept. 30.

Most of the transactions Price attempted did not go through, as they were flagged as suspicious by Citibank, which issued the card. But Price was able to pay $658.81 toward a delinquent Armed Forces Bank loan in Fort Leavenworth, Kan., in January 2012, Assistant U.S. Attorney James Wilson said.

“This case with this high-profile victims calls attention to the seriousness of the crime of identity theft,” U.S. Attorney David Hickton said.

Microsoft and Citibank did not immediately respond to requests for comment Thursday.

Price had left his unit without permission at Fort Polk, La., in July 2010 and wasn’t found until the FBI arrested him in Pittsburgh in March 2012. Fort Polk officials did not immediately return a call, but Wilson said after Thursday’s hearing that Price has since been court-martialed and discharged.

In order for Price to plead guilty, Wilson had to detail the evidence for the judge, explaining the scam began when Price called Citibank in late December 2011 and pretended to be Allen.

Price told a customer service representative “he was attempting to do online banking and needed his debit card number” but didn’t have it handy, Wilson said.

Price was able to give the rep the last four digits of Allen’s Social Security number, the last two digits of a debit card account and the entire number for one of Allen’s checking accounts, Wilson said. Despite that, Citibank didn’t give Price the account number he sought, though he did get the number two days later when he called Citibank back and provided additional personal information about Allen.

Price then changed the address on Allen’s account to Price’s home address in Pittsburgh, and after again pretending to be Allen and claiming the card was lost, Citibank sent a replacement to Price’s home.

Price first used the card to make the delinquent loan payment, then attempted several transactions that didn’t go through, including a $1 purchase at a dollar store near his home.

Price also tried to use the card to make three transfers — of $94,000, $800,000 and $130,000 — to accounts he controlled. He also unsuccessfully tried to open an investment account with a $388,000 funds transfer and to purchase $250,000 in certificates of deposit, Wilson said.

FBI agents later determined Price logged onto publicly available computers at a local job center, where he searched for topics including “identity theft,” ”brokerage accounts” and “Paul G. Allen.” Wilson said he doesn’t know why the billionaire was targeted.

Wilson called it a “very odd case” given that Price appears to be a “very marginal person who drifted through the Army and appears to be pretty inept at almost every aspect of daily normal life.”

Both Price and his federal public defender declined to comment.

Bank fraud carries a sentence of up to 30 years in prison, but Price’s case will be governed by guidelines dictated by the amount stolen. The government argues the “loss” is the $1.6 million Price tried to steal, but his attorney contends it’s merely the $658.81 he actually siphoned from Allen’s account.

Wrongful Death Remains of Dylan Redwine Found Near Vallecito

Searchers have found the remains of Dylan Redwine, a 13-year-old boy who disappeared while spending a court-ordered Thanksgiving week visit with his father last year, the LaPlata County Sheriff’s Office said Thursday.

Sheriff’s Department spokesman Dan Bender said a variety of items, including bones, have been identified as Redwine’s.

Bender said the Colorado Bureau of Investigation positively identified the remains Thursday and notified Redwine’s family. The bones were found during a five-day search in the Vallecito area along 12 miles of USFS Middle Mountain Road.

Middle Mountain is north and within sight of Vallecito Lake. The search area ranged from 8,000 to 11,000 feet altitude amid deep canyons and dense forest, the sheriff’s department said in a news release.

Bender would not identify the other items found with the bones.

About 45 law enforcement and search and rescue workers were deployed, working more than 1,600 man hours during the search, Bender said.

The latest searches, through steep drainages with extensive ground cover, were not the result of new information, Bender said. They were part of a series of followup searches conducted after the snow melted.

Redwine disappeared while spending a visit with his father, Mark, in Vallecito, near Durango. He lived near Colorado Springs with his mother and her boyfriend.

Dylan’s parents have blamed each other for their son’s disappearance. In appearances on the “Dr. Phil Show,” Elaine Redwine said she believed Mark had something to do with their son’s disappearance, while the husband reiterated his unsubstantiated but strong belief that his wife was involved.

Searches for the boy were called off during the winter months, but resumed in the spring.

Mark Redwine claimed he left Dylan at home alone while he was out running errands, and when he returned, his son was gone.

Missing Person Kansas City, KS Police Department Search for Oliver Berry

The Kansas City, Kan., Police Department is looking for a missing 58-year-old man.

Oliver L. Berry, 58, was last seen at a funeral this Monday.

He suffers from mental illness and he hasn’t had his medication since Monday, according to the Kansas City, Kan., Police Department.

Arson Investigation Yosemite Lakes Park, CA Couple Arrested

A Yosemite Lakes Park couple was booked into Madera County jail late Tuesday night on charges of arson after a half-acre vegetation fire that started on their cul-de-sac, East Revis Circle in YLP.

Tuesday night’s arrests come after a month of sleepless nights for many YLP residents – especially those living off of Revis Road – who have been hit with a majority of more than 20 vegetation fires in the park since May. The fires included a string of eight in three days, along with a 91-acre blaze May 19 that destroyed a home on Lilley Mountain Drive.

Allison Waterman, 47, and Kenneth Jackson, 40, were booked on charges of arson. Jackson is being charged with 31 counts of arson, resisting arrest, and attempted battery on a peace officer. Waterman was booked on a single charge of arson.

Cal Fire Battalion Chief Christopherson said the couple arrested were booked in relation to the series of fires in the YLP area. The area fires have burned about 100 acres over the last six weeks, he said.

“The Yosemite Lakes Park community has been threatened by countless wildfires over the last several months that we believe were a result of arson,” said Nancy Koerperich, Cal Fire unit chief for Madera-Mariposa-Merced Unit. “We appreciate the community’s support and assistance as we worked to track down these suspects.”

Jackson owns Ken Jackson Transport, a heavy equipment trucking/hauling business. Those that know him say he previously worked in construction in the Valley. In Madera County, the only previous offense jail officials said he was charged with was a DUI in 2000.

Waterman has worked as a teacher at a preschool in the Valley and at a church. Madera County Department of Corrections said she had no previous criminal record in the county and that she bailed out of jail, set at $25,000, around 2:30 p.m. Wednesday.

Reportedly, the couple also filed for bankrupcy in 2010. They were married in October of 2002.

While Christopherson said details regarding the fire investigations are currently unavailable, according to a source who wished to remain anonymous, Cal Fire investigators have been hiding in camouflage on Revis Mountain in YLP 24 hours a day for a couple weeks looking to catch the person, or persons, they suspected were lighting the fires.

Every 10 hours, fire investigators would swap out with a new group, and during one of the early swaps, someone saw the camouflaged investigators come out of the bushes and jump into the back of a white jeep, reporting them as possible suspects.

At that point, investigators reportedly stopped using the jeep and started parking a different vehicle a couple miles away and hiking to the mountain.

After the white jeep story surfaced, the suspect arsonist then reportedly used it in an attempt to throw off investigators looking into Sunday’s nine-acre fire off of River Road (400).

However, according to the anonymous source, the attempt to throw off investigators was actually what tipped them off to their suspect – because officials knew they did not have investigators hiding near Road 400.

Cal Fire said numerous agencies assisted in the investigation and arrest, including the Madera County Sheriff’s Office, Madera County District Attorney’s Office and Yosemite Lakes Park security staff. Fire officials said Cal Fire law enforcement officers work diligently in arson cases to aggressively investigate and prosecute those suspected of intentionally starting fires.

“As fire danger remains extreme across California, arson is a major threat to both life and property,” stated Cal Fire in a prepared statement. “Residents should be vigilant in their preparedness and aware of suspicious persons when a fire does start.

“If you witness someone suspicious make note of the time, his or her physical description, as well as any vehicle description, including the license plate number. Always contact law enforcement, never approach a suspicious person. Anyone with information about arson is urged to contact the Cal Fire Arson Hotline at 1-800-468-4408. Callers can remain anonymous.”

Insurance Fraud Louisiana State Police Arrest 8

Detectives with the Louisiana State Police Insurance Fraud Unit have broken up a criminal staged crash ring with the arrest of eight people.

In February 2012, Lafayette Field Office Insurance Fraud Detectives received information from the Louisiana Department of Insurance about crashes which occurred in the Lafayette Parish area. Early indications pointed toward the fact that the crashes may have been staged; and that the occupants of the vehicles may have defrauded insurance companies out of hundreds of thousands of dollars.

In the initial stages of their investigation, detectives learned that three crashes in question were staged from September of 2011 through May of 2012. While reviewing the crash reports, detectives found that six children, ranging in ages from one to thirteen-years-old, were among the occupants in the various vehicles. Two of the crashes involved a total of eight people, including children, while one crash involved a total of ten people.

Information gathered during the investigation showed that 43-year-old Farice Daigle Jr. of Arnaudville coordinated and arranged the crashes. For his part, Daigle was paid a portion of each individual’s settlement from the insurance claims.

Each adult involved in the crash filed separate fraudulent bodily injury claims for themselves and the children for which they were responsible. In all, the total amount of money fraudulently obtained by the group was over $112,000.00.

On Friday, June 21, 2013, Detectives located Daigle in Lafayette and arrested him without incident. He was booked into the Lafayette Parish Correctional Center for warrants charging him with insurance fraud (3 counts), theft over $500 (3 counts), child endangerment (2 counts) and money laundering (2 counts.) Daigle remains in jail on a $500,000 bond.

According to authorities, the following individuals were arrested for warrants in relation to this case:

Chase Joseph 24-years-old of Lafayette, one count each of insurance fraud, theft over $500 and child endangerment;
Chelsie Chevalier 21-years-old of Baton Rouge, one count each of insurance fraud and theft over $500;
Candice Alex 27-years-old of Carencro, one count each of insurance fraud, theft over $500 and child endangerment;
Cherita Washington 24-years-old of Opelousas, one count each of insurance fraud, theft over $500 and child endangerment;
Gregory Hayes 29-years-old of Opelousas, two counts each of insurance fraud, theft over $500 and one count of child endangerment;
Angel Broussard 21-years-old of Baton Rouge, one count each of insurance fraud and theft over $500;
Jamie Ceasar 32-years-old of Opelousas, one count of insurance fraud;
Kendall Traller 24-years-old of Lafayette, one count each of insurance fraud, theft over $500 and conspiracy to commit child endangerment.

Identity Theft NM Man Pleads Guilty to Securities Fraud

An accountant accused of defrauding two New Mexico businesses has pleaded guilty to securities fraud and aggravated identity theft.

Prosecutors say 31-year-old Roger L. Baeza, of Jal, entered into a plea agreement Tuesday.

He was indicted on 81 counts in October 2012.

The indictment alleged that Baeza embezzled more than $500,000 from two Jal-based businesses between June 2010 and February 2012.

At the time, Baeza was employed as the in-house accountant by the owners of the two businesses.

Prosecutors say Baeza is facing up to 10 years in in prison on each of the 78 securities fraud and access device fraud charges and a two-year term on the aggravated identity fraud charge.

At his yet-to-be-scheduled sentencing, prosecutors say Baeza also will be ordered to pay more than $501,000 in restitution.

Missing Person Larry Wayne Bennett of Milam County, TX

The Milam County Sheriff’s Office is currently seeking information in reference to a missing man, Larry Wayne Bennett, 55 years of age, last believed to have been around Sugar Loaf Mountain on June 9th. Family members contacted the Sheriff’s Office on June 22nd when they were unable to contact Mr. Bennett after repeated efforts. The Sheriff’s Office was aware that Mr. Bennett’s vehicle was left parked along a rural County Road near Sugar Loaf Mountain in eastern Milam County around the time that he had last been heard from. Based on the information we have so far, the Sheriff’s Office is concentrating their efforts on and around Sugar Loaf Mountain.

Milam County Sheriff’s Deputies were assisted today by Search Dog Network out of Bryan Texas. Search Dog Network is a volunteer group specializing in Search and Rescue incidents utilizing dogs specially trained in locating missing persons. Teams searched the rough and thickly wooded terrain for just over five hours but were unsuccessful in locating Mr. Bennett. The search was suspended due to the high temperatures taking a toll on personnel assisting in the search. Search Dog Network teams will resume their search on Saturday with additional members and hope to be able to canvass the entire search area.

The Milam County Sheriff’s Office would like any persons who may have seen or spoken to Mr. Larry Bennett since June 8th to please contact Chief Deputy Chris White at 254-697-7033. Although foul play is not suspected at this time, it cannot be completely ruled out. For that reason we are hoping to obtain information from someone in the community or surrounding areas who might know about Mr. Bennett or his whereabouts. Insurance Fraud Former Washington Police Officer Charged

Officials confirm a former Washington Police officer was arrested Tuesday for insurance fraud after the new pickup truck he reported stolen 5 years ago was recently found at the bottom of a creek.

38-year-old Jerry Davis of Brick Kiln Road in Washington was arrested Tuesday and charged with 2 counts of felony insurance fraud and conspiracy to obtain property by false pretenses. The Beaufort County Sheriff’s Office says Davis was the owner of the truck.

Investigators say July 4th, 2008, the Beaufort County Sheriff’s Office received a report of a truck theft at a home on Pirates Cove Road in Washington. Davis told deputies his 2008 Ford F150 pickup was stolen from his yard. No leads were developed immediately.

After receiving tips, deputies recovered the truck from the bottom of Tranter’s Creek near Mason’s Landing Boating Access on Clark’s Neck Road in Washington in April of this year.

The Sidney Dive Team located the truck and assisted with the recovery.

Davis was released on a $15,000 bond. An additional arrest in the case is pending.

Pedophile Tracking Man Convicted in Colorado Chugs Poisoned Drink

A man convicted of a child sex offense after a five-day trial in Colorado Springs apparently tried to poison himself in court Monday as his “guilty” verdicts were being read aloud by a judge.

Seated at the defense table in a 4th Judicial District courtroom, 48-year-old Todd Wesley Eckley began chugging from a Lipton’s ice tea bottle the moment Judge Barney Iuppa announced the jury’s findings, according to Iuppa and multiple court officers who witnessed the scene.

After an obscenity laced outburst, Eckley was forcefully restrained by El Paso County sheriff’s deputies, who led him out of court.

“On his way out he said, ‘I’ll be dead in 10 minutes anyway,'” Iuppa said, citing reports from court staff who heard the statement.

The defendant, who hurled epithets at the judge, jury and sheriff’s deputies, later claimed the bottle contained a mixture of alcohol and oleander, a toxic plant that can be deadly if ingested in sufficient quantities.

Eckley was treated at Memorial Hospital on Monday and taken to the El Paso County jail, where he remained in custody as of Tuesday afternoon, said sheriff’s spokesman Lt. Jeff Kramer. It wasn’t clear if testing was done to confirm whether the bottle actually contained the toxic substance.

Eckley, a registered sex offender who had served four years in prison after a prior conviction for child sex abuse, was convicted by a jury Monday on all counts in a case that involved repeated rapes of a 10-year-old boy. He faces the potential of life in prison. His sentencing date wasn’t immediately available.

The defendant was free on $10,000 bond during his trial, meaning he would be free to enter the courthouse with a bottled drink the same as any other visitor, sources said.

The courthouse is equipped with metal detectors at all entrances, but Iuppa said, “we weren’t policing” what the defendant brought to court to drink.

Oleanders bloom from summer to fall and produce a variety of colorful flowers, according to the National Gardening Association website, which lists a number of vendors that sell the plant in Colorado Springs.

Poison control websites warn anyone who may have ingested the plant to seek immediate medical attention.

Eckley’s attorney, David Foley, did not return a voicemail message seeking comment on behalf of his client.
