Wrongful Death Lexington Woman Withdraws Plea in Deadly Crash

There was a surprising development Friday in what was supposed to be the sentencing day in a deadly crash.

Kayla Foster chose to withdraw her guilty plea in a Fayette County courtroom. She had accepted a plea deal in the death of Enereida De Los Santos in 2014.

Police say Foster’s vehicle crossed the center line hitting another vehicle. The accident resulted in the death of 51-year-old De Los Santos. Her plea deal would have given her a sentence of 8 years for second-degree manslaughter and 12-months for leaving the scene of an accident.

Foster tearfully told the judge she wanted to withdraw her plea and she could be heard telling her attorney, “I don’t know what to do.”

The family of De Los Santos left courtroom very upset with the developments. Neither they nor Foster’s attorney issued a statement.
