Private Detective: Man Arraigned After Infant Hospitalized With Head Injury

A man arrested after a seven-week-old baby girl was taken to the hospital with a severe head injury appeared in court to answer to the accusations.

Deputies say that the child’s biological father, Gary Nicely, was caring for her at their home on Philpot Road and had no explanation as to the cause of the injury.

The biological mother of the child had taken a seven-year-old child to school early Tuesday morning and deputies say that when she came home, the baby was found unresponsive.

Deputies say that two other children were present in the home, a four-year-old and another seven-week old baby.

The baby girl is in critical condition at UK Medical Center.

Nicely was charged with assault first-degree, domestic violence, wanton endangerment first-degree, resisting arrest, disorderly conduct second degree, and menacing. Friends who have known Nicely for years say it is not possible that he would hurt his child. Some of those friends spoke to LEX 18 as Nicely was arraigned Wednesday.

“Everything must’ve gotten twisted really fast in the heat, because he’s nothing like that he wouldn’t abuse his kids, no. That’s definitely out of the question,” said friend Linda Campbell.

Deputies say that Nicely became very irate at the hospital when he was arrested. After a brief struggle, deputies say he was taken into custody.

Nicely was taken into the Laurel County Detention Center.  Nicely pleaded not guilty to the charges. He remains in jail on a $100,000 bond.
