Wrongful Death Suspects in Death of Lexington Toddler Plead Not Guilty

The two men charged in the shooting death of a Lexington toddler asleep on her family’s couch entered not guilty pleas in court Wednesday.

Two-year-old Nova Gallman wanted to sleep by her family’s Christmas tree. While she slept, police say an argument and robbery broke out between her mother’s boyfriend and two suspects, Marquis Thurman and Adrian Dunn. Gallman was shot in the head.

She later died at UK Hospital.

Marquis Thurman and Adrian Dunn were charged with robbery and assault in connection with the case. Police say charges could be added or upgraded.

They are scheduled to appear in court again on December 13.

Missing Person Golden Alert Issued for Harlan Co. Man

Harlan County Emergency Management has announced that a Golden Alert has been issued for a man from Evarts.

They say 66-year-old Michael Clementz was driving a 2006 maroon Chevy Trailblazer with Kentucky tags 054TMY.

He is described as 5’10’’ and 150 pounds.

Accident Reconstruction Girl Escapes Submerged Vehicle After Fatal Crash

Kentucky State Police say a woman was found dead after a report of a vehicle found submerged and upside down in a creek off South Hwy. 421 in the Big Creek community Monday.

Trooper Don Trosper said Chasity A. Murphy, 34, of Manchester, was found in the Chevrolet Cavalier. It was determined that she had been driving north on 421 when she lost control of her vehicle, dropped off the roadway and traveled an estimated 100 feet over an embankment before overturning in the creek.

Tpr, Trosper was still on the scene when he was notified that a passing motorist on the Hal Rogers Parkway located 9-year-old Mylee S. Murphy over an embankment. Trooper Trosper said she was Chasity’s daughter and was a passenger in the vehicle. She survived the collision and escaped the vehicle, swam across the creek and climbed up the embankment to get help. She fell asleep until she was located.

Monday morning, the store where Chasity Murphy worked, the Bears Den Market, opened up as usual at 9:00. About an hour later, friends say her husband received a phone call from police with the news about his wife.

“I was over there comforting him, or trying my best to. He looked at me and said, that’s my whole life down there,” said Lance Caldwell, who was with Chasity’s husband Monday morning.

“It was devastating for everybody to hear about it. It was,” said Ronnie Sizemore, who knew Murphy. “It’s a bad accident. The whole community is in shock over it. It’s just bad because we’re all gonna miss Chas.”

Murphy was a vendor at the flea market located near the Leslie/Clay County line. Caldwell says she helped his family open the market five years ago.

“She wasn’t just a helper, or a vendor. She was a part of our family, more than a friend,” said Caldwell.

Caldwell says Chasity was a Sunday School teacher, dedicated to her faith and family, and she never met a stranger.

He says that Sunday was Mylee’s ninth birthday. She was transported to the Manchester Memorial Hospital and later flown to UK Medical Center where she was treated for her injuries.

She was released from UK Medical Center on Tuesday.

Wrongful Death Teen Accused in Stepmother’s Murder Pleads Not Guilty

The stepdaughter of a Boyle County murder victim who was reported missing the same day as the crime pleaded not guilty Tuesday to charges connected to the case.

15-year-old Jenna Oakley was reported missing after the body of Rhonda Oakley was discovered in their Boyle County home. The death was labeled as a homicide.

Jenna was found in New Mexico along with her boyfriend, 20-year-old Kenneth Nigh. The two were discovered in a white Honda Civic that belonged to Rhonda Oakley and was reported stolen the day her body was discovered.

Nigh committed suicide in jail.

Oakley is facing charges of complicity to commit murder.

Rhonda Oakley’s husband spoke to LEX 18 back in September saying he believes the death was completely preventable.

“It’s just unthinkable,” Phillip Oakley told LEX 18. “People will ask you, if you know something, talk to someone. Guess what? We did, and no one did anything. This is the result.”

Jenna Oakley entered a not guilty plea to charges of complicity to commit murder and theft on Tuesday.

Her status hearing will be January 3.

Wrongful Death Harlan Co. Woman Arrested After Baby Found Dead

A two-month-old baby was found dead in a home on Eastbrook Station Road during a welfare check, and the mother faces charges.

KSP troopers say Social Services had received a complaint in regards to the infant’s mother, Sierra Foster, being under the influence and unable to care for the child.

Preliminary investigation indicated that Foster was under the influence and had not cared for the child for at least 12 hours.

An autopsy will be performed Wednesday in Frankfort.

The 23-year-old mother was arrested and charged with murder, criminal abuse 1st degree, tampering with physical evidence, poss. of controlled substance 2nd, and poss. of drug paraphernalia.

She was lodged in the Harlan County Detention Center.

Wrongful Death Man Charged in Teen’s Death Extradited

The Fayette County Sheriff’s Department announced that the man charged with the Thanksgiving murder of a 14-year-old Lexington boy has been extradited from West Virginia to Fayette County.

Kevin Garcia is now in the Fayette Community Corrections Center and will be arraigned Wednesday at 1:00 p.m.

Garcia is charged in the murder of Angel Juarez who deputies say was shot as he opened the front door of his home on November 24.

Private Detective: Cincinnati Man Sentenced to 300 Months for Distributing Fentanyl Resulting in Serious Bodily Injury

A Cincinnati, Ohio man has been sentenced to 300 months in federal prison for selling fentanyl that resulted in a near-fatal overdose.

Today, U.S. District Judge Amul Thapar sentenced Antoine Dudley, 32, for distribution of fentanyl causing serious bodily injury.  Dudley must serve at least 85 percent of his prison sentence and will be on supervised release for fifteen years after he completes his prison sentence.

Dudley pleaded guilty on October 27, 2016 in the middle of his trial.  According to testimony at trial, Dudley regularly sold both heroin and fentanyl to multiple customers throughout Northern Kentucky, between September 1, 2014 and his arrest on May 8, 2015.  Evidence also showed that he distributed fentanyl, on November 21, 2014 in Covington, that caused the user to overdose and stop breathing.

Paramedics of the Covington Fire Department responded to the call and were able to revive the victim of the overdose through repeated administration of naloxone (Narcan®).  The victim has made a full recovery, but evidence showed that she would have died if not for the actions of the responding paramedics.

Kerry B. Harvey, United States Attorney for the Eastern District of Kentucky, and Amy Hess, Special Agent in Charge, Federal Bureau of Investigation, jointly announced the sentence.

The investigation was conducted by the FBI Safe Streets Task Force.  Assistant U.S. Attorney Tony Bracke prosecuted this case on behalf of the federal government.

Private Detective: Former Counselor at Federal Prison Pleads Guilty to Bribery Charge

A former counselor at the federal prison in Lexington has pleaded guilty to smuggling tobacco into the prison in exchange for payments from inmates.

On Friday, 43 year-old Elianna D. Gill, formerly employed as a counselor at the Federal Medical Center in Lexington, pleaded guilty to receiving a bribe as a public official.  Gill waived her right to be indicted by a grand jury and pleaded guilty to the charges brought by Kerry B. Harvey, U.S. Attorney for the Eastern District of Kentucky.

According to her plea agreement, from February 2014 to August 2015, Gill smuggled tobacco into the prison facility for multiple inmates who paid her a total of $5,500 in return.  Prisoners incarcerated in federal correctional facilities, including FMC Lexington, are prohibited from possessing tobacco.

U.S. Attorney Harvey; John F. Oleskowicz, Special Agent in Charge, Department of Justice, Office of the Inspector General, Chicago Field Office; and Amy Hess, Special Agent in Charge, Federal Bureau of Investigation, jointly made the announcement.

The investigation was conducted by the Department of Justice, Office of the Inspector General and the Federal Bureau of Investigation.  Assistant U.S. Attorney Andrew E. Smith prosecuted this case on behalf of the federal government.

Gill is scheduled to appear before U.S. District Judge Danny C. Reeves for sentencing on March 24, 2017.  She faces a maximum sentence of 15 years of imprisonment, a $250,000 fine, and three years of supervised release.  As a condition of her plea agreement, Gill must also repay all of the money she received from the offense.

Wrongful Death Two Suspects in Custody After 2 Year Old Killed in Shooting

Lexington Police are investigating the city’s latest shooting that has left one man wounded and a child dead. They now say two suspects have been taken into custody.

Family members tell LEX 18 that 2-year-old Nova Gallman was killed after being shot in the head. The shooting happened around 11 p.m. Monday night at a home on Kenton Street. Police say two men came to the door of that house and after some sort of altercation, the suspects fired several shots.

A man was hit in the leg and the stomach and a child was shot in the head. Both were immediately rushed to UK Hospital. The man is stable. After being rushed through two surgeries, Gallman died. The coroner confirms Gallman will be taken to Frankfort for an autopsy.

Police say the child’s mother was also inside at the time but she was not hurt. Police believe the male victim is her boyfriend.

Officials say two suspects were taken into custody after they checked themselves into a hospital for injuries they sustained during the gunfire. Their names have not been released. Police say they believe the two suspects knew the male victim.

Missing Person Wallace Jones of Ludlow, MS

The Scott County Sheriff’s Department needs your help locating a missing person.

Authorities are looking for 49-year-old Wallace Jones of Ludlow, Miss.

He was last seen by a family member on November 18. He was wearing blue jeans, a hat, and an unknown shirt type or color shirt when last seen.
